Zolla Financial raised funds through transactions that “were typically styled as loans offering a fixed return, with the company’s returns purportedly generated through algorithmic trading,” according to the Justice Department.

“Piercey often paid off his lines of credit, credit cards, and personal and business expenses with investor funds, and his companies did not generate revenue sufficient to cover overhead and expenses while still paying investors the returns they were promised or otherwise led to expect,” the Justice Department said in the detention memorandum.

The Justice Department said Piercey had a pattern of paying old investors with money he raised from new investors “while making various false and misleading statements, half-truths, and omissions” to hide his “constant downward financial spiral.”

Piercey faces 31 felony counts, including wire fraud, mail fraud, witness tampering and money laundering. Each count carries a maximum penalty of 20 years in prison.

A colleague of Piercey’s, Kenneth Winton, 67, of Oroville, California, was charged separately Monday with a single count of conspiracy to commit wire fraud.

Messages left with David Fischer, a lawyer representing Piercey, were not immediately returned. Adam Gasner, a lawyer for Winton, said in a statement that his client “was made aware of these allegations and will immediately and voluntarily appear in court.”

“Mr. Winton is a family man with no prior criminal record and wishes to address the conduct alleged to have been committed by him and not be prejudiced by the actions of others charged in this case,” Gasner said.

Josh Kons, a lawyer who represents investors in securities fraud matters, said he was stunned by Piercey’s attempt to elude law enforcement.

“You never really know what people are thinking about when they get indicted or when the FBI tries to bang down their door, but certainly this one goes down in the books,” said Kons, who has consulted with people who say they lost money to Piercey. “I don’t know if we’ll ever see a more novel escape attempt by a Ponzi scheme artist again.”

McCabe repeatedly rejected Republican claims that the FBI’s actions were politically motivated.

“Let me be very clear: We didn’t open a case because we liked one candidate or didn’t like the other one,” he said in his opening statement. “We didn’t open a case because we intended to stage a coup or overthrow the government.”

McCabe, who testified remotely because of the pandemic, acknowledged serious FBI mistakes in the Page wiretap applications, one of which he signed. He said he would not have approved it knowing what he has learned since. “We’re all responsible for the work that went into that FISA,” McCabe said.

A Justice Department inspector general report issued in December found egregious errors and omissions in the applications to wiretap Page in the months after he left the Trump campaign, based on investigators’ suspicions about his ties to Russia.

Republicans pressed McCabe about who at the FBI was to blame for the problems. They wrongly insisted that no one had been held responsible; the inspector general’s report did assign blame, singling out an FBI agent assigned as “primarily responsible for some of the most significant errors and omissions.”

The FBI director, Christopher Wray, has said line-level employees who played a role in the Page wiretap applications were referred to the bureau’s office of professional responsibility, its disciplinary arm.

The inspector general report also found that the FBI had sufficient reason to open the Russia investigation and that investigators acted without political bias in doing so.

Democrats on the committee made clear they had little patience for Graham’s inquiry, believing it was a waste of time as they accused Attorney General William Barr of politicizing the Justice Department.

“This is a last-ditch, desperate undertaking to deal with President Trump’s grievances about that election,” said Sen. Richard Durbin, D-Ill., accusing the Republican-led committee of holding another “partisan hearing to advance President Trump’s theories.”

Before the hearing started, Trump took aim at McCabe, a frequent target. “Republicans, don’t let Andrew McCabe continue to get away with totally criminal activity,” the president wrote on Twitter. “What he did should never be allowed to happen to our Country again. FIGHT FOR JUSTICE!”

During the hearing, Graham repeatedly accused the FBI of treating Trump unfairly, saying he should have been warned about Russian attempts to interfere in the 2016 election on his behalf.

Graham pointed to a recently declassified document of unverified information that suggested that Russian intelligence had acquired information that Hillary Clinton had approved a plan for her 2016 campaign to “stir up a scandal” against Trump by tying him to the Russian hackers who had broken into Democratic servers.

Though Trump’s allies have promoted the document, other officials rejected its information after evaluating it, including the special counsel, Robert Mueller, and the Republican-led Senate Intelligence Committee.

McCabe said he had never seen the document before and it was not clear to him that the information alluded to criminal conduct.

Sen. Sheldon Whitehouse, D-R.I., a former federal prosecutor, defended the FBI for not investigating the claim, noting that even information related to a possible Clinton campaign strategy did not amount to a crime but rather to typical politics.

Sen. Ted Cruz, R-Texas, also brought up reports that advisers to President-elect Joe Biden were talking to foreign leaders and compared that to the FBI's scrutiny of Flynn in connection with his December 2016 calls with the Russian ambassador during Trump’s transition.

Cruz demanded to know whether Biden and his team were violating the Logan Act, a 1799 statute that says it is a crime for a private citizen to interfere with diplomatic relations between the United States and foreign governments. Cruz eventually pointed out that the Logan Act is widely considered to be unconstitutional, saying that Biden was therefore not violating it but that it was illegitimate to “go after” Flynn for the same thing.

In a heated exchange with Cruz, who repeatedly cut him off, McCabe said that “there were no discussions of the Logan Act” regarding Flynn, leading Cruz to suggest that he might be committing perjury. But permitted to complete his answer, McCabe clarified that agents opened the counterintelligence investigation into Flynn based on something else — a suspicion that he might be a conduit between the campaign and Russia.

Notes released in connection with the Justice Department’s attempt to drop the prosecution of Flynn, despite his guilty plea for lying to the FBI about his conversations with the Russian ambassador, have shown that there were discussions of the Logan Act in 2017.

A Homeland Security official was quoted by Reuters as saying that people across the country are receiving suspicious calls, urging them to stay at home on the day of election.

Even though the FBI did not explain the calls in detail, they claimed that they are currently looking into the matter.

"There's a little bit of confusion about this one across the industry," Giulia Porter, vice president of RoboKiller told Reuters.

RoboKiller tracks robocalls and telemarketers, and has been actively following the campaign.

The audio of one of these calls was shared by RoboKiller, and an automated female voice could be heard asking people to stay at home.

"Hello. This is just a test call. Time to stay home. Stay safe and stay home”, it said.

Porter added that the call had been made over millions of times in the last 11 months, but its attempt to reach more people jumped dramatically today, while the US votes to choose its next president.

In the list of top spam calls, the call is currently at #5 or #6, fluctuating from time to time.

Porter claimed that the call is being sent out at a very high volume. "This robocall is being sent at a very high volume," she said.&nbsp; According to Porter, at leasts “thousands or tens of thousands” of people had received such robocalls.

While some companies got duped through phishing emails, rest gave permission to the group to modify their codes, which provided them free and unlimited access to clients' computers and internal data.

The group has been alleged of hacking hundreds of computers of various companies around the world. The hackers accessed identities, personal information and used the hacked information to ask for ransom and commit&nbsp;cryptocurrency/bitcoin frauds. They also hacked into systems of gaming companies through which they used the data to sell game items back to the customers and dupe them of money.

They have&nbsp;also been alleged of compromising government&nbsp;data in Vietnam and India.&nbsp;

Whether or not the group was working for the Chinese government is not yet clear. The court has alleged that the hackers collected information regarding pro-democracy activists of Hong Kong and&nbsp;a Buddhist monk from Tibet. One of the hackers,&nbsp;Jiang Lizhi, has a history of working with&nbsp;China's Ministry of State Security.

However, none of these allegations have successfully proved a connection between the hacker group and the Chinese government. More investigation is being carried out for this.

"She was never told the reasons she was detained," Fenton said. "She was misled; she was tricked, in fact."

The Canadian Attorney General's lawyer, Robert Frater, opposed the unredacted publication of the documents and denied any plot with the FBI.

He dismissed the allegations as "fanciful inferences from anodyne statements" in the court filings.&nbsp;

In a sworn statement delivered to a Vancouver court in July, a Canadian foreign ministry official said the full disclosure of the documents could "renew tensions" between the two countries and put Canadians in danger.

A few days after Meng's arrest in Vancouver, China jailed former Canadian diplomat Michael Kovrig and his fellow countryman Michael Spavor, who were later charged with spying.

Their detention is largely seen in the West as a reprisal for Meng's arrest.
