While hearing a petition filed by the Chandni Chowk Sarv Vyapar Mandal against encroachments in the area, the bench observed that a Supreme Court order declaring Chandni Chowk as a no-vending zone has to be complied with.

Delhi Police&#39;s Standing Counsel Rahul Mehra said continuous drives were being undertaken to make the area encroachment-free but vendors resurface after the conclusion of the drive.

Advocate Sanjeev Ralli, appearing for the Mandal, said there was no doubt that drives were carried out but the situation was practically unchanged.

The court had earlier warned of serious action against the MCD and the police if they failed to stop encroachments in the area.

It had said that despite the order of the apex court that the police would be held responsible for encroachments in the Chandni Chowk area, it found that the orders were not being complied with.

The bench had also taken into account some photographs of the area submitted by the petitioner which showed that the place was full of encroachments.

The Delhi High Court today asked the police to ensure that no one uses stage and loudspeaker at a South Delhi ground for Chhath Puja by two organisers and maintain law and order.

The court said that public address system should be used only by the police to address a large number of people gathered at the Chhath ground in Aya Nagar here.

&quot;This court is of the view that Delhi Government may consider the suggestion made by district magistrate (South) last year and implement it in the present season,&quot; Justice Vibhu Bakhru said.

The court also asked Additional Commissioner of Police (Licensing) to immediately issue an advisory directing that no person is allowed to use the stage and public address system, which should only be used by the police to address the public to maintain law and order.

The court passed the order while disposing of a plea filed by Purvanchal Chhath and Sanskritik Vikas Samiti, a registered society which claimed to be organising Chhath Puja for people of Bihar and eastern Uttar Pradesh for last 24 years.

The Samiti, in its petition filed through advocate Ritesh Sharma, sought direction prohibiting the police from issuing the licence to another society -- Purvanchal Sanskritik and Samajik Vikas Manch -- for organising Chhath Puja at the ground on October 26 and 27.

It said the ground was not large enough to accommodate two organisers and may create law and order problem as every year, around 10,000 people gathered there to worship Sun God.

Additional standing counsel Satyakam, who appeared for Delhi government and Delhi Police&#39;s ACP, told the court that the licences were granted for the puja by the police after receiving reports from the local police and traffic police.

He said law and order situation was examined and licences were issued after examining all aspects and that it was a considered decision to grant the licence to more than one organiser as Chhath was a big religious programme.

He also argued that it was a personal and political fight of the petitioner and not a legal fight.

The petition claimed that the president of the other organiser, Purvanchal Sanskritik and Samajik Vikas Manch, was a member of BJP and he was seeing the function as an opportunity for his political ambition.

It said the ground was not large enough to accommodate two organisers and may create law and order problem as every year, around 10,000 people gathered there to worship Sun God. Additional standing counsel Satyakam, who appeared for Delhi government and Delhi Police's ACP, told the court that the licences were granted for the puja by the police after receiving reports from the local police and traffic police. He said law and order situation was examined and licences were issued after examining all aspects and that it was a considered decision to grant the licence to more than one organiser as Chhath was a big religious programme. He also argued that it was a personal and political fight of the petitioner and not a legal fight. The petition claimed that the president of the other organiser, Purvanchal Sanskritik and Samajik Vikas Manch, was a member of BJP and he was seeing the function as an opportunity for his political ambition.

&quot;Argue on the merits of the case,&quot; said the judge.

During the proceedings, the ED submitted that foreign funds were used for terror activities including stone pelting on the security agencies in the Valley.

The agency told the court that the source of funding of properties of Shah, worth hundreds of crores of rupees, had to be unearthed.

The prosecutor told the court that Shah, arrested on July 25 in the money laundering, was &quot;totally non-cooperative&quot; during his questioning by the ED.

Advocate M S Khan, appearing for Shah, however, alleged that his client was being pressured and compelled to give various statements during his custody by ED officials.

He opposed the submission made by the agency, saying that it was not revealing the complete facts before the court.

The agency said there was a need to probe a lot of cash transactions which were used for terror activities and stone pelting causing huge inconvenience in the Valley.

The records relating to the donations were to be recovered and the accused had to be confronted with them, the agency said.

A bench of acting chief justice Gita Mittal and justice Anu Malhotra released former Congress councillor Balwan Khokhar on bail as his wife is slated to undergo an operation at the AIIMS on May 15.

While restraining the convict from moving out of Delhi, the bench asked him to surrender immediately after the expiry of a week starting that day.

It also asked him to furnish a bail bond of Rs 25,000 with one surety of the like amount.

Khokhar&nbsp;has urged the court to release him on two-month bail to look after his wife after she undergoes the operation at AIIMS.

His plea was opposed by the CBI on the ground that the convict&#39;s conduct in the past was not satisfactory.

Khokhar, a retired naval officer Captain Bhagmal, Girdhari Lal and two others were held guilty in a case relating to the murder of five members of a family in Raj Nagar area of Delhi Cantonment on November 1, 1984, after the assassination of then Prime Minister Indira Gandhi.

They had challenged their conviction and the award of life sentence by the trial court in May 2013.

The trial court had acquitted Congress leader Sajjan Kumar but awarded life term to Khokhar, Bhagmal and Girdhari Lal and three-year jail term to two others,&nbsp;former MLA Mahender Yadav and Kishan Khokhar.

The convicts have filed appeals before the High Court while CBI too has filed an appeal alleging that they were engaged in &quot;a planned communal riot&quot; and &quot;religious cleansing&quot;. The agency has also appealed against acquittal of Kumar.

The Delhi High Court has approved a settlement of the $1.18 billion dispute between Tata Sons and NTT DoCoMo, allowing the Indian firm to buy out the Japanese firm&#39;s stake in the telecoms joint venture, TV news channels reported on Friday.

India&#39;s central bank had blocked Tata&#39;s offer, saying a rule change in 2016 prevented foreign investors from selling stakes in Indian firms at a pre-determined price.

DoCoMo entered India in 2009 with an investment of nearly $2.2 billion in Tata group&#39;s telecoms arm Tata Teleservices for a 26.5 per cent stake in the venture. Competition and a low subscriber base forced DoCoMo to rethink its strategy and it decided to get out of India in 2014.

Under the terms of the deal, in the event of an exit, DoCoMo was guaranteed the higher of either half its original investment, or its fair value.

Tata was unable to find a buyer for the Japanese firm&#39;s stake and offered to buy the stake itself for half of DoCoMo&#39;s investment.

The matter is&nbsp;at present being heard by the Apex Court bench headed by Justice Dipak Misra and Justices R&nbsp;Banumathj and Ashok Bhushan. On November 7, the top court&nbsp;amicus curiae in the case, Raju Ramachandran, had asked the apex court to set aside the death penalty awarded to the accused.

In his written submissions, the senior advocate listed six fundamental errors committed by the trial court while awarding death sentences, including not taking the mitigating circumstances of the accused persons into consideration and not hearing them in person on their punishment.

Amicus curiae refers to someone who is not a party to the case but volunteers to offer information on a point of law or some other aspect of the case to assist the court in deciding a matter before it.

The top court had on April 4 begun final hearing of the convicts&#39;&nbsp;appeal almost two years after staying their execution. Two of the four death-row convicts had written to Chief Justice TS Thakur and Justice Deepak Misra, stating that they do not approve of the defence counsel appointed by the court to argue their case before the top court as they had given statements against them to the media in the past.

The trial court had in September 2013 awarded death sentences to the convicts. Six months later, the Delhi High Court upheld their conviction and sentence. All the convicts moved the apex court in 2014, which stayed their execution.

Six people, including a juvenile, had brutally assaulted the woman in a moving bus in South Delhi. Later, the accused threw out the victim and her male friend at an isolated spot. She died in a Singapore hospital on December 29, 2012, triggering nation-wide protests that resulted in giving more teeth to laws related to rape and other forms of sexual harassment.

Any event organiser, if using copyrighted music or songs in a party, would have to inform the copyright societies which will issue an invoice for payment of royalty along with proof of their rights as per an interim arrangement arrived at in the Delhi High Court between a firm and three such societies.

Under the arrangement, anyone who is going to hold an event will inform the three societies -- Indian Performing Right Society (IPRS), Phonographic Performance Ltd (PPL) and Novex Communications Pvt Ltd -- about the copyrighted work to be used and one of these three, which holds the rights, shall issue an invoice for royalty along with proof of ownership of the copyright.

The event organiser would have to pay the royalty prior to holding the event, Justice Najmi Waziri noted in his order in which he also directed the respondent societies to &quot;upload on their respective websites the (copyright) assignment deeds along with the list of songs pertaining to such assignment deed&quot;.

The order came after the societies claimed that they &quot;are legitimate assignees of copyrighted works or are otherwise duly authorised agents of copyright owners&quot; and sought to enforce their rights under section 18 (assignment of copyright) and 30 (licences by owners of copyright) of the Copyright Act.

They argued before the court that as long as the owner of a copyright exercises its rights under section 18 and section 30 read with section 19 (mode of assignment of copyright) of the Act, &quot;there is no bar on the copyright owner or his agent or an assignee from monetising the copyrighted works&quot;.

The court was hearing an application moved by the three societies against its December 23, 2016, decision restraining them from granting any licence, as a copyright society under section 33 of the Act, to play music and songs of various artists in public.

Event organisers can use copyrighted songs if they pay, says Delhi HC

Lashing out at the police machinery for falsely implicating many Muslim youths on fabricated charges of terror, former Chief Justice of Delhi court on Friday said that there was an urgent need to compensate innocents implicated on false charges of terrorism by the government. He also advocated for punishment for those who fabricate evidence in order to prosecute many such Muslim youths in terror-related cases. &nbsp;

Justice Shah also appealed to media to stop calling people alleged of masterminding terrorist activities as &quot;terrorists&quot;, only to create sensationalism.&nbsp;

&ldquo;There must be a reward for the years lost and lives crushed. For equity to be believed to be done, those blameworthy of confining individuals must be made to endure the results,&quot; Shah, who had led the law commission as well, said at the arrival of the jury report of the principal open tribunal of vindicated innocents.

The event at Delhi Press club was organized by Innocence&nbsp;Network, an organisation working for the rights and rehabilitation of people acquitted in cases of terrorism. A report was also released by the network regarding the Legislative framework for Compensation and Rehabilitation for Innocents acquitted in terror cases.

At the event, Justice Shah read out the recommendations of the jury after the release of the report. He pointed out that the issue of forced confessions extracted under duress, delay in granting bail, wrongful detention, malicious prosecution, and presenting fabricated evidence has become endemic to terror prosecution. Hence, the violence on those who have been accused of terror crimes is much more than ordinary crime, and hence legitimates corrective mechanisms by the state.

Mohammad Amir Khan, who remained behind bars for 14 long years before being acquitted of 19 charges of terror against him, talking to WION, said, &ldquo;I am hopeful that these recommendations pointed out in the report drafted under the supervision of a reputed seniors judge and former chairperson of law commission does not remain merely in the books, I hope people get to read this report and understand the plight of people who have suffered so much, our acquittal does not mean much unless we are compensated&quot;.&nbsp;

'Forced confessions, delay in granting bail, wrongful detention, malicious prosecution, presenting fabricated evidence has become endemic'

Lashing out at the police machinery for falsely implicating many Muslim youths on fabricated charges of terror, former Chief Justice of Delhi court on Friday said that there was an urgent need to compensate innocents implicated on false charges of terrorism by the government. He also advocated for punishment for those who fabricate evidence in order to prosecute many such Muslim youths in terror-related cases. Justice Shah also appealed to media to stop calling people alleged of masterminding terrorist activities as "terrorists", only to create sensationalism. “There must be a reward for the years lost and lives crushed. For equity to be believed to be done, those blameworthy of confining individuals must be made to endure the results," Shah, who had led the law commission as well, said at the arrival of the jury report of the principal open tribunal of vindicated innocents. The event at Delhi Press club was organized by Innocence Network, an organisation working for the rights and rehabilitation of people acquitted in cases of terrorism. A report was also released by the network regarding the Legislative framework for Compensation and Rehabilitation for Innocents acquitted in terror cases. At the event, Justice Shah read out the recommendations of the jury after the release of the report. He pointed out that the issue of forced confessions extracted under duress, delay in granting bail, wrongful detention, malicious prosecution, and presenting fabricated evidence has become endemic to terror prosecution. Hence, the violence on those who have been accused of terror crimes is much more than ordinary crime, and hence legitimates corrective mechanisms by the state. Mohammad Amir Khan, who remained behind bars for 14 long years before being acquitted of 19 charges of terror against him, talking to WION, said, “I am hopeful that these recommendations pointed out in the report drafted under the supervision of a reputed seniors judge and former chairperson of law commission does not remain merely in the books, I hope people get to read this report and understand the plight of people who have suffered so much, our acquittal does not mean much unless we are compensated". After struggling for five long years since he has been out of jail, Amir finally found a job with Delhi Waqf Board. But due to interventions by the lieutenant governor of Delhi, Najeeb Jung, his job could not remain intact and he lost his job. The move covered fixed-dose combination drugs, which are cocktails of medicines that are used worldwide to improve patients&#39; compliance in complicated courses of treatment, especially for conditions such as HIV, tuberculosis and malaria.

In India, however, lax regulation and inconsistent enforcement of laws has led to many such drugs entering the market without central government approval, a Reuters investigation found last year. Roughly half the drugs sold on the Indian market are combination medicines, including many antibiotics, the misuse of which leads to antibiotic resistance.&nbsp;

The government announced the ban in March saying extensive deliberations with scientific experts had found the medicines lacked therapeutic efficacy.

Most companies filed petitions arguing the government did not exercise its powers appropriately.

The reversal of the ban means companies can continue to sell these drugs.

The decision is another setback for India&#39;s efforts to weed out irrational fixed-dose combination drugs from the market. A similar move in 2007 to ban about 294 such drugs was also met with stiff resistance from the industry, which obtained a stay.

A son, irrespective of his marital status, has no legal right to live in the self-acquired house of his parents and can reside there only at their &quot;mercy&quot;, the Delhi high court has said.

The court also said that only because parents have allowed the son to live in their house as long as their relations are cordial does not mean they have to bear his &quot;burden&quot; throughout his life.

&quot;Where the house is self-acquired by the parents, son whether married or unmarried, has no legal right to live in that house and he can live in that house only at the mercy of his parents up to the time the parents allow,&quot; Justice Pratibha Rani said in an order.

&quot;Merely because the parents have allowed him to live in the house so long as his relations with the parents were cordial does not mean that the parents have to bear his burden throughout his life,&quot; the court said.

It said this while dismissing an appeal by a man and his wife challenging the order of a trial court which had passed a decree in favour of his parents, who had filed a suit seeking a direction to their son and daughter-in-law to vacate the floors in their possession.

The parents, both senior citizens, had told the lower court that both their sons and daughters-in-law, who were living with them, have made their &quot;life hell&quot; after which they had given complaints to the police and also issued public notices in 2007 and 2012 debarring them from their self-acquired property.

Both the sons and daughters-in-law had contested the suit before the trial court while denying the allegations. They had also claimed that they were the co-owners of the property as they had contributed towards its purchase and construction.

However, the trial court had passed the decree in favour of the parents after which one of the sons, along with his wife, had moved the high court.

In the order, Justice Rani noted that the son and his wife were unable to prove that they were the co-owners of the property, while his parents have established their contention on the basis of documentary evidence.

Delhi high court quashes appointment of 21 legislators as parliamentary secretaries

The new privacy policy of internet-based mobile messaging application Whatsapp has been challenged before the Delhi High Court in India. 
 
The recent change in policy allows for sharing the app users&rsquo; data with Facebook. 
 
A public interest litigation (PIL) in the matter was filed by two students - Karmanya Singh Sareen and Shreya Sethi - who claimed that the new policy was in contradiction to Whatsapp&rsquo;s terms and conditions set in 2012. The change would &ldquo;endanger&rdquo; the privacy of its users, they said. 
 
Based on the PIL, a bench of Chief Justice G Rohini and Justice Sangita Dhingra Sehgal on Tuesday issued notices to the Department of Telecommunications (DoT) and Telecom Regulatory Authority of India (TRAI) and asked them to file their replies by September 14. 
 
The new policy, likely to come into effect from September 25, seeks to change the &ldquo;most valuable, basic and essential feature&rdquo; of WhatsApp by &ldquo;unilaterally threatening to take away the protection to privacy of data&rdquo;, the plea said. 
 
According to the new policy, there will be data-sharing with parent company Facebook.&nbsp; 
 
While it was clarified that messages and photos will not be shared, they will &ldquo;coordinate&rdquo; more to help improve ad experience on Facebook and its products. 
 
It &ldquo;will share some of your account information with Facebook and the Facebook family of companies, like the phone number you verified when you registered with WhatsApp, as well as the last time you used our service,&rdquo; reads the new policy.

India: WhatsApp?s new privacy policy challenged in Delhi high court

Indian Supreme Court will now hear together the Delhi Government&#39;s civil suit seeking a declaration that the national capital is a state and its petition against the order of the high court which held that the city is a union territory with Lt Governor as its administrative head. 
 
This was stated by a bench of Justices A K Sikri and N V Ramana today after the Arvind Kejriwal government informed the apex court that it will file an appeal shortly against yesterday&#39;s high court verdict. 
 
As AAP government&#39;s earlier suit came up for hearing, the court said that instead of pursuing its earlier civil suit, the city government should file an appeal challenging the Delhi high court&#39;s decision. 
 
&quot;You have to challenge the order of the Delhi high court. Whether the HC has decided the issue rightly or wrongly would be decided by the Supreme Court in a special leave petition (SLP). What is the use of this suit now. What is the point in duplicating the proceedings,&quot; a bench of Justices A K Sikri and N V Ramana said. 
 
The observation came when senior advocate Indira Jaising, appearing for the Arvind Kejriwal government, informed the bench that a fresh appeal would be filed shortly in the apex court against the decision of the high court. 
 
She sought adjournment of the proceedings on the original civil suit earlier filed by Delhi government seeking various reliefs including a declaration that the national capital is a state and not a union territory. 
 
She said that the law suit and the SLP, which will be filed shortly, be heard together. 
 
Attorney general Mukul Rohatgi and solicitor general Ranjit Kumar, both representing the Centre, vehemently opposed the plea of Delhi government saying that they cannot pursue parallel recourse for the same relief. 
 
The bench termed one of the applications of the Delhi government as infructuous in which it had sought directions restraining the high court from pronouncing verdict on its petition on the conflict of power with the LG. 
 
During the brief hearing, the bench asked the Delhi government to apprise it about the issues already addressed by the high court in its verdict yesterday. 
 
The bench considered the submissions of Delhi government and adjourned the hearing on the lawsuit to August 29. 
 
It, however, clarified that the lawsuit and the SLP will be heard together. The Chief Justice of India will decide which bench will hear the matter. 
 
The high court had yesterday held that Delhi will continue to remain a union territory under the Constitution with the LG as its administrative head. 
 
The special constitutional provision Article 239AA dealing with Delhi does not &quot;dilute&quot; the effect of Article 239 which relates to the Union territory and hence, concurrence of the LG in administrative issues is &quot;mandatory&quot;, the bench headed by Chief Justice G Rohini had said.&nbsp; 
 
Kejriwal-led government had approached the court alleging that it was unable to function as most of its decisions were either annulled or changed by the federal government at the behest of the lieutenant governor. 
 
The court also held that no action can be taken by the anti-corruption branch against federal government officials.&nbsp;Delhi unit of India&#39;s ruling Bharatiya Janata Party Satish Upadhyay welcomed the court order. 
 
&quot;They will have to follow the high court&#39;s order. They will have to rule within law. The president has given powers to the governor as an administrator. You will have to take the needed permissions and sanctions from the governor,&quot; said Upadhyay. 
 
The relations between Delhi and Prime Minister Narendra Modi&#39;s government have remained frosty since AAP swept to power in the national capital in last year&#39;s polls.&nbsp;AAP alleges that Modi government is creating hurdles in the functioning of Delhi government, a charge the latter denies.

The Supreme Court of India will today begin its hearing in the appeals filed by the four accused in the landmark December 16 gang rape case which had rocked the nation. 
 
Twenty three-year-old Nirbhaya was brutally assaulted and gang-raped by six people in a moving bus in the capital city of New Delhi on the night of December 16, 2012 and thrown out of the vehicle. She died in a Singapore hospital on December 29. 
 
A special bench of the Indian apex court hearing the plea of convicts awarded death in the case has decided to sit two hours beyond its working time to ensure speedy disposal of the case that has been pending in the court for more than two years. 
 
The convicts Vinay Sharma (23), Akshay Thakur (31), Mukesh (29) and Pawan Gupta (22) were awarded death sentence by a trial court in September 2013 and six months later the Delhi High Court upheld their conviction and sentence. All the convicts then approached the Supreme Court which in 2014 had stayed their execution and the matter is pending in the top court since then. 
 
The Delhi High Court had upheld their conviction and award of death penalty by terming the offence as &#39;extremely fiendish&#39; and &#39;unparalleled in the history of criminal jurisprudence&#39; and said the exemplary punishment was the need of the hour. 
 
Though arguments started in April before a three-judge bench headed by Justice Dipak Misra, arguments will have to be made afresh since the combination of judges in the bench has been changed. 
 
The bench comprises Justices Dipak Misra, C. Nagappan and Ms. R. Banumathi.

Though arguments started in April before a three-judge bench headed by Justice Dipak Misra, arguments will have to be made afresh since the combination of judges in the bench has been changed.
