Kolkata horror: CBI alleges false records created at police station in RG Kar case

Karnataka government withdrew open consent to the Central Bureau of Investigation (CBI) to conduct inquiries in the state, alleging that the bureau was functioning in a "motivated matter" and had a "biased approach".&nbsp;

The government announced the decision during a cabinet meeting&nbsp;chaired by Chief Minister Siddaramaiah.&nbsp;

The opposition claimed that the CBI was ordered by the Bharatiya Janata Party to target its leaders, especially before the elections. It further ruled out any link to Mysuru Urban Development Authority, or MUDA, land scam allegations against&nbsp;Chief Minister Siddaramaiah.

Law Minister HK Patil said that it was not prompted by the Karnataka High Court's ruling upholding Governor Thaawarchand Gehlot’s probe sanction against the CM in the MUDA site allotment case.

"We are withdrawing open consent for CBI investigation in the state. We are expressing our concerns about the misuse of the agency. They are biased... that is why are taking this decision," Patil said.

"This is not because of MUDA (land scam)..." Patil said at a press briefing, stressing, "Whole Cabinet expresses solidarity with Chief Minister...we have encouraged him to fight back."&nbsp;&nbsp;

"In all cases, we have referred to the CBI, they have not filed chargesheets...leaving many cases pending. They also refused to investigate the cases we sent. There are numerous such instances."

Patil stressed that this is meant to "control them (the CBI) from taking the wrong path".&nbsp;

“The Governor, who is the highest authority in the state, has upheld a false allegation against the state government. Where are the documents to show the involvement of the CM in the MUDA case?” he said.

<h2>Why did the government decide&nbsp;to withdraw consent?</h2>

Patil said that the CBI and Centre have not been judiciously using their instrumentalities. "So, case-by-case, we will verify and give (consent) to the CBI, general consent has been withdrawn.”

He noted that “in the case of the CM, the court has directed a Lokayukta inquiry. The question of the withdrawal of general consent to the CBI is not linked to the MUDA case.”

‘Biased approach,’ Karnataka withdraws general consent to CBI for probing cases in state

Institutions, including Election Commission and investigative agencies, perform their duty under tight situations and an observation can “despirit” them, Vice President Jagdeep Dhankhar has said.

He also said that one has to be “extremely conscious” about the country’s institutions, which are robust and are working independently under the rule of law with suitable checks and balances.

His remarks at an event in Mumbai on Sunday came against the backdrop of a Supreme Court judge observing on Friday that probe agency must be above board and the Central Bureau of investigation (CBI) should dispel notion of it being a caged parrot.

Former RG Kar Medical College principal, Sandip Ghosh, gave misleading responses during a polygraph and layered voice analysis, according to CBI officials. The CBI is investigating the brutal rape and murder of a trainee doctor at the hospital on August 9.

CBI claims that&nbsp;Ghosh was informed about the incident at 9:58 AM but delayed reporting it to the police. When he did file a report, it was vague.

CBI officials also accused Ghosh of introducing a suicide theory. "He did not try to get an FIR lodged immediately. Rather, a new theory of suicide was introduced, which is not possible as per external injury visible on the body of the victim that was undressed at the lower part," CBI told the news agency.

However, a doctor had already examined her and declared her dead.

The CBI claims the GDE was falsified in coordination with hospital authorities and others, deliberately providing inaccurate information. The agency further alleged that Mondal’s delay in filing the FIR and securing the crime scene resulted in the loss of crucial evidence.

Mondal is also accused of protecting Sanjay Roy, the suspect who had unauthorised access to the crime scene. The victim was found raped and murdered in the seminar hall, where she had gone to rest. A doctor discovered her body.

Sanjay Roy, a police volunteer, was arrested the following day after CCTV footage showed him entering the room at 4:03 am. The Central Forensic Science Laboratory (CFSL) in New Delhi later found Roy’s account to be "deceptive on certain important issues," PTI reported.

The AAP leader's petitions include one appealing against the denial of bail and another contesting his arrest by the Central Bureau of Investigation (CBI) in connection with the excise policy case. If the court rules in his favour, Kejriwal could be released almost six months after his initial arrest by the Enforcement Directorate (ED) and two months after receiving bail for the arrest. The Supreme Court had granted him bail on July 12 in the case investigated by the ED. However, he remained in custody because the CBI had arrested him on June 26, just as the ED withdrew its challenge in the same case. A Kolkata court on Friday rebuked the Central Bureau of Investigation (CBI) after the officer in charge of investigating the rape and murder of a 31-year-old trainee doctor failed to attend an important hearing of Sanjay Roy, the main suspect in the case at Kolkata's RG Kar Medical College and Hospital.

Judge Pamela Gupta voiced her frustration when both the CBI’s investigating officer and public prosecutor (PP) did not show up on time, causing a delay in the proceedings. The judge even questioned whether Roy, the accused, should be granted bail due to the CBI’s unpunctuality, asking, “Where are the PP and IO? Should I grant bail?”

She further added, “This reflects a severely lethargic attitude on the part of the CBI. It is very unfortunate.”

Dipak Poria, the CBI lawyer, reportedly arrived nearly an hour late and briefly argued against granting bail, saying that Roy’s release could hinder the ongoing investigation.

The court refused to grant bail to Sanjay Roy, a civic volunteer with Kolkata Police, who was taken into custody on August 10. The court ordered Roy to remain in judicial custody for 14 more days, with his next court appearance set for September 20, during which the CBI will continue to oversee the case.

'Shall I grant bail?' Kolkata court rebukes CBI over lawyer's absence in Sanjay Roy's bail hearing

India’s Supreme Court on Thursday (Sep 5) reprimanded the Central Bureau of Investigation (CBI) for arresting Delhi Chief Minister Arvind Kejriwal in the liquor policy case while he was in judicial custody with the Enforcement Directorate (ED). India’s top court passed its remarks while hearing the Delhi CM’s plea for regular bail and challenging his arrest by the CBI.

The court, on Thursday, reserved its order in the case after hearing arguments from both sides. The verdict is expected to be out on Tuesday (Sep 10).

The apex judicial body noted that the federal agency required the permission of the court to do so.

"When you are in custody... if you are arresting him again, then you need the permission of the court. There is something in the criminal procedure code," the SC said.

It must be noted that the Delhi CM was first detained by the ED on March 21 in the liquor policy case. He was then arrested by the CBI on June 26 in a corruption case. The apex court had granted Kejriwal bail in the ED case on July 12 but he continues to be behind bars due to the arrest made by the CBI.

Arvind Kejriwal bail hearing: SC scolds CBI for arresting Delhi CM without court's approval

India’s Central Bureau of Investigation (CBI) and West Bengal police locked horns Friday (Aug 30) amid claims that the crime scene of the rape and murder case&nbsp;at&nbsp;Kolkata's RG Kar Medical College and Hospital may have been “compromised”.

The CBI earlier alleged that the crime scene where the 31-year-old junior doctor was raped and murdered was tampered with. The central agency claimed in India’s Supreme Court that the victim’s family was misled over their daughter’s death and that efforts were made to brush off the gruesome incident as “suicide.”

Kolkata police were quick to retaliate as CBI’s allegations directly raised a question of their efficiency. They claimed that all individuals present at the scene, as depicted in a photograph, were fully authorised to be there. Amidst this, a photo went viral on social media showing a crowd present inside the seminar hall where the incident took place.

Kolkata horror: ‘Everything was altered at crime scene,’ CBI’s big claim in SC; Bengal police fire back

In a significant development regarding the Kolkata doctor rape and murder case, the Central Bureau of Investigation (CBI) sought permission from a Kolkata Court on Tuesday to conduct a polygraph test on Anup Dutta, the Kolkata Police Assistant sub-inspector (ASI).&nbsp; The CBI was conducting the polygraph test on Wednesday at the time&nbsp;of filing of this story. While working on the case, CBI has already conducted lie-detector test on seven people, including the primary accused Sanjay Roy, former principal of RG Kar Medical College, Sandip Ghosh, and five more people.&nbsp;

The CBI&nbsp;had taken permission from a Kolkata court to conduct the polygraph test on Assistant Sub-Inspector Dutta, who was earlier questioned by the agency in the case, said a report in The Telegraph.&nbsp;

Officials said that though the information revealed in&nbsp;polygraph test may not be used as evidence during trial but CBI may gather corroborative evidence which could be used in court.

Investigators monitor the&nbsp;psychological responses, heart rate, breathing pattern, sweating and blood pressure of suspects and witnesses during&nbsp;polygraph test to assess inaccuracies in their statements and determine if there are discrepancies in their responses.

The CBI is investigating whether Anup Dutta helped the main suspect, Sanjay Roy, in covering up the rape and murder of the 31-year-old female postgraduate trainee doctor. This horrific incident occurred on August 9&nbsp;in the seminar hall of RG Kar Medical College and Hospital in Kolkata.&nbsp;

<h2>Who is Anup Dutta</h2>

As per PTI, Anup Dutta has close ties with the primary accused, Sanjay Roy, who was a police volunteer at a police post near the RG Kar Medical College and Hospital. This test will aid the CBI in finding whether Anup Dutta helped Roy or not. The ASI, Anup Dutta, is facing allegations that he helped the primary accused, Sanjay Roy, gain access to police headquarters and motorcycle, as he is not entitled to any of these services as a police volunteer.&nbsp;

Officials told PTI on Tuesday that Dutta was allegedly helping Roy, and the central agency is trying to find out whether Roy told Dutta about the crime and received any favours from him. The polygraph test will help the CBI to assess the inaccuracies and discrepancies in the statements of suspects.&nbsp;

Delhi High Court (HC) on Monday (Jul 29) reserved its judgment on the bail plea filed by Chief Minister Arvind Kejriwal in the liquor excise policy scam.&nbsp;The Aam&nbsp;Aadmi Party (AAP) leader, currently in judicial custody, had directly approached the HC, seeking bail without going to the trial court.&nbsp;

Central Bureau of Investigation (CBI) argued against the bail saying "mere filing of chargesheet" did not give the Delhi CM, the right to bail. The premier agency called Kejriwal the 'sutradhar' (mastermind) of the scam, adding that without his arrest, "the investigation would not have been completed".&nbsp;

“There are no orders which have released him on bail. Those are just interim orders. First was for elections, and other is that it may be extended or can be reversed by the constitutional bench. Stay on bail in ED case still continues. It is an interim release dependent on another circumstance of the constitutional bench," argued CBI counsel DP Singh.

"The amount of evidence that has come in the last one month is of that nature…for lack of better words, he is the ‘sutradhaar’ (mastermind) of the entire excise scam," he added.&nbsp;

Kejriwal's counsel Abhishek Mau Singhvi, N Hariharan and Ramesh Gupta called CBI's allegations as poetic and said the excise policy was prepared by an expert committee, not the CM alone.&nbsp;

“Sutradhar is the word used. CBI is poetic. The first time excise policy went into making is 4-9-2020. There were nine expert committees for one year. These included four departments…After one year, in July 2021, for the first time, policy is published. At least 50 bureaucrats were involved,” Singhvi said.

The Central Bureau of Investigation (CBI) told a court on Wednesday (July 10) that the 1994 ISRO espionage case, which&nbsp;falsely implicated ISRO scientist Nambi Narayanan,&nbsp;was fabricated by a senior police officer in Kerala to illegally detain a Maldivian woman who rejected his advances. The CBI presented this claim in a court in the Indian city of Thiruvananthapuram to point out that the case falsely implicated ISRO scientist Nambi Narayanan.

According to the CBI chargesheet, S Vijayan, a special branch officer at the time who later retired as a Superintendent of Police (SP), orchestrated the case after a Maldivian woman Mariyam Rasheeda rebuffed his romantic overtures. Vijayan allegedly confiscated Rasheeda's travel documents and air tickets to prevent her from leaving the country.

'Did not blame Sisodia': Arvind Kejriwal's rebuttal on CBI's claims in court

India's Central Bureau of Investigation (CBI) formally arrested Delhi Chief Minister Arvind Kejriwal in the alleged liquor policy case inside Delhi's Rouse Avenue Court on Wednesday (June 26).

The chief minister was arrested hours before a plea challenging the stay imposed by the High Court on the grant of regular bail for his arrest by the Enforcement Directorate was to be heard in the Supreme Court.

Special Public Prosecutor appearing for CBI, advocate DP Singh said, "I am seeking permission because he's in custody and investigation is my prerogative. I would like to seek formal custody of Arvind Kejriwal to interrogate and make a formal arrest."

The permission was sought after the court asked Kejriwal's lawyers where the proceedings would take place since he had not been formally arrested.

CBI had sought the permission of the court to interrogate Kejriwal in the adjoining room before arresting him formally. The court had allowed the agency to carry out the examination and place on record the material they had collected for his arrest.&nbsp;

CBI then informed the court that they had formally arrested Kejriwal and provided the court with all the required documents.

Advocate DP Singh said to the court, "There are certain dates...I got permission under PC Act on 23rd April 2024 and since elections were on and then he was on interim bail, we refrained from investigating him."

<h2>Supreme Court begins hearing Kejriwal's plea</h2>

Supreme Court started hearing Kejriwal's plea which challenged the June 21 order of the Delhi High Court which imposed interim stay on regular bail granted to him in the Delhi excise policy case. He is being probed by the Enforcement Directorate (ED) in the case.

Senior advocate Abhishek Manu Singhvi, who represented Kejriwal, informed the court that the Delhi High Court ordered a stay on bail order and he wishes to withdraw the plea before the apex court against the interim order. He added that Kejriwal will file&nbsp;a fresh petition to challenge the June 25 order.

The court had allowed the agency to carry out the examination and place on record the material they had collected for his arrest. CBI then informed the court that they had formally arrested Kejriwal and provided the court with all the required documents. Advocate DP Singh said to the court, "There are certain dates...I got permission under PC Act on 23rd April 2024 and since elections were on and then he was on interim bail, we refrained from investigating him." Supreme Court begins hearing Kejriwal's plea Supreme Court started hearing Kejriwal's plea which challenged the June 21 order of the Delhi High Court which imposed interim stay on regular bail granted to him in the Delhi excise policy case. The Supreme Court of India on Monday&nbsp;questioned the West Bengal state government as to why it has come in as a petitioner before it for "protecting the interest" of some private individuals in the Sandeshkhali sex abuse and land grabbing case.&nbsp;It adjourned hearing on a special leave petition moved by the east Indian state's government.

The apex court was hearing the state government's plea challenging the Calcutta High Court's April 10 order which directed a CBI investigation into allegations of crimes against women and land grabbing in Sandeshkhali.&nbsp;

“Why should the state come in as a petitioner for protecting the interest of some private individuals?,” a bench of Justices B R Gavai and Sandeep Mehta asked.&nbsp;

The counsel appearing for the state said it was aggrieved by some comments made in the high court order.

The bench of justices BR Gavai and Sandeep Mehta adjourned the matter till July. The plea was made by the West Bengal government's counsel and senior advocate AM Singhvi.&nbsp;

The court further recorded the statement of West Bengal government counsel that the pending status of the petition will not be exploited or used for any other purposes.

The state government had moved the apex court stating that the Calcutta High Court erroneously ruled an order directing the CBI to probe and submit a report concerning the accusations made by the residents of Sandeshkhali.

The high court had directed a probe by the Central Bureau of Investigation (CBI) into the allegations of land grabbing and sexual assault in Sandeshkhali.

The government pleaded in the top court that the high court order transgressed the culmination of probes into 43 FIRs, all leading to charge sheets.

It said that the sidelining of the state government's actions in favour of political voices risks bias in the investigation.

The government further said that the High Court decision had cast baseless imputations on the probes carried out by the State Police without taking into account the correct tangible matrix and the measures essayed by the petitioner state in diligently investigating all the FIRs.

Bharat Rasthra Samithi (BRS) leader K Kavitha was on Thursday (Apr 11) arrested by India's Central Bureau of Investigation (CBI) over her alleged involvement in a corruption case that is further connected to the Delhi excise policy scandal, said the officials.

Former Telangana chief minister K Chandrashekar Rao's daughter Kavitha was imprisoned in Delhi's Tihar Jail following her arrest by the Enforcement Directorate (ED) that took place on March 15.

After obtaining permission from a special court, the CBI officials&nbsp;interrogated Kavitha inside the jail over the WhatsApp chats that were recovered from co-accused Buchi Babu’s phone.

She was also questioned by the probe agency regarding the documents about a land deal in which&nbsp;Rs 100 crore was purportedly paid to the Aam Aadmi Party (AAP) in kickbacks to sway the excise policy for Delhi to the advantage of a liquor lobby.&nbsp;

<h2>Kavitha pens note from jail to Delhi court</h2>

The BRS leader penned a note from prison on Tuesday (Apr 9) alleging that the probe by the central agencies has meddled with her reputation and has also invaded her privacy.

" Madam Justice, as the whole nation witnessed, the past two and a half years of "Never Ending", ED and CBI investigation has turned into a media trial. Being a woman politician, I am the most victimized in the process, severely denting my personal and political reputation. My personal mobile phone number was displayed on all television channels, directly invading my privacy," the letter stated.

"After two and a half years of failed investigation, ED arrested me on March 15, without any proof, just based on statements and right before the elections. Despite giving an undertaking of no coercive action in the Supreme Court, they arrested me," it added.

The letter further claimed that more than 90 per cent of the cases of the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) were filed against the opposition leaders and that the investigation is abruptly put to a halt once the accused joins the Bharatiya Janata Party (BJP).

"On the floor of the Parliament, BJP leaders openly threaten opposition saying "Chup ho jaao, warna ED bhej dunga." In this dire situation, Madam Justice, the opposition parties are looking up to the judiciary with great hope to give us respite," Kavitha said in her letter.

"I have time and again cooperated with both the agencies. I have appeared before them four times. I have answered all their questions to the best of my knowledge and gave all my bank and business details. I will fully have cooperated with the agencies by submitting all of my mobile phones that the agencies blamed me for destroying. In the last two and a half years of investigation, both the agencies conducted multiple raids, physically and mentally harassed, threatened and arrested many people," she&nbsp;further alleged.
