Directorate General of Civil Aviation (DGCA) has done the safety audit of five airlines, including Air India, and has listed out security concerns in these carriers, said Civil Aviation Minister Hardeep Singh Puri on Thursday.

In a written reply in the Rajya Sabha, Puri said, "The implementation of Safety Management System (SMS) was found to be deficient. Quantum of Digital Flight Data Recorder (DFDR) data analysed under Flight Operations Quality Assurance (FOQA) was not as per the Indian safety regulators' requirement."

"Inspection schedules were not revised as per the latest Maintenance Planning Document (MPD). Maintenance Control Centre was found not to be maintained as per the required manpower. Flight crew rostering software was not upgraded," he added.

The Civil Aviation Minister further said, "Untrained staffs were found manning check-in counters. The other staff at counters too were found to have inadequate knowledge for the handling of Dangerous Goods despite being trained in Dangerous Good Regulations (DGR). DGCA found that there was a delay in carrying out the corrective actions for the FOQA exceedances."

"DGCA has directed the operators to take corrective action," he said.

Puri said, "The DGCA proactively works towards improving the safety level of civil air transport in the country."

"The DGCA regularly conducts safety audits of scheduled and non-scheduled airline operators in the country as per the annual surveillance plan. The last five safety audits conducted were of Air India Express, SpiceJet, Air India, Indigo and GoAirways," his reply reads.

On the question of whether there are any plans or any private airline came before the DGCA for its revival, Puri said, "No such proposal for revival from any private airline has been received by the DGCA."

The top court also said that the 15 rebel MLAs cannot be compelled to participate in the Assembly proceedings or the trust vote on Thursday. 15 rebel MLAs had approached the Supreme Court seeking direction to the speaker to accept their resignations at the earliest. Karnataka government has been reduced to minority in the Assembly after 16 rebel legislators resigned and 2 Independents withdrew support to it. (With inputs from agencies)

India has dismissed the arrest of 26/11 mastermind Hafiz Saeed and has called it a drama which New Delhi has seen in the past.

Ministry of External Affairs spokesperson Raveesh Kumar said, "We have seen the arrest reports. This has been going on for a long time. The arrest-release drama has happened more than 8 times since 2001."

"The question is, will Saeed be tried this time. We reiterate Saeed is a designated terrorist, listed by the UN," Kumar added.

Saeed carries a reward of $10 million on him as announced by the US state department.

Kumar reiterated India's stance on cross border terror saying, "Pakistan's sincerity to take action against terrorism will be judged based on their action against terrorists and groups. We hope that this time Saeed will be brought to justice".

The MEA spokesperson also reacted to the tweet by US President Donald Trump on the arrest, "This tweet has to be seen in the context of global cooperation in the fight against terrorism," Kumar stated.

Trump had tweeted that it was because of "great pressure" that has been "exerted over the last two years to find him" that led to Saeed's arrest.

Saeed was arrested by Pakistan's Punjab government on Wednesday over terror financing charges and has been sent on 7-day judicial remand.

The ICJ had allowed India consular access to Jadhav and asked it to review the executing order while informing that it was acting in contravention of the Vienna Convention.

"ICJ verdict final and binding," the ministry of external affairs said, adding,"Pak does not have patience to read."

The ministry said PM Modi had tweeted and welcomed the verdict and it had a statement in both Houses of Parliament which was a complete vindication and validation of India's stand, it said.

All efforts are being made to get Jadhav back," the MEA said. "We will put all efforts together to extradite Jadhav back to India," it addded. "Pakistan is in breach of obligations," MEA said.

All points say verdict is in favour of India, the MEA said. "ICJ has unanimously declared it has jurisdiction".

"Pakistan has to just act now."

Pakistan PM Imran Khan in a tweet however tried to put a spin on the verdict saying that he "appreciated" ICJ's decision not to "acquit, release & return Commander Kulbhushan Jadhav to India."

"He is guilty of crimes against the people of Pakistan. Pakistan shall proceed further as per law," Pak PM Imran said.

Just after the verdict was annouced Anwar Mansoor Khan, Pakistan Attorney General was quick to tell reporters that it was "a clear, clear win for Pakistan".

After the judgement, India's advocate at the ICJ Harish Salve said that there has to be fair adjudication of consular access.

"We made Pakistan adhere to the Vienna Convention," he declared.

The world court had found that Pakistan had "deprived India of the right to communicate with and have access to Kulbhushan Sudhir Jadhav, to visit him in detention and to arrange for his legal representation."

The ICJ added that Pakistan must provide "by the means of its own choosing, effective review and reconsideration of the conviction and sentence of Kulbhushan Sudhir Jadhav".

The Murder Case

In 1999, on the advice of an astrologer, Rajagopal had sought to marry for the 3rd time as it was said that it would bring him good fortune. He allegedly wanted to marry the daughter of a Saravana Bhavan Chennai branch employee. The woman whom he wanted to marry was in her twenties and she rejected his proposal to marry a man of her choice. Later, she went on to marry Prince Shantakumar who was also an employee in the Saravana Bhavan restaurant.

Rajagopal had allegedly threatened the couple and demanded that they separate. When they resisted against his advances, the couple was abducted by Rajagopal’s men, which prompted the couple to file a Police complaint on October 1 2001.

A few days later, Shantakumar was abducted again and taken to the Kodaikanal Hill Station, where his body was found by the first department officials from the Tiger Chola forests.

The post-mortem report said that the cause of death was strangulation.

Shortly after the case garnered attention, Rajagopal surrendered in late 2001 and was released on bail. Later in July 2003, he was again in trouble for trying to bribe the same woman and assaulting her brother.

Delhi High Court on Thursday granted time to Robert Vadra to file a rejoinder on the Enforcement Directorate's (ED) reply to the petition challenging the constitutional validity of certain sections of the Prevention of Money Laundering Act (PMLA).

The plea filed by Robert Vadra and his close aide Manoj Arora had also sought quashing of the Enforcement Case Information Report (ECIR), under which they have been charged.

A division bench of Justices Manmohan and Justice Sangeeta Dhingra Sehgal also dismissed as withdrawn, another plea by the petitioners seeking no coercive action against them as both have already been granted anticipatory bail by the trial court.

The court has slated the next hearing in the case to August 21.

Senior advocate KTS Tulsi, who is from Congress, appeared for Vadra and Arora while senior lawyer Amit Mahajan and DP Singh represented the ED.

Solicitor General (SG) Tushar Mehta, who had earlier appeared for ED, had questioned the maintainability of the petition challenging the PMLA Sections saying that the matter concerned is already pending before the Supreme Court.

Union Minister Gen (retired) VK Singh on Thursday hailed the Kulbhushan Jadhav verdict and asserted that the positive judgment may make Pakistan realize their mistake.

Speaking to ANI on the International Court of Justice`s verdict delivered yesterday, Singh said, "The judgement is positive. With a judgment of 15:1 they have supported what we have said. It is visible that ICJ has honoured the basic conventions of law and justice and India has been successful in its mission".

On being asked about whether India will further exhort more pressure on Pakistan for resolution of this issue, he said, "The way they had abducted Kulbhushan and filed a fake case, we believe something must be done about it. Hopefully, Pakistan will realise the mistake that they have made and will take action to ensure that Kulbhushan Jadhav gets justice and is returned to India. "

His reaction comes after the ICJ on Wednesday continued its stay on the execution of the Indian national Kulbhushan Jadhav, held in a Pakistani jail on allegations of spying, and called for an effective review and reconsideration of the conviction.

Jadhav, 49, was purportedly "arrested" from Balochistan by Pakistani security forces on March 3, 2016, after he allegedly entered the country from Iran, as claimed by Islamabad.

India has held that Pakistan, which faces several problems on its border with Iran, has been using Jadhav`s case to blame India for its problems in Balochistan.

It has used proxy groups such as Jaish al Adl against Iran, while Iranian officials have spoken of Pakistan`s sponsorship of terror activities along the Iran-Pakistan border.

It was on March 25, 2016, that then Foreign Secretary of Pakistan, Aizaz Ahmad Chaudhry, had informed the Indian High Commissioner in Islamabad of Jadhav`s "arrest."

Since then, Pakistan has not offered any explanation as to why Islamabad took over three weeks to inform the Indian High Commissioner about Jadhav`s arrest.

Jadhav was sentenced to death by a Pakistani military court on April 11, 2017.

Following this, India on May 8, 2017, approached the ICJ against Pakistan "for egregious violations of the Vienna Convention on Consular Relations, 1963" in the matter.

India alleged that Pakistan is in breach of Article 36(1) (b) of the Vienna Convention, which obliged Pakistan to inform India of the arrest of Jadhav "without delay".

A timeline to Kulbhushan Jadhav's case in International Court of Justice

The International Court of Justice (ICJ) is expected to pronounce its verdict in the Kulbhushan Jadhav case on Wednesday. Jadhav, a 49-year-old Indian national, was sentenced to death over allegations of espionage and terrorism by a military court in Pakistan on April 11, 2017.

But not only did Pakistan made an error by falsely implicating Jadhav, it also made "egregious violations of the Vienna Convention on Consular Relations, 1963" in the matter, said India as it moved the ICJ.

India has contended that it had not been informed of Jadhav's detention until long after his arrest and that Pakistan had failed to inform the accused of his rights to defend himself by a legal counsel of his choice. India further said that in violation of the Vienna Convention, the authorities of Pakistan had denied India its right of consular access to Jadhav, despite repeated requests - in fact, India was denied consular access to Jadhav 16 times.

According to Article 30 of the Vienna Convention, it was mandatory for Pakistan to inform Indian consular officers about Jadhav's address without delay. But Pakistan authorities failed to do so and informed the Indian High Commissioner three weeks after his arrest. On May 18, 2017, a 10-member bench of the ICJ had restrained Pakistan from executing Jadhav till the adjudication of the case.

The verdict by Pakistan's military court was based on Jadhav's confession taken under custody, without proper legal representation and this was in clear violation of the Vienna Convention and the international law, including international covenant on civil and political rights. However, the international covenant on civil and political rights clearly states that use of military courts for the trial of civilians is in violation of due process standards.

In a statement in the Rajya Sabha on April 11, 2017, then External Affairs Minister Sushma Swaraj had reiterated that Kulbhushan Jadhav has been awarded a death sentence by a Pakistani military court-martial on "concocted charges". "To make matters even more absurd, three hours after the death sentence was announced the Indian High Commission received an official communication from the Foreign Ministry of Pakistan reiterating the Pakistani proposal for conditional consular access. That tells us a lot about the farcical nature of the alleged proceedings which have led to an indefensible verdict against an innocent kidnapped Indian," Swaraj had informed the Upper House of Parliament.

"Our position on this matter is clear. There is no evidence of wrongdoing by Jadhav. If anything, he is the victim of a plan that seeks to cast aspersions on India to deflect international attention from Pakistan's well-known record of sponsoring and supporting terrorism," she had further said in her statement.

The verdict is likely to be read out by President of the ICJ Judge Abdulqawi Ahmed Yusuf at around 6:30 pm (IST) at the Peace Palace in The Hague.

Ahead of ICJ verdict, a look at how Pakistan violated international law in Kulbhushan Jadhav case

While Indian flights will save time and fuel, the expenses will reduce drastically after Pakistan announced the opening of its airspace for civil traffic, according to Air India, Director (Operations) Captain Amitabh Singh.

On being asked to respond to Pakistan`s decision to open its airspace for civil traffic, Singh on Tuesday told ANI, "With this opening, we will be saving 1.5-2 hours of flying time between India-Europe and India-USA.

We will save on fuel consumption too. The expenses will reduce drastically.

"He added that the decision will be beneficial for both Indian and foreign carriers as the closure had generated inconvenience for the traveling public."It is going to be beneficial for Indian carriers as well as for foreign carriers. The closure generated a lot of inconvenience for the traveling public," he opined.

This response came after neighbouring country Pakistan on Tuesday morning announced the opening of its airspace for civil traffic, which was closed over four months back after the Balakot strikes.

Earlier this month, the Centre had informed Rajya Sabha that Indian airlines suffered losses worth over Rs 548 crore due to airspace closure by Pakistan after the Balakot airstrike in February.

In a written response to a question in Rajya Sabha, Minister of State for Civil Aviation (Independent Charge) Hardeep Singh Puri had said the national carrier Air India lost Rs 491 crore till July 2, while IndiGo suffered a loss of Rs 25.1 crore till May 31.

SpiceJet and GoAir lost Rs 30.73 crore and Rs 2.1 crore, respectively till June 20.

"The airspace closure by Pakistan is a unilateral measure that followed the non-military counter-terrorism airstrike by the Indian Air Force against terror camp in Balakot in Pakistan in February 2019," Puri had said in the upper House of Parliament.

Earlier, an Air India official had told ANI that the national carrier was losing 6 crore a day due to airspace closure by Pakistan.

Pakistan had earlier claimed that it would not open its airspace for commercial flights until India removed its fighter jets from forwarding Indian airbases.

Pakistan had fully shut its airspace on the eastern border with India after the Indian Air Force (IAF) had carried out airstrikes on a Jaish-e-Mohammed (JeM) terror camp in Balakot on February 26.

The strikes on the terror camp were in response to the JeM-perpetrated terror attack in Pulwama in Jammu and Kashmir on February 14 in which 40 CRPF personnel had lost their lives.

In mid-April, Pakistan opened one of its 11 air routes for westbound flights from India airlines like Air India and Turkish Airlines have started using it.

In March, the neighbouring country partially opened its airspace but did not allow Indian flights to fly over its airspace.

The bill was passed in the Lok Sabha with 278 members voting in its favour and six against it. While it was passed in the Rajya Sabha by a voice vote.

The National Investigation Agency (Amendment) Bill aims at enhancing the jurisdiction of NIA to investigate scheduled offences committed outside India targeting Indians as well as Indian assets abroad.

Assuring the House against the misuse of the bill, Home Minister Amit Shah said, "I want to assure the House that Prime Minister Narendra Modi government will not allow any misuse of this law."
