Guntur police had said that they had a feeling that the man would commit suicide after investigating his call data record. He had told one of his relatives that he had committed a crime and was ashamed of it.&nbsp

The incident took a political turn as YSR Congress party president YS Jaganmohan Reddy held chief minister N Chandrababu Naidu responsible for the incident and said the accused could be an activist of the ruling Telugu Desam Party.

Taking cognizance of such crimes, President Ram Nath Kovind, on April 22, promulgated the Criminal Law (Amendment) Ordinance, 2018, for effective deterrence against the commission of rape.

A 17-year-old girl was allegedly abducted and subsequently raped by eight men in Haryana's Mewat, following which she committed suicide, the police said today.

The girl was found lying unconscious after she was gang-raped in a secluded area in Nuh district after being abducted from her house on Monday, according to a complaint filed by the girl's father with the police.

The teenager was alone in the house when the accused came on two motorcycles and a car and abducted her, it said.

After committing the crime, the accused fled the spot, a police officer of Rojka Meo police station said over phone today.

Following the incident, the girl allegedly committed suicide in her house on Tuesday by hanging herself.

Her father told the police that the 17-year-old had identified the accused, who had stalked her in the past as well.

"We have registered a case of abduction, gang-rape and abetment to suicide against the accused, and are conducting raids to nab them," said Rojka Mev SHO Jai Bhagwan.

"Investigations in the case are on," SP, Mewat, Nazneen Bhasin said.&nbsp;

Registered cases of sexual violence have been steadily rising despite the national outrage that followed the fatal gang-rape of a student on a bus in New Delhi in 2012.

Amid the wave of anger at that time, the government promised to speed up rape trials, introduce harsher penalties, including the death sentence in extreme cases, and introduced a law against stalking.

But statistics show that since 2012, reported rape cases climbed 60 percent to about 40,000 in 2016, with child rape accounting for about 40 percent of them.

17-year-old raped by 8 men in Haryana's Mewat, hangs herself

The bone ossification test report of an accused held in connection with the rape of a 10-year-old girl inside a madrassa in Ghaziabad has indicated that he is a major, police said Tuesday.&nbsp

The report was submitted to juvenile justice board Tuesday and the matter has been listed for hearing tomorrow, said a senior police officer.&nbsp

A bone ossification test was carried on the accused since his family had failed to submit documents that could help the police to ascertain if he was below 18 years of age, he said.

“The test report indicates that he is a major,” the officer said.

Earlier this week, the police had also arrested Ghulam Shahid, the madrassa cleric, for allegedly being aware of the presence of the girl on the premises.

The police were informed on April 21 by the girl’s father that she had gone missing from Ghazipur in east Delhi after she went to the market. Subsequently, the girl was rescued from the madrassa on April 22 by a Delhi Police team and the “juvenile” apprehended, the police said.

The victim had recorded her statement in front of a magistrate on April 23. She had said the accused had taken her to the madrassa to meet his friends.

Wading into the debate on violence against women and minor girls once again, Uttar Pradesh’s ruling BJP legislator Surendra Singh has said parents are responsible for the increasing incidents of rape and should not let their children roam around freely.&nbsp

The legislator from Bairia in Ballia district, who had earlier made news when he said no one can rape a mother of three children, also advised parents not to give their children mobile phones.&nbsp

“The parents of youths are responsible for growing incidents of rape as they do not take care of their wards,” local BJP MLA Surendra Singh told reporters in Balia on Monday night.

“Children up to 15 years of age should be kept under strict vigil. It is the duty of parents to take care of their wards. But they allow their wards to roam around freely. This is the main reason for the social evil,” he said. Children should not be given undue freedom, he said and asked parents not to give mobile phones to them.

The remarks come in the backdrop of outrage over the brutal gangrape and murder of an eight-year-old girl in Kathua in Jammu and Kashmir, and the rape of a 17-year-old girl in Uttar Pradesh’s Unnao district, allegedly by BJP MLA Kuldeep Singh Sengar.

Defending Sengar, Surendra Singh had said, “I am speaking from a psychological point of view no one can rape a mother of three children. The cabinet reshuffle was necessitated after two BJP ministers were forced to resign for attending a rally taken out in Kathua in support of the suspected rapists.&nbsp;

BJP national general secretary Ram Madhav, who attended the swearing-in ceremony, however said today's changes had no connection with the Kathua case.&nbsp;

Besides Gupta and Sharma, the new BJP faces sworn in as ministers were the MLAs from Kathua and adjoining Sambha, Rajiv Jasrotia and Devinder Kumar Manyal, respectively.

The BJP also upgraded Sunil Sharma, at present minister of state for transport, to the rank of cabinet minister. BJP legislator Shakti Raj took oath as a minister of state.

From the PDP, Pulwama MLA Mohammed Khalil Band and Sonawar MLA Mohammed Ashraf Mir took oath as ministers.

Of the eight, seven are first-time ministers. Seven of the eight are cabinet ministers.&nbsp;

The 17-minute-long audio clip had the religious leader talk about his plan to get his aides, Sharad and Shilpi, out first after which he shall also soon join his devotees.&nbsp;

Asaram, in the clip, was also heard saying that he is aware of some people eyeing to become the director of the ashram by levelling allegations against him. He stated that he is a follower of Mahatma Gandhi and that he will not resort to violence.&nbsp;

Asaram expressed his faith in higher judiciary saying that if there is anything amiss, it will be rectified by the higher courts.&nbsp;

A 14-year-old girl was gang-raped repeatedly by five people for two more than months in the Gorakhpur area here, a senior police official said today.

The girl's parents approached the police last night alleging that five people, aged between 18 and 21, gang-raped their daughter, Gorakhpur Superintendent of Police Arjun Uike said.

"The parents approached the police after the news spread that the girl underwent an abortion two days ago," the official said.

Three accused, identified as Saurabh Chakravarty, Pramod Chakravarty and Honey Chakravarty, had been arrested, he said.

"Two others, Rahul Chakravarty and Bantu Sonker, are on the run," Uike said.

Two more constables will stand guard outside her house in addition to the five policemen already deployed there, and a strict vigil is being maintained on all the visitors using CCTV cameras," Superintendent of Police KB Singh had told PTI .

A vigil was also being kept outside Asaram's ashram at Rudrapur, he added.&nbsp;

The Union Home Ministry's advisory was sent in view of the fact that large-scale violence was witnessed in Haryana, Punjab and Chandigarh after a special court in Mohali convicted Dera Sacha Sauda chief Gurmeet Ram Rahim last year.

Final arguments in the Asaram case had been completed by the special court for SC/ST cases on April 7 and the court had kept the order reserved for April 25.

Asaram was arrested in Indore and brought to Jodhpur on September 1, 2013. He has been in judicial custody since September 2, 2013.

Asaram unsuccessfully moved 12 bail applications, of which six were rejected by the trial court, three by the Rajasthan high court and three by the Supreme Court.&nbsp;

The charge sheet against Asaram and four other co-accused Shiva, Shilpi, Sharad and Prakash had been filed by the police on November 6, 2013 under various sections of the POSCO Act, Juvenile Justice Act and IPC.&nbsp;

Saroj Khan defends casting couch, says it 'provides livelihood'

The Mehbooba Mufti government in Jammu and Kashmir today approved an ordinance providing death penalty to those guilty of raping children, a development that comes in the wake of massive outrage over the Kathua rape and murder case.

Significantly, the government also shifted the 'burden of proof' on the accused, while bringing provisions to ensure time-bound fast-track investigation and trial in such cases, a minister said.

The Centre had also approved an ordinance to amend the Protection of Children From Sexual Offences (POCSO) Act only last week.&nbsp&nbsp &nbsp

In cases of rape, where the victim is a child up to the age of 12, we have provided for death penalty to those found guilty, Jammu and Kashmir Law Minister Abdul Hak Khan told reporters here today.

The state Cabinet, which met under Chief Minister Mehbooba Mufti, approved two ordinances to provide stringent punishment including death penalty for those convicted of rape of minor girls, the minister said.&nbsp

"One ordinance is the criminal law ordinance 2018, in which enhancement of punishment in rape victim cases is provided and the second is Jammu and Kashmir protection of children from sexual violence ordinance," Khan said.

We are amending the Ranbir Penal Code (RPC) criminal procedure and evidence act, Khan, who flanked by State Finance Minister Syed Altaf Bukhari, said.

The second ordinance is aimed at checking offences against children up to the age of 16 and that is a special act we have brought in the shape of an ordinance today, he said.&nbsp

The government had specified in the ordinance that life means "entire life" in terms of punishment, the minister said. Earlier, the interpretation of life sentence was different, from 10 years to 16 years, now we have kept it in the law so that nobody can interpret it otherwise, he added.

The government has changed the pattern of investigation and trial of rape cases in J&K would be fast-tracked, he said.&nbsp"Only women police officers will investigate such cases and two months has been set as the time frame for completion of investigation," Khan said.&nbsp

We have fixed a six months period for trial, he added.

An appeal time of six months has been provided in such cases and it is to be decided within six months, he said.&nbspIn cases of fine imposed by the court, the new ordinance would direct that amount for the rehabilitation of the victims, unlike earlier when it used to go to the state exchequer, he said.

The trial will be in camera and bail provisions made tougher, he said.

He said child-friendly provisions had been brought through the second ordinance so that the victims are not harassed.&nbspIt is must for the courts to record the victim's statement within 30 days, he said. "We have put in the ordinance that the burden of proof is on the accused. Accused has to prove that I have not committed crime," he said.&nbsp

This step has been taken in view of the Kathua rape and murder case by the Mehbooba Mufti government in J&K, he said.&nbspThe body of a girl, from the Bakerwal community, was recovered from a forest on January 17, a week after she went missing while grazing horses in the forest area.&nbsp

The crime branch arrested 8 people including Juvenile and submitted charge-sheet in the court in Kathua on April 9. The trial has begun in the case on Monday last.&nbsp

The Court questioned the government during the hearing of a PIL which is seeking to do away with amendments in rape law after the December, 2012 rape of a girl in Delhi, the petitioner claims the amendments are being abused.

The High Court said the government was "not even looking at the root cause" or "educating people" as the offenders are often found below the age of 18 and are mainly someone from the family or known to them.

The Court also asked the government whether the victims' views were taken while Ordinance was being drawn up.

The government's move on Saturday came after nationwide outrage over the Kathua and Unno rape cases in J&K and Uttar Pradesh which led to widespread protests with political parties and civil society gathering to call for stern action against the guilty.&nbsp;

A 23-year-old woman was allegedly raped by two men after being confined to the basement of a house in the civil lines area here for around two months, the police said on Wednesday.

The victim filed a complaint with the police, alleging she was kept at the location for two months and raped by a man and his uncle, according to Station House Officer D K Tyagi.

The woman somehow managed to escape from the house on February 1, he said.

Police have registered a case against the accused and his uncle.

One of the accused has been arrested. Police are conducting searches to nab the uncle, who is on the run, the SHO said.

The incident comes amid a furore over cases of rapes reported from several parts of the country.&nbsp

A brave 16-year-old girl who was allegedly raped by two men in 2017 got her parents booked when try tried to convince her to change her statement against the case in exchange for bribe, reports said on Tuesday.&nbsp;

The girl had gone missing in August last year after which her parents had filed a police complaint. She returned after a week and told police that she was held captive by two men who raped her.&nbsp;

The two men were later arrested. However, one of them got out on interim mail and approached her parents on April 10 hoping they would convince their daughter to withdraw the case in exchange for a bribe of Rs 20 lakh. As per reports, the parents quickly agreed and asked for an advance but the girl went to the police on Tuesday to lodge a complaint against them.&nbsp;

The victim told the police that she was in her room when her parents met the accused and heard the entire conversation. She said that as soon as the man left her house, she went up to her parents to ask for justification. Instead, they tried to convince her to give a false statement.&nbsp;

Reports say that the girl was thrashed and blackmailed by her parents, saying that they desperately needed the money. She said that after thrashing her for a while, someone came to their house to hand them Rs 5 lakh as advance money. Her parents hid that money beneath the bed and left for court.

But, the girl quickly took the bag and went to Aman Vihar police station to lodge a complaint. She narrated the entire incident to the police, immediately after which a case under IPC Sections 195 (A) (threatening any person to give false evidence), 506 (threatening any person to give false evidence) and 120 (B) (punishment of criminal conspiracy) and Section 75 of the Juvenile Justice Act was registered.

Later the mother, upon her arrival from court, was arrested. The father, however, fled as he got the news of his wife's arrest. The police are on a lookout for the man to arrest him.&nbsp;

PM should 'speak up if serious about providing justice for our daughters': Rahul

Disturbed over the rape and murder of an eight-year-old girl in Kathua in the Jammu region, Union minister Maneka Gandhi has asked her department to work on a proposal to amend the POCSO law to bring in the provision of death penalty for the rape of a minor below the age of 12 years.

In the present Protection of Children Against Sexual Offences (POCSO) Act, there is no provision for capital punishment with the maximum sentence being life imprisonment for penetrative sexual assault as well aggravated penetrative sexual assault.

The Women and Children Development (WCD) minister has now proposed that rape of any child below the age of 12 years could lead to the death penalty, WCD officials said.

"I have been deeply, deeply disturbed by the rape case in Kathua and all the recent rape cases that have happened on children. I and the (women and child development) ministry intend to bring an amendment to the POCSO Act asking for death penalty for rape of children below 12 years," Maneka Gandhi was heard saying in a video, which was uploaded on Twitter.

The minor girl in the Kathua case, who belonged to the minority nomadic community, had disappeared from near her home in the forests next to a village in Kathua, 90 km from here, on January 10.

A week later, her body was found in the same area, and medical examination pointed towards sexual assault.

During initial investigations, the police arrested a juvenile. Later, the case was transferred to the Jammu and Kashmir Police's Crime Branch.

Two Special Police Officers (SPOs) and later, another five people, including a former revenue official and the alleged conspirator, who surrendered before the Special Investigation Team, were arrested.

The Crime Branch, which probed the rape and killing of the girl, had filed a main charge sheet against seven people and a separate charge sheet against the juvenile in a court in Kathua district earlier this week.

Jammu has been on tenterhooks since the brutal incident. The bar associations have been opposing the action against the accused, alleging that the minority Dogras were being targeted.

Lawyers took to the streets shouting slogans and trying to block the road outside the court where the charge sheets were filed.

The court has fixed the next date of hearing on April 16 when the case would be committed to sessions court for trial.&nbsp

The Crime Branch, which probed the rape and killing of the girl, had filed a main charge sheet against seven people and a separate charge sheet against the juvenile in a court in Kathua district earlier this week. Reluctance to report a sexual assault to police immediately does not mean the victim is lying, as Indian women would rarely make such false allegations, the Bombay High Court has said, upholding the conviction of four men for gang-rape.

Justice AM Badar earlier this week dismissed the appeals of Dattatraya Korde, Ganesh Pardeshi, Pintu Khoskar and Ganesh Zole, who had challenged a sessions court order of April 2013 sentencing them to 10 years in jail for gang-rape.

They were convicted of gang-raping a woman and thrashing her male friend on March 15, 2012, when the two were returning from Trimbakeshwar in Nashik district. The convicts claimed that they were framed up as they had seen the victim and her friend in a compromising position and threatened to take them to police for indecent behaviour.

The appeals sought to highlight that while the woman claimed that the incident took place on March 15, she lodged the complaint two days later. A medical examination had ruled out a rape since there was no injury on the woman's body, the appellants said.

The high court, however, upheld the conviction and sentence, citing a Supreme Court's observation in a past case that "rarely will a girl or woman in India make false allegations of sexual assault". The victim, who comes from a conservative section of society and who is separated from her husband, must have been afraid of stigma and "reflection on her chastity", Justice Badar said.

"She had fear of being looked down upon by the society including her parents... Being overpowered by a feeling of shame on account of gang-rape, her non-approaching a police station immediately...Cannot be said to be abnormal and throwing doubt on her version," the judge said.

Because of her secret excursion with a male friend, she must have felt that she would be branded as promiscuous if the incident came to light, the high court said. "Minor discrepancies" such as delay in lodging the complaint does not weaken her case, the court said.

The juvenile jurisprudence in India seemed to have come of age with the decision of trying the 16 years old perpetrator of the murder in Ryan International School in Gurugram as an adult in view of the original juvenile legislation being replaced by Juvenile Justice (Care and Protection of Children) Act, 2015 (The Act). The new Act lowered the age of adult criminal liability from 18 to 16 with certain conditions. This was the result of an outcry in the wake of infamous Nirbhaya gang-rape and murder case in 2012, where the most brutal of the accused was treated as a juvenile despite he was just a little under 18 years. The government did get up, took notice and made some amendments as stated above but the concept does need a deeper analysis.&nbsp;

One of the arguments advanced in support of keeping the juvenile law as invasive as possible is that, till the age of 18 (now 16), the mental faculty of the child is not developed enough so as to be able to understand the nature and consequences of the action. But it is to be understood that this assertion was justified at the time when the technology was not as advanced and surrounding societal circumstances were conducive. In the present scenario, technology has provided every information at the fingertips of an individual and, as such, the child is able to imbibe that much earlier than what he would have been able to, a few decades ago. In terms of society, the prevalent hostile environment has also caused the children of a reasonable age to experience the same and start responding to it at a much younger age.

The system needs to be receptive to the environment and change its perception according to the need of the hour. The brain is only an organ of the body but the mind is referred to as the ability of an individual to be aware of things, to think and to feel. That ability differs from person to person depending upon the circumstances that child is surrounded by. As a reference, a child who is exposed to a greater degree of public interaction would end up being more street smart as compared to a child of the same age who lives in the protective environment of the household.&nbsp;

The Act has, for the purpose of the application, classified the offences in three categories: 
Firstly, petty - which include the offences with a maximum punishment up to 3 years.&nbsp;Secondly, serious - which include the offences for which punishment is between 3 to 7 years.&nbsp;Thirdly, heinous - which include the offences for which minimum punishment is 7 years or more.&nbsp;

It is to be noted that, except heinous offences, for all other offences, the juvenile will not be trialled as an adult but would receive the institutional care for a maximum period of three years. Even for heinous offences, the minor accused, aged more than 16, would be presented before the Juvenile Justice Board and the Board will decide as to whether to send the child for trial as an adult or to send the accused to rehabilitation centre based upon the mental and physical ability of the child.&nbsp;

The present form of the statute, although better than before, still leaves a lot wanting and is just not sufficient to rein in the growing menace of juvenile crimes when even the serious offences are considered to have been committed without knowing the consequences of the action. It is reiterated that mental ability is an abstract principle and it changes with the circumstances. Criminal law provides two major touchstones to determine criminal liability i.e. a guilty mind and a criminal act in pursuance thereof. &nbsp;

There are certain offences where, irrespective of age, if committed, the guilt of the individual automatically follows. We cannot forget the Guwahati molestation case where a young lady was sexually assaulted for about 40 minutes in full public view. One of the perpetrators there was a juvenile. Unfortunately, even after the present amendment, this sinister offence would not make the accused liable to be trialled as an adult since the punishment for the same is a maximum term of five years. No stretch of the imagination could justify the argument that the juvenile there was not aware of his actions.

The changing paradigm of society makes it imperative to have the focus more on the offence rather than the offender, especially for the offences which inherently call for a punitive action. The rights of a victim cannot be brushed aside merely because they are in dispute with the age of the offender. It is hoped that coming years would bring with them a tilt towards reality rather than abstraction.&nbsp;

Speaking on the incident, ACP and chief PRO of Gurgaon police Manish Sehgal informed that four persons have been arrested after the victim&#39;s husband managed to note down the registration number of one of the two vehicles.&nbsp;

Supreme Court directs two AIIMS doctors to supervise rape of 8-month-old baby

As a result of the #MeToo campaign, US sexual assault hotlines are receiving a record number of calls from victims trying to reach out for help.

According to reports, the spike in calls was seen ever since the movement began in October 2017.

Reuters reported that the hotline operated by the &#39;Rape, Abuse and Incest National Network&#39;&nbsp;received a total of 209,480 calls, highest ever since the network was set-up in the year 1993.

People waited for up to three hours to talk at the National Sexual Assault Hotline, stated reports.

According to the DC Rape Crisis Center&#39;s Executive Director, Indira Henard, close to 70 people seek legal, physical or psychological help in a week. The number was around 30 to 40 a week before the campaign started.

The center also saw a spike in its donations.

The MeToo campaign became viral October 2017 onward as a hashtag started from Twitter.

The campaign started with an aim to spread awareness about the widespread prevalence of sexual harassment.

Many celebrities revealed shocking instances of sexual misconduct faced by them.

Allegations of sexual misconduct emerged against eminent Hollywood personalities like Harvey Weinstein and Kevin Spacey.

Dozens of women accused Harvey Weinstein of sexual misconduct, however, Weinstein denied the reports.

Some of the most notable personalities who shared stories of sexual violence included Jennifer Lawrence, Reese Witherspoon, Lady Gaga, Uma Thurman, Ellen DeGeneres and Ashley Judd among others.

As a result of the #MeToo campaign, US sexual assault hotlines are receiving a record number of calls from victims trying to reach out for help. According to reports, the spike in calls was seen ever since the movement began in October 2017. Reuters reported that the hotline operated by the 'Rape, Abuse and Incest National Network' received a total of 209,480 calls, highest ever since the network was set-up in the year 1993. People waited for up to three hours to talk at the National Sexual Assault Hotline, stated reports. According to the DC Rape Crisis Center's Executive Director, Indira Henard, close to 70 people seek legal, physical or psychological help in a week. The number was around 30 to 40 a week before the campaign started. The center also saw a spike in its donations. The MeToo campaign became viral October 2017 onward as a hashtag started from Twitter. The campaign started with an aim to spread awareness about the widespread prevalence of sexual harassment. Many celebrities revealed shocking instances of sexual misconduct faced by them. Allegations of sexual misconduct emerged against eminent Hollywood personalities like Harvey Weinstein and Kevin Spacey. Dozens of women accused Harvey Weinstein of sexual misconduct, however, Weinstein denied the reports. Some of the most notable personalities who shared stories of sexual violence included Jennifer Lawrence, Reese Witherspoon, Lady Gaga, Uma Thurman, Ellen DeGeneres and Ashley Judd among others. In yet another shocking incident, a three-year-old daughter of a labourer was allegedly raped by a 14-year-old minor neighbour on Tuesday, in Haryana&#39;s Hisar.

The incident occurred when the girl&#39;s parents had gone out to work.&nbsp;

The accused also threatened the girl with severe consequences if she told anyone about the incident.

It is the fifth case of rape in the last five days.

The accused has been arrested by the Police.

The incident comes at a time when the state is already under scanner for the brutal rape and murder of a 15-year-old Dalit girl.

She was abducted and raped with her private parts being mutilated.&nbsp;

He further requested the Opposition parties to not politicise the issue.

A 45-year-old constable from Utter Pradesh allegedly assaulted a 7-year-old girl in Greater Noida on Wednesday, reports said.&nbsp;

The accused abducted the girl and took her to his house in Greater Noida&rsquo;s Surajpur locality where he assaulted her. Alarm was raised when the girl screamed for help.

He was thrashed by locals and the victims family members before handing him over to the police.&nbsp;

The man, identified as Subhash Singh, is a constable on deputation with sales tax department in Gautam Budh Nagar.&nbsp;

A video clip of a group of more than 100 people beating the accused has surfaced on social media ever since.

He has been booked under the stringent Protection of Children against Sexual Offences (POCSO) Act, which carries a minimum sentence of 10 years in prison.

The child has been sent to the district hospital at Sector 30, Noida for medical test and reports are awaited.
