Historian Ramachandra Guha detained by Bengaluru police for protesting against CAA

The protests over scrapping of Citizenship Amendment Act is gaining momentum in many parts of India, in view of which the administration of the concerned states and districts has imposed section 144 to curb any violent activity. #CAA #India #Delhi #CAAprotest

Section 144 imposed in Karnataka, Uttar Pradesh and parts of Delhi

Protesters remained undeterred by the imposition of Prohibitory Orders in the city of Bengaluru as they took to the streets from Thursday morning to demonstrate against the contentious Citizenship Amendment Act.

Despite the imposition of Section 144 in the city, that prevents the gathering of groups of more than 4 members in public places, protesters gathered with placards and roses for what they called a peaceful demonstration. Several agitators were detained, including noted historian Ramachandra Guha.

"The government is giving these orders to arrest protesters. We are protesting peacefully against this discriminatory Act passed by the Central Government. But look at what is happening. Do you see any violence here? Why are the police behaving in such a manner?" said Guha before being taken away by the police. Several civic activists and students were also detained as police were given orders to not allow big gathering up until December 21.

Rajeev Gowda, Rajya Sabha MP has filed a PIL in the Karnataka High Court saying the petitioners have the right to protest and assemble peacefully which is protected under Article 19 (1) of the constitution.

"It is a total abuse of power. The commissioner has been badly advised. The Home Secretary should have advised him properly. Section 144 has to be imposed only when there is an incitement for violence. None of that has happened here. People are peacefully protesting. People have come here to exercise their right to protest under the Constitution and to say the Constitution matters to them. If the parliament has passed a bill without discussing with the people of India, people are upset. That's why they are out and if you go and arrest them, how are you going to call this a democracy anymore. This is declaring an emergency without calling it that," said environmentalist Leo Saldanha.

Protesters belonging to a multitude of civic organisations continued to pour into the city's Townhall to participate in the demonstrations.

Dramatic scenes were witnessed as many of the peaceful protesters were forcibly carried into police vehicles and detained at different stations.

"We came here from the National Law School of India for a silent protest. We are sitting silently across the road. Around 30 of my colleagues were loaded into a bus and taken away. I do not know where they are. One of them was manhandled. We were not doing anything," said Hamza, a student from the National Law School of India.

IIM Bangalore has decided to stage a unique agitation to circumvent Section 144 imposed by the city police. At any point in time, just three protesters will stage a demonstration outside the IIM-B gates and the protesters will rotate every few minutes.

"Section 144 allows groups of 3-4 to take turns to protest. Some of us are organizing a protest where three IIM-B members will take turns to protest. We will be at the IIM-B main gate at 6:00 pm. At any given time only three of us are going to be outside the main gate. We will be within the bounds of Section 144 and yet register our protest against the divisive CAA-NRC, the police brutality against Jamia and AMU students, and the arbitrary imposition of "144" and arrests across the country,’ read a mail circulated within the IIM-B community.

Protests erupted in Kalburgi and Mangalore districts as well despite the prohibitory orders in place. Protesters are awaiting the hearing on the PIL against the imposition of Section 144 which they believe curtails their right to peaceful demonstration and free speech.

The traffic disruption has been caused by protests in Delhi and in several cities across the country against a contentious new citizenship law that is largely seen as anti-Muslim.

"Due to traffic restrictions and to accommodate passengers reaching late to the airport, we have rescheduled and curtailed our schedule in and out of Delhi by approximately 20 departures," IndiGo said in a statement, adding that this accounts for about 10 per cent of its total flights out of the capital.

India leads the world in pollution-linked deaths followed by China and Nigeria, according to a report published Wednesday that estimated the global impact of contaminants in the air, water and workplace.

India leads the world in pollution-linked deaths followed by China and Nigeria, according to a report published Wednesday that estimated the global impact of contaminants in the air, water and workplace. The report by the Global Alliance on Health and Pollution (GAHP) found pollution to be the largest environmental cause of premature death on the planet, causing 15 per cent of all deaths -- some 8.3 million people. Among the ten countries with the most pollution deaths in 2017, the latest year for which data was available, were some of the world's largest and wealthiest nations, along with some poorer ones. India and China led in the number of pollution deaths, with about 2.3 million and 1.8 million deaths respectively, followed by Nigeria, Indonesia and Pakistan. The United States, with 325 million people, came in at number seven with almost 200,000 deaths. "The report reminds us all that pollution is a global crisis," said Rachael Kupka, acting Executive Director of GAHP. "It does not matter where you live. Pollution will find you." Pollution-linked deaths rates were highest in some of the world's most impoverished countries where poor water sanitation and contaminated indoor air are major killers. Chad, Central African Republic and North Korea saw the highest number of deaths per 100,000 people (287, 251 and 202 respectively), with India entering the per capita list at number 10 with 174 deaths per 100,000 people. "India has seen increasing industrial and vehicular pollution from urban growth while poor sanitation and contaminated indoor air persist in low-income communities," the report said. On the other end of the scale, five nations in the Arabian Peninsula rank among the 10 countries in the world with the lowest death rates from pollution, with Qatar reporting the lowest. Drawing its data from the Institute of Health Metrics Evaluation, which is based in Seattle and was founded by the Bill and Melinda Gates Foundation, the report broke risk factors into four categories: air, water, occupational, and lead. Air pollution represents a combination of household and outdoor contaminants as well as ozone, while water pollution included unsafe water and poor sanitation. Occupational risk encompassed deaths from carcinogens, second-hand smoke, particulates, gases, and fumes, while lead pollution deaths were those associated with exposure to legacy emissions from leaded gasoline. This refers to the lead that was deposited, and still remains, in the soil from car exhausts. The report also named ambient air pollution responsible for 40 per cent of all pollution-related deaths, led by China, India and Pakistan (1.2 million, 1.2 million and 130,000 respectively). And the number of global deaths linked to pollution just exceeded those from tobacco use, which is around 8 million, but greatly eclipsed deaths from alcohol and drugs, high sodium diets, HIV, malaria, TB, and war, it said.

Amid allegations Delhi that it forcefully entered the premises of Jamia Millia Islamia University campus during protest against the new citizenship law and harassed students, Delhi Police said that they entered the campus to identify the agitators and protect students. In an FIR lodged against the property damage during the protest on Sunday near the university, the police said that the agitators pelted stones and did not heed warnings of the personnel deputed there to bring the situation under control, reported news agency ANI. "The angry mob pelted stones at the police from inside the campus and burnt the tyres on the road in front of the university gates. They also vandalised an ambulance. The situation was not coming under control," Delhi Police said in the FIR that was filed on Monday. The FIR was filed on the basis of a complaint by Station House Officer (SHO) Upender Singh. It said that police personnel entered the university and urged agitators to get out of the campus but the agitators continued pelting stones. "The agitators were then run out of the campus by the use of minimum force on the directions of senior officers. Several police officials sustained serious injuries due to the stone pelting and scuffle. The officials were admitted to hospitals for treatment," the FIR added. Police said that the protestors also set two police booths in the area on fire and vandalized around 70-80 motorcycles. A case was registered under several sections of the Indian Penal Code (IPC) including assembly of unlawful mob, rioting, obstructing public servant in discharge of duty, assault and attempt to commit culpable homicide, etc. A protest, led by the students of Jamia Millia Islamia, against the Citizenship (Amendment) Act, 2019, had turned violent on Sunday, following which the police had to resort to lathi-charge and tear gas shelling to bring the situation under control. Andhra Pradesh Chief Minister YS Jagan Mohan Reddy has reportedly said the state may have three capitals.

Speaking at a discussion on capital, Reddy cited the example of South Africa and said that the mindset of capital being at same place should change.

"Decentralised (capital) is a good concept. South Africa has three capitals. We too should change. We may set up legislative capital here (Amaravati). We may constitute Assembly here. We may set up Executive capital at Visakhapatnam. Officials may start working from there. High court may be set up in Kurnool. Thus legislative, executive, and judicial capitals may be set up at different places. We are in a condition to think of different possibilities. Probably, Andhra Pradesh may get three capitals," Reddy was quoted as saying.

Jagan stated that setting up executive capital at Visakhapatnam needs not much expenditure.

"That city has all facilities for employees to work. One metro rail is enough. We have to think seriously. For that sake, we already have constituted a committee. That committee is studying. It may submit its report within a week or 10 days. The committee is preparing a detailed report. We have to discuss in depth on it, take a good decision, and go ahead so that future generations will be benefitted," he added.

Replying to Reddy`s statement in the state Assembly, BJP leader GVL Narasimha Rao tweeted, "Andhra Pradesh Chief Minister YS Jagan has made a statement today in the state assembly about his plans for the state capital. On 28th August, I had predicted in a Press Conference that the state government has plans for a new capital city. #Amaravati."

In a major sigh of relief, India on Wednesday granted temporary relaxation to those who have not got their Overseas Citizenship of India (OCI) cards re-issued.

According to an official notification, OCI cards holders, who are either below 20 years or above 50 years of age and have renewed their passports, can continue their travel to India till June 30.

They, however, are subjected to carry their existing OCI cards along with the new and old passports.

The move came after India citizens, who have settled abroad, complained that they were being subject to harassment by both the immigration authorities in cases pertaining to the re-issuing of the OCI cards.

In many cases, OCI cardholders had to cancel their trip to India or had to abruptly return mid-way due to the previous inconvenience.

The MEA had earlier allowed that OCI card needed to be re-issued each time a new passport was acquired by the cardholders up to the age of 20 years.

In addition, the cardholders were also required re-issued them once on acquiring a new passport after completing 50 years of age.

The OCI card was also not required to re-issue each time a passport was issued to a cardholder between 21 and 50 years of age.

In an apparent attack on Chief Minister Mamata Banerjee, West Bengal Governor Jagdeep Dhankar on Wednesday said the Citizenship Amendment Act is the law of the land and those who are on constitutional and government posts are bound by it.

"I don't care about (what) political parties do. They are free to say whatever they want. According to the Constitution, the state government is bound to follow the law. And those who are on government posts are fully bound by the law of the land. The Chief Minister took the oath to act according to the Constitution, and this law is part of the Constitution," Dhankar said at a press conference.

Banerjee, who has been at the loggerheads with Dhankar, is opposed to the Citizenship Amendment Act and has said that she will not allow the legislation to be implemented in West Bengal.

Dhankar said that the amended Citizenship Act is not against any citizen of India.

"The Citizenship Amendment Act is not against any citizen of India and it does not deprive any citizen of this country in any manner whatsoever. If any impression is being given that it affects the citizen of the country, it is erroneous and misinterpretation," he said.

"It is giving a healing touch to those who have no other place to go and India is their natural home. Citizenship Act doesn't affect the interest of any Indian citizen," Dhankar said.

The Governor expressed hope that the Chief Minister will enter into a dialogue with him.

"I have no doubt that the Honourable Chief Minister would also enter into a dialogue with me. That dialogue will be beneficial for both of us and it will be in the interest of West Bengal. And it will serve a large constitutional purpose," he said.
