Having lost his legal battle in all the lower courts, Mumbai attack accused Tahawwur Rana, a Canadian national of Pakistani origin, has now knocked on the doors of the US Supreme Court against his extradition to India.

India has sought Rana's extradition for his involvement in the 2008 Mumbai terror attack. Rana had last reached out to the US Court of Appeals for the North Circuit in San Francisco after losing the legal battle in lower courts and several federal courts.

On September 23, the circuit court threw out his petition to give a stay on the decisions of the other courts that approved the move of the Department of State to extradite him to India. On November 13, Rana filed a “petition for a writ of certiorari” before the US Supreme Court.

In a long battle, this is Rana's last legal chance not to be extradited to India.

In his "petitions for a writ of certiorari to review the judgment of the United States Court of Appeals for the Ninth Circuit” in this case, Rana makes the same argument that he was tried and acquitted in federal court in the Northern District of Illinois (Chicago) on charges relating to the 2008 terrorist attack on Mumbai.

"India now seeks to extradite him for trial on charges based on the identical conduct at issue in the Chicago case,” it says.

The&nbsp;petition says that if the “elements” standard applies, he very likely will be sent to India to be put on trial a second time for the same conduct, with conviction and a death sentence ominously on the horizon for him.

Mumbai attack accused Rana rushes to US Supreme Court against India's extradition request

Canadian national and former Pakistani army doctor Tahawwur Rana, wanted by India's National Investigation Agency (NIA) for his role in the 26/11 terrorist attack, is extraditable to India under the extradition treaty between Washington DC and New Delhi, the US Court of Appeals for the Ninth Circuit has ruled.&nbsp;

"The (India US Extradition) Treaty permits Rana’s extradition," the court said in its ruling on August 15.

Ruling on an appeal filed by Rana, a panel of judges of the US Court of Appeals for the Ninth Circuit affirmed the District Court in the Central District of California’s denial of his habeas corpus petition challenging a magistrate judge’s certification of his extradition to India.

The judicial panel held that Rana's alleged offence fell within the terms of the extradition treaty between the United States and India, which included a Non-Bis in Idem (double jeopardy) exception to extraditability "when the person sought has been convicted or acquitted in the Requested State for the offence for which extradition is requested".&nbsp;

After Rana served seven years in prison for those convictions and upon his compassionate release, India issued a request for his extradition to try him for his alleged participation in the Mumbai attacks.&nbsp;

Before the magistrate judge who initially decided Rana’s extraditability (the extradition court), Rana argued that the US extradition treaty with India protected him from extradition because of its Non Bis in Idem (double jeopardy) provision. He also argued that India did not provide sufficient evidence to demonstrate probable cause that he committed the charged crimes.&nbsp;

India maintains that the Indo-US extradition treaty permits Rana’s extradition because the Indian charges contain distinct elements from the crimes for which he was acquitted in the United States.&nbsp;

Rana argued, however, that, based on the government’s interpretation of the Treaty in Headley’s plea agreement, we should judicially estop the government from advocating for its current interpretation of the Treaty.&nbsp;

"We decline to do so," the judge said.&nbsp;

"Because the parties do not dispute that the crimes charged in India have elements independent from those under which Rana was prosecuted in the United States, the Treaty permits Rana’s extradition," Judge Smith said.&nbsp;

Rana has not yet run out of all the legal options to prevent his extradition to India.

A US court ordered a stay on the extradition of Pakistani-origin Canadian businessman Tahawwur Rana to India, where he is facing a trial in the 2008 Mumbai terror attack in which 166 people were killed. Rana appealed before the Ninth Circuit Court against an order by a US District Court in the Central District of California that denied the writ of habeas corpus.&nbsp;

According to a report by the news agency PTI on Tuesday (August 22), District Judge Dale S Fischer in his latest order said that Rana's “ex parte application” seeking a stay on his extradition was granted.

“The extradition of Rana to India is stayed pending the conclusion of his appeal before the United States Court of Appeals for the Ninth Circuit,” the order issued on August 18 read.

The report said that in doing so, the judge overrode the government's recommendations that there should be no stay on Rana's extradition. Judge Fischer wrote that the court did not find that Rana made a strong showing that he was likely to succeed on merits,&nbsp;otherwise, the court would have ruled in his favour in the first instance.

Fischer noted that the proper meaning of offence in Article 6(1) of the extradition treaty was not clear different jurists could come to different conclusions. "Rana's position is certainly colourable and could very well be found to be correct on appeal,” he added.

“The final two factors “merge when the Government is the opposing party.” There is value in compliance with India's extradition request, but Rana's extradition proceedings have been going on for more than three years, which suggests that the process has not been rushed so far. Otherwise, the public interest, if anything, favours Rana,” the judge further wrote.

The US Court of Appeals for the Ninth Circuit has asked Rana to submit his argument before October 10 and Washington has been asked to submit its response by November 8.

Judge Fischer also said that Rana has shown that he is likely to suffer significant irreparable harm absent a stay. He will be extradited to India for a trial on serious crimes with no hope for a review of his arguments or hope for his return to the United States.&nbsp;

Filing the writ of habeas corpus through his lawyer, Rana, 62, has challenged his extradition by the Government of India.

Rana's lawyers have argued that his extradition would violate the United States-India extradition treaty in multiple aspects. They say Rana has&nbsp;been tried and acquitted in the United States District Court for the Northern District of Illinois on charges of similar conduct for which India seeks to prosecute him.

They've argued that extradition is therefore barred under Article 6(1) of the Treaty, which declares that "[e]xtradition shall not be granted when the person sought has been convicted or acquitted in the Requested State for the offence for which extradition is requested."

On June 10, 2020, India filed a complaint seeking the provisional arrest of Rana with a view towards extradition. The Biden administration had supported and approved the extradition of Rana to India.

“The Court has reviewed and considered all of the documents submitted in support of and in opposition to the Request, and has considered the arguments presented at the hearing,” Judge Jacqueline Chooljian, US Magistrate Judge of the US District Court Central District of California, said in a 48-page court order dated May 16, 2023.

<h2>Rana knew of David Headley’s complicity in 26/11 attacks</h2>

During court hearings, the US Government lawyers stated that Rana was aware that his childhood friend Pakistani-American David Coleman Headley was involved with Lashkar-e-Taiba (LeT). Rana still assisted&nbsp;Headley and provided him cover for his activities. Thereby,&nbsp;he was supporting the terrorist organisation and its associates.

Rana knew of Headley's meetings, what was discussed, and the planning of the attacks, including some of the targets.

The US government asserted that Rana was part of the conspiracy and there is probable cause that he committed the substantive crime of commission of a terrorist act.

In a big win for the Indian government, a US court in California approved the extradition of Pakistani-Canadian businessman Tahawwur Rana to India where he is sought for his involvement in the 2008 Mumbai terror attack. This development comes after a US court in April dismissed a status conference motion moved by Rana, stating that it anticipates a ruling on his extradition to India within 30 days. Rana, 62, is said to be linked with Pakistan's Inter-Services Intelligence (ISI) and was arrested in the US for his role in the Mumbai terror attack which saw 10 Lashkar-e-Taiba (LeT) terrorists storm buildings in Mumbai, killing more than 160 people, including six Americans, in a 60-hour siege. Out of the 10 terrorists responsible for the attack, nine were killed and Ajmal Kasab was the only terrorist arrested alive by police. He was later hanged in Pune's Yerawada jail on November 21, 2012 after conviction and being sentenced to death. Who is Tahawwur Rana? Tahawwur Rana is a Canadian businessman of Pakistani descent. He was born in 1961 in Chichawatni in Pakistan's Punjab province. Rana is a physician by profession and served as a captain-general duty practitioner in the Pakistan Army medical corps. The couple lived primarily in Chicago and owned several businesses, including an immigration service agency. Rana is said to be linked with the ISI and was arrested in the US for his role in the 26/11 attack. His arrest (in the US) was made at India's request as per the 1997 Extradition Treaty between the two countries. In 2011, he was convicted in Chicago of providing material support to the LeT, which planned the Mumbai terror attacks. The court proceedings Judge Jacqueline Chooljian, US Magistrate Judge of the US District Court Central District of California said in an order dated May 16 that based on the foregoing, the court concluded that Tahawwur Rana was extraditable for the offences for which the extradition had been requested and on which the US was proceeding, the news agency ANI reported. "Based on such review and consideration and for the reasons discussed herein, the court makes the findings set forth below and certifies to the Secretary of State of the US the extraditability of Rana on the charged offences that are the subject of the Request," the order added. According to Judge Chooljian, India accused Rana of offences including waging war, committing to a terrorist act and issued an arrest warrant, on which the US is also proceeding. During the court proceedings, federal prosecutors argued that Rana was aware that his friend Headley was involved with the LeT, and helped him in scouting locations and landing zones in Mumbai for carrying out the attacks. The 62-year-old was aware of what was discussed in Headley's meetings, including the planning of the attacks as well as the targets. Rana was also accused of allowing Headley to open a branch of his Chicago-based immigration law business in Mumbai as a cover and travel as a representative of Denmark. Where is David Headley now? David Headley, a US-Pakistani national, was involved with the LeT. Headley performed five spying missions in Mumbai to scout targets for the 2008 terror attack. He was arrested at the Chicago airport in October 2009 after being tracked by the Federal Bureau of Investigation (FBI) for more than two months. He is currently serving a 35-year sentence in the US after pleading guilty to 12 international terrorism charges. Rana's extradition contested While the extradition has been contested by Tahawwur Rana's lawyer, judge Chooljian ruled that there is sufficient competent evidence to extradite him. And the court concluded that the 62-year-old is extraditable for offences for which extradition was requested and on which the US is proceeding, ANI reported. The extradition requested for conspiracy to wage war, to commit murder, to commit forgery for the purpose of cheating, to use as genuine a forged document or electronic record, and to commit a terrorist act; waging war; murder; committing a terrorist act; and conspiracy to commit a terrorist act. "It is therefore ordered that Tahawwur Hussain Rana be and remain committed to the custody of the US Marshal pending a final decision on extradition and surrender by the Secretary of State to India for the trial of the offences as to which extradition has been granted pursuant to Title 18, US Code, section 3186 and the Treaty," the judge ruled.
