Kerala floods: India not accepting foreign aid, Thai envoy confirms in tweet

Aam Aadmi Party leader Ashish Khetan has quit the party, AAP sources said on Wednesday, a week after another leader, Ashutosh, announced his resignation.

Khetan, who did not deny the resignation, said he was not involved in "active politics at the moment" and was not interested in rumours.

According to sources in the party, Khetan had sent his resignation to AAP chief Arvind Kejriwal on August 15.

It was the day Ashutosh had announced his resignation from the party.

Both resignations are yet to be accepted by Kejriwal, party insiders said.

"I had resigned from DDC in April, to join the legal profession. That is all. Not interested in rumours," Khaitan tweeted, referring to the Delhi Dialogue and Development Commission, an advisory body of the Delhi government.

"I am completely focused on my legal practice and not involved in active politics at the moment. Rest is all extrapolation," he said in another tweet.

Khetan had resigned as DDC vice chairman citing "frustration" due to the tussle between the Centre and the AAP-led government.

AAP sources claimed Khetan wanted to contest the 2019 Lok Sabha elections from the New Delhi parliamentary seat that he had lost to BJP's Meenakshi Lekhi in 2014. But his demand was not being accepted by the leadership and he had been upset for a while.

Chinese Defense Minister Wei Fenghe commended relations with India, depicting them amid a gathering with Prime Minister Narendra Modi as a kinship going back to antiquated occasions, as relations between the two nations warm further.

Chinese President Xi Jinping and Modi concurred in April to open another chapter in ties, months after a disagreement about a stretch of their high-height Himalayan outskirt revived feelings of dread of war.

Wei told Modi that China and India had a long-standing friendship, China’s Defence Ministry said in a statement late on Tuesday.

He said Modi’s trip would deepen security exchanges, strengthen mutual trust, help protect peace on their border and make a positive contribution towards developing their partnership, the ministry said.

Wei is also scheduled to meet Indian Defence Minister Nirmala Sitharaman, where they will further discuss the border, the statement said.

Hundreds of troops from both sides were deployed in 2017 on the Doklam plateau, near the borders of India, its ally Bhutan, and China after India objected to Chinese construction of a road in the Himalayan area in their most serious standoff in years.

There is still deep mistrust between the two giant neighbours over their festering border dispute, which triggered a brief war in 1962.

Meanwhile, Prime Minister Narendra Modi on Tuesday said India and China are handling their differences with “sensitivity and maturity” by not allowing them to become disputes and this was evident from peace in border areas.

Modi also termed India-China relations as a factor of stability in the world and appreciated the increased momentum of high-level contacts between the two countries across all spheres, including in areas of defence and military exchanges.

Defence Minister Nirmala Sitharaman and her Chinese counterpart Wei Fenghe will hold extensive talks on Thursday, focus of which will be to remove distrust and boost coordination between the armies of the two neighbours guarding their disputed border, official sources said.

Wei arrived here Tuesday on a four-day visit, nearly three-and-half months after Prime Minister Narendra Modi and Chinese President Xi Jinping agreed that strategic communication between the two armies should be enhanced to avoid Doklam-like standoffs.

The Chinese defence minister met Modi during which the PM said both the countries are handling their differences with "sensitivity and maturity" by not allowing them to become disputes.

Sources said the primary objective of Wei's visit is to deliberate with Indian defence establishment on the implementation of decisions taken by Modi and Xi during the informal summit in Wuhan in April.

In the delegation level talks, the Indian side is likely to raise the issue of the presence of a sizeable number of Chinese troops in North Doklam.

Doklam, in the Sikkim sector, is a strategically important area which is claimed by Bhutan. India has been acting as security guarantor to the tiny country in the sensitive region.

The two sides are likely to deliberate on a mechanism under which troops from both sides will inform each other before carrying out any patrolling on the disputed areas along the nearly 4,000-km border.

The sources said both sides will also attempt to resolve differences in setting up of a hotline between the armies of the two countries.

After the Wuhan summit, both sides revived the long-pending proposal to set up the hotline so as to avoid flare-ups along the disputed border. But, the initiative hit roadblocks over differences on issues relating to protocol and technical aspect of the hotline.

The Indian Army has been maintaining that the hotline should be between its Director General of Military Operations (DGMOs) and his equivalent official in Peoples Liberation Army (PLA). However, Beijing proposed that the deputy commander of its Chengdu-based Western Theatre Command would engage with the Indian DGMO.

The Indian Army is opposed to the Chinese proposal, insisting that an officer equivalent to Indian DGMO at PLA's headquarters should be deputed for the communication through the hotline.

Currently, India and Pakistan have a hotline between their DGMOs.The hotline between India and China was first mooted by the two countries in 2013.

India, China to explore ways to avoid Doklam-like standoffs

Prime Minister Narendra Modi today said India and China are handling their differences with “sensitivity and maturity” by not allowing them to become disputes and this was evident from peace in border areas.

Modi also termed India-China relations as a factor of stability in the world and appreciated the increased momentum of high-level contacts between the two countries across all spheres, including in areas of defence and military exchanges.

He made these remarks when State Councillor and Defence Minister of China General Wei Fenghe called on him here on Tuesday, according to a statement from the Prime Minister’s Office. “Terming India-China relations as a factor of stability in the world, the prime minister said that maintenance of peace and tranquillity in the border areas is indicative of the sensitivity and maturity with which India and China handle their differences, not allowing them to become disputes,” the PMO said.

Prime Minister Modi also warmly recalled his recent meetings with President Xi Jinping in Wuhan, Qingdao and Johannesburg. The Chinese defence minister’s four-day visit to India, beginning today, is being seen as a significant development by officials on both sides to improve communications and atmospherics between militaries of the two countries after last year’s 73-day Doklam standoff.

According to official sources here, the primary objective of Wei’s visit is to deliberate with Indian defence establishment on the implementation of decisions taken by Modi and Xi in their informal summit in Wuhan in April, including for improving mutual trust and avoid a repeat of any Doklam-like face-offs.

In the summit, Modi and Xi had resolved to open a new chapter in ties and had directed their militaries to boost coordination along the border, months after the most serious military faceoff in decades between the two nuclear-armed neighbours in Doklam triggered fears of a war. Wei, who is a key member in China’s State Council — the executive organ of China’s central government — is scheduled to hold restricted as well as delegation-level talks with Sitharaman tomorrow.

The National Aeronautics and Space Administration (NASA) has released a video that shows the rain activity over India in the past week and highlights the floods in Kerala and Karnataka.

The video takes into account the satellite image data and shows an estimate of the average rainfall across India.

It depicts the state of Kerala highlighted and subsequently going red, indicating severe rainfall and flooding in the region. The video goes on to show the monsoon activity over other parts of the country.

According to NASA, the rainfall accumulations from August 13 to 20 showed two bands of heavy rain across India.

The first band, associated with the general monsoon circulation, appeared much broader and extends across the northern part of the peninsula with weekly rainfall totals ranging from over 5 inches towards the western half of the peninsula to as much as 14 inches over parts of the eastern half towards the Bay of Bengal.

The second band appeared more concentrated and intense, closely aligned with the southwest coast of India and the Western Ghats where onshore flow was enhanced by an area of low pressure embedded within the general monsoon.

NASA attributed the heavy rains along the southwest coast of India to the Western Ghats.

NASA stated that the range is well positioned to enhance the rainfall along the West Coast of India as they intercept the moisture-laden air that is drawn from the warm waters of the northern Indian Ocean and the Arabian Sea as part of the southwest monsoon circulation.

NASA used the Integrated Multi-satellitE Retrievals for GPM (IMERG) to create the video. The technology is usually used to estimate precipitation and the data is generated every half an hour.

The technology enables scientists to track rainfall across the globe almost in real time.

Facing allegations of getting undue benefits from the multi-billion dollar Rafale deal, Anil Ambani-led Reliance Group has sent legal notices to several Congress leaders asking them to "cease and desist" from levelling such charges, which was promptly dubbed by the party as evidence of a "nexus between the BJP and the corporate world".

The Congress leaders said they will not be scared or silenced by such notices, which have been sent to several spokespersons and other leaders of the party.

The notices have been served amid a month-long offensive planned by the Congress on the Rafale deal under which top party leaders will be holding press conferences and demonstrations across the country targeting Prime Minister Narendra Modi and his government.

Reliance Group has denied the allegations relating to the deal under which France's Dassault is supplying the fighter jets and has entered into a joint venture with Anil Ambani-led group firm to meet its offset requirement of the contract.

Ambani recently wrote to Congress president Rahul Gandhi on the deal saying his party has been "misinformed, misdirected and misled" by "malicious vested interests and corporate rivals" on the issue.

Gandhi has been attacking the government for allegedly inking the deal at a much higher price than the one the previous UPA regime had negotiated to benefit "one businessman".

Speaking to reporters in Chandigarh, Congress MP Sunil Jakhar said he has received the notice asking him to refrain from "making allegations" on the Rafale deal.

Jakhar, however, asserted that the Rafale matter was a serious national security issue for his party and alleged the legal notice was the result of a "nexus between the BJP and the corporate world".

The Punjab Congress chief and Lok Sabha member, who had raised the issue in Parliament as well, said, "I reiterate, my aeroplane making skills (as demonstrated in Lok Sabha) are better than yours", as he tweeted a picture of a paper plane made from the notice.

"It is a dark day for the democracy. An industrialist serving legal notice to an elected representative is a serious issue," Jakhar said while asserting that the Congress will continue to fight the nexus between capitalists and BJP.

The Congress leaders said the notices have been issued by Mumbai-based advocates on behalf of Reliance firms to Randeep Surjewala, Ashok Chavan, Abhishek Manu Singhvi and Sunil Jakhar among others, saying they were making "derogatory and defamatory statements in the press and electronic media in relation to the purchase of 36 Rafale fighter aircraft by India from France in a government-to-government contract."

The notices have come days before a series of press conferences lined by the Congress across the country from August 25 to September 6 on Rafale deal. The party has also planned district and state-level agitations starting September 7.

The cautionary 'cease and desist' notice has been served on behalf of three group firms -- Reliance Infrastructure, Reliance Defence and Reliance Aerostructure Ltd.

"As a cautionary measure, our clients strongly urge you to avoid, cease and desist from making any unverified, speculative, incorrect, false, frivolous, misleading derogatory and defamatory statements against them on such a sensitive subject relating to national security," one Congress leader quoted from the notice.

"At the same time our clients reserve the right to take recourse to all remedies available to them under the law of land for the protection of their name, brand, reputation and goodwill in case of any scurrilous statements being made against them," the notice further said.

Asked about the notice, Congress spokesperson Shaktising Gohil said at an AICC briefing that he has received two such notices.&nbsp

He said one was received earlier and another one was received yesterday, which claim he has caused loss to the company to the extent of Rs 50,000 crore.

"I had received a notice earlier and had sent a reply saying whatever has been stated is on the basis of documents in public domain. The notices show that the prime minister is worried and is now getting back at the Congress by serving such notices," he said.

Gohil said Congress leaders are placing on record information already in public domain and are speaking out in the national interest against alleged corruption in the deal.

"We want to assure all industrialists that we are not against those who are doing business honestly. We are with them. We will not be cowed down by anyone and neither fear from anyone and will continue to highlight the corruption in the Rafale deal," he told reporters.

Congress spokesperson Priyanka Chaturvedi said she has been served a notice too.

"The promptness that they have shown to send these notices is similar to their eagerness to manufacture defence aircrafts as soon as they formed a company and Modi government obliged. But will not be subdued and silenced till we don't get our answers on the scam," she said.

Another Congress leader Jaiveer Shergill said he has received the notice too, threatening him with legal consequences if he speaks on Rafale deal.

"My reply - I am a Congress soldier, a proud Punjabi who does not get scared with such notices - taxpayer of this country deserves to know why they paid extra Rs 42000 crore. The fact that Anil Ambani sent us a notice exposes that there is something fishy in the Rafale deal," he said.

The government is unlikely to accept any foreign financial assistance for flood relief operations in Kerala, official sources said.

Chief Justice of India Dipak Misra's tenure will perhaps go down as the most controversial in the history of India's Supreme court. Misra was sworn in as the 45th CJI on August 29, 2017.

He retires on October 2, giving him a tenure of a little over a year. In that one year, he heard a number of important cases, many of which made international headlines.

Here is a list of important judgements awaited before Misra steps down:

The constitutional validity of Aadhaar: Several petitioners moved the apex court asking it to examine the constitutional validity of the government's Aadhaar scheme and the Centre's decision to make Aadhaar mandatory for the availing of various services and government welfare. Last year, a nine-judge Constitution bench had held that the Right to Privacy was a Fundamental Right under the Constitution. Several petitioners challenging the validity of Aadhaar had raised the issue that the scheme violated privacy rights.

Judgement reserved on: May 10, 2018.

The decriminalisation of homosexuality, Section 377: Petitions had challenged the constitutional validity of Section 377, which says homosexuality is a crime, and had asked for the striking down of the section .

Section 377 refers to "unnatural offences" and says "whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, will get life imprisonment, or with imprisonment of either description for a term which may extend to 10 years, and shall also be liable to pay a fine."

The archaic law dates back to 1861, and the ambit extends to any sexual union involving penile insertion.

Judgment reserved: July 17, 2018.

The adultery law, section 497: The apex court had been hearing a clutch of pleas seeking quashing of the adultery provision in the IPC on the ground that it only punishes married men for having extramarital sexual relations with a married woman.

Section 497 of the 158-year-old IPC says: "Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery. He shall be punished with imprisonment of either description for a term which may extend to five years, or with fine or with both. In such case the wife shall not be punishable as an abettor."

Judgement reserved: August 8, 2018.

Ban on entry of women into Sabarimala temple: A bunch of pleas have challenged the ban on entry of women in the age group of 10-50 into the Sabarimala temple in the state of Kerala.

The apex court had on October 13 last year referred the issue to a Constitution bench after framing five "significant" questions including whether the practice of banning the entry of women into the temple amounted to discrimination and violated their fundamental rights under the Constitution.

The Kerala government, which has been changing its stand on the contentious issue, had on July 18 told the Supreme Court that it now favours their entry.

Judgment reserved: August 1, 2018.

It is expected that CJI Dipak Misra will be remembered, by litigants and citizens, for both the right and the wrong reasons. From the opposition demanding his impeachment to petitioners seeking his recusal from cases that accused him of being involved in cases of bribery — CJI Misra has seen it all.

Lest we forget, there was the unprecedented press conference by the four seniormost judges of the supreme court telling the CJI that he was master of the roster but also only first among equals.

Apart from constitution bench cases, other important cases like Hadiya's marriage to Shafin Jahan article 370 that gives special status to the state of Jammu and Kashmir and multiple cases of women moving court asking that they be allowed to abort their foetuses — all made headlines from court number 1 of the Indian Supreme Court.

Many of the judgements Misra was involved in — "no one can judge the judges", "collegium decisions will be made public", and "how can the supreme court intervene in the marriage of two consenting adults?" — will be seen as both progressive and contentious at the same time.

The current India partner, Anil Ambani's Reliance Defence Ltd, has absolutely no experience in the aerospace industry. Reliance Defence replaced the public sector HAL as Dassault's India partner only a few days after it was incorporated.

Rafale deal: Anil Ambani's Reliance Defence tells Congress to behave responsibly

As the operations to rescue those stranded in rain-ravaged areas in Kerala near completion, a political war erupted on Wednesday with Congress-led UDF Opposition and BJP blaming the state government for a "man-made disaster".

Training its guns on the Left-led state government, Leader of Opposition in Kerala Assembly Ramesh Chennithala demanded a judicial probe into the circumstances that led to opening of shutters of 40-odd dams at a time in the state.

"The government had no idea which areas would be submerged when nine dams across the Pamba river, 11 dams in the Periyar in Idukki and Ernakulam districts and six across Chalakudy river in Thrissur were opened," he said.

Though there was an increase of 41.44 per cent rainfall this time, the flood situation worsened not because of the downpour, but due to the opening of shutters of 44 dams at a time without giving prior warning, the Congress leader alleged.&nbsp

"It was a man-made disaster," Chennithala said.

Bhartiya Janata Party (BJP) state president P S Sreedharan Pillai also blamed the Pinarayi Vijayan government for the deluge and said there was "lack of foresight" on part of the state.

However, Kerala State Electricity Board (KSEB) chairman K P Sreedharan Nair denied the allegations, saying there was no lapse on part of the board which owns the dams and that they were opened only after enough alerts were issued.

There is no point in blaming the board for opening the dams as most of the rivers were overflowing due to heavy rains, he said.

Terming the charges as "baseless," Dam Safety Chairman C N Ramachandran Nair said, "Everyone knows water was rising in the reservoirs and rivers were in spate. Now the allegations are being levelled only for the sake of blaming somebody".&nbsp

Amrita Singh, Chairperson, Special Centre for Disaster Research and Jawaharlal Nehru University (JNU) professor, attacked the state government and said the flood was not caused merely due to excess rain.
"This was caused by human blunder. The Kerala government could have prevented it, but did not have the foresight to do so," she said in a Facebook post.

Even as the controversy played out, Kerala turned its attention to cleaning of houses and public places which were damaged in the unprecedented rains that lashed the state.

As people left camps, many found mud and slush up to six feet level in front of their houses and interiors.

Fridges, television sets and other electronic equipment were all lying upside down in the turbid waters.&nbsp

Many children lost their books and certificates. Many people lost their Aadhaar and ration cards.&nbsp

"We will have to start afresh. Right from the beginning," a woman lamented.

Political war erupts in Kerala as rescue operations draw to a close

The Maharashtra government has decided to demolish over hundred illegal bungalows including that of fugitive diamantaire and Punjab National Bank scam accused, Nirav Modi and his uncle Mehul Choksi, owing to illegal construction.

The information was announced by Maharashtra Environment Minister Ramdas Kadam in Mumbai on Tuesday.

The government will demolish about 121 bungalows in Alibaug and 151 bungalows in Murud mostly owned by industrialists and businessmen.

The minister said, "There are 121 bungalows in Alibaug and 151 bungalows in Murud that are illegal and mostly owned by industrialists and businessmen. Some locals also have illegal bungalows, there are 60 of them in Alibaug and 50 more in Murud".

Nirav Modi and Mehul Choksi's bungalows which will be demolished is located in Raigad.

The minister also said that the Maharashtra government would take strict action against the illegal bungalows and that he has instructed the district collector of Raigad to immediately demolish the bungalows belonging to Nirav Modi and Mehul Choksi.

"The (state) government will take action against all these bungalows. Nirav Modi and Mehul Choksi's bungalows are also there. There are a few more big names on the list and action will be taken against them too. No relief would be given to those owning these illegal bungalows", he said.

The multi-crore scam was detected by the officials of the Punjab National Bank (PNB) earlier this year, after Nirav Modi and Mehul Choksi had allegedly cheated the bank to the tune of two billion dollars, with the purported involvement of a few employees of the bank.

On Monday, the United Kingdom authorities confirmed that Nirav Modi is present in their country, the Central Bureau of Investigation (CBI) said.

Earlier on July 2, a Red Corner Notice was issued by the Interpol against the fugitive diamond trader in connection with the scam.

On the other hand, Choksi reportedly took refuge in Antigua and Barbuda in July. After the scam was unearthed, Choksi`s passport was also revoked by the Ministry of External Affairs (MEA) in February.
