The US Supreme Court has paused the bankruptcy proceedings about Purdue and its affiliates, saying that they will hold oral arguments in December in the Biden administration’s appeal of a lower court’s ruling upholding the settlement.&nbsp;

The order would possibly delay any payments to the thousands of plaintiffs who have sued the Sacklers and Purdue, the maker of the prescription painkiller OxyContin which has been widely blamed for the <a href="https://www.wionews.com/world/purdue-pharma-pleads-guilty-to-criminal-charges-for-opioid-sales-337138">opioid crisis</a> in the US.&nbsp;

The order by the SCOTUS, whose new term begins in October, comes in response to an objection filed by the Department of Justice, which said that Purdue’s plans allowed the members of the Sackler family to take advantage of legal protections meant for debtors in “financial distress,” not for billionaires like the Sacklers.

Sackler family members withdrew $11 billion from Purdue before agreeing to contribute $6 billion to its opioid settlement, said the Biden administration.&nbsp;

<h2>Purdue settlement</h2>

Purdue’s plan involves paying up to $6 billion to settle thousands of lawsuits filed by states, hospitals, people who had become addicted and others who have sued the Connecticut-based company over its misleading marketing of OxyContin in exchange for full immunity from all civil legal disputes.&nbsp;

The top court justices said they will hear arguments about whether the agreement is authorised by the US bankruptcy code. Purdue filed for Chapter 11 bankruptcy in 2019 to address its debts, nearly all of which stemmed from thousands of OxyContin-related lawsuits.&nbsp;

Purdue’s bankruptcy settlement, approved by a US bankruptcy judge in 2021, would provide around $10 billion in value to its creditors, said the company. However, the Biden administration and eight states challenged the settlement, but the states later <a href="https://www.wionews.com/world/us-states-drop-opposition-to-purdue-pharma-bankruptcy-plan-396799">dropped the opposition</a>. &nbsp;

In a statement, Purdue said it was disappointed that the US Trustee, the DOJ’s bankruptcy watchdog, filed a challenge that has “single-handedly” delayed “billions of dollars in value that should be put to use for victim compensation, opioid crisis abatement for communities across the country and overdose rescue medicines.”&nbsp;

It added that the company is confident about the legality of its “universally supported plan of reorganization” and that the SCOTUS will agree with it.&nbsp;

The plans are aimed at preventing US&nbsp;capital and expertise from helping develop technologies that could support China’s military modernisation and threaten US&nbsp;national security.

Reuters reported on Friday that President Joe Biden was expected to soon issue a the long-awaited executive order to screen outbound investments in sensitive technologies to China this week.

The senior government source said that order is expected Wednesday. The White House declined to comment on Tuesday.

Biden administration officials have stressed for months any restrictions on US&nbsp;investment in China will be narrowly targeted.

“These are tailored measures,” National Security Adviser Jake Sullivan said in April. “They are not, as Beijing says, a ‘technology blockade’.”

US&nbsp;Commerce Secretary Gina Raimondo said in March the administration did not “want to be overly broad…. Anything that’s overly broad hurts American workers and the economy.”

The administration is expected to target active investment such as US&nbsp;private equity, venture capital and joint venture investments in China in semiconductors, quantum computing and artificial intelligence.

Most investments captured by the order will require that the government be notified about them, sources have said. Some transactions will be prohibited.

The New York Times reported on Tuesday that the Biden administration plans to require firms making investments in a broader range of Chinese industries to report that activity, which will give the US&nbsp;government great visibility into financial transactions between the United States and China.

Sources previously told Reuters investments in semiconductors that will be restricted are expected to track export control rules for China issued by the US&nbsp;Department of Commerce in October.

Emily Benson, of the Centre for Strategic and International Studies (CSIS), a bipartisan policy research organisation, said she expects investments in artificial intelligence to be prohibited to military users and uses, and that other investments in the sector will only require notification to the government.

U.S. District Court Judge Tanya Chutkan set the hearing for Friday at 10 a.m. ET (1400 GMT), shortly after Trump's attorneys and members of U.S. Special Counsel Jack Smith's office had clashed in a joint court over when to schedule the proceeding.

Prosecutors had said they were available all week, while Trump's lawyers had asked for a postponement until early next week.

Trump's attorneys said limits would infringe on his right to free speech, protected by the First Amendment of the U.S. Constitution.

Trump is not expected to be present in the courtroom on Friday, after Chutkan waived his appearance.

Typically, defense lawyers do not oppose such protective orders because doing so can delay the government from producing the evidence it intends to use at trial in a process known as discovery.

The disagreement between the parties over the hearing date represented the latest effort by Trump's team to delay or slow legal proceedings.
