"Accordingly we direct the Secretary MoEF&amp;CC in collaboration with Secretary Ministry of Road Transport and Highways (MoRTH) to evolve an effective monitoring mechanism at national level with the object of ensuring maintenance of green belts on both sides of all Highways up to specified distance, there is no construction up to specified distance, there is no direct access to the Highway, there is no encroachment and buildings on roadsides are regulated in terms of environmental norms so that no air/water pollution or encroachment of Highway is caused," the NGT said in its order.

The tribunal directed the MoEF&amp;CC to collect the requisite data in respect of National Highways from NHAI and in respect of State Highways from respective States and UTs and said that data may be compiled by the Chief Secretaries of States/UTs in coordination with their respective Environment, Forests, and Public Works Departments.

The data should contain details of extent of encroachment and action plan for its removal, provisions for leaving space up to a particular distance from the road for expansion and for plantation, extent of access directly allowed from Highway to buildings and ensuring that there is no direct access to the road obstructing existing or potential plantation and buildings near roads up to a specified distance are regulated to ensure that no air, water or other pollution is caused and no encroachment takes place or space on roads on account of activities of such buildings.

The NGT said that the monitoring mechanism may deal with the issue in following parts&nbsp;future policy with regard to Highways to be constructed henceforth; policy with regard to Highways already constructed or in progress where space is available; policy with regard to highways where constructions have already been made with regard to division in nature of construction and legality thereof.

The MoEF&amp;CC was directed to file an affidavit within two months. Research published in November 2015 by NASA's Earth Observatory stated, "satellites began to detect large numbers of active fires in mid-October. Normally extensive agricultural burning lasts for about three weeks. Although most of the haze appears to originate from the agricultural fires, other factors such as urban and industrial smog may also be contributing".

It explained how several types of particles and gases are released into the atmosphere, "including smog-forming carbon monoxide, and nitrogen dioxide" due to this fire.&nbsp;

"Haze that forms over Punjab rarely stays there. While the fires burn, smoke often blankets much of the Indo-Gangetic Plain, exposing millions of people in the densely populated plain to <a href="https://www.wionews.com/india-news/over-12-million-early-deaths-in-india-due-to-air-pollution-report-207651">elevated levels of air pollution</a>," it added.&nbsp;

Another piece shared by the Earth Observatory way back in the year 2010 described skies over northern Indian as "some of the haziest in the world".

"After the rains of the summer monsoon clear the dust, the composition of the air shifts in the fall crop-burning season (October and November) for farmers, particularly in the northwestern Indian states of Punjab and Haryana. When MODIS passed over on November 4, 2010, the sensor observed numerous small fires and a large smoke plume lingering downwind."

The finding published on NASA's webpage attributed the change in air quality in Northern India to a host of factors ranging from smoke originating from cooking, heating stoves in rural areas, "smattering of agricultural fires that continue through the winter", adding that the urban community adds to the worsening air quality by the means of vehicular pollution, "coal-fired power plants, and other industrial sources".

Meanwhile, the National Green Tribunal (NGT) on Tuesday sought a report from the governments of Uttar Pradesh, Haryana and Punjab over the action taken to stop stubble burning in their respective states, news agency ANI reported.&nbsp;

The NGT said that the report should be filed by November 15 which is also the next date of hearing.&nbsp;

NASA images show stubble burning in Punjab, Haryana

Mining rights were also given in violation of NGT orders.

All those who were ministers in that period will also be investigated, <a href="https://www.wionews.com/india-news/llegal-sand-mining-supreme-court-seeks-response-from-centre-cbi-and-5-states-238146">CBI</a> sources said.

Akhilesh Yadav held the charge of mining ministry between 2012 to July 2013 and hence can come under scanner in the ongoing probe.

Bansal had claimed the country's top environmental pollution control boards like Central Pollution Control Board (CPCB) and Delhi Pollution Control Committee (DPCC) have unequivocally said that odd-even policy, which was implemented in 2016, has failed to curb air pollution in the city-state.

"During the odd-even implementation period, the ambient air quality was found to be more deteriorated when the said restriction was not in force," the petition claimed.

"The recent decision of the Delhi government to implement the odd-even policy solely on the basis of the study done by foreign researchers having no credentials and willful ignorance of findings of top-level institutes like CPCB and DPCC is not only unpleasant but also downsize the reputation of such institutes," it said.

On September 13, Chief Minister Arvind Kejriwal announced that the car rationing or odd-even scheme will be implemented in the city from November 4 to 15.

He said that studies have shown that the scheme helps to reduce air pollution.

While making the announcement, Kejriwal said that smog from adjoining states due to the burning of stubble is the major cause of pollution in Delhi and odd-even is one among the slew of measures that Delhi government will take to deal with the problem.

"Odd-even will be implemented from November 4 to November 15. Studies show that it reduces pollution by 10-13 per cent," he had said.

Petitioner withdraws plea challenging Delhi government's odd-even scheme

Volkswagen Group India spokesperson on Thursday stated that the automobile giant will challenge the NGT order before the Supreme Court.

The environmental watchdog enhanced the compensation amount of Rs 171.34 crore, which was recommended by an NGT-appointed committee, as a means of "creating deterrence," news agency PTI reported.&nbsp;

India's environmental watchdog, the National Green Tribunal (NGT), has slapped Rs 500 crore fine on German automotive company Volkswagen for damaging environment by using cheat devices in diesel cars in India.

The case relates to health damage caused by excess emissions of pollutants and emissions violations.

A bench headed by NGT chairperson Justice Adarsh Kumar Goel directed the carmaker to deposit the amount within two months.

The tribunal enhanced the compensation amount of Rs 171.34 crore, which was recommended by a NGT-appointed committee, as a means of "creating deterrence".

The automaker, however, said that it did not violate the BS-IV norms and that the test results were based on "road testings" for which there were no prescribed standards.

It said that the apex pollution monitoring body may consider utilising the money towards improving air quality in the National Capital Region and other highly polluted areas.

The value may be considered conservative due to lack of methodologies for calculating the overall impact of nitrogen oxide on the environment in India and hence only health damages are valued.

"Further, the valuation is for Delhi considering that the value of NOx is 435 tonnes released in the city. This is assumed because lack of data on the geographical locations and plying regions of Volkswagen vehicles which have caused the damage and for all the years which have been considered for damage," the committee has said in its report.

The panel was formed by the NGT on November 16 last year to give its opinion whether the manufacturer has exceeded the prescribed environmental norms and fair estimate of the damage caused to the environment.

The committee has told the NGT that automobiles are a major source of nitrogen oxide. Emission fiasco: NGT slaps Rs 500 crore fine on Volkswagen

The National Green Tribunal Tuesday expressed dissatisfaction over the cleaning of <a href="http://www.wionews.com/india-news/supreme-court-asks-ngt-to-widen-scrutiny-into-emission-violations-by-car-manufacturers-191886">river Yamuna</a> and directed Delhi, Haryana and Uttar Pradesh governments to submit a performance guarantee of&nbsp;Rs 10 crore each within a month.&nbsp;

A bench headed by NGT chairperson Justice Adarsh Kumar Goel directed the state governments to furnish a performance guarantee with the Central Pollution Control Board (CPCB) to ensure there was no further lapse in this regard.

The tribunal also warned that chief secretary of all the three states would be personally liable for any non-compliance.

The green panel made it clear that the amount will be forfeited if the work was not carried out as per the recommendations of the monitoring committee constituted by it and asked the panel to expeditiously submit its final report.

It directed that steps be taken by the three states at the earliest for disposal of municipal solid waste, cleaning of drains and ensuring cleaning of garbage.

The order came after perusing the interim report filed by the monitoring committee comprising retired expert member B S Sajwan and former Delhi chief secretary Shailaja Chandra.

The monitoring committee in its action plan submitted has recommended a study to assess the environmental flow of the <a href="http://www.wionews.com/india-news/yamuna-delhi-crosses-danger-mark-167962">Yamuna river </a>for the stretch between Hathanikund and Okhla.&nbsp;

It said the river was "fighting to stay alive" and it would not be possible to rejuvenate it unless minimum environmental flow was provided.

With regard to idol immersion, the committee has asked the authorities in the city to look for the possibility of creating artificial ponds and pits in various localities.&nbsp;&nbsp; &nbsp;&nbsp;

That mining goes on unabated in the state can be gauged from the fact that heaps of freshly dug coal is dumped on both sides of the road that approaches Lumthari from Khliehriat, the district headquarters of East Jaintia Hills.

Meanwhile, official sources said the NGT committee, which has sought police investigation into the registered cases of illegal mining, is set to visit the state by January-end.

The committee, headed by retired judge Justice (Retd) B P Katakey, will conduct a field visit to South Garo Hills on January 30-31 to study the ground-level situation, they said.

Katakey told PTI that 98 cases of illegal quarrying have been registered in East Jaintia Hills district alone since the ban.

The committee, after a thorough study, will prepare a report and present it before the tribunal by March 31, he said.

"We have directed investigation into nearly 1200 cases of illegal mining and transportation of coal since the 2014 ban. In East Jaintia Hills, the SP has been asked to submit a report at the earliest in connection with the 98 cases recorded in the district," Katakey added.

An official in the state mining and geology department said Meghalaya does not maintain statistics on mining and mishaps.

"As there is no study or statistics on the prevalence of mining in the state, the three-member NGT panel has asked district deputy commissioners to furnish all available data in connection with the illegal practices," he added.

The NGT Eastern Zone principal bench comprising Judges S P Wangdi and non-judicial member Nagin Nanda on Tuesday said the fine should be paid within two weeks of the order to the Central Pollution Control Board, failing which, the government will have to pay an additional Rs 1-crore as fine for every month's delay to the CPCB.

The order was given in the wake of West Bengal government not enforcing several measures recommended by the NGT in an earlier order in 2016 to check air pollution, the bench observed.

In the order, the NGT had recommended measures like introducing alternative mechanism to put a lid on high number of polluting diesel vehicles in the twin cities of Kolkata and Howrah, introducing remote sensing device (RSD) to monitor smoke emission, increasing number of computerised air monitoring stations from the existing ones.

The other measures include introducing the system of allowing private vehicles with odd and even registration numbers on specific days in the week, monitoring entry of non-BS 4 commercial vehicles to twin cities, stop burning of waste in dumping sites in different parts of state.

The green body in subsequent sittings in the intervening period of two years had sought to know if the West Bengal government's Environment department and the West Bengal Pollution Control Board had taken any steps towards the direction.

The NGT had passed the 2016 order on the basis of a report submitted by an expert committee but environmentalist Subhas Datta had moved a contempt petition recently which led to imposition of the fine by the tribunal.

The NGT on Tuesday also directed the West Bengal chief secretary to file an affidavit by January 8, 2019 regarding the follow-up action plan and payment of fine.

NGT slaps Rs 5 crore fine on West Bengal government for failing to curb air pollution

Punjab Chief Minister Captain Amarinder Singh on Monday extended his sympathies with the farmers of the state over the prohibition on stubble burning but told them that the National Green Tribunal (NGT) laws must be followed.

Addressing a presser here, Singh said, "This is a law of National Green Tribunal. My sympathies are with the farmers, but law is law and the law must take its course. I have written twice to the Prime Minister, Agriculture Minister and the Food Processing Industries Minister to compensate farmers who do not burn stubble with an additional Rs 100 per quintal."

Singh further stated that if the Centre does not provide Rs 100 per quintal compensation to the farmers, it will be difficult to control stubble burning. Although many farmers have stopped burning stubble as they have resorted to converting it into bio-fuel, the practice still, to a limited extent, remains active in the state, the chief minister added.

As autumn sets in, bringing along with it the harvesting period for Kharif crops, the increasing cases of stubble burning in Punjab and Haryana are worsening the air pollution crisis in New Delhi and the neighbouring National Capital Region.

Singh further stated that if the Centre does not provide Rs 100 per quintal compensation to the farmers, it will be difficult to control stubble burning. Although many farmers have stopped burning stubble as they have resorted to converting it into bio-fuel, the practice still, to a limited extent, remains active in the state, the chief minister added. As autumn sets in, bringing along with it the harvesting period for Kharif crops, the increasing cases of stubble burning in Punjab and Haryana are worsening the air pollution crisis in New Delhi and the neighbouring National Capital Region. The Waste-to-Energy Plants at Okhla, Ghazipur and Bawana in the national capital are not complying with emission standards and are causing air pollution, a committee has informed the National Green Tribunal.

A joint inspection committee of Central Pollution Control Board (CPCB) and Delhi Pollution Control Committee (DPCC) told a bench headed by NGT Chairperson Justice A K Goel that the three plants are non-compliant with respect to the standards of the particulate matter emitted by them.&nbsp;

Taking note of the report, the green panel said if the project proponents fail to maintain the standards, even after rectifying the deficiencies noticed in the joint inspection report, the Central Pollution Control Board may recommend imposition of fine for the environmental damage caused by them.&nbsp;

The NGT also directed the CPCB to send a copy of its report to the project proponents of Okhla, Ghazipur and Bawana Waste-to-Energy Plant for compliance and conduct another inspection within a month in view of the fact that the earlier inspection was carried out in February.&nbsp;

"We do not find any ground to accept the prayer for relieving the Central Pollution Control Board of its requirement in monthly monitoring. If there is a manpower constraint, it is for the CPCB to make any other appropriate arrangement for discharging its functions. This cannot be a ground to avoid responsibility under the binding directions of this tribunal," the bench said.

The tribunal had earlier directed the Delhi government and the civic bodies to submit an action plan for identifying alternative landfill sites and setting up waste-to-energy plants in the city.

It had said it was unfortunate that at a time when the national capital was grappling with the huge quantum of waste to the tune of 14,000 metric tonnes on a daily basis, the authorities were involved in a "blame game" and showing an irresponsible attitude.

With the rapid development and massive urbanisation of the metropolis, the waste generation was increasing on a daily basis which has resulted in the saturation of the existing landfill sites which can handle only up to 7,000 metric tonnes of waste, the tribunal had said.

Three waste-to-energy plants in Delhi causing pollution, NGT orders fresh inspection

The deputy chief minister of Tamil Nadu, O Panneerselvam on Monday said that he will take all step to shut down Vedanta's copper smelter.

News agency Reuters reported him saying that "his government would take all steps to permanently shut a copper smelter run by London-listed Vedanta Resources after deadly protests demanding its closure on environmental grounds."

Environmental activists along with hundreds of Residents of the area are protesting against the Sterlite Copper smelter plant for causing pollution to the groundwater and air of the area.&nbsp

The liquid waste released by the plant is toxic and causing bad effects on residents of the area.&nbsp

The residents have also claimed to be experiencing illness related to skin problems, fainting, especiall seen among children.

Last week at least 13 people lost their lives in the firing by police during protests against the Sterlite factory on May 22 and 23. More than 70 people are undergoing treatment.

A bench headed by Justice Jawad Rahim slammed the authorities for not submitting their plan and said despite specific timeline, there is a lapse in compliance of the direction on creating management facilities for construction and debris waste, plastic and e-waste.

&quot;We had directed the chief secretary to coordinate and ensure corporations must meet and resolve dispute by a decision which should crystallise into action plan on the above issues. They were directed to file result action plan.

&quot;Till now the action plan has not been filed. Hence, we direct it should be filed within two weeks from now and we give them a last chance to comply with the order. In case of any lapse on part of any authority, we shall hold the commissioner of each municipal corporation responsible and we further direct the chief secretary to comply with the directions,&quot; the bench said.

The tribunal took exception to the submission of South Delhi Municipal Corporation (SDMC) that the order for filing action plan was not available on the website due to which they could not do the needful.

However, the bench said, &quot;The order speaks for itself it was not confined only to SDMC, but the direction involved all the municipal corporations. Therefore such a plea is not unacceptable&quot;.

The green panel directed the Central Pollution Control Board to comply with the order and also ensure steps are taken for compliance of this order.

The matter is posted for next hearing on March 15.
