India said today that Russia's S-400 missile defence <a href="https://www.wionews.com/india-news/indias-buying-of-s-400-from-russia-will-have-serious-implications-on-defence-ties-us-223011">system will be delivered in April 2023</a>, a move likely to anger the United States which has been against the deal from the start.

&nbsp;The announcement was made by the minister of the state of defence Sripad Naik in a written statement in Lok Sabha.&nbsp;

India had signed the missile deal in October 2018 during Russian President Putin's visit. The deal<a href="https://www.wionews.com/south-asia/indias-decision-to-buy-s-400-missile-system-will-further-destabilise-region-pakistan-172373"> was worth $5 billion</a> ensuring the advanced long-range surface-to-air missile would become a key weapon in India's arsenal.

Asked about India facing American sanctions under the&nbsp;Countering America’s Adversaries Through Sanctions Act (CAATSA) law, Naik said, "Government takes sovereign decisions based on threat perception, operational and technological aspects to keep the Armed Forces in a state of readiness to meet the entire spectrum of security challenges."

However, the Trump administration had warned that the deal would have serious implications for India even though no specific details were put forward by the US. India feared US sanctions under the Countering America's Adversaries Through Sanctions Act (CAATSA) instituted by the US Congress on arms purchases from Russia, but it did not transpire after Indian officials communicated India's defence requirements to Trump's officials.

In fact, former US defence secretary James Mattis had expressed confidence that US and India would "work out the matter"&nbsp;concerned with the deal even as several US officials frowned at the Russian deal.

"India has been spent many, many years in its nonaligned status, and it's drawn a lot of weapons from Russia," Mattis had told reporters at the Pentagon when asked about the deal, adding, "we'll work all this forward."

S-400 is known as Russia's most advanced long-range surface-to-air missile defence system.&nbsp;

China was the first foreign buyer to seal a government-to-government deal with Russia in 2014 to procure the lethal missile system. Moscow has already started delivery of an undisclosed number of the S-400 missile systems to Beijing.

Recently, the Erdogan-led government procured the first batch of the S-400 missiles from Russia with more due to arrive in 2023 despite heavy criticism by US officials.

Russia's S-400 missile defence system to be delivered in April 2023: India

The International Court of Justice (ICJ) on Wednesday accepted India's plea to give consular access to Kulbhushan Jadhav and agreed that Pakistan indeed violated the provisions of 1963 Vienna Convention.

What the ICJ said in Kulbhushan Jadhav case

Pakistan's<a href="https://www.wionews.com/india-news/kulbhushan-jadhav-case-will-not-prejudge-verdict-says-pakistan-foreign-office-236511"> Inter-Services Intelligence</a> (ISI) used Salafi jihadist terrorist organization Jaish ul-Adl and conspired to get Kulbhushan Jadhav kidnapped.&nbsp;

Sources in the Indian government have said that Kulbhushan Jadhav was kidnapped in Iran's Chabahar and moved to Pakistan by an armed group Jaish al Adl.&nbsp;

Indian agencies reportedly have enough evidence to prove how Pakistani agencies framed Jadhav in a fake spy case.&nbsp;

Pakistan faces a plethora of problems along its border with Iran. The country has used Jaish ul-Adl against Iran as well. Iranian officials have spoken of Pakistan's support to terrorist activities along the Iran-Pakistan border. Recently, the US State Department designated Jaish al Adl as a front of Jundullah, who is a 'Specially Designated Global Terrorist.'

On 8 May 2017, India instituted proceedings in the International Court of Justice about egregious violations by Pakistan of the Vienna Convention on Consular Relations, 1963 in the matter of arrest, detention and trial of Jadhav, an Indian citizen. Military courts were set up by Pakistan after 2015 as an instrument for the military to engage in summary trials. These courts have been responsible for several death sentences given after April of 2017. Jadhav was denied the right to be defended by a legal counsel of his choice. His conviction and death sentence is based on 'confessions' taken in captivity.

India has succeeded in stopping Pakistan from taking the law into its own hands. Its approach and efforts at the ICJ led to pressure on Pakistan and Jadhav's execution was stopped. Pakistan's argument that ICJ had no jurisdiction was overruled by the ICJ.

Pakistan's military has been restrained using the weight of ICJ and India's strong legal case.

ICJ is scheduled to deliver its verdict in Kulbhushan Jadhav case on Wednesday.

In a big win for India, the International Court of Justice (ICJ) on Wednesday gave consular access to Kulbhushan Jadhav, who was arrested and given death sentence by Pakistan on charges of espionage.

Upholding India's stand that Pakistan has violated the 1963 Vienna Convention, the ICJ said that Jadhav's trial by a military court in Pakistan is not accepted thereby stopping his execution.

The death sentence by a Pakistani military court was questioned by India, which said its based on an "extracted confession".&nbsp;

International Court of Justice will deliver on Wednesday its much-awaited verdict in the case of Kulbhushan Jadhav, who was captured by Pakistani security forces and sentenced to death in 2017 on charges of spying for India.&nbsp;

Jadhav, an Indian national, has been sentenced to death by a Pakistani military court on alleged charges of espionage and terrorism.

India has repeatedly sought consular access to Jadhav since March 2016, when the High Commission of India in Islamabad was first informed of his custody with Pakistan authorities.In a statement in the Rajya Sabha on April 11, 2017, then External Affairs Minister Sushma Swaraj had reiterated that "Kulbhushan Jadhav has been awarded a death sentence by a Pakistani military court-martial on concocted charges, I repeat on concocted charges."

"To make matters even more absurd, three hours after the death sentence was announced the Indian High Commission received an official communication from the Foreign Ministry of Pakistan reiterating the Pakistani proposal for conditional consular access. That tells us a lot about the farcical nature of the alleged proceedings which have led to an indefensible verdict against an innocent kidnapped Indian," Swaraj had informed the Upper House of Parliament.

"Our position on this matter is clear. There is no evidence of wrongdoing by Jadhav. If anything, he is the victim of a plan that seeks to cast aspersions on India to deflect international attention from Pakistan's well-known record of sponsoring and supporting terrorism. Under these circumstances, we have no choice but to regard the sentence, if carried out, as an act of premeditated murder," she had further said in the statement.

The verdict is likely to be read out by President of the ICJ Judge Abdulqawi Ahmed Yusuf at around 6:30 pm (IST) at the Peace Palace in The Hague.

According to media reports, the Indian side is expected to be represented by Joint Secretary (Pakistan, Afghanistan, and Iran) Deepak Mittal and officials from the Legal and Treaties Division of the Ministry of External Affairs (MEA).

Pakistan's legal team, headed by Attorney General for Pakistan Anwar Mansoor Khan has reached The Hague in the Netherlands, where the ICJ is headquartered.&nbsp;

The team also included Foreign Office Spokesperson Muhammad Faisal.Jadhav, a 49-year-old former Naval officer, was sentenced to death by a Pakistani military court on April 11, 2017, on alleged charges of espionage and terrorism.&nbsp;

Following this, India had approached the ICJ against Pakistan "for egregious violations of the Vienna Convention on Consular Relations, 1963" in the matter.India has contended that it had not been informed of Jadhav's detention until long after his arrest and that Pakistan had failed to inform the accused of his rights.India further alleged that in violation of the Vienna Convention the authorities of Pakistan had denied India its right of consular access to Jadhav, despite repeated requests.

Subsequently, on May 18, 2017, a 10-member bench of the ICJ restrained Pakistan from executing Jadhav till the adjudication of the case.In February this year, the ICJ rejected five pleas made by Pakistan during the hearing of Jadhav's case, including the playing of so-called "confessional statement" of the Indian national and a request to adjourn the hearing citing illness of its ad-hoc judge.

The four-day hearing in Jadhav's case started on February 18 at the ICJ headquarters in The Hague.Pakistan had further urged the ICJ to dismiss India`s plea for relief for Jadhav.

Facebook's rather questionable proposal to combat revenge porn which was first introduced in Australia in November will now move to the US, Canada, and the UK, reports said.&nbsp;

The request: asking users to send their intimate pictures to Facebook in order for it to register and block them from ever being posted by other users.&nbsp;

The program is called the Non-Consensual Intimate Image Pilot, and as described by Facebook, which is an “emergency option” for people who are worried their images might be shared in the future.

The idea received a lot of flak in Australia. No further information was revealed on how the trial went in the country.&nbsp;

In the UK, if you suspect that an image of you could be leaked on the social media website, Facebook says you should contact its partners for the trial - Revenge Porn Helpline.&nbsp;

The staff there will then get in touch with Facebook and you'll get sent a link to upload the photo. The idea is that Facebook can then digitally fingerprint the submitted image and block its potential future spread.

So, who will the photos be sent to on Facebook? Facebook's Global Head of Safety Antigone Davis told local media that the photos will only be viewed by a small group comprising of five specially trained reviewers who will give the photo a unique digital fingerprint which will be stored on the database.&nbsp;

If anyone in future tries to upload an intimate picture of a person, the system will recognise the code and block it from appearing on Facebook, messenger, and Instagram.&nbsp;

However, it's unclear if this idea would be a hit. The problem is not the technology but&nbsp;what's bizarre is Facebook's fuzzy proposal and the fact that anyone submitting their photo to Facebook would still be vulnerable to potentially having that image be exploited.

One in eight American social media users has been a target of non-consensual pornography, according to a 2017 study conducted by the Cyber Civil Rights Initiative.

Facebook's Global Head of Safety Antigone Davis told local media that the photos will only be viewed by a small group comprising of five specially trained reviewers who will give the photo a unique digital fingerprint which will be stored on the database. If anyone in future tries to upload an intimate picture of a person, the system will recognise the code and block it from appearing on Facebook, messenger, and Instagram. However, it's unclear if this idea would be a hit. The problem is not the technology but what's bizarre is Facebook's fuzzy proposal and the fact that anyone submitting their photo to Facebook would still be vulnerable to potentially having that image be exploited. One in eight American social media users has been a target of non-consensual pornography, according to a 2017 study conducted by the Cyber Civil Rights Initiative.

Big win for India: ICJ grants consular access to Kulbhushan Jadhav

The International Court of Justice (ICJ) order in the <a href="https://www.wionews.com/india-news/big-win-for-india-icj-grants-consular-access-to-kulbhushan-jadhav-236703">Kulbhushan Jadhav case</a> came as a huge relief for India. The order has many points in favour of India but concerns remain about Jadhav’s security and life in Pakistan.

There are some areas of worry too. First, let us take a look at victories for India.

The biggest victory for India is the fact that Jadhav's death sentence remains suspended. <a href="https://www.wionews.com/india-news/full-text-of-icj-order-in-kulbhushan-jadhav-case-236712">The court</a>, in its ruling by 15-1, declared "a continued stay of execution" on Jadhav, saying it "constitutes an indispensable condition for the effective review and reconsideration of the conviction and sentence" of the accused. The court had in May 2017 ordered a stay on Jadhav's execution till the final verdict in the case after India approached it against the Pakistani military court's award of death sentence in an opaque trial.

<a href="https://www.wionews.com/india-news/it-is-no-doubt-a-big-victory-for-india-rajnath-singh-on-icj-verdict-236718">India's stand vindicated by ICJ</a>: India had contended that by not allowing consular access to Jadhav, Pakistan has violated the 1963 Vienna Convention. The ICJ accepted India's stand and and agreed to entertain its plea. "The Court is of the view that Pakistan is under an obligation to cease those acts and to comply fully with its obligations under Article 36 of the Vienna Convention. Consequently, Pakistan must inform Mr. Jadhav without further delay of his rights under Article 36, paragraph 1 (b), and allow Indian consular officers to have access to him and to arrange for his legal representation," the ICJ said on Wednesday.

Pakistan asked to carry out effective review of the death sentence given to Jadhav: "The Court further finds that the appropriate reparation in this case consists in the obligation of the Islamic Republic of Pakistan to provide, by the means of its own choosing, effective review and reconsideration of the conviction and sentence of Jadhav, so as to ensure that full weight is given to the effect of the violation of the rights set forth in Article 36 of the Convention," the ICJ said in its order today.

Moreover, the entire judicial process of Pakistan was found inadequate in the case. The ICJ rejected the objections put forward by Pakistan to the admissibility of India's application. "The ICJ has ruled in favour of India on merits, affirming Jadhav's right to consular access and notification," Reema Omer, international legal advisor, South Asia, of the ICJ said on Twitter.

Lastly, India can again raise the matter with the court, if review by Pakistan is considered not to be effective.

But there are issues which do worry the Indian government:

Effective review of the case has been left to Pakistan to do by means of its own choosing. "Appropriate remedy is effective review and reconsideration of conviction&nbsp; and sentence of Mr. Jadhav - full weight to be given to the effect of violation of rights set forth in Article 36 - choice&nbsp; of&nbsp; means&nbsp; left&nbsp; to&nbsp; Pakistan - Pakistan to take all measures to provide for effective review and reconsideration, including, if necessary, by enacting appropriate legislation - continued stay of execution constitutes condition for effective review and&nbsp; reconsideration of conviction and sentence of Mr. Jadhav," the court said in its order.

Since courts in Pakistan are open to manipulation by the army, how much effective the review really be is anybody's guess.

Kulbhushan Jadhav's release has not been ordered: "With regard to India's contention that it is entitled to restitutio in integrum and its request to annul the decision of the military court and to restrain Pakistan from giving effect to the sentence or conviction, and its further request to direct Pakistan to take steps to annul the decision of&nbsp; the&nbsp; military&nbsp; court, to release Mr. Jadhav and to facilitate his safe passage to India, the Court reiterates that it is not the conviction&nbsp; and sentence of Mr. Jadhav which are to be regarded as a violation of Article 36 of the Vienna Convention. The Court also recalls that "[i]t is not to be presumed... that partial or total annulment of conviction or sentence provides the necessary and sole remedy" in cases of violations of Article 36 of the Vienna Convention. Thus, the Court finds that these submissions made by India cannot be upheld," the court said in its 42-page order.

What this means, worryingly, is that Jadhav remains vulnerable like Sarabjit who was killed inside the Kot Lakhpat prison.

And finally, the ICJ has also not asked assurance from Pakistan that no harm should come in the way of Kulbhushan Jadhav.

ICJ verdict in Kulbhushan Jadhav case: Victories and worries for India

The International Court of Justice (ICJ) on Wednesday accepted India's plea to give consular access to Kulbhushan Jadhav and agreed that Pakistan indeed violated the provisions of 1963 Vienna Convention.

Here are the excerpts from the ICJ order accepting India's plea of granting consular access to Kulbhushan Jadhav:

"The Court concludes that Pakistan's objection based on the said doctrine must be rejected.
&nbsp;
To conclude, the Court finds that Pakistan is under an obligation to provide, by means of its own choosing, effective review and reconsideration of the conviction and sentence of Mr. Jadhav, so as to ensure that full weight is given to the effect of the violation of the rights set forth in Article 36 of the Vienna Convention, taking account of paragraphs 139, 145 and 146 of this judgement.

Unanimously: Finds that it has jurisdiction, on the basis of Article I of the Optional Protocol concerning the Compulsory Settlement of Disputes to the Vienna Convention on Consular Relations of 24 April 1963, to entertain the Application filed by the Republic of India on 8 May 2017;

By 15 votes to one: Rejects the objections by the Islamic Republic of Pakistan to the admissibility of the Application of the Republic of India and finds that the Application of the Republic of India is admissible;

Finds that, by not informing Mr. Kulbhushan Sudhir Jadhav without delay of his rights under Article 36, paragraph 1 (b), of the Vienna Convention on Consular Relations, the Islamic Republic of Pakistan breached the obligations incumbent upon it under that provision;

Finds that, by not notifying the appropriate consular post of the Republic of India in the Islamic Republic of Pakistan without delay of the detention of Mr. Kulbhushan Sudhir Jadhav and thereby depriving the Republic of India of the right to render the assistance provided for by the Vienna Convention to the individual concerned, the Islamic Republic of Pakistan breached the obligations incumbent upon it under Article 36, paragraph 1 (b), of the Vienna Convention on Consular Relations;

Finds that the Islamic Republic of Pakistan deprived the Republic of India of the right to communicate with and have access to Mr. Kulbhushan Sudhir Jadhav, to visit him in detention and to arrange for his legal representation, and thereby breached the obligations incumbent upon it under Article 36, paragraph 1 (a) and (c), of the Vienna Convention on Consular Relations;

Finds that the appropriate reparation in this case consists in the obligation of the Islamic Republic of Pakistan to provide, by the means of its own choosing, effective review and reconsideration of the conviction and sentence of Mr. Kulbhushan Sudhir Jadhav, so as to ensure that full weight is given to the effect of the violation of the rights set forth in Article 36 of the Convention, taking account of paragraphs 139, 145 and 146 of this Judgment;

Declares that a continued stay of execution constitutes an indispensable condition for the effective review and reconsideration of the conviction and sentence of Mr. Kulbhushan Sudhir Jadhav."

The International Court of Justice (ICJ) is set to rule on Wednesday in a <a href="https://www.wionews.com/world/live-kulbhushan-jadhav-case-verdict-today-at-international-court-of-justice-236670">case relating to Indian national Kulbhushan Jadhav</a>, whose death sentence by a Pakistani court based on an "extracted confession" has been questioned by India.

In hearings before the 15-judge panel earlier this year, India argued that the <a href="https://www.wionews.com/photos/kulbhushan-jadhav-case-what-is-the-international-court-of-justice-and-how-does-it-work-236692">ICJ </a>should annul the decision of Pakistan's military court and order the release of <a href="https://www.wionews.com/india-news/kulbhushan-jadhav-a-profile-236673">Kulbhushan Jadhav</a>, a former Indian navy commander who was arrested in Pakistan in March 2016 and convicted of spying. Even if Jadhav is not released, says India, he should at least be given a trial beforw a civilian court.

India has also said that it should be given the right to arrange for Jadhav's legal representation and demanded full consular access.

"All eyes are set on today's verdict. Pakistan will be left exposed this time around as they have no accountability for justice. Kulbhushan is innocent and today we are hoping Indian diplomacy will finally bring good news for us and family of Jadhav," his friend Arvind Singh told WION ahead of the crucial verdict.

While Pakistan has sent a 13-member team to the ICJ for today's verdict, India is being represented by Joint Secretary Deepak Mittal and officers from the Legals and Treaties Division of the Ministry of Expertan Affairs.

The death sentence, given by a military court in Pakistan, had evoked sharp reactions in India.

India filed a claim against Pakistan before the ICJ in May 2017 arguing Islamabad had breached the 1963 Vienna Convention by not allowing diplomatic assistance to Jadhav during his secretive trial. Harish Salve, who was representing India in the case, questioned the functioning of Pakistan's notorious military courts and urged the top UN court to annul Jadhav's death sentence, which is based on an "extracted confession".

India won an injunction that ordered Jadhav's execution stayed while the court looked into the case.

Pakistan said that India was trying to use the court intended to resolve international disputes as a criminal appeals court. They also said the relief sought by India was disproportionate even if the treaty were violated, and at most Jadhav's case could be reviewed.

The ICJ is the United Nation's highest court, and its decisions are binding - though it has no power to enforce them and they have been ignored in rare instances.

All eyes on ICJ ahead of crucial verdict in Kulbhushan Jadhav case

The International Court of Justice (ICJ) will deliver its verdict in the <a href="https://www.wionews.com/india-news/kulbhushan-jadhav-case-international-court-of-justice-to-deliver-verdict-today-at-630-pm-236541">Kulbhushan Jadhav case</a> on Wednesday evening. Jadhav has been imprisoned in Pakistan since his arrest in 2016.

Forty-nine-year-old Jadhav is a retired Indian Navy officer and belongs to Maharashtra. He joined the navy in 1991.

Jadhav belongs to the family of police officers and had set up a business of operating ferries from the Iranian port of Bandar Abbas. He was arrested by Pakistan in 2016 on suspicion of espionage, but India says he was kidnapped from Iran.

But a Pakistani military court went ahead and <a href="https://www.wionews.com/india-news/ahead-of-icj-verdict-a-look-at-how-pakistan-violated-international-law-in-kulbhushan-jadhav-case-236581">sentenced him to death</a> on charges of "espionage and terrorism" after a closed trial in April 2017. Jadhav's sentencing evoked a sharp reaction in India.

Pakistan even rejected India's plea for consular access to Jadhav at the ICJ. However, it facilitated a meeting of Jadhav with his mother and wife in Islamabad on December 25, 2017.

India <a href="https://www.wionews.com/south-asia/a-timeline-to-kulbhushan-jadhavs-case-in-international-court-of-justice-236582">moved the ICJ</a> on May 8, 2017, for the "egregious violation" of the provisions of the Vienna Convention by Pakistan by repeatedly denying New Delhi consular access to Jadhav.

A bench of the ICJ, which was set up after World War II to resolve international disputes, on May 18, 2017 had restrained Pakistan from executing Jadhav till adjudication of the case.

During the hearing in ICJ, both India and Pakistan submitted their detailed pleas and responses.

India based its case on two broad issues - breach of Vienna Convention on consular access and the process of resolution.

Union Minister Amit Shah on Wednesday said that the government is determined to identify all the illegal immigrants and infiltrators living on every inch of this country and deport them as per the international law.

Responding to a supplementary query by Samajwadi Party member Javed Ali Khan in the Rajya Sabha, Shah said: "It is a very good question. The NRC is part of the Assam Accord and was also in (BJP's) election manifesto based on which the government has came to power. The government will identify illegal immigrants living on every inch of the country's soil and will deport them as per international law."&nbsp;

On Tuesday, the government said that it has adopted a multi-pronged approach to ensure effective surveillance and domination of international borders to check infiltration of illegal immigrants.

The Ministry of Home Affairs said in a written reply to Parvesh Sahib Singh in Lok Sabha said that physical infrastructure like border fencing, floodlighting, construction of border roads and establishment of border outposts have been created.

Currently, the National Register of Citizens (NRC) is being updated under the direct monitoring of the Supreme Court. The apex court has fixed July 31 as the deadline for finalisation of the NRC in Assam.

The NRC aims to separate "genuine" citizens from "illegal immigrants". The government has maintained that its intention is to ensure no illegal immigrant is registered under the NRC and no genuine citizen is left out of it.

Karnataka crisis: Rebel Congress-JD(S) MLAs refuse to participate in trust vote on Thursday

Defence Minister Rajnath Singh said on Wednesday that the Indian and Chinese forces were observing "full restraint" at Doklam, where a standoff had taken place between the two sides in 2017, and noted that infrastructure was being ramped up along the <a href="https://www.wionews.com/opinions/what-should-india-do-if-china-sticks-to-its-wide-territorial-claims-209197">border with China </a>to ensure security.

Responding to a concern raised by Congress member Adhir Ranjan Chowdhury in Lok Sabha about alleged intrusion China at Demchok sector, Singh said that the government was fully aware of security requirements of the country.

He said that the security requirements are reviewed from time to time and appropriate decisions are taken.

He said both the countries are following existing agreements so that peace and tranquillity are ensured on the border.

"The infrastructure on India-China borders such as road, tunnel, railway line and airfield is being developed to ensure the country's security and integrity," he said.

Singh said that standoff at Doklam between the two countries that occurred in August 2017 was resolved and the government has already stated its position.

"Both sides are observing full restraint at Doklam," he said.

Singh said Prime Minister Narendra Modi and Chinese President Xi Jinping had given strategic guidance to their forces following the Wuhan informal summit last year so that there is better dialogue, mutual confidence is created and management of border affairs improves.

He said that while there was dialogue at the political level between special representatives of two countries on outstanding issues related to the border, there were other mechanisms including Working Mechanism for Consultation and Coordination on India-China Border Affairs (WMCC) which has regular meetings.&nbsp;

Government ramping up infrastructure along border with China: Rajnath Singh

In an order that left the fate of the JD(S)-Congress coalition government in Karnataka hanging by a thread, the Supreme Court on Wednesday held that the 15 rebel MLAs of the ruling side cannot be compelled to participate in the trust vote in the Assembly tomorrow even as it gave freedom to the Speaker to decide on their resignation in a timeframe he considers it appropriate.

However, the court said that the Speaker's order on the resignations of the MLAs, whenever it is taken, should be placed before it.

"Until further orders, the 15 Members of the Assembly ought not to be compelled to participate in the proceedings of the ongoing session of the House and an option should be given to them that they can take part in the said proceedings or opt to remain out of the same," a bench comprising Chief Justice Ranjan Gogoi and Justices Deepak Gupta and Aniruddha Bose said in its verdict.

The court observed that Speaker K R Ramesh Kumar cannot be forced to decide within a time frame on the resignations of the rebel MLAs.

"In these circumstances, the competing claims have to be balanced by an appropriate interim order, which according to us, should be to permit the Speaker of the House to decide on the request for resignations by the 15 members of the House within such time frame as the Speaker may consider appropriate," the bench said.

A floor test is scheduled for tomorrow in the Assembly when it will take up the Confidence Motion to be moved by Chief Minister H D Kumaraswamy.

In the 224-member House, the 13-month-old coalition is precariously placed if the rebels keep out of the Assembly during the vote tomorrow.&nbsp;

Without the support of the rebels, the coalition enjoys the support of around 100 members as against the support of 105 being claimed by the Opposition BJP.

Senior advocate Mukul Rohatgi, representing the rebel MLAs, told reporters, "In view of the trust vote kept for tomorrow, the Supreme Court has said two important things - the 15 MLAs will not be compelled to attend the House tomorrow. All the 15 MLAs are given the liberty that they may or may not go to the House tomorrow".&nbsp;

"The three-line whip issued to the rebel MLAs to attend the House tomorrow is not operative in view of the Supreme Court judgement. Secondly, the Speaker has been given time to decide on the resignations as and when he wants to decide."The Speaker welcomed the apex court's order saying he respected it.

Karnataka minister and chief troubleshooter for the Congress, D K Shiv Kumar also welcomed the order saying the Speaker's position under the tenth schedule has been respected but warned the rebels whether they would like to lose the chances of becoming a minister by keeping away from voting tomorrow.

He said while the MLAs cannot be compelled to participate in the House proceedings, there was also the question of the effectiveness of the anti-defection law under which political parties are empowered to issue whip to the members to participate in the business of the House and vote in accordance with its direction.

Kumar said the rebel MLAs, some of whom are experienced MLAs for five or seven terms, were being "misled".

The rebel MLAs had filed a petition before the apex court claiming that the Speaker was not deciding on their resignation letters and was attempting to force them to participate in the voting by threatening disqualification.

Those who filed the petition included Pratap Gouda Patil, Ramesh Jarkhiholi, Byrati Basavaraj, BC Patil, S T Somashekar, Arbail Sivaram Hebbar and Mahesh Kumathalli from Congress and K Gopalaiah, H D Vishwanath and Narayan Gowda from JD(S).

Five other rebel MLAs - K Sudhakar, Roshan Baig, MTB Nagaraj, Muniratna and Anand Singh - had approached the court on July 13 contending they had resigned "voluntarily" and that their resignation must be accepted by the Speaker.&nbsp;

In its order, the court observed that the issue arising in the case is whether the resignations submitted by MLAs a point of time earlier than petitions for their disqualification under the Tenth Schedule of the Constitution (anti-defection law) should have priority in the decision-making process or whether both sets of proceedings should be taken up simultaneously or the disqualification proceedings should have precedence over the requests for resignation.

Referring to the arguments of counsels for the parties on the touchstone of Articles 164, 190, 191, 221(2) and 361B and the Tenth Schedule of the Constitution, the court said we have considered the same.

"Constitutional principles should not receive an exhaustive enumeration by the Court unless such an exercise is inevitable and unavoidable to resolve the issues that may have arisen any judicial proceedings."In the present case, having regard to the stage at which the above issues are poised in the light of the facts and circumstances surrounding the same, we are of the view that the aforesaid questions should receive an answer only at a later stage of the proceedings," the judges said.

The imperative necessity at this stage, the judges said, is to maintain the constitutional balance and the conflicting and competing rights that have been canvassed before them.&nbsp;

The bench said, "such an interim exercise has become prudent in view of certain time frame exercise(s) that is in the offing in the Karnataka Legislative Assembly, particular, the no-trust motion against the present government, which we are told is due for being taken up on July 18, 2019".

"In these circumstances, the competing claims have to be balanced by an appropriate order, which according to us, should be to permit the Hon'ble Speaker of the House to decide on the request for resignations by the 15 Members of the House within such time frame as the Hon'ble Speaker may consider appropriate" they said.

"We also take the view that in the present case, the discretion of the Hon`ble Speaker while deciding the above issue should not be fettered by any direction or observation of this Court and the Hon'ble Speaker should be left free to decide the issue in accordance with Article 190," they added.

The also observed that read with Rule 202 of the Rules of Procedure and Conduct of Business in Karnataka Legislative Assembly framed in exercise of the powers under Article 208 of the Constitution.

"The order of the Hon'ble Speaker on the issue of the resignation, as and when passed, be placed before the Court. We also make it clear that until further orders the 15 Members of the Assembly, ought not to be compelled to participate in the proceedings of the ongoing session of the House and an option should be given to them that they can take part in the said proceedings or opt to remain out of the same. We order accordingly," the judges said. &nbsp;

In the 224-member House, the 13-month-old coalition is precariously placed if the rebels keep out of the Assembly during the vote tomorrow. Without the support of the rebels, the coalition enjoys the support of around 100 members as against the support of 105 being claimed by the Opposition BJP. Senior advocate Mukul Rohatgi, representing the rebel MLAs, told reporters, "In view of the trust vote kept for tomorrow, the Supreme Court has said two important things - the 15 MLAs will not be compelled to attend the House tomorrow. All the 15 MLAs are given the liberty that they may or may not go to the House tomorrow". Five other rebel MLAs - K Sudhakar, Roshan Baig, MTB Nagaraj, Muniratna and Anand Singh - had approached the court on July 13 contending they had resigned "voluntarily" and that their resignation must be accepted by the Speaker. The imperative necessity at this stage, the judges said, is to maintain the constitutional balance and the conflicting and competing rights that have been canvassed before them. "The order of the Hon'ble Speaker on the issue of the resignation, as and when passed, be placed before the Court. We also make it clear that until further orders the 15 Members of the Assembly, ought not to be compelled to participate in the proceedings of the ongoing session of the House and an option should be given to them that they can take part in the said proceedings or opt to remain out of the same. We order accordingly," the judges said.

Supreme Court verdict leaves Karnataka govt hanging by a thread

Former TMC MP Kunal Ghosh on Wednesday appeared before the Enforcement Directorate (ED) for questioning in connection with Saradha chit fund case.&nbsp;

The ED had on Monday summoned Ghosh to appear before it. The Central Bureau of Investigation (CBI) had earlier questioned Ghosh and Rajeev Kumar, who headed the Special Investigation Team of the state police that probed the multi-crore scam case. Ghosh was arrested by the state police on November 23, 2013.&nbsp;

He sent to CBI custody on September 4, 2014 after the agency took over the investigation on the orders of the Supreme Court. In 2016, the Calcutta High Court had granted interim bail to Ghosh against a bond of Rs 2 lakh.&nbsp;

Kumar, the former Kolkata Police commissioner, is accused of tampering with evidence in the case.&nbsp;

The CBI had earlier said that there was prima facie evidence against Kumar that he "tried to destroy or tamper with evidence and shield high and mighty" in the case. The probe agency had claimed that Kumar did not disclose any crucial information he was privy to.&nbsp;

An unprecedented chain of events unfolded on February 3 when a CBI team was detained by Kolkata Police when it reached Kumar`s residence to question him.&nbsp;

It was followed by West Bengal Chief Minister Mamata Banerjee's visit to the officer`s home. The CBI officers were taken into police custody and later released.
