Political uncertainty continued for weeks after Shiv Sena, the then ally of the BJP, demanded rotation of the chief minister`s post and equal power-sharing, something rejected by the later.

The NCP leader, however, also clarified that "it is not decided yet how many ministers will take the oath with the Chief Minister tomorrow."

Maharashtra Chief Minister Fadnavis and governor pay tribute to 26/11 victims at memorial

The Supreme Court will pass its order on Tuesday morning over a joint petition filed by Shiv Sena, Congress and Nationalist Congress Party against the decision of the Maharashtra Governor Bhagat Singh Koshyari to invite BJP to form the government in the state.

A bench of Justices N V Ramana, Ashok Bhushan, and Sanjiv Khanna on Monday heard the arguments put forth by counsels appearing for Governor, Maharashtra BJP and other parties and reserved its order.

The petitions were filed after BJP's Devendra Fadnavis took oath for the second consecutive term as the state Chief Minister, with NCP's Ajit Pawar as his Deputy Chief Minister on Saturday morning.

This came when deliberations among Congress, NCP and Shiv Sena on the government formation had reached the final stage.
On the directions of the top court, Solicitor General Tushar Mehta, appearing for the Maharashtra Governor's office, handed over an original letter of Governor inviting BJP leader Devendra Fadnavis to form a government.

Mehta said that the Governor, in absolute discretion, invited the largest party [BJP] to form the government on November 23.

"Devendra Fadnavis staked claim following the letter of NCP's Ajit Pawar along with letters of support of 11 independent and other MLAs. The Governor then wrote to the President and requested for revocation of the President's Rule; Governor in his wisdom invited the leader of the largest party," he submitted.

The Solicitor General added that Fadnavis has a support of 170 MLAs. He also sought two-three days' time from the court to file a reply by asserting that he wants to place additional material on record.

Meanwhile, Advocate Mukul Rohatgi, appearing for Maharashtra BJP, echoed similar sentiments and said that the governor has an absolute discretion to appoint the Chief Minister.

"Judicial review not permitted. The floor test is imperative. But it is the discretion of the Speaker to decide when the floor test is to be held," he said.
Senior Advocate, Maninder Singh next made his submissions on behalf of NCP's Ajit Pawar and said that there was nothing contrary to show that his client was not the NCP leader as of November 22.

"My list [granting support to BJP] was constitutionally, legally correct. There is nothing to show that I was not the NCP leader on November 22. I will resolve disputes within my party but this petition must end now," Singh told the court on behalf of Ajit Pawar.

The contentions were made after NCP chief Sharad Pawar said that the decision to support the BJP was not backed by him and was his nephew's [Ajit Pawar] personal one.

Senior advocate Kapil Sibal, appearing for Shiv Sena, said, "What was the national emergency that President rule was revoked at 5.17 am and swearing-in was at 8 am? President Rule was revoked at 5.17 am which means everything happened before 5.17."

He further said that a floor test must be conducted within 24 hours with videography and a single ballot.

Advocate Abhishek Manu Singhvi, representing Congress, referred the motion to invite the BJP to form the government in Maharashtra as "murder of democracy".

"What BJP alliance has shown to Court are signatures of 54 NCP MLAs electing Ajit Pawar as legislative party leader. They were not signed in support of joining the BJP alliance to form a government. NCP's support to Ajit Pawar was without any covering letter. How can the Governor turn a blind eye to this," he told the court.

On Monday, NCP legislative party leader Jayant Patil along with Shiv Sena leader Eknath Shinde, Congress leader Prithviraj Chavan and others visited Raj Bhawan and gave a letter showing the strength of 162 MLAs to the officials at Raj Bhavan.

Maharashtra political turmoil: Top court to pass orders at 10:30 AM today

A sudden turn of events in the last 48 hours in Maharashtra has done many things simultaneously in Indian politics. It has humbled modern-day Chanakyas who tried to pull a rabbit out of the hat at last minute.

BJP’s midnight drama was being showcased as the killer instinct of BJP and failure of the opposition to come together in time. But ultimately BJP had to bite the dust. Maharashtra proved that there is a limit to political manoeuvring which BJP must have realised when Ajit Pawar resigned from the position of Deputy Chief Minister.

Ajit Pawar continues to be one of the most tainted politicians in Maharashtra. BJP which projects itself as the party with a difference came out bruised and battered. By aligning with Ajit Pawar, it not only lost its credibility but also lost power within 48 hours as Ajit Pawar ditched BJP. BJP lost its handle on the issue of corruption forever. The shortsighted alliance has done more&nbsp;damage to BJP than what party top brass thinks to be. BJP will find it difficult to beat other parties on the issue of corruption again.

It bruised political credibility of Home Minister Amit Shah and also impacted the image of the Prime Minister Narendra Modi who tweeted after Devendra Fadnavis’s swearing-in. BJP by creating a constitutional and political turmoil in the state also ended up alienating a lot of political players. BJP wanted to send the signal that there cannot be a united opposition against them, but circumstances proved them wrong.

BJP successfully sent a similar message right before the Lok Sabha election when they poached back Nitish Kumar into their fold. Today, BJP stands isolated in the context of regional parties. BJP forgot that it was able to grow by building strong and organic alliances wherever it was limited by an ideological appeal.

By getting into a fist-fight with a junior partner, BJP came across as an unfair giant who ended up being defeated by political pygmies. Both Congress and NCP were decimated by BJP in Lok Sabha elections. Today, by forging an alliance with ideologically different parties, the idea of a united opposition looks possible. Lok Sabha elections are far away but there are a number of state elections where BJP is pitched directly against regional parties. Imagine, if all political parties merge their differences to support an anti-BJP front? Maharashtra escapade of BJP has made those ideas thinkable which in past would have been ridiculed.

This is not to say that this alliance can run smoothly or can finish the entire term together. The alliance marks a churning in Indian politics where Congress party will need to play a supportive role in large parts of India. Congress which ruled Maharashtra for decades is the smallest player in the alliance. The state unit of Maharashtra prevailed over Sonia and Rahul Gandhi. On top of it, the Congress old guard was active, and Rahul Gandhi was nowhere to be seen.

The old guard led by Ahmed Patel was able to negotiate a deal with Sharad Pawar and Udhhav Thackery. It just goes on to show how little Rahul Gandhi counts when it comes to ‘real’ politics in the country. The old guard not only managed to give a good fight but also ensured that the alliance succeeds. Maharashtra alliance may function or may not but throws open a lot of political opportunities for India’s opposition which is both faceless and disunited.

BJP, on the other hand, should moderate its stand when it comes to managing regional parties. What happens is future is a larger debate but for now, regional parties are a reality and they feel threatened by BJP.

Shortly after the Supreme Court ordered a floor test of the Fadnavis government in Maharashtra, a joint meeting of MLAs from the Nationalist Congress Party (NCP), Shiv Sena and Congress were called on Tuesday to elect their "leader".

Taking to Twitter, NCP leader Nawab Malik tweeted, "Today 5 pm joint meeting of NCP, SS and INC MLAs to elect a leader."
The meeting will place at the Trident Hotel, Bandra Kurla Complex.

A floor test will be held in the Maharashtra Assembly on November 27, the Supreme Court ordered today, days after BJP's Devendra Fadnavis took oath as the state's chief minister, nixing Shiv Sena-Congress-NCP's bid to form the government.

A floor test is a constitutional mechanism under which a chief minister can be asked to prove majority in the state Assembly.

A three-judge bench, headed by Justice Ramana, passed the order on a joint petition filed by the three parties challenging Maharashtra Governor Bhagat Singh Koshyari's decision to administer the oath to Fadnavis as Chief Minister and NCP's Ajit Pawar as his deputy during the early hours of Saturday.

The BJP had won 105 seats in the 288-member assembly in last month's assembly polls followed by Shiv Sena 56, NCP 54 and Congress 44. Although BJP and Shiv Sena got the mandate to form the government, the two parties parted ways over power-sharing.

On the occasion of Constitution Day today, Opposition parties, including Congress staged a protest against government formation by BJP in Maharashtra in front of Ambedkar Statue inside Parliament complex while a joint sitting of both the houses was underway in the Central Hall. (ANI)

Maharashtra Floor Test: Apex Court to pass order today at 10.30 AM

Senior leader Eknath Shinde on Monday said that <a href="https://www.wionews.com/india-news/ncp-congress-shiv-sena-petition-supreme-court-to-pass-order-tomorrow-1030-am-264329">Shiv Sena, NCP and Congress </a>have the required numbers and added that they have given the letter, where 162 MLAs have pledged support to their alliance to Maharashtra Governor Bhagat Singh Koshyari.

Earlier today, Congress-NCP-Shiv Sena leaders submitted the letter to the officials at Raj Bhavan in Mumbai.

"We`ve given the letter of support of 162 MLAs to the Governor. In a democracy, only the majority number holds importance. We want that the minority government formed on November 23, should resign as they can`t prove the majority. Those with the majority should be given the opportunity," said Shinde.

"Shiv Sena, NCP and Congress have numbers and we want to form the government but our claim was rejected and it`s like cheating the democracy," he added.

Shinde further demanded <a href="https://www.wionews.com/india-news/devendra-fadnavis-takes-oath-as-maharashtra-chief-minister-ajit-pawar-as-deputy-cm-263978">Chief Minister Devendra Fadnavis</a>`s resignation citing lack of numbers.

"We have signatures of 162 MLAs and we have proven that we can form the government. The current government which is formed overnight should not be given acceptance as they don`t have the numbers. We demand the resignation of Chief Minister Fadnavis as they don`t have numbers," said Shinde.

Echoing similar sentiments, NCP leader Jayant Patil earlier today had asserted that a government has been formed in the state but the concerned political parties do not have adequate numbers.

"We have a doubt that if the BJP Government is unsuccessful in proving the numbers, they will indulge in bad practices and therefore we have taken signatures of MLAs beforehand. The government that does not have numbers and have no third person other than the two faces which are being shown regularly, should not create a false public perception that they have numbers and can form the government," said Patil.

Patil told reporters here that he will once again try to convince Deputy Chief Minister Ajit Pawar for one last time.

"I will go to <a href="https://www.wionews.com/india-news/ajit-pawar-took-false-documents-to-raj-bhawan-yesterday-sanjay-raut-264162">Ajit Pawar</a> once again to convince him and this could be for the last time. Maharashtra: NCP, Shiv Sena, Congress challenge government formation by BJP; SC to hear plea today

The Supreme Court on Sunday while hearing the NCP-Sena-Congress joint plea against BJP-led government formation in Maharashtra remarked that the "sky is the limit for Supreme Court" and "anybody can ask for anything in Court".

The remark was made by Justice NV Ramana when senior Counsel Mukul Rohatgi, appearing for the BJP, questioned the plea filed by Congress-NCP-Shiv Sena.

"In this court, the sky is the limit, anybody can ask for anything. Any person can ask to make him the Prime Minister," observed Justice NV Ramana.

The Bench consisting Justice Ramana, Ashok Bhushan and Sanjiv Khanna, asked the Solicitor General Tushar Mehta to produce relevant documents including Maharashtra Governor's letter inviting BJP to form the government and letter of support of MLAs by 10 am tomorrow.

Senior counsel Mukul Rohatgi while arguing on behalf of BJP in Supreme Court appealed the court not to pass an order to fix the date for the floor test in Maharashtra Assembly and asserted that Governor Bhagat Singh Koshyari has committed no "illegality".

"There is no need for the court to pass order today. There was no illegality in the Governor's decision. The court should not pass an order to fix the date of the floor test. The three parties here have no fundamental rights," said Rohatgi."

There are some things that are with the President which are not even open to judicial intervention," he argued.

At a time when deliberations among Congress, NCP and Shiv Sena on the formation of a non-BJP government in the state had seemingly reached the final stage, the BJP formed the government in a surprise development on Saturday morning when Devendra Fadnavis took oath for the second consecutive term as the state Chief Minister, with NCP's Ajit Pawar as his Deputy Chief Minister.

The BJP won 105 seats in the 288-member assembly followed by Shiv Sena 56, NCP 54 and Congress 44.

Devendra Fadnavis takes oath as Maharashtra's CM for 2nd time

Three Nationalist Congress Party (NCP) legislators alleged they were not aware of an oath-ceremony when "they were taken" to Maharashtra Raj Bhavan earlier on Saturday morning and they were with party chief Sharad Pawar.

They made the remarks at a joint press conference addressed by Sharad Pawar and Shiv Sena chief Uddhav Thackeray. The press conference was held hours after Devendra Fadnavis and Ajit Pawar were sworn-in as Chief Minister and Deputy Chief Minister respectively.

NCP MLA Rajendra Shingane said Ajit Pawar had called him to discuss something. "From there I was taken with other MLAs to Raj Bhavan," he said.

"Before we could understand the oath ceremony was complete, I rushed to Pawar sahab and told him I am with Sharad Pawar and NCP. I was taken there without any prior information," he said.

NCP MLAs, Sandip Kshirsagar and Sunil Bhusara, also echoed Shingane's allegations and affirmed their support to Sharad Pawar.

The NCP supremo said that the party will take action against his nephew for lending support to BJP for government formation in the state.

He also said that NCP will elect its new legislative party leader at 4 pm today.

"Ajit Pawar's decision is against the party line and is indiscipline. No NCP leader or worker is in favour of an NCP-BJP government. All the MLAs who are going must know that there is an anti-defection law and the possibility of them losing their assembly membership is high," Sharad Pawar said.

He said that NCP, Congress and Shiv Sena, which have been in talks will form the government and Fadnavis will not be able to prove his majority.

"I am sure that the Governor has given them time to prove majority but they won't be able to prove it. After that, our three parties will form the government as we had decided earlier," he added.

In a sudden turn of events, Fadnavis earlier this morning took oath as Maharashtra Chief Minister while Ajit Pawar took oath as Deputy Chief Minister of the state.

Governor Bhagat Singh Koshyari administered the oath of office to the two leaders.

The move came at a time when deliberations between Congress, NCP and Shiv Sena had seemingly reached a final stage.

The BJP, which emerged as the single-largest party, could not stake claim to form a government as its ally Shiv Sena remained firm on rotating the Chief Minister's post.

The BJP won 105 seats in the 288-member assembly followed by Shiv Sena 56, NCP 54 and Congress 44.&nbsp;
