<p>The conservative-dominated Supreme Court on Friday overturned its monumental decision in Roe v. Wade, putting an end to the federal right to abortions it established nearly 50 years ago.&nbsp;</p>

<p>The seismic ruling immediately triggered a wave of right-leaning states to impose new bans on the procedure with Missouri being the first.&nbsp;</p>

<p>Less than two hours after the court's decision, the state's attorney general Eric Schmitt tweeted a photo of himself signing off on the prohibition, calling the occasion "a monumental day for the sanctity of life".</p>

<p>The swift ban forced the Planned Parenthood clinic on St. Louis’ Forest Park Avenue which had been the last facility providing abortions in the state to immediately stop offering the procedure.</p>

<p>"Today, for me, it's tragic because we fought so hard to get this law passed in 1973," said Lukehart, who was accompanied by her granddaughter Audrey at the protest outside the Planned Parenthood clinic.&nbsp;</p>

<p>"Now 50 years later, they have jerked this away from us. This is wrong. It's totally wrong," she said.</p>

<p><strong>'We cannot stand by'</strong></p>

<p>While Midwestern, conservative Missouri was the first state to ban abortions after the ruling, it was not the last.</p>

<p>As of Friday evening, at least six other states had imposed bans: Alabama, Arkansas, Kentucky, Louisiana, Oklahoma, and South Dakota.&nbsp;</p>

<p>Indiana also announced it would take steps to do the same, and abortion providers in Wisconsin said the procedure was now banned there as well.</p>

<p>Hundreds of protesters took to the streets in St. Louis following the ban, chanting "My body, my choice," and carrying signs bearing slogans like "Abortion is Healthcare."</p>

<p>Addressing the crowd through a megaphone, one speaker said: "We cannot stand by while our rights are taken away from us."</p>

<p>Back at the Planned Parenthood clinic, protester Alec Ryan, 31, said the new bans on abortion would have tangible consequences.</p>

<p>"So there are going to be women and pregnant people who are trapped in abusive marriages because they can't get an abortion. There are going to be people who are put in situations that they shouldn't be put into," he told AFP.&nbsp;</p>

<p>Linda Locke, who sits on the Planned Parenthood's board in St Louis, worried about the impact of Friday's decision on younger generations.</p>

<p>"I have granddaughters, right?" she said. "And they all grew up thinking their body was under their control. And today, it's just shocking to me and disappointing that the Supreme Court just told them that, 'No, you don't.&nbsp;We don't trust you to make decisions about your own body.''</p>

Roe vs Wade ruling (1973) enshrined women's right to abortion. US Supreme Court has now said that individual states can now permit or restrict procedure themselves. The ruling is likely to open a Pandora's Box and draw strong political reactions welcoming and condemning the latest decision of the US Supreme Court. It is anticipated that the ruling would be followed by flood of state legislations. It is expected that half of 50 US states would make new laws severely restricting or even criminalising abortions.</p>

<p>"The Constitution does not confer a right to abortion; Roe and Casey are overruled; and the authority to regulate abortion is returned to the people and their elected representatives," the court said. Currently, the US Supreme Court is dominated by judges with a conservative view.</p>

<p>In the majority opinion, Justice Samuel Alito said "abortion presents a profound moral issue on which Americans hold sharply conflicting views.</p>

<p>"The Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion," he said.&nbsp;</p>

<p>Dissenting were the three liberals on the court.</p>

<p>Soon after the decision, former US vice president Mike Pence said that Roe vs Wade was consigned to 'ash heap of history'.</p>

<p><strong>What does Roe vs Wade overturn mean?</strong></p>

<p>Overturning Roe vs Wade means that access to abortion no longer has constitutional backing in the US. Individual states are now free to decide whether access to abortion should be free or should there be restrictions on it. States now have sanction to form new laws which may even criminalise abortion.</p>

<p><strong>What do backers of abortion rights say?</strong></p>

<p>They say that abortion right is a matter of personal freedom. The activists have been saying that banning or restricting abortions was against the rights of women who have right over their own bodies and should have free choice to decide whether they want to continue with the pregnancy or not</p>

<p><strong>What do those in opposition say?</strong></p>

<p>There are strong backers of the assertion that abortion amounts to 'killing' the unborn child. Abortion for them is hence an act against nature. There are also religious overtones to this assertion and those opposing abortion are often seen to have conservative views.&nbsp;</p>

<p>Many of 'pro-life' advocates are however silent when asked whether they are opposed to abortions even when pregnancy is cause due to crimes such as rape.</p>

<p>Andrea Prudente, 38, was on holiday with her partner, Jay Weeldreyer, 45, on Gozo island on June 12 when she began bleeding heavily in the night. Last week, the doctors told her that the pregnancy was no longer viable.&nbsp;</p>

<p>Since the baby's heart was beating, Andrea was not given the choice of abortion.</p>

<p>Since then, Andrea and her husband Jay Weeldreyer had been seeking a medical transfer from Malta to the UK, which the couple say is their only option due to the risk to her life.</p>

<p>They alleged that the medical staff were uncooperative in their attempts to leave and in sharing medical records with the couple’s insurance company.</p>

<p>The rise comes as the U.S. Supreme Court is set to rule this month in a case widely expected to end or severely curtail the right to the procedure, as indicated by a leaked draft of the court's opinion.</p>

<p>The increase means that the impact of overturning the court's decision in the 1973 Roe v. Wade case, which legalized abortion at the federal level in the United States, would be bigger than anticipated, said researcher Rachel Jones, co-author of the study.</p>

<p>"In the 20-something years I’ve been doing research on abortion at Guttmacher, this is the first time we’ve had an increase in abortion over two years," Jones said in an interview.</p>

<p>In 2020, the report shows, there were 930,160 abortions in the United States, up from 862,320 in 2017. Slightly more than one in five pregnancies - or 20.6% - ended in abortion in 2020, up from 18.4% in 2017.</p>

<p>The changes varied by state. Mississippi, for example, had a 40% increase in the number of abortions performed, while Oklahoma showed a jump of 103% during the three-year period.</p>

<p>By comparison, abortions in Missouri dropped by 96%, from 4,710 in 2017 to 170 in 2020, as all but one provider left the state. Neighbouring Illinois showed a 25% increase in abortions, indicating that women from Missouri may have sought abortions there.</p>

<p>It was not immediately clear what drove the increase in abortions. One factor may have been an expansion of coverage in many states under the Medicaid program, which provides health care for poor and low-income Americans, the report said.</p>

<p>Another possibility is that some women lost access to contraceptive care under restrictions in public programs during Republican Donald Trump's presidency, which may have led to more unintended pregnancies, the report said.</p>

<p>In Texas, conservative lawmakers deemed abortion a non-essential service during the height of the pandemic, leading to a slight drop in 2020 over the prior year. Over the three years, however, abortions in Texas increased by 5%.</p>

<p>In 2021, Texas enacted a law banning abortion after fetal cardiac activity can be detected, generally about six weeks after the woman's last menstrual period. The law has led many women to seek abortion in other states.</p>

United States: Abortions increased by 8 per cent from 2017 to 2020, reversing three-decade downward trend

<p>For 40 years, gynecologist Michele Mariano has been the only person performing abortions in Italy's conservative Molise region.&nbsp;</p>

<p>He has delayed retiring twice because no one will replace him, many refusing to terminate pregnancies as conscientious objectors.&nbsp;</p>

<p>It's an extreme example, but emblematic of a wider issue in Italy, where abortion up to 90 days after conception has been legal since 1978 -- but many healthcare providers don't offer them.&nbsp;</p>

<p>A majority of gynecologists refuse on conscientious objection grounds, driven either by religion or societal pressure, while recent moves by right-wing politicians with links to the Church have only increased obstacles for women. &nbsp;</p>

<p>As a result, dozens of hospitals and clinics across the country provide no abortion services at all.&nbsp;</p>

<p>Finding doctors to perform them can be a minefield, since there are no official lists disclosing those who do, while services vary wildly across the country.</p>

<p>"Someone goes to the hospital not knowing whether the doctor in front of them will do it," said Eleonora Mizzoni, 32, an abortion activist in Pisa.</p>

<p><strong>Something wrong</strong></p>

<p>Some 67 per cent of gynaecologists across Italy in cities and rural areas alike are conscientious objectors, according to the latest health ministry figures from 2019.&nbsp;</p>

<p>That figure exceeds 80 per cent in five of Italy's 20 regions.&nbsp;</p>

<p>Martina Patone, 35, described how she called about 10 hospitals in Rome and other cities to get an abortion eight years ago before a charity helped her out.</p>

<p>She had sought a medical abortion -- which involves taking pills -- but in the end had to undergo surgery.</p>

<p>Patone recalled having to explain to a nurse how the abortion pills worked, and before getting help from the charity having to lining up at 6:00 am in a "rusty staircase" of a Rome hospital basement to be put on a long waiting list.</p>

<p>"I really thought that going to the hospital would be easy. Not at all," she told AFP.</p>

<p>Besides the red tape, the process makes women feel as if "you did something wrong, you shouldn't say anything", she said.</p>

<p>She called it "absurd" that women continue to have the same problems exercising their right to abortion.&nbsp;</p>

<p>Data published in May by the Luca Coscioni Association, which advocates for abortion rights, found that in at least 31 hospitals, all doctors or health workers who would assist in an abortion were objectors.</p>

<p>To help avoid such roadblocks, Mizzoni's group "Obiezione Respinta" (Objection Overruled) created an interactive online map where women can warn others where they will be turned away.</p>

<p>One woman on the site described waiting hours outside an operating room in Caserta, north of Naples, only for the hospital's gynaecologist to dismiss her saying, "I'm an objector, see you later".</p>

<p>Another in the Tuscan city of Pistoia recalled how the gynaecologist wrote her a prescription for a fertility drug, instead of the requested day-after pill.&nbsp;</p>

<p>A woman in the Umbrian town of Foligno said she was refused follow-up care after an abortion -- administered by the hospital's sole non-objector -- despite suffering from pain and fever.&nbsp;</p>

<p>The law stipulates that objectors cannot refuse medical care before and after abortion, but that is not always respected.</p>

<p>A 32-year-old Sicilian, Valentina Milluzzo, died of sepsis in 2016 in the fifth month of pregnancy when doctors refused to intervene when one twin died inside her womb but another was still alive.</p>

<p><strong>Obstacle course</strong></p>

<p>Italy is an outlier in western Europe, where the trend in recent decades has been to remove barriers to abortion, said Leah Hoctor, the Center for Reproductive Health's European director.</p>

<p>"Patients are going through a quagmire, an obstacle course, barrier after barrier because of these widespread refusals of care and the complete abdication of the state... this is unacceptable," she told AFP.</p>

<p>The Council of Europe has twice censured Italy over inadequate access to abortion, with little consequence.&nbsp;</p>

<p>Conscientious objectors say faith drives their refusal to perform abortions. The Catholic Church is uncompromising on the issue, with Pope Francis calling it "murder".</p>

<p>"You can't force a doctor to kill," said Lorena, a 60-year-old mother of 12 at an anti-abortion rally in Rome last month, declining to give her last name.&nbsp;</p>

<p>The Italian Association of Catholic Obstetricians and Gynaecologists says its mission is "to counter the culture of death" and promote respect for life following "Christian principles".</p>

A leaked draft of the US Supreme Court has suggested that majority of the judges are of the opinion that the historic Roe v Wade judgment be overtured. If this happens, laws on access to abortion to women in US will may potentially be re-written. Overturning Roe vs Wade thus has opponents in the US.</p>

<p>With all this debate going on in the US. What about India? Is abortion legal in India?</p>

<p>Short answer is yes, it is legal. Women can seek abortion before 24 weeks of pregnancy are complete</p>

<p>Medical Termination of Pregnancy Act (1971) makes abortion legal. The law defines conditions, period and rule surrounding abortion. The act makes abortion legal in specific conditions</p>

<p>According to India's Ministry of Health and Family Welfare, The Medical Termination of Pregnancy Act (1971) was passed to “provide for the termination of certain pregnancies by registered Medical Practitioners and for matters connected therewith or incidental thereto”</p>

<p>The conditions under which abortion is allowed are enlisted in the MTP act.</p>

<p>Pregnancy can be terminated upon opinion of 1 doctor before 20 weeks are complete. If pregnancy is to be aborted before 24 weeks, it needs opinion of two doctors</p>

<p>A woman can abort the pregnancy if there is major threat to her life due to childbirth. A woman can also abort the pregnancy if it is found the child will be born with significance physical or mental disabilities.</p>

<p>Under the MTP act, identity of the woman undergoing abortion procedure must be kept confidential.&nbsp;</p>

<p>The gestation period of 20 weeks can be extended to 24 weeks under these conditions:</p>

<ul>
	<li>Survivors of sexual assault or rape or incest</li>
	<li>Minors</li>
	<li>Change of marital status during the pregnancy (widowhood and divorce)</li>
	<li>Women with physical disabilities</li>
	<li>Mentally ill women</li>
	<li>Women pregnant with a child that has fetal abnormalities that can have a substantial risk of being incompatible with life</li>
	<li>Women with pregnancy in humanitarian settings or disaster or emergency</li>
</ul>
