<p>A Tokyo court upheld a ban on same-sex marriage on Wednesday but said a lack of legal protection for same-sex families violated their human rights, a comment welcomed by plaintiffs as a step towards aligning Japan with other G7 nations.</p>

<p>Japan is the only G7 nation that does not allow same-sex marriage, and its constitution defines marriage as based on the mutual consent of both sexes.</p>

<p>Although Prime Minister Fumio Kishida's ruling party has revealed no plans yet to review the matter or propose changes, several senior members support same-sex marriage.</p>

<p>In Wednesday's ruling, the Tokyo district court said the ban was constitutional, but added that the absence of a legal system to protect same-sex families infringed their human rights.</p>

<p>"This is actually a fairly positive ruling," said Nobuhito Sawasaki, one of the lawyers involved in the case.</p>

<p>"While marriage remains between a man and a woman, and the ruling supported that, it also said that the current situation with no legal protections for same-sex families is not good, and suggested something must be done about it," he told Reuters.</p>

<p>Japan does not permit same-sex couples to marry or inherit each other's assets, such as a shared home, and denies them parental rights to each other's children, while even hospital visits can be difficult.</p>

<p>Though partnership certificates from municipalities cover about 60% of Japan's population, they do not give same-sex couples the same rights enjoyed by heterosexual couples.</p>

<p>The Tokyo ruling promises to be influential as the capital has an outsized influence on the rest of Japan.</p>

<p>It had been keenly awaited after hopes were raised by a 2021 ruling in the city of Sapporo that the ban was unconstitutional, although another decision in Osaka in June upheld the ban.</p>

<p>The eight plaintiffs in the case said the ban contravened their human rights and demanded damages of 1 million yen, although the court rejected that.</p>

<p>"This is hard to accept," said Gon Matsunaka, head of the activist group Marriage for All Japan.</p>

<p>Both heterosexual and same-sex couples should be able to benefit equally from the system of marriage, as everyone is equal under the law, he added.</p>

<p>"It (the ruling) clearly said that is not possible."</p>

<p>Yet the recognition that same-sex families lacked legal protections was "a big step", he said.</p>

<p><strong>ENCOURAGING STEP</strong></p>

<p>The plaintiffs, who unfurled a banner outside the courthouse reading, "A step forward for Marriage Equality" after the ruling, said they were encouraged.</p>

<p>"There were parts of this that were disappointing, but parts of it gave me hope," said one of them, Katsu, who gave only his first name.</p>

<p>The decision came a day after the U.S. Senate passed a same-sex marriage protection bill and Singapore lifted a ban on gay sex but limited the prospects for legalising same-sex marriage.</p>

<p>Two more cases are pending in Japan, and activists and lawyers hope an accumulation of judicial decisions supporting same-sex marriage will eventually push lawmakers to change the system, even if this is unlikely soon.</p>

<p>"I hope there will be legislative debate about this," said plaintiff Shizuka Oe. "We will keep making efforts."</p>

<p>The situation has limited the talent pool for global firms, as groups such as the American Chamber of Commerce in Japan have pointed out, calling for change.</p>

<p>"Thinking about the future of their lives, they don't see anything in Japan," said Masa Yanagisawa, head of prime services at bank Goldman Sachs and a member of the group Marriage for All Japan.</p>

<p>"So they move to more friendly jurisdictions, like the United States."</p>

Japan court upholds ban on same-sex marriage but voices rights concern

<p>A Japanese court has ruled that the country's decades-old constitution's definition of marriage as something based on "the mutual consent of both sexes" is legal.&nbsp;The Tokyo court, however, added that the country's failure to legally protect same-sex partners creates an "unconstitutional situation".</p>

<p>"The current lack of legal framework that allows same-sex partners to become family is a serious threat and obstacle" to individual dignity and "this creates an unconstitutional situation with regards to clause two of article 24," said the court in its ruling.</p>

<p>In March of last year, a court in Sapporo made a similar ruling, while an Osaka court ruling from June of this year deemed that a ban on same-sex marriage was constitutional.&nbsp;</p>

<p>Japan remains the only country in the G7 group of nations that does not allow same-sex marriage.</p>

<p>The ruling comes in a case in which eight people (four same-sex couples) had demanded one million yen ($7,208) each in damages.</p>

<p>Even though their demand for damages was rejected, the group hailed the ruling as "a big step forwards".</p>

<p>Chizuka Oe, one of the plaintiffs, as per Reuters, said "There was progress" adding that even though the "judiciary delegated it to the legislature, I hope that the legislature will actively deliberate about it (same-sex marriage)".</p>

<p>Talking to AFP, another person said that the ruling "went as far as to criticise the lack of a legal system that allows same-sex couples to become family."</p>

<p>In recent years, Japan which is a country deeply rooted in traditional values has taken small steps towards embracing sexual diversity. Early last month, the country's capital Japan even started issuing partnership certificates to LGBTQ couples. While these certificates do not confer the same legal rights as marriage, it is still a welcome development for couples who previously lacked official documentation of their relationship.</p>

Cuba legalises same-sex marriages in landmark referendum after citizens approve new family code 

<p>Cuba is currently voting in a landmark referendum which will decide whether to legalize same-sex marriage in the country. According to AFP, it will also include legal discourses regarding surrogacy, adoption by same-sex couples and also rights given to non-biological parents in Cuba.</p>

<p>Back in the 1970s, homosexual individuals were sent to military labour camps in Cuba as part of the government’s initiative to punish them. However, President Miguel Diaz-Canel said that the referendum will be the “needed revision” of the rules implemented through the 1975 Family Code.</p>

<p>During an interaction with the reporters after casting his vote in capital Havana, Diaz-Canel and his wife said that the referendum "is a fair, necessary, up-to-date, modern norm that gives rights and guarantees to all people, to the full diversity of families, of people and of creeds."</p>

<p>The voting is open for all individuals aged 16 and above in the country. The law will need more than 50 per cent of the votes to be accepted with the country looking to modernise their social system.</p>

<p>According to the new referendum, marriage will be defined as the “union between two people” rather than “between man and wife”. The other major aspect will be the boost to surrogacy pregnancies which will be completely legal if there is no money involved in the process.</p>

<p>Cuba tried to pass a similar referendum in 2019 but it failed due to criticism from the church. The church leaders have once again urged the people to vote against it.</p>

<p>'The law as it stands...Personal laws are settled and marriage which is contemplated to be is between (a) biological man and (a) biological woman," he said, adding that petitioners' perception of the Supreme Court's decriminalisation verdict is unclear.</p>

<p>"The issue here is whether marriage is permissible between homosexual couples. Your lordships have to see that. There is some misconception regarding Navtej Singh Johar case. It merely decriminalises consensual homosexual act. It does not talk about marriage," Mehta contended.</p>
