Solicitor General Tushar Mehta on Sunday told the Delhi High Court that there is a deliberate, calculated and well thought of design by the Nirbhaya gangrape and murder case convicts to "frustrate mandate of law" by getting their execution delayed.

Mehta told Justice Suresh Kait that convict Pawan Gupta's move of not filing a curative or a mercy petition is a deliberate, calculated inaction.

The four Nirbhaya case convicts are playing with judicial machinery and trying patience of the nation, Mehta said.

"There is deliberate, calculated and well thought of design to frustrate mandate of law," Solicitor General Mehta told the high court.

The high court is hearing the Centre's plea challenging stay on the execution of the four death row convicts in the Nirbhaya gangrape and murder case.

Advocate A P Singh appeared for convicts Akshay Singh (31), Vinay Sharma (26) and Pawan gupta (25) opposing the Centre's plea to set aside stay on execution of death sentence.

Senior advocate Rebecca John, representing the fourth convict Mukesh Kumar (32), raised preliminary objection on the Centre's plea saying it was not maintainable.

She contended that the Centre was never a party in the case proceedings before the trial court and while the government was accusing the convict of delay, it has woken up just two days ago.

"It was the victim's parents who moved the trial court for issuance of death warrants against the convicts. At no point the central government or the state government approached the trial court to immediately issue death warrants," John contended.

The proceedings are currently underway.

John told the high court that the Centre has moved a plea in the Supreme Court seeking clarification whether co-convicts can be executed separately and this petition is pending before the apex court.

A 23-year-old paramedic student, referred to as Nirbhaya, was raped and brutally assaulted on the intervening night of December 16-17, 2012 inside a moving bus in south Delhi by six persons, before being thrown out on the road.

She died on December 29, 2012 in Singapore's Mount Elizabeth Hospital.

One of the six accused in the case, Ram Singh, allegedly committed suicide in the Tihar Jail.

A juvenile, who was among the accused, was convicted by a juvenile justice board and was released from a reformation home after serving a three-year term.

Nirbhaya convict to challenge SC order dismissing juvenility plea

Expressing happiness over the Supreme Court's decision, Nirbhaya's father Badrinath Singh said, "I welcome the decision of the top court. There is, of course, a delay in the process but we are not disappointed. We hope they will be hanged soon."

Another Nirbhaya convict files mercy plea with President

Amid the outrage row over delay in death penalty of Nirbhaya, gang-rape and murder case convicts, the Ministry of Home Affairs on Wednesday moved to Supreme Court to seeking modifications of the "convict-centric" guidelines to make them more "victim-centric".

In the plea, the government sought a direction from the top court in fixing the deadline for filing of curative pleas after the rejection of review petitions.

According to the plea filed in the top court today, the modifications are needed to reinforce the "people's faith in the rule of law". It also asked to set a time-limit for convicts using their available legal options.

The government also wanted the court to direct that a death row convict can only file a mercy plea within seven days of receiving the death warrant; while the state governments and authorities should issue death warrant within seven days of the mercy plea being rejected.

"If the convict of death sentence wants to file mercy petition, it would be mandatory for a convict of death sentence to do so only within a period of seven days from the date of receipt of death warrant issued by the competent court", the government stated in the plea.

The top court, on January 20, had rejected the plea of a death row convict in the Nirbhaya gang rape and murder case challenging the Delhi High Court order which had dismissed his claim of being a juvenile at the time of offence saying he cannot re-agitate the issue by filing a fresh application.

A Delhi court has recently issued fresh death warrants for February 1 against the four convicts -- Vinay Sharma (26), Akshay Kumar Singh (31), Mukesh Kumar Singh (32) and Pawan (26) -- in the case after their hanging got delayed from January 22 due to pending petitions.

According to the plea filed in the top court today, the modifications are needed to reinforce the "people's faith in the rule of law". It also asked to set a time-limit for convicts using their available legal options. The government also wanted the court to direct that a death row convict can only file a mercy plea within seven days of receiving the death warrant; while the state governments and authorities should issue death warrant within seven days of the mercy plea being rejected. "If the convict of death sentence wants to file mercy petition, it would be mandatory for a convict of death sentence to do so only within a period of seven days from the date of receipt of death warrant issued by the competent court", the government stated in the plea. The top court, on January 20, had rejected the plea of a death row convict in the Nirbhaya gang rape and murder case challenging the Delhi High Court order which had dismissed his claim of being a juvenile at the time of offence saying he cannot re-agitate the issue by filing a fresh application. A Delhi court has recently issued fresh death warrants for February 1 against the four convicts -- Vinay Sharma (26), Akshay Kumar Singh (31), Mukesh Kumar Singh (32) and Pawan (26) -- in the case after their hanging got delayed from January 22 due to pending petitions. Besides Pawan Kumar Gupta, three others - Akshay, Vinay, and Mukesh are facing the gallows in the case.

She said that promises of fast-track courts and installation of CCTV cameras which were made in 2012 have not been fulfilled yet.

"In 2012, several such promises were made. Fast track courts have been made but nobody questions the non-availability of judges in them."

Her daughter, a paramedic student, was gang-raped and murder on December 16, 2012, by six men. All the accused were arrested and charged with sexual assault and murder.

One of the accused was a minor and appeared before a juvenile justice court, while another accused committed suicide in Tihar jail. The rest of the convicts are facing the gallows.

The apex court had confirmed capital punishment for the four men in 2017.

One of the convicts, Vinay, moved a mercy petition last month but has now sought to withdraw it.

Vice President Venkaiah Nadu on Sunday expressed concern over the growing crimes against women in the country and said that the change of mindset is the need of the hour to curb the menace.

"In Indian tradition, we treat women as our mothers and as sisters but what has happened in recent days in certain parts of the country is really shameful and is a challenge for all of us. The change in the mindset is the need of the hour. Such incidents are bringing a bad name to India. We must never denigrate our country," he said while addressing a function in Pune.

Promoting better practices is the need of the hour and which is why I feel that in every educational institute, with education, we should also educate children about our culture. This should be the responsibility of the teachers".

We should not look it from the political prism. The moment you look it from the political prism, the cause is lost."

We should not look at it from the angle of religion and also from the angle of the region. We should not look it from the political prism. The moment you look it from the political prism, the cause is lost." "Bringing new laws are not the solution, however, I am not against bringing any new law or the new Bill. We brought the Bill on Nirbhaya what happened? Is the problem solved? So, I always feel that what is required is not a Bill rather a political and administrative skill to kill the social evils of the society," he added.

Nirbhaya's mother Asha Devi had said that the culprits must be hanged to death.

"I have been running from pillar to post for the last 7 years to get justice in the Nirbhaya case. I appeal to the justice system of this country and the government that Nirbhaya's culprits must be hanged to death at the earliest," said she.

On November 27, &nbsp;a doctor was brutally gang-raped and killed by four persons before they burnt her body in Shahshabad area. The four accused were in judicial custody at Cherlapally Central jail in Hyderabad.

The burnt body of the 26-year-old veterinary doctor was found on November 28 under a culvert on the Hyderabad-Bengaluru national highway.&nbsp;

Meanwhile,&nbsp;the father of the woman veterinarian expressed his gratitude towards the police and the government after the news about the encounter broke out. &nbsp;

''It has been 10 days to the day my daughter died. I express my gratitude towards the police and the government for this. My daughter's soul must be at peace now,'' he said.

The remaining four rapists were convicted and handed death sentence by a trial court in 2013, which was confirmed by the Delhi High Court in March 2014.
