“Rebooting. We (have) started. We continue. (The) Ministry continues to work as usual,” Umerov said in a Facebook post.

The Ukrainska Pravda news site quoted unnamed government sources as saying all the deputy ministers had resigned voluntarily following a request by Umerov and would not be returning to their posts.

It said consultations were underway on candidates to replace them and quoted a source close to the ministry as saying “a complete overhaul is underway” at the ministry.

Umerov has said his priorities include making the ministry the main institution for coordinating Ukrainian defence forces, enhancing the value attached to individual soldiers, developing Ukraine’s military industry and fighting corruption.

Maliar, a war crimes lawyer, had served as a deputy defence minister since 2021 and her latest update on the war in Ukraine appeared on Monday morning.

She faced criticism last week after initially reporting that Ukrainian forces had recaptured an eastern village from Russian forces, but later saying her report was inaccurate and that fighting was still raging around the village. Its capture was then announced by the military the next day, but Russia has since denied losing control of the village.

The Constitution of India provides a parallel executive, legislature and judiciary for the union and the states. The President is the Head of State for the whole of India and the Governor is the head of a state. No doubt that the Governor is appointed by the President under Article 155, whereas the President is elected under Article 54. This has been interpreted to mean that the Governor is the agent of the President and not an independent entity. Constitutionally that is a completely wrong interpretation, because in the matter of exercise of executive power, summoning of the Legislature, its prorogation and its dissolution, the Governor is totally independent of the President. Otherwise, the Governor, under Article 163, functions according to the aid and advice of his Council of Ministers, not that of the President. In legislative matters, it is the Governor who gives assent to Bills passed by the State Legislature, unless he reserves any for the prior approval of the President. Just as the President functions according to the aid and advice of his Council of Ministers, the Governor is in exactly the same position vis-à-vis the State and, therefore, the two offices of President and Governor are in parallel and not in a position of superiority or subordination.

The Governors, under the scheme of things in the Indian Constitution, have an independent place of their own and are expected to function as impartial Heads of States within the territory of their own State. This brings us to the question of what sort of persons should be appointed as Governors. What should be their qualifications or other competence to occupy this high office? Unfortunately, the Constitution is silent on this behalf except to state what is given in Article 157, that is, that no one who is not a citizen of India can be appointed as a Governor and that the person so appointed should have completed thirty-five years of age. Under Article 158, the Governor shall not be a Member of Parliament or of a State Legislature and on his assuming office, if he is such a Member of a Legislature, he will be deemed to have vacated his seat in the House. Secondly, the Governor is prohibited from holding any other office of profit. Other than this there are no qualifications laid down for appointment as Governor. Theoretically, he can be uneducated with a low intelligence quotient (IQ), with no record of public service or professional ability and, at least in explicit terms, is not even required to be sane. This probably means that even a certifiable lunatic could be appointed as Governor because there is no constitutional prohibition on this behalf. The Governor can be partisan, affiliated to a political party, but he can still be appointed as Governor. Is this the kind of person we need as Head of State?

It is a fact of which we can take notice that since 1967 (initiation of Mrs Gandhi’s Rule), all successive Governments, be it single majority or coalition, basically had four unspoken criteria for the appointment of Governors. They were (1) Party hacks who had put in a few decades of service to the party at the menial or low-grade political level, who have expectations that now that the party has come to power their loyalty will be rewarded. (2) If the State Government is to be destabilised, then send in a political person as Governor. (3) Where the Prime Minister and the Chief Minister of a State are on good terms, then send a Governor with the Chief Minister’s approval. (4) Decrepit politicians aged almost to the point of senility, with major health problems, could be sent to a Raj Bhavan to enjoy its comforts and avail of the high-quality medical services which would be available to the Governor. In other words, use the Raj Bhavan as a nursing home for the aged and the sick.

Right from the time of Indira Gandhi, the post of Governor has been used for picking people who are party loyalists and want a comfortable position for themselves because they are otherwise worthless. It is unfortunate that the unspoken criteria laid down by the Congress party have been adopted wholeheartedly by every government which has succeeded Indira Gandhi. Every successive government does just the same, but one had expectations from Narendra Modi that he would understand the constitutional importance of the post of Governor and would appoint persons who could act in a nonpartisan manner. Unfortunately, that has not happened. This is not what we expect of our government and by sending middle-level politicians as Governors, a post which by its very nature should be apolitical. 

Of course, there will be controversy about any suggestions made regarding the qualifications for the post of Governor but as a starting point of debate, one should attempt some suggestions or a few considerations which must go into the appointment of a person as Governor. First and foremost, no active politician should ever be appointed as Governor. This means that for at least five years prior to such appointment the person should not have participated in any active politics, nor should formally be a member of any political party. The person appointed should not be more than seventy years of age and should not be considered for more than one additional term of reappointment. The person should have had formal education at least to the collegiate level. The person could be a professional such as a lawyer, doctor, etc. He could be a technocrat, an academician, a renowned architect, a person who has earned distinction in literature, someone who earned distinction as an administrator or diplomat, a successful farmer, environmentalist or social activist, or someone who has served the armed forces or the police and has earned a reputation for integrity and professional competence, a businessman with a clean record or anyone from any profession who has exhibited the ability to think and perform, whilst earning a reputation for honesty. The present government led by Prime Minister Narendra Modi, which is a pathfinder in so many such matters, would perform a great service to India if it codifies the principles on which Governors should be selected. In the long run, an impartial Governor would always be more useful to the nation than one who is partisan.

As reported by Reuters, Pope said in the 90-minute interview that discussed the new constitution for the central administration, known as the Curia, "I am open to giving (women) an opportunity." He mentioned that last year, for the first time, he named a woman to the number two position in the governorship of Vatican City, making Sister Raffaella Petrini the highest-ranking woman in the world's smallest state.

They are currently headed by male clerics. Francis has already named a number of women, both nuns and laywomen, to Vatican departments.

This comes as the current chief, General Qamar Javed Bajwa, is not seeking an extension. He will retire on November 29 this year, as per a statement of Pakistan Army. &nbsp;

So, the speculations are rife about the next army chief in the country. With the political circles already tense after the ouster of former PM Imran Khan, several politicians are commenting on the matter. &nbsp;

Over the appointment, PPP co-chair Asif Ali Zardari and PML-N's vice president Maryam Nawaz had made comments recently. &nbsp;

At a press conference in Karachi on Wednesday, when asked about Lt Gen Hameed, Zardari said, "The helpless Faiz Hameed has been sidelined." &nbsp;Later, he issued a clarification and said he "unintentionally" said the sentence.&nbsp;

From June 16, 2019 to Oct 19, 2021, Lt Gen Hameed served as the Inter-Services Intelligence chief. &nbsp;

Outside the Islamabad High Court, Maryam told reporters that the next army chief should have a "flawless reputation", which is free from any kind of criticism or doubts. &nbsp;

The PML-N leader made the comment when asked about Defence Minister Khawaja Asif's remarks where he said Lt Gen Hameed's name can be considered for new army chief. &nbsp;

"The nation looks at the army for the unity and security of Pakistan. So, it is important that the army chief is a person who is worthy and stainless so that people salute the Pakistan Army," Maryam said. &nbsp;&nbsp;

Without naming any particular politician, the Inter-Services Public Relations (ISPR) said comments over Lt Gen Faiz Hameed, who is currently serving as Peshawar Corps Commander, are "very inappropriate". &nbsp;

"One of the most competent and professional officers is entrusted with the responsibility to lead this prestigious formation. Imprudent comments made by important senior politicians recently about [the] Peshawar Corps commander are very inappropriate," the ISPR said in a statement. &nbsp;&nbsp;

"It is expected that the senior political leadership of [the] country refrains from passing objectionable remarks against the institution, whose brave officers and men are constantly putting their lives on the line to guard the integrity and sovereignty of Pakistan," the statement concluded. &nbsp;&nbsp;

The latest announcement comes days after the Taliban appointed Haji Mohammad Idris as the acting head of the Da Afghanistan Bank (DAB) —Afghanistan’s central bank.

According to local media reports in Afghanistan, apart from the above appointments, the Taliban have so far nominated&nbsp;seven senior leaders to key ministerial posts. They are:

1. Gul Agha named as the finance minister.

2. Sadr Ibrahim named as&nbsp;the acting interior minister.

The emerging consequences of COVID-19 particularly in the field of healthcare and medicine gave a new fillip to the online medical teleconsultation. In an effort to govern the medical teleconsultation the Ministry of Health and Family Welfare (“MoHFW”), Government of India issued the ‘Telemedicine Practise Guidelines’ for governing the practice of online medical consultation in India on 25 March 2020. The Telemedicine Practise Guidelines (“Guidelines”) were made by the Board of Governors under the Indian Medical Council Act, 1956, in consultation with the Niti Aayog.

In view of the prevailing COVID19 pandemic, it was felt that it is safer for other patients as well as the health workers to provide consultation and initial treatment through information and communication technologies. The Guidelines were promulgated to achieve quality healthcare in a cost-effective manner.&nbsp;

The practice of online medical consultation (through the internet or other communication technologies) has been prevalent across the world. Considering the nature of medical emergencies, effective and immediate guidance by a medical practitioner can be the difference between life and death. This practice is better known as ‘telemedicine’.

The World Health Organisation (“WHO”) defines ‘telemedicine’ as – “The delivery of health care services, where distance is a critical factor, by all health care professionals using information and communication technologies for the exchange of valid information for diagnosis, treatment and prevention of disease and injuries, research and evaluation, and for the continuing education of health care providers, all in the interests of advancing the health of individuals and their communities.”

WHO has further recognised four essential features which are intrinsic to the practice of ‘telemedicine’ – (i) Providing clinical support; (ii) Overcoming geographical barriers; (iii) Use of various types of information &amp; communications technology; and (iv) Improvement of health outcomes.

Chapter 1 of the said Guidelines provide for the Scope and Application thereof. It provides that the Guidelines are meant for Registered Medical Practitioners (RMP) only, those who are enrolled in the State Medical Register or the Indian Medical Register. Further, RMPs can provide online consultation to and from any part of India adhering to the applicable rules and regulations. RMPs are free to use any information or communication technology such as telephones, messages, WhatsApp, Facebook messenger etc.

The RMPs may ask for any information (Such as complaints, symptoms etc.) from the patients, and the latter will be responsible for the accuracy of such information. The RMP has the responsibility to realise when the disease or condition is not adequately addressable through online consultation. Guideline 3.7.2, makes it incumbent on the RMPs to keep all records of the online consultation including reports, documents, prescriptions etc.&nbsp;

The Board of Governors, which superseded the Medical Council of India by virtue of Section 3A of the Indian Medical Council Act, 1956, has the authority to make regulations under Section 33 thereof. The Guidelines were brought about as an amendment to the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.

The amendment added Regulation 3.8 to the aforesaid regulations, which stated that the Guidelines shall be included in the Appendix 5 of the aforesaid Regulations, thereby giving them statutory force.&nbsp;

The Draft Indian Medical Council (Professional Conduct, Etiquette and Ethics) (Amendment) Regulations, 2020 along with the Guidelines were placed for approval before the MoHFW on the 24 April 2020, and the approval was accorded to these amendments on 25 March 2020.

Thereafter, in view of the urgency, the Guidelines were published on the website of the Medical Council of India for use by the role players. The Guidelines were subsequently also published in the Gazette of India on 12 May 2020 and were made effective from 25 March 2020.

Interestingly, the framework of governance of the medical education and medical practice field was again revised by virtue of the National Medical Commission, Act 2019, which has come into effect from 25.09.2020. Therefore, the Indian Medical Council Act, 1956 stood repealed and the Board of Governors was replaced by the National Medical Commission.&nbsp;

There is no specific savings clause in the Indian Medical Council Act 1956, therefore the effect of its repeal would be governed by Section 60(2) of the National Medical Commission Act, 2019, derived from Section 6 of the General Clauses Act, 1897.

Since there is no specific mention of the effect of the new Act of 2019 on the Guidelines, they shall continue to govern the field of telemedicine under the erstwhile Act of 1956.&nbsp;

Additionally, the Act of 2019 also specifically provides for a transitory provision under Section 61 (2), the purport of which would mean that until the National Medical Commission amends or issues new Guidelines, the extant Guidelines, in effect from 25.03.2020, shall continue to have effect.

Since the Guidelines are included in Appendix 5 of the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002 and were brought about as an amendment to the said regulations, their existence is protected under the transitory provisions of the Act of 2019. Section 61 (2) of the Act of 2019 states that the rules and regulations framed under the Act of 1956 shall continue to be in force and operate, till new rules and regulations are issued by the National Medical Commission.&nbsp;

In view of the above, it is abundantly clear that the Guidelines have statutory force and are binding on the RMPs. Notably, since the Guidelines themselves provide for strict adherence of the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002 and any violation thereof, would constitute ‘Misconduct’ under the regulations.

This implies that if online consultation patients have a grievance against the conduct of an RMP, they can initiate disciplinary proceedings against them at the State Medical Council, and if found guilty of misconduct or negligence, they will be punished under the said regulations. Additionally, the protection of data needs to be given prime importance and as per the Information Technology Act (in view of the sensitive personal data involved).

Police reforms: DGPs must have at least six months left in tenure on the appointment, says Supreme Court

The centre appointed 34 judges to six high courts on Saturday, according to media reports.

28 judges were appointed in Allahabad high court, in which 15 were lawyers and 13 judicial officers.

Allahabad HC had only 89 judges and with additional 28 the number goes to 117.

Two lawyers were appointed as judges in Gauhati high court, one of whom became the fist from a tribal community of Arunachal.

One judge was appointed to each high courts of Meghalaya, Delhi, Orissa and Madras.

Other high courts with vacancies are Telangana and Arunachal Pradesh HC, Delhi HC and Calcutta HC.

In 2017, the centre had processed the SC collegium's recommendations and appointed 117 as high court judges.

Over 43 lakh cases are pending in India.

Allahabad HC had only 89 judges and with additional 28 the number goes to 117. Two lawyers were appointed as judges in Gauhati high court, one of whom became the fist from a tribal community of Arunachal. One judge was appointed to each high courts of Meghalaya, Delhi, Orissa and Madras. Other high courts with vacancies are Telangana and Arunachal Pradesh HC, Delhi HC and Calcutta HC. In 2017, the centre had processed the SC collegium's recommendations and appointed 117 as high court judges. Over 43 lakh cases are pending in India.

ANI reported that the cases were registered against allegations of irregularities in the selection and appointment of teaching faculty at the NDA.&nbsp;

Cases were registered against a professor of political science, assistant professors of chemistry and mathematics, and the HOD of the chemistry department.&nbsp;

ANI reported that the CBI is conducting raids on the premises of the National Defence Academy, including the offices and homes of the accused.&nbsp;

CBI conducts raids on National Defence Academy

The Central government has cleared the file of Senior Advocate Indu Malhotra for elevation as Supreme Court judge.&nbsp;

The official notification regarding the same will be published soon.

She is likely to take an oath as a judge on Friday this week.

Indu Malhotra was one of the two names recommended by the Supreme Court Collegium for appointment as Supreme Court judge.&nbsp;

The other name recommended was that of Justice KM Joseph, the current Chief Justice of Uttarakhand High Court.

Malhotra, who was designated as a senior advocate in 2007, would be the first woman lawyer to be directly appointed as a judge of the top court, instead of being elevated from a high court.

She will be the seventh woman judge since independence to make it to the Supreme Court. At present, Justice R Banumathi is the lone woman judge in the apex court.

The first woman to be appointed as a judge of the apex court was Justice M Fathima Beevi in 1989.

Thereafter, Justice Sujata V Manohar, Justice Ruma Pal, Justice Gyan Sudha Misra and Justice Ranjana Prakash Desai made it to the top court as judges.
