Tahawwur Rana, accused of masterminding the 2008 Mumbai terror attacks, has been extradited from the United States and is expected to arrive in India. Upon arrival in India, Tahawwur Rana will be held in the custody of the National Investigation Agency (NIA) for the initial weeks of interrogation and investigation.

26/11 plotter Tahawwur Rana extradited from US to India

The US Supreme Court has denied a plea filed by 26/11 attack accused Tahawwur Rana seeking an emergency stay on his extradition. This clears the way for his handover to India. Tahawwur Rana sought a stay on his extradition and surrender to India citing a pending litigation. He had cited the risk of torture and poor health in his failed bids to block extradition. A notice on the Supreme Court's website stated that Tahawwur application has been denied by the court. The Canadian national of Pakistani origin is presently being held at the detention center in Los Angeles. He will be handed over to NIA by FBI on a day to be decided by both sides. It was in February this year that Donald Trump announced the approval to run his extradition during Indian Prime Minister Narendra Modi's visit to Washington DC. Watch in for more details!

US Supreme Court clears Mumbai terror attack convict Tahawwur Rana's extradition to India

Having lost his legal battle in all the lower courts, Mumbai attack accused Tahawwur Rana, a Canadian national of Pakistani origin, has now knocked on the doors of the US Supreme Court against his extradition to India.

India has sought Rana's extradition for his involvement in the 2008 Mumbai terror attack. Rana had last reached out to the US Court of Appeals for the North Circuit in San Francisco after losing the legal battle in lower courts and several federal courts.

On September 23, the circuit court threw out his petition to give a stay on the decisions of the other courts that approved the move of the Department of State to extradite him to India. On November 13, Rana filed a “petition for a writ of certiorari” before the US Supreme Court.

In a long battle, this is Rana's last legal chance not to be extradited to India.

In his "petitions for a writ of certiorari to review the judgment of the United States Court of Appeals for the Ninth Circuit” in this case, Rana makes the same argument that he was tried and acquitted in federal court in the Northern District of Illinois (Chicago) on charges relating to the 2008 terrorist attack on Mumbai.

"India now seeks to extradite him for trial on charges based on the identical conduct at issue in the Chicago case,” it says.

The&nbsp;petition says that if the “elements” standard applies, he very likely will be sent to India to be put on trial a second time for the same conduct, with conviction and a death sentence ominously on the horizon for him.

“In addition, resolution of this issue will have considerable and increasing impact, as the growing globalisation of criminal law enforcement and international cooperation, which in turn has led to a dramatic rise in extraditions, will affect more and more individuals and nations going forward,” it said.

Mumbai attack accused Rana rushes to US Supreme Court against India's extradition request

Canadian national and former Pakistani army doctor Tahawwur Rana, wanted by India's National Investigation Agency (NIA) for his role in the 26/11 terrorist attack, is extraditable to India under the extradition treaty between Washington DC and New Delhi, the US Court of Appeals for the Ninth Circuit has ruled.&nbsp;

"The (India US Extradition) Treaty permits Rana’s extradition," the court said in its ruling on August 15.

Ruling on an appeal filed by Rana, a panel of judges of the US Court of Appeals for the Ninth Circuit affirmed the District Court in the Central District of California’s denial of his habeas corpus petition challenging a magistrate judge’s certification of his extradition to India.

The judicial panel held that Rana's alleged offence fell within the terms of the extradition treaty between the United States and India, which included a Non-Bis in Idem (double jeopardy) exception to extraditability "when the person sought has been convicted or acquitted in the Requested State for the offence for which extradition is requested".&nbsp;

After Rana served seven years in prison for those convictions and upon his compassionate release, India issued a request for his extradition to try him for his alleged participation in the Mumbai attacks.&nbsp;

India maintains that the Indo-US extradition treaty permits Rana’s extradition because the Indian charges contain distinct elements from the crimes for which he was acquitted in the United States.&nbsp;

Rana argued, however, that, based on the government’s interpretation of the Treaty in Headley’s plea agreement, we should judicially estop the government from advocating for its current interpretation of the Treaty.&nbsp;

"Because the parties do not dispute that the crimes charged in India have elements independent from those under which Rana was prosecuted in the United States, the Treaty permits Rana’s extradition," Judge Smith said.&nbsp;

26/11 Mumbai terror attack: Former Pakistan Army doctor Tahawwur Rana extraditable to India, US court rules

A US court ordered a stay on the extradition of Pakistani-origin Canadian businessman Tahawwur Rana to India, where he is facing a trial in the 2008 Mumbai terror attack in which 166 people were killed. Rana appealed before the Ninth Circuit Court against an order by a US District Court in the Central District of California that denied the writ of habeas corpus.&nbsp;

According to a report by the news agency PTI on Tuesday (August 22), District Judge Dale S Fischer in his latest order said that Rana's “ex parte application” seeking a stay on his extradition was granted.

“The extradition of Rana to India is stayed pending the conclusion of his appeal before the United States Court of Appeals for the Ninth Circuit,” the order issued on August 18 read.

The US Court of Appeals for the Ninth Circuit has asked Rana to submit his argument before October 10 and Washington has been asked to submit its response by November 8.

Judge Fischer also said that Rana has shown that he is likely to suffer significant irreparable harm absent a stay. He will be extradited to India for a trial on serious crimes with no hope for a review of his arguments or hope for his return to the United States.&nbsp;

US: Mumbai 26/11 attack accused Tahawwur Rana challenges order of his extradition to India

In a big win for the Indian government, a US court in California approved the extradition of Pakistani-Canadian businessman Tahawwur Rana to India where he is sought for his involvement in the 2008 Mumbai terror attack.

In a big win for the Indian government, a US court in California approved the extradition of Pakistani-Canadian businessman Tahawwur Rana to India where he is sought for his involvement in the 2008 Mumbai terror attack. This development comes after a US court in April dismissed a status conference motion moved by Rana, stating that it anticipates a ruling on his extradition to India within 30 days. Rana, 62, is said to be linked with Pakistan's Inter-Services Intelligence (ISI) and was arrested in the US for his role in the Mumbai terror attack which saw 10 Lashkar-e-Taiba (LeT) terrorists storm buildings in Mumbai, killing more than 160 people, including six Americans, in a 60-hour siege. Out of the 10 terrorists responsible for the attack, nine were killed and Ajmal Kasab was the only terrorist arrested alive by police. He was later hanged in Pune's Yerawada jail on November 21, 2012 after conviction and being sentenced to death. On June 10, 2020, the Indian government sought the provisional arrest of Rana with a view towards extradition. And the request for the extradition was supported and approved by Washington. Who is Tahawwur Rana? Tahawwur Rana is a Canadian businessman of Pakistani descent. He was born in 1961 in Chichawatni in Pakistan's Punjab province. Rana is a physician by profession and served as a captain-general duty practitioner in the Pakistan Army medical corps. The couple lived primarily in Chicago and owned several businesses, including an immigration service agency. Rana is said to be linked with the ISI and was arrested in the US for his role in the 26/11 attack. His arrest (in the US) was made at India's request as per the 1997 Extradition Treaty between the two countries. In 2011, he was convicted in Chicago of providing material support to the LeT, which planned the Mumbai terror attacks. The court proceedings Judge Jacqueline Chooljian, US Magistrate Judge of the US District Court Central District of California said in an order dated May 16 that based on the foregoing, the court concluded that Tahawwur Rana was extraditable for the offences for which the extradition had been requested and on which the US was proceeding, the news agency ANI reported. "The court has reviewed and considered all of the documents submitted in support of and in opposition to the Request and has considered the arguments presented at the hearing," the 48-page court order said. "Based on such review and consideration and for the reasons discussed herein, the court makes the findings set forth below and certifies to the Secretary of State of the US the extraditability of Rana on the charged offences that are the subject of the Request," the order added. According to Judge Chooljian, India accused Rana of offences including waging war, committing to a terrorist act and issued an arrest warrant, on which the US is also proceeding. Rana would be charged with the following offences: > conspiracy to wage war, to commit murder, to commit forgery for cheating, to use as genuine a forged document or electronic record, and to commit a terrorist act > waging war > murder > committing a terrorist act > conspiracy to commit a terrorist act Rana's friendship with David Headley During his college days, Tahawwur Rana befriended David Headley, an American terrorist who was involved with the LeT. During the court proceedings, federal prosecutors argued that Rana was aware that his friend Headley was involved with the LeT, and helped him in scouting locations and landing zones in Mumbai for carrying out the attacks. The 62-year-old was aware of what was discussed in Headley's meetings, including the planning of the attacks as well as the targets. Rana was also accused of allowing Headley to open a branch of his Chicago-based immigration law business in Mumbai as a cover and travel as a representative of Denmark. Where is David Headley now? David Headley, a US-Pakistani national, was involved with the LeT. Headley performed five spying missions in Mumbai to scout targets for the 2008 terror attack. He was arrested at the Chicago airport in October 2009 after being tracked by the Federal Bureau of Investigation (FBI) for more than two months. He is currently serving a 35-year sentence in the US after pleading guilty to 12 international terrorism charges. Rana's extradition contested While the extradition has been contested by Tahawwur Rana's lawyer, judge Chooljian ruled that there is sufficient competent evidence to extradite him. And the court concluded that the 62-year-old is extraditable for offences for which extradition was requested and on which the US is proceeding, ANI reported. The extradition requested for conspiracy to wage war, to commit murder, to commit forgery for the purpose of cheating, to use as genuine a forged document or electronic record, and to commit a terrorist act; waging war; murder; committing a terrorist act; and conspiracy to commit a terrorist act. "It is therefore ordered that Tahawwur Hussain Rana be and remain committed to the custody of the US Marshal pending a final decision on extradition and surrender by the Secretary of State to India for the trial of the offences as to which extradition has been granted pursuant to Title 18, US Code, section 3186 and the Treaty," the judge ruled. US court approves extradition of 26/11 attack accused Tahawwur Rana to India

Who is Tahawwur Rana & how is he involved in the 26/11 Mumbai terror attacks?

A US court has granted permission for the extradition of 2008 Mumbai terror attack accused Tahawwur Rana to India. Tahawwur Rana, a Canadian businessman of Pakistani origin, is being sought in India for his alleged involvement in the 2008 Mumbai terror attack. US has allowed extradition on India’s request.

US court allows extradition of 26/11 accused Tahawwur Rana to India

Tahawwur Rana, a suspect in 26/11 Mumbai terror attack case will remain in United States custody, as a federal judge in Los Angeles weighs whether the fugitive will be extradited to India for his alleged role in the 2008 terror attack that killed more than 160 people.&nbsp;

Magistrate Judge Jacqueline Chooljian on Thursday ordered the defence attorneys and prosecutors to file additional documents by July 15, which was reported by a US news agency.

The extradition hearing, at the request of the Indian government, was held in the court of Magistrate Judge in Los Angeles.

Fifteen years ago, Pakistan-born Rana was operating a travel and immigration service in Chicago`s West Rogers Park neighbourhood, helping vacationers set up visits to his former homeland in Pakistan. Indian authorities allege that Rana conspired with his childhood friend David Coleman Headley to assist the Pakistani terror group Lashkar-e-Taiba “in the orchestration of the terror attacks.

Headley and Rana attended military high school in Pakistan together. Rana`s immigration law centre in Chicago, as well as a satellite office in Mumbai, was allegedly used as a front for their terrorism activities between 2006 and 2008, prosecutors say.

Headley, the master plotter of the 26/11 Mumbai attack, had pleaded guilty and testified against Rana. Rana is fighting extradition by claiming double jeopardy because he was acquitted of Mumbai massacre charges in a Chicago federal courtroom.&nbsp;

Rana is arguing that he has already been acquitted of the charges he would face overseas. After asking for COVID-based relief, Rana was actually released from federal prison after nearly finishing his Chicago sentence, only to be immediately re-arrested and re-jailed on the request by India to send him overseas. Learning from media reports on the development New York-based legal expert Ravi Batra told ANI, "Tahawwur Rana, no stranger to conspiring to give material support to terrorism given his conviction for activities in Denmark, resists Indian extradition - the venue of the Mumbai terror attack - as an artful dodger. Tahawwur Rana, a suspect in 26/11 Mumbai terror attack case will remain in United States custody, as a federal judge in Los Angeles weighs whether the fugitive will be extradited to India for his alleged role in the 2008 terror attack that killed more than 160 people. Headley, the master plotter of the 26/11 Mumbai attack, had pleaded guilty and testified against Rana. Rana is fighting extradition by claiming double jeopardy because he was acquitted of Mumbai massacre charges in a Chicago federal courtroom. It remains India`s right and burden to prove his guilt in a court of law in India."

Assistant US attorney John J Lulejian in his submission said that the 59-year-old Rana had met all the criteria to be extradited to India to be tried.

"The United States respectfully requests that following the April 22, 2021, extradition hearing, the Court certify India's request for Rana's extradition for the Secretary of State's surrender decision," Lulejian said.

Rana, who was a childhood friend of David Coleman Headley, was re-arrested on June 10 in Los Angeles on an extradition request by India. Lulejian added that the criteria warranting certification of extradition was satisfied in this case.

Rana has been declared a fugitive by India.

"Fugitive Tahawwur Hussain Rana is wanted in India to stand trial for offences related to his role in the 2008 terrorist attacks in Mumbai, India, that resulted in the death of 166 people, the injury of 239 people, and the damage to property in excess of $ 1.5 billion," Lulejian said.

India's extradition request contains evidence to establish probable cause that the individual appearing in court is the fugitive who committed the offence for which extradition is requested, Lulejian said.

In his court submission, Rana's attorney had argued that Rana's extradition is barred under Article 6 of the United States-India extradition treaty as he had previously been acquitted of the offences for which his extradition was sought, and under Article 9 of the treaty because the government has not established probable cause to believe that Rana committed the alleged offences.

"Rana's attempts to undermine India's evidence of probable cause by questioning the credibility of the key witness, David Headley. Not only is Rana's challenge improper in this extradition proceeding but his claims are also not supported by the law or the evidence," Lulejian said.

Govt of India trying for the extradition of 26/11 accused Tahawwur Rana: MEA

Rana, 59, a childhood friend of David Coleman Headley, was rearrested on June 10 in Los Angeles on an extradition request by India for his involvement in the Mumbai terror attack in which 166 people, including six Americans, were killed.

Your Story: U.S. Court rejects bail plea of 26/11 accused Tahawwur Rana

A US court has set February 12 as the date of hearing for the extradition of Pakistani-origin Canadian businessman Tahawwur Rana, who has been declared a fugitive by India for his involvement in the 2008 Mumbai terror attack case.

The 59-year-old Rana, a childhood friend of David Coleman Headley, was re-arrested on June 10 in Los Angeles on an extradition request by India for his involvement in the 2008 Mumbai terror attack in which 166 people, including six Americans, were killed.

US District Court Judge in Los Angeles Jacqueline Chelonian said in her order on November 13 that the Extradition Hearing in this case is scheduled for February 12, 2021, at 10:00 a.m.

Rana has time till December 21 to file his opposition to the request for extradition.

The United States Government will have another months' time to file its reply.

In its motion on September 28, the US government supported Rana's extradition to India where he has been charged with the offenses of conspiracy to wage war, commit a terrorist act, the waging of war, the commission of murder, and a terrorist act.

Rana, in his defense, has argued that the US' decision not to extradite his co-conspirator, David Headley, to India is inconsistent and bars his extradition.

However, the US government argued differently "because Headley fulfilled the required terms, the plea agreement established that Headley would not be extradited to India," said US attorney Nicola T Hanna.

"Rana's situation is different because he neither pleaded guilty nor cooperated with the United States. As a result, cannot avail himself of the benefits afforded to Headley through his negotiated plea. Such a position is neither inconsistent nor a bar to extradition," he said.

Unlike Rana, Headley immediately accepted responsibility for his conduct and pleaded guilty to all of the charges in the Superseding Indictment, Hanna said.

As per the plea agreement, the United States agreed that it would not extradite Headley to India "for the foregoing offences, including conduct within the scope of those offences for which he has been convicted in accordance with this plea so long as he fully discloses all material facts concerning his role with respect to these offences and abides by all other aspects of this agreement."

Pakistan-born Rana completed Army Medical College there, and served in the Pakistani Army as a doctor for more than a decade, but eventually deserted.

He is currently a Canadian citizen but was a resident of Chicago where he had a business.

According to the court papers, he has also resided in and travelled to Canada, Pakistan, Germany and England and speaks seven languages.

According to the federal prosecutors, between 2006 and November 2008, Rana conspired with Headley, also known as 'Daood Gilani', and others in Pakistan to assist Lashkar-e-Taiba (LeT) and Harakat ul-Jihad-e-Islami, both US-designated terrorist organisations, to plan and carry out the Mumbai terrorist attacks.

Pakistani-American LeT terrorist Headley was involved in plotting the 2008 Mumbai terror attack.

He was made an approver in the case, and is currently serving a 35-year prison term in the US for his role in the attack.

India seeks his arrest on a number of offences, including the conspiracy to commit murder, conspiracy to commit forgery for the purpose of cheating, and murder under relevant sections of the Indian Penal Code (IPC).

The 2008 Mumbai attack was one of the most horrific terrorist attacks in India in which 166 people were killed and over 300 injured as 10 heavily-armed terrorists from Pakistan created mayhem in the country's financial capital.

Pakistani national Mohammed Ajmal Kasab, the lone terrorist captured alive, was hanged to death on November 21, 2012.

Extradition hearing for 26/11 terror attack accused Tahawwur Rana to be held on February 12

There is a "strong possibility" of Tahawwur Hussain Rana - currently serving a 14-year jail term in the US for plotting the 2008 Mumbai terror attack - being extradited to India, an informed source said.&nbsp;

The Indian government, with "full co-operation" from the Trump administration, is currently working on completing the necessary paperwork to ensure the extradition of the Pakistani-Canadian national before his current jail term ends in December 2021.

Rana was arrested in 2009 on the charges of plotting the 26/11 terror attack. Some 166 people, including US nationals, were killed in the attack carried out by 10 Pakistan-based Lashkar-e-Taiba (LeT) terrorists. Nine of the attackers were killed by police while lone survivor Ajmal Kasab was captured and hanged after handed down death sentence by an Indian court.

In 2013, Rana was sentenced to 14 years of imprisonment.&nbsp;

According to the US officials, he is set to be released in December 2021.

"There is a strong possibility of extradition of Rana to India on completion of his jail term here. We (US and India) are working on this," a source told PTI.
But the "challenge" is to complete the necessary paperwork during this period and overcome the cumbersome bureaucracy of the two countries and the independent judiciary, the source said.

India's Ministry of External Affairs, Ministry of Home Affairs and Ministry of Law and Justice and the US' State Department and the Department of Justice, each of them has their own extradition procedure in place.

And they are unwilling to cut down or speed up their own process when it comes to extradition, it added.

Following a recent visit to the US by India's National Investigation Agency (NIA) team, officials from both sides have agreed to cut down on the bureaucratic procedures so that all the necessary paperwork is ready before the current jail term of Rana ends in December 2021.&nbsp;

From now on, the NIA is expected to have direct communication with their US counterparts to cut short the timeframe and bureaucratic formalities.

In case, the US government in co-operation with the Indian government is unable to complete the necessary paperwork before that, officials here said it would become very tough to ensure a smooth extradition of Rana once he is released from the jail in Chicago, where he is currently serving his sentence.

As per the existing US law, Rana, a Pakistan-born Canadian national, would most probably be deported to Canada if India and the US are unable to complete the cumbersome extradition process before his release.

However, people familiar with the matter told PTI, that there is a "desire" so there is assurance from the highest level in the Trump administration that all necessary steps would be taken in a timely fashion to ensure extradition of Rana before his release.

According to the US officials, the extradition of Rana would help in cementing the relationship between the two countries, boost up the counter-terrorism co-operation and enhance America's image among Indians.

On the 10th anniversary of the Mumbai terror attack, in November 2018, the Trump administration had reiterated its resolve to bring to justice those involved in it.&nbsp;

Vice President Mike Pence had raised this issue during his meeting with Prime Minister Narendra Modi in November.

During their recent visit, the NIA team also received guidance from their US counterparts on the paperwork which India needs to complete to meet the requirements of the American judiciary system and their standards.&nbsp;

India would not seek extradition of Rana on the charges for which he is already serving his jail sentence, as officials pointed out that the "double jeopardy" clause in the US justice system prohibits to punish a person twice for the same crime.

India is seeking extradition of Rana on the ground that he was actively involved in planning an attack on the New Delhi-based National Defense College and Chabad Houses in several cities. There is also forgery case registered against him in India.

Citing the partial government shutdown, the State Department and the Department of Justice expressed their inability to respond to the questions related to the extradition of Rana.&nbsp;

'Strong possibility' of 26/11 accused Tahawwur Rana to be extradited to India: Sources

India has once again requested the US for the extradition of David Coleman Headley and Tahawwur Rana, wanted for their roles in the November 26, 2008 Mumbai terror attacks, a report in<a href="http://www.thehindu.com/news/national/india-makes-fresh-bid-to-get-headley-rana/article18164823.ece?homepage=true"> The Hindu</a> stated.

Headley and Rana are accusing of conspiring with Pakistan-based terrorist group Lashkar-e-Taiba (LeT) for plotting the 26/11 terror attacks&nbsp;that claimed the lives of over 160 people. &nbsp;

India&#39;s National Investigation Agency (NIA), which is investigating the attacks, raised the matter of Headley and Rana&#39;s extradition with deputy director of the Federal Bureau of Investigation (FBI)&nbsp;Andrew McCabe, when he visited India earlier this month.

Tahawwur Rana was convicted by a US court for providing material support to the LeT.

The NIA told the FBI deputy director that Rana had not been tried for the offences forgery and criminal breach of trust registered against him in India. It also said it had received no response to multiple requests for Tahawwur Rana&#39;s custody.

McCabe assured the investigating agency that its request would be looked into, The Hindu reported.

Headley has been sentenced to 35 years in prison by a US court. One of the biggest impediments for his extradition to India is the &quot;double jeopardy clause&quot; in US law that prohibits punishment for the same crime twice.&nbsp;

NIA officials said they were hopeful of securing Headley&#39;s custody because a large number of Indians were killed in the terror attacks, whereas the US investigation mostly centred on the death of six American nationals.

Rana is accused of helping Headley open an immigration firm in Mumbai with forged documents which in turn provided him with a cover for the reconnaissance of 26/11 targets.&nbsp;

The 26/11 attacks, which targetted Mumbai&#39;s key landmarks including the Chhatrapati Shivaji Terminus, the Oberoi Trident, Taj Mahal Palace Hotel and Leopold Cafe, were carried out by 10 LeT terrorists headed by Ajmal Kasab.&nbsp;

Kasab was captured alive by the police and hanged to death in 2012.
