The Enforcement Directorate alleged on Monday that K Kavitha, a leader of the Bharat Rashtra Samithi (BRS), conspired with top leaders including Arvind Kejriwal and Manish Sisodia of the Aam Aadmi Party (AAP) to pay ₹1&nbsp;billion&nbsp;($12 million).&nbsp;

According to an ED statement, "Kavitha along with others "conspired with the top leaders of AAP including Arvind Kejriwal and Manish Sisodia for getting favours in the Delhi excise policy-formulation and implementation."

"In exchange of these favours, she was involved in paying&nbsp;₹100 crore to the leaders of AAP," the agency added.

Last week, the Enforcement Directorate (ED) apprehended the daughter of former Telangana chief minister K Chandrasekhar Rao, who remains in the agency's custody until March 23. According to the ED, "corruption and conspiracy" in the development and execution of Delhi's excise policy resulted in "a consistent flow of illicit funds in the guise of kickbacks from wholesalers" to the AAP.

The Enforcement Directorate claimed that the 45-year-old BRS leader and her associates were intended to retrieve the pre-paid proceeds of illegal activity given to the AAP and to subsequently generate profits or proceeds of crime through this comprehensive scheme.

<h2>‘Kavitha a key conspirator,’ says&nbsp;ED</h2>

During the request for remand of the BRS MLC, the ED informed the special Prevention of Money Laundering Act (PMLA) court that Kavitha was identified as "one of the masterminds, a pivotal conspirator, and a beneficiary of the Delhi excise policy scandal."

Kavitha had previously stated that she had not engaged in any wrongdoing and accused the Centre of utilising the ED due to the BJP's failure to gain entry into Telangana indirectly. The AAP has accused the BJP of employing the ED and CBI as their "enforcers" to eliminate political adversaries.

Taking cognisance of the matter, additional chief metropolitan magistrate Divya Malhotra directed Kejriwal to physically appear in court.

Earlier, based on ED's first complaint, he was directed to appear before the court on February 7. Appearing virtually before the court on February 17,&nbsp;he contended that due to the ongoing budget session, he could not appear in court physically.

The Delhi court at the time had granted an exemption to Kejriwal from personal appearance.

ED issued its last summons in February and directed the Aam Aadmi Party leader to appear before it for questioning on Monday (Mar 4). However, Kejriwal skipped the summons, calling them "illegal". Instead, he offered to appear before the enforcement directorate via video-conferencing.

Excise policy case: Delhi Court summons Arvind Kejriwal over eight ED no-shows

Delhi Chief Minister Arvind Kejriwal on Monday (Mar 4) finally sent a reply to the summons of the Enforcement Directorate (ED), India’s premier economic intelligence agency, in an alleged excise policy scam. Kejriwal added he was ready to answer all questions via video conferencing after March 12, reported news agency PTI. The response came after he skipped eight summons of the ED one after another, calling them illegal and politically motivated.

PTI quoted Kejriwal’s Aam Aadmi Party sources as saying that the chief minister still thought of ED summons as illegal but he was willing to cooperate.

This comes ahead of his scheduled appearance in a Delhi court on March 16 in a case filed by the ED.

<h2>ED’s case against Kejriwal</h2>

The ED had approached a Delhi court against Kejriwal&nbsp;on February 3, following his snub to its fifth summon a day earlier.

ED said it wanted to record Arvind Kejriwal's statement in the case on issues such as the formulation of excise policy, meetings held before it was finalised, and allegations of bribery.

On the other hand, AAP and Kejriwal maintain that the summons should be stopped as the matter was pending in court.

So far, Kejriwal has skipped summons issued by the ED on February 26, February 19, February 2, January 18, January 3, November 2 and December 22.

Delhi CM Kejriwal agrees to cooperate with ED after skipping eight summons in a row

The Chief Minister of Delhi, Arvind Kejriwal is in a big tussle with India's anti-money laundering agency- the enforcement directorate. The ED is asking Kejriwal to appear before the agency for a probe linked to an alleged scam. But Kejriwal has skipped 7 ED summons so far, and an eighth summon has been issued by the ED.

The Enforcement Directorate is expected to issue fresh summons to Delhi Chief Minister Arvind Kejriwal for questioning in the excise policy-linked money laundering case, official sources said on Monday.

The ED sources claimed that a local court has prima facie held Kejriwal guilty of “disobeying” the earlier notices issued to him in this case, warranting the seventh summons.

Kejriwal, 55, refused to depose before the federal agency for the sixth time on Monday with the Aam Aadmi Party (AAP) saying the ED should wait for the court’s decision instead of repeatedly sending summonses to the CM, also the party’s national convenor.

A Delhi court on February 17 had granted an exemption to Kejriwal from personal appearance for the day in connection with the complaint filed by the central agency for disobeying its summons in the excise policy-linked money laundering case.

The court posted the matter for March 16 and Kejriwal’s counsel assured the court of his physical appearance that day.

The ED sources said the agency had filed a complaint before this court under section 174 of IPC against Kejriwal for “intentionally disobeying” the first three summons issued to him in this case.

The court has taken cognisance of the same and prima facie accepted that Kejriwal committed an offence for which he is liable to be prosecuted, the sources claimed.

The court had said that from the contents of the complaint and the material placed on record (by the ED), a prima facie offence under Section 174 of the Indian Penal Code (IPC) is made out and there are sufficient grounds for proceeding against the accused (Kejriwal).

The question in front of the court is not about the validity of the summons but rather the illegal act on the part of Kejriwal of intentionally disobeying the said three summons, the sources said.

Hence, the ED is not wrong in issuing him a summons despite the court matter listed for March 16, they said.

The agency has said that the accused were in touch with him regarding the preparation of the now-scrapped Delhi Excise Policy 2021-22. AAP leaders Manish Sisodia and Sanjay Singh apart from communications in-charge of the party Vijay Nair have been arrested in this case by the ED till now.

The ED had claimed in its charge sheet that the AAP used “proceeds of crime” to the tune of about Rs 45 crore in its Goa election campaign.

The agency is also expected to file a fresh supplementary charge sheet in the case and may name the AAP as a “beneficiary” of the alleged kickbacks that were generated through the excise policy.

Your obstinacy is tantamount to assuming the role of judge, jury and executioner at the same time which is not acceptable in our country governed by the rule of law."

India’s economic intelligence agency Enforcement Directorate (ED) has reportedly issued a lookout notice for Shahjahan Sheikh, a leader of the Trinamool Congress (TMC) party after the agency’s officials were attacked by a mob for the second time in a row within a span of a few hours in the state of West Bengal.&nbsp;

The team of officials from the central agency were attacked by a mob in the Sandeshkhali village of West Bengal’s North 24 Parganas district when they were carrying out raids on Sheikh’s home for his alleged involvement in a million dollar ration distribution scam in the state.&nbsp;

<h2>Why was a lookout notice issued?</h2>

During the raids conducted by the ED late on Friday (Jan 5), the agency focussed its attention on former Bongaon Municipality Chairman and TMC&nbsp;leader Shankar Adhya who was arrested following an extensive search.&nbsp;

The ED issued a lookout notice for Sheikh and his four brothers on Saturday (Jan 6) after&nbsp;reportedly saying&nbsp;that the TMC official tried to cross over to Bangladesh but failed as&nbsp;security along the international border has been heightened due to the&nbsp;<a href="https://www.wionews.com/south-asia/bangladesh-elections-2024-live-polling-begins-as-pm-sheikh-hasina-eyes-another-term-677303">elections in the country.</a>&nbsp;

In a statement, the central agency said that their officials who were accompanied by Central Reserve Police Force (CRPF) personnel, were “badly attacked by crowds” who they said were suspected to be instigated by “Sheikh and his associates.”

At least three officers were hospitalised after they suffered what the ED has described as “grievous injuries” as the mob marched towards the officials “with an intention to cause death”.&nbsp;

The mob, according to the ED, also snatched official and personal belongings including laptops, wallets and cash. The police said no arrests were made as of Saturday evening but a few people have been detained for questioning.&nbsp;

In the statement, the central agency said that when they arrived at Sheikh’s house on Friday, the door was locked from the inside and the TMC leader refused to open it. “His mobile location at that time indicated that he was inside this house.”

Around half an hour later, the ED officials were&nbsp;taken by surprise after the mob charged them with weapons like lathis, stones, bricks, etc., and gheraoed them.&nbsp;&nbsp;

One FIR was registered against the central agency’s officials based on a complaint lodged by the caretaker of Sheikh’s house who alleged that the agency officials tried to enter the house without proper documents, according to media reports citing officials.&nbsp;

The second one was filed based on the complaint by ED under several sections of the Indian Penal Code (IPC) involving rioting and assault on public servants. The third one was suo motu registered by the police against unknown persons for attacking officers of the central agency.&nbsp;
