A Delhi bench Monday reserved order on whether to take cognisance of a supplementary charge sheet against British National Christian Michel James and businessman Rajeev Saxena in the AgustaWestland chopper scam.

Special Judge Arvind Kumar reserved order for September 25 after the public prosecutor, appearing for the CBI, submitted his argument that there was enough material to proceed against both the alleged middlemen as well as 13 others in the case.

According to sources, the probe report filed on Friday details the alleged role played by the accused in bringing bribes for politicians, bureaucrats and Indian Air Force (IAF) officials.

The sources said that the CBI, which had earlier this year sought sanction from the authorities concerned to prosecute former defence secretary Shashi Kant Sharma, has not named him as an accused since the request has not been granted yet.

The agency told the court that it may file another supplementary charge sheet in the matter later.

The first charge sheet in the case was filed in September 2017 naming former IAF chief SP Tyagi and others.

The agency had earlier told the court that during the course of investigation, copies of classified/ secret official documents of Indian Air Force (IAF)/ Ministry of Defence (MoD) such as Operational Requirements for VVIP helicopters before issuance of Request of Proposal and other incriminating documents running into more than one lakh pages received from Italy and Switzerland.

It had also said that a payment sheet recovered from Michel, prepared on his dictation, shows that an amount of 30 million euro was paid/ proposed to be paid to the officers of IAF, MoD, bureaucrats, politicians and family in India for showing favour in the VVIP helicopter deal.

Michel had entered into as many as five contracts through two of his firms to legitimise the illicit commission/ kickbacks on the procurement of VVIP helicopters by MoD, India, the CBI said.

An amount of 42.27 million euro was paid by the Westland Group Companies to the firms of the applicant as kickbacks/ bribes without undertaking any work against the receipt of such amount, it said.

It said that out of the kickbacks received from AgustaWestland, Michel further made payments to various persons in India.

Michel was taken into custody by the Central Bureau of Investigation (CBI) on December 5 last year after his extradition from Dubai, while the ED took him into custody on December 22 last year. He is currently in judicial custody in both cases.

Dubai-based businessman Saxena was extradited to India on January 31, 2019 in connection with the scam relating to the purchase of 12 VVIP helicopters from AgustaWestland.

ED had earlier arrested Saxena but he was later granted bail after the agency supported his plea to turn approver in the case.

The agencies had told the court that Michel made 24.25 million euro and 1,60,96,245 pound from the now-scrapped AgustaWestland deal.

The CBI has alleged that the deal signed in February 2010 to supply VVIP choppers worth 556.262 million euro caused an estimated loss of 398.21 million euro (about Rs 2,666 crore) to the state exchequer.

The CBI has alleged that the deal signed in February 2010 to supply VVIP choppers worth 556.262 million euro caused an estimated loss of 398.21 million euro (about Rs 2,666 crore) to the state exchequer.

Launching a scathing attack on the opposition for the ruckus during the discussion on Agri Bills in Upper House of Parliament (Rajya Sabha), Defence Minister Rajnath Singh on Sunday said that the behaviour displayed by various parties was "saddening, unfortunate and shameful".

“What happened in Rajya Sabha today was saddening, unfortunate and shameful. It is the responsibility of the ruling side to enable discussions in the House but it is also the duty of the Opposition to maintain decorum,” said Defence Minister Rajnath Singh.

"As far as I know, this has never happened in the history of Lok Sabha or Rajya Sabha. This happening in Rajya Sabha is an even bigger matter. Attempts are being made to mislead the farmers on the basis of rumours. What happened is against the decorum of House," he said.

"It is expected of a good Opposition to help with the Parliament's proceedings. Acting for vested political interests and misleading people isn't healthy democratic practice," he said.

'Saddening, unfortunate and shameful': Rajnath Singh slams opposition for ruckus in Upper House

The News Broadcasters Association (NBA) has suggested to the Supreme Court that its "code of ethics" should be made part of statutory rules on cable TV by the central government to ensure it becomes binding on member and non-member news channels alike.

Taking note of the NBA's alleged inadequacy in regulating "hurtful" and "communal" contents in television programmes of news channels, the top court on September 18 had sought suggestions from it and the Centre to strengthen the association's self-regulatory powers.

A bench headed by Justice D Y Chandrachud has been hearing a case of a lawyer seeking granting of pre-telecast ban on a programme called 'UPSC Jehad' of Sudarshan TV and it will hear the case on Monday again.

At present, the court has stayed the telecast of episodes which deal with alleged infiltration of Muslims in bureaucracy.

Annie Joseph, secretary general of the NBA, has filed the affidavit in pursuance of the court's direction asking it to give suggestions as to how the self-regulatory mechanism of the NBA could be strengthened and made more effective in regard to the electronic media.

The NBA said its code of ethics should be given a statutory recognition by making it a part of the Programme Code under the Cable TV Rules so that these codes become binding on all news channels.

The move will give official recognition and power to the regulatory body.

"This court may grant recognition to NBSA (News Broadcasting Standard Association) the 'independent self-regulatory mechanism' so that complaints against all news broadcasters, whether members of NBA or not, may be entertained by the NBSA and the orders passed by the NBSA would be binding and enforceable on all news broadcasters," Joseph said in her affidavit.

"Recognition to the NBSA would also strengthen the News Broadcasting Standard Regulation and the penalties mentioned therein could be made more stringent," the affidavit stated.

The self-regulatory body said that amenability to the NBSA mechanism should be made a term of the "uplinking/downlinking permission for news channels, and the orders made, if any, against any news broadcaster may be considered by the (information and broadcasting) ministry at the time of grant and renewal of such permissions".

The NBSA is currently headed by retired Supreme Court judge A K Sikri.

Earlier, the bench had said it was against the practice of courts granting pre-telecast injunctions on shows and that such orders are a "nuclear missile" and hence, the self-regulatory mechanism needed to be strengthened.

It had also questioned Sudarshan TV over its 'Bindas Bol' programme, the promo of which had claimed that the channel would show the "big expose on conspiracy to infiltrate Muslims in government service".

The bench had asked whether media can be allowed to “target whole set of communities.

Simultaneously, it had taken note of alleged inadequacy of self-regulatory mechanism of the NBA and had observed: "The NBA says that Sudarshan TV is not its member so it cannot do anything."

NBA says they have a committee headed by a retired Supreme Court judge. They can impose a maximum fine of Rs one lakh and this shows how toothless they are. But, the NBA is only for members, so Sudarshan News not being a member is not governed by the NBA," the bench had observed.

Rajya Sabha saw a major ruckus on Sunday as Opposition members left their seats to demand a division of votes during passage of the two key farm bills.

Rajya Sabha, on Sunday, passed Farmer's Produce Trade and Commerce (Promotion and Facilitation) Bill, 2020, and the Farmers (Empowerment and Protection) Agreement of Price Assurance and Farm Services Bill, 2020. These bills have already been passed by the Lok Sabha.

These key bills were passed by voice vote.

The Opposition resolutely demanded that the bills be sent to House panel for a closer scrutiny. The demands were negated by voice vote. The ruckus in the House had already started.

Deputy Chairman Hariavansh overuled the demand for a division of votes.

What followed was pure pandemonium. Opposition MPs, led by Trinamool Congress, rose from their seats and entered the well of the House. Books were flung at the Deputy Chairman. House marshals had to do their best to protect the Chair from this onslaught. The ruckus created by the Opposition had previously compelled Agriculture Minister Narendra Singh Tomar to cut short

"These are the rules...!" TMC MP Derek Obrien could be heard telling the Deputy Chairman. He charged towards the podium. Obrien had the rulebook in hand. He has been accused of trying to tear the rulebook. He has denied the accusation.

The bills are facing staunch opposition from some farmer bodies as well as from within the ruling coalition. Harsimrat Kaur Badal, the food processing minister from the Shiromani Akali Dal party, resigned from the government last week.

Opposition parties as well as the SAD felt the bills are the first step toward removing the MSP which will force the farmers to make distress sales to private companies.

The Farmers'' Produce Trade and Commerce (Promotion and Facilitation) Bill, 2020 seeks to give freedom to farmers to sell their produce outside the notified APMC market yards (mandis). This, the government says, is aimed at facilitating remunerative prices through competitive alternative trading channels.

Farmers will not be charged any cess or levy for sale of their produce under this Act, according to the government.

It will open more choices for farmers, reduce marketing costs, and help them get better prices. It will also help farmers of regions with surplus produce to get better prices and consumers in areas with shortages at lower prices.

The Farmers (Empowerment and Protection) Agreement of Price Assurance and Farm Services Bill, 2020 seeks to give farmers the right to enter into a contract with agribusiness firms, processors, wholesalers, exporters, or large retailers for the sale of future farming produce at a pre-agreed price.

It seeks to transfer the risk of market unpredictability from farmers to sponsors.

Tomar said this legislation guarantees cultivators the price they negotiate at the time of sowing itself.

A third bill, the Essential Commodities (Amendment) Bill, 2020 that seeks to remove commodities like cereals, pulses, oilseeds, onion, and potatoes from the list of essential commodities and will do away with the imposition of stock holding limits, is to be moved separately.

Slogans raised, documents torn: This is how Opposition behaved in Upper house of the Parliament

Prime Minister Narendra Modi on Sunday described the passage of two farm sector bills as a "watershed moment" in the history of Indian agriculture, asserting that they will ensure a complete transformation of the farm sector and empower crores of farmers.

In a series of tweets after Rajya Sabha passed the bills by voice vote amid din created by protesting opposition members, Modi said these proposed laws will liberate farmers from numerous adversities as he noted that peasants were for decades bound by various constraints and bullied by middlemen.

He again assured farmers that the existing government support system for them will continue.

Farmers in states like Punjab and Haryana have been protesting against these bills, with their leaders alleging that the legislations will dismantle the existing system and leave them to the mercy of corporate interests.

Reaching out to the peasantry in Punjab, the prime minister posted his tweets in Punjabi as well.

Shiromani Akali Dal, the BJP's oldest ally, has quit the Modi government in protest against these bills.

Modi asserted, "I said it earlier and I say it once again: System of MSP will remain.

Government procurement will continue.

"We are here to serve our farmers. We will do everything possible to support them and ensure a better life for their coming generations." These bills will add impetus to the efforts to double income of farmers and ensure greater prosperity for them, he said.

"Our agriculture sector is in desperate need of latest technology that assists the industrious farmers. Now, with the passage of the bills, our farmers will have easier access to futuristic technology that will boost production and yield better results. This is a welcome step," the prime minister said. The two bills were earlier passed by Lok Sabha.

After they get the presidential assent, they will be notified as laws.

"A watershed moment in the history of Indian agriculture! Congratulations to our hardworking farmers on the passage of key bills in Parliament, which will ensure a complete transformation of the agriculture sector as well as empower crores of farmers," Modi added in another tweet.

The Farmers' Produce Trade and Commerce (Promotion and Facilitation) Bill, 2020 seeks to give freedom to farmers to sell their produce outside the notified APMC market yards (mandis).

This, the government says, is aimed at facilitating remunerative prices through competitive alternative trading channels.

Farmers will not be charged any cess or levy for sale of their produce under this Act, according to the government.

It will open more choices for farmers, reduce marketing costs, and help them get better prices.

The mosque to come up in Ayodhya pursuant to the Supreme Court verdict in the Ram Janmabhoomi case may have a shape that is different from the traditional shape of mosques and will not be named after any emperor or king.

Secretary and spokesperson of the Indo-Islamic Cultural Foundation (IICF) Athar Hussain told PTI on Sunday, "A mosque measuring 15,000 square feet will be built in Dhannipur village. It will be of the same size as that of the Babri mosque. The shape of the mosque may be completely different from that of other mosques. It may be square-shaped like the Kaaba Sharif in Mecca, as hinted by architect SM Akhtar."

To a question on whether the mosque at Dhannipur will have no domes or minarets like the Kaaba Sharif, Mr Hussain said it could be a possibility.

He said the architect has been given a free hand in this regard.

"The mosque will not be named Babri Masjid. It will not be named after any king or emperor. My personal opinion is that it should be called the Dhannipur Masjid," Hussain said.

He also informed that the trust is making its portal so that people can donate for the mosque and the museum, hospital and research centre which will be built inside the complex. Write-ups by national and international Islamic scholars will also appear on the portal.

He said some work on the portal is yet to be completed and hence, donation is yet to begin.

The Uttar Pradesh Sunni Central Waqf Board has formed the IICF, a trust, for the construction of the mosque on a five-acre plot.

The state government has allotted the five-acre plot in Ayodhya's Dhannipur for the construction of the mosque on the directive of the top court.

After a protracted legal tussle, the Supreme Court, on November 9 last year, ruled in favour of the construction of a Ram temple at the disputed site in Ayodhya and directed the Centre to allot an alternative five-acre plot to the Sunni Waqf Board for building a new mosque at a "prominent" place in the holy town in Uttar Pradesh.

The Babri mosque in Ayodhya was demolished on December 6, 1992 by "karsevaks", who claimed that an ancient Ram temple stood at the same site.

The overall number of cases and deaths per million population due to COVID-19 in the country is low compared to similarly affected countries, Minister of State for Health Ashwini Kumar Choubey told Rajya Sabha on Sunday.

Noting that there are no established pharmaceutical interventions that can break the chain of transmission, Mr Choubey said non-pharmaceutical interventions such as hand and respiratory hygiene, wearing of mask/face cover, physical distancing measures, preventing large gatherings, etc are the only tools to suppress and break the chain of transmission.

This has to be in turn supported by heightened community awareness and behavioral change communication.

He was responding to a question on the reasons for spread of COVID-19 at an increased rate despite lower numbers at the initial stage in India as compared to other countries.

"COVID-19 is a highly infectious disease. Many of the epidemiological parameters such as agent-host interaction, socio-cultural and environmental factors, modes of transmission, susceptibility of individuals, immune response are still under research," Mr Choubey said in a written reply.

The Government of India since January, has followed a pre-emptive, graded and proactive approach for managing COVID-19, the minister said.

States have been supported in terms of logistics, funding and technical guidance right from the beginning.

To blunt the progression of cases in the country, the government had taken series of steps under Disaster Management Act, 2005 including lockdown, Mr Choubey highlighted.

"This in effect reduced the growth rate of cases, increased community awareness, and the period was utilized to upgrade health infrastructure and health staff capacities which has supported the country in terms of managing the disease.

India's parliament on Sunday passed new bills the government says will make it easier for farmers to sell their produce directly to big buyers amid a pandemonium in the Upper House by the opposition parties.

Prime Minister Narendra Modi has said the new laws will reform antiquated laws and remove middlemen from agriculture trade, allowing farmers to sell to institutional buyers and large retailers like Walmart. The bills also will make contract farming easier by providing a new set of rules.

On Sunday, some opposition lawmakers raised slogans, tore documents and tried to grab the speaker's microphone in Rajya Sabha, before the two controversial bills were passed by a voice vote.

The Congress and other opposition party members sat in protest inside Rajya Sabha even after the House was adjourned for the day after the passage of two farm bills.

Members of the Congress, Trinamool Congress, DMK, Left parties and some others sat in protest inside the Rajya Sabha chamber even after it was adjourned.

The House sitting ends at 1 pm and Rajya Sabha chamber has to be sanitised by 3 pm when Lok Sabha sits for a session. Both the chambers of Lok Sabha and Rajya Sabha are being used for each House to allow members to follow physical distancing norms.

Earlier, Modi's food processing minister from an alliance party resigned on Thursday in protest calling the bills "anti-farmer", and the opposition parties have said farmers' bargaining power will be diminished by allowing retailers to have tighter control over them.

Harsimrat Kaur Badal, Modi's former food processing minister, is from a regional party which has a strong base in the northern state of Punjab and believes the bills will increase farmer suffering in the breadbasket state.

Her party believes the laws will destroy wholesale markets which ensure fair and timely payments to farmers, weaken the state's farmers and the overall state economy.

Many farmer organisations have in recent days held street protests in Punjab and the neighboring Haryana state near New Delhi. On Sunday, India's main opposition Congress party criticised the government.

"We will make sure that the government will have to step down on its knees before the farming community of this country," said Randeep Surjewala, a party spokesman.

"It will be farmers one side and big businesses on the other side, how will they fight?," he added.

Congress chief whip in Rajya Sabha told PTI that the opposition members will continue to sit in Rajya Sabha chamber till 3 pm to lodge their protest against the government's attitude.

This was done to mark their protest against the manner in which 'The Farmers' Produce Trade and Commerce (Promotion and Facilitation) Bill, 2020' and 'The Farmers (Empowerment and Protection) Agreement of Price Assurance and Farm Services Bill, 2020' were passed in the House without taking into consideration the demands of the opposition.

The opposition members had given notices to move motions for sending the bills to a Select Committee for further scrutiny, but the same were not taken up as these members were not on their seats in the House and could not move them as they were protesting.

Earlier the House witnessed uproarious scenes when some opposition members led by the TMC climbed on to the chairman's podium as the government pushed for the passage of the two contentious farm bills.

Slogan-shouting opposition members, including those from the TMC, Congress and Left, created ruckus after Deputy Chairman Harivansh did not consider their demand for a division of votes on a resolution to send the two bills to a select committee.
