The Lahore High Court (LHC) on Friday posed questions regarding the legality of the treason case filed against former dictator Pervez Musharraf and the formation of the special court that conducted the trial and handed death sentence to the retired general after finding him guilty.

According to local media reports, a three-member bench, comprising Justice Syed Mazahar Ali Akbar Naqvi, Justice Mohammad Ameer Bhatti and Justice Chaudhry Masood Jahangir, was hearing a set of petitions filed by Musharraf challenging multiple actions against him, including conviction in high treason, the establishment of the trial court and filing of the complaint by the government.

Barrister Ali Zafar, who has been appointed as the court's amicus curea in the case, said that the case against Musharraf seemed to have been filed on the behest of the then prime minister, Nawaz Sharif, as there is record of the matter being on the agenda of any of the cabinet meetings held at the time.

"A case under Article 6 cannot be filed without the cabinet's approval," Barrister Zafar insisted. The court asked if the matter was on the agenda of any cabinet meeting, to which Zafar responded in the negative.

"None of the cabinet meetings were held on the matter," Barrister Zafar said.

"This was history's most important matter; can the cabinet discuss it without it being an agenda item?" the bench asked.

Justice Bhatti pointed out that during a recent case pertaining to the extension and reappointment of the army chief, the strength of the cabinet was discussed.

"But in Pervez Musharraf's case, the cabinet's approval or its role cannot be seen," the judge said. Justice Bhatti was referring to pertaining to the tenure of the army chief heard by the Supreme Court, where the bench had inquired how many members of the federal cabinet had approved Prime Minister Imran Khan's decision to extend the tenure of Army Chief Gen Qamar Javed Bajwa.

"On June 21, 2013, the attorney general sent a summary to the prime minister that a case be prepared against Pervez Musharraf under Article 6," Barrister Zafar told the court. "The interior secretary was given the authority to file a complaint on December 29, 2013."

"The case that was prepared was not in accordance with the law, neither was the formation of the special court in accordance with the law," Zafar said and added: "The complaint against Pervez Musharraf was not filed by the lawful authority; the law was violated here as well. According to the law, the cabinet has to nominate the relevant authority which would file the complaint."

Justice Naqvi also inquired how the judges who heard the treason case were appointed.

"On what basis were the judges appointed to the special court?" he asked. "Was there a written communication regarding the appointment of judges to the special court or was everything [decided] over the telephone?"

"The Ministry of Law and Justice wrote a letter to the Supreme Court registrar [asking] for names of judges to form the special court [bench]," the counsel for the federal government told the court.

"When the formation of the court [that heard the case] is wrong and illegal then all its steps and decisions will be considered illegal," Zafar said.

"The federal government constituted the special court but did not decide how the criminal proceedings will be held," Barrister Zafar said. "After the 18th Amendment [in] Article 6, it was imperative to amend the 1973 and 1976 laws pertaining to treason."

Zafar said that though a new offence was added in Article 6, its manner of punishment was not decided.

The charge sheet which was filed does not mention Article 6 at all," Justice Naqvi noted.

"The special court indicted [Musharraf] on the first day the case was heard," Zafar told the court. "The Supreme Court did not define the relation [of the action] with Article 6 but termed it as an unconstitutional step."

Zafar further said that that the trial was conducted in Musharraf's absence.

"If a person is not joining a trial, the court can, at most, declare him a proclaimed offender," Justice Naqvi said and added: "Which law allows punishing a person without hearing them?"

Referring to the special court's verdict, Justice Naqvi said: "Looking at the verdict, everyone who supported [Musharraf] at the time can be accused of abetting."

Barrister Zafar insisted that "no one can commit an Article 6 offence alone", saying that "it would be unconstitutional if proceedings are carried out against selected people."

"Can the special court summon other suspects if the federal government does not name them [in the case]?" asked Justice Jahangir, to which Barrister Zafar responded in the negative.

The court asked the federal government to submit a summary of the formation of the special court and directed the state's lawyer to present arguments on Monday. The hearing was adjourned until Monday.

Musharraf, in his petition, had asked the LHC to set aside the special court’s verdict for being illegal, without jurisdiction, unconstitutional, in violation of Articles 10-A, 4, 5, 10 and 10-A of the Constitution. He sought suspension of the verdict till the decision of the petition.

Pakistan: Decision to extend Nawaz Sharif's stay abroad due next week

The government has decided not to allow Maryam Nawaz, vice president of Pakistan Muslim League-Nawaz and daughter of former prime minister Nawaz Sharif, to travel abroad and rejected her application.

"The rules concerning placement of the name of persons on Exit Control List [ECL] do not allow the government to entertain her application to remove her name from the no-fly list," said senior lawyer and aide to the prime minister Babar Awan while talking to Dawn on Sunday.

Headed by Law Minister Farogh Naseem, the subcommittee of the federal cabinet that deals with ECL cases rejected her plea, as she had sought the facility for flying to London to look after her ailing father who is currently undergoing medical treatment, Awan said.

"In fact, the subcommittee is part of the cabinet and a formal announcement to bar Maryam from traveling abroad will be made by the federal cabinet in its meeting [on Tuesday]," Awan said.

Referring to the Exit from Pakistan (Control) Rules, 2010, the Prime Minister's aide on legal affairs said that even if a person has valid travel documents to proceed to any destination outside Pakistan, the government could stop them from leaving the country for being involved in corruption and loss to government funds.

Earlier, Special Assistant to the Prime Minister on Information Firdous Ashiq Awan after the December 18 meeting of the Pakistan Tehreek-e Insaf's core committee had also said that the government would not accept Maryam's request.

Meanwhile, the PML-N Information Secretary Marriyum Aurangzeb, in a statement issued on Sunday, said that the government's decision to bar the daughter of the ex-prime minister from traveling abroad did not surprise anyone, considering that the PTI regime had always been desperately looking for opportunities to victimise and persecute the PML-N leadership.

Aurangzeb said that the PML-N was aware of the "prejudice and vengeful mindset" of the government that was why she had also filed a request with the court to allow her to travel abroad.

Imran's government denies Maryam Nawaz permission to travel abroad

Former Pakistan Prime Minister Nawaz Sharif is likely to fly to the United States for the treatment of his ailment there, according to family sources.

Sharif, a former three-time prime minister, is currently receiving treatment at the Harvey Clinic in London. He is currently residing at Avenfield flats owned by his son Hasan Nawaz since November 20, The Dawn reported.

Sharif has been diagnosed with an immune system disorder that has caused a low platelet count. Sources said that the treatment of his ailment was not available in London and hence, the former prime minister has to be shifted to the US for further medical treatment.

"The medical tests conducted in London revealed that blood supply to a part of Nawaz Sharif's brain was obstructed causing low platelet count issue and the surgical procedure facility required to treat it was available only in Boston, US," they were quoted as saying.

The ailing PML-N leader had arrived in the UK in an air ambulance accompanied by his younger brother and party president Shehbaz Sharif and personal physician Dr Adnan Malik. Nawaz was allowed to fly abroad after the Lahore High Court had ordered the federal government to strike off his name from the Exit Control List (ECL) for four weeks.

On October 27, the Islamabad High Court had granted an eight-week bail on medical grounds to Sharif, who is serving a seven-year jail term in the Al-Azizia corruption case.

However, the 69-year-old former leader has rejected the ruling Pakistan Tehreek-e-Insaf (PTI) government's condition for submitting an indemnity bond as a guarantee for returning to Pakistan after his treatment.

Shehbaz Sharif gave an undertaking in the court that he would ensure his brother's return based on a certification by doctors that he was fit to travel to Pakistan.

Earlier in the day, PML-N spokesperson Marriyum Aurangzeb said that shifting Sharif from London to the US will be challenging for the medical team considering his current health condition.

She also said that the medical reports of the former prime minister revealed that there was an 88 per cent blockage in arteries circulating blood to his brain.

Meanwhile, a group of senior PML-N leaders is in London and were briefed on Sharif's condition by his personal physician, after the delegation was not allowed to meet the ailing party supremo.

Nawaz Sharif likely to be flown to United States on December 16 for further treatment

The party's spokesperson stressed that Sharif will soon undergo a biopsy in light of his latest positron emission tomography (PET) scan and said that the platelet count of the ailing leader is showing no improvement.

"There has been no improvement in his platelet count despite the high doses of steroids, which were also causing his blood sugar levels to rise," she said, adding that the reason for the dwindling platelet count is yet to be determined.

Close aides of the former Pakistan prime minister and party workers greeted him upon his arrival at his Avenfield House residence. The former prime minister's departure to the UK was delayed by over a week after his ticket was cancelled as the authorities did not remove his name from the Exit Control List. Sources had earlier told ANI that Sharif will be admitted to London's Charlestown Clinic. All the arrangements for his medical treatment at the clinic have been completed. Sharif has secured an eight-week bail on medical grounds from the Islamabad High Court in the Al-Azizia Mills corruption case. He was serving seven years imprisonment in connection with the case. He also obtained bail from the Lahore High Court in the money laundering case. The former Pakistan premier was rushed to the hospital from Kot Lakhpat jail in Lahore last month after his personal physician raised an alarm over his deteriorating health. Sharif, who has been diagnosed with an immune system disorder, was recommended by doctors to go abroad as his condition continued to deteriorate despite treatment. Doctors were struggling to bring his platelet count that had dropped to dangerous levels back to normal.

WION Dispatch: Is Nawaz Sharif really that ill?

Pakistan's Nawaz Sharif arrived in London last night but it’s not news of his arrival that has made the headlines, rather the ruling Pakistan Tehreek-e-Insaf (PTI) administration has alleged that the ailing Prime Minister who was allowed to seek treatment abroad on account of being critically ill didn’t look to be quite as ‘critical’.

Nawaz Sharif was seen walking up to greet family members and supporters who had gathered to receive him at London’s Heathrow Airport.

The sight of a suited-booted Sharif walking without support or any medical apparatus rang alarm bells within the Imran Khan administration back home.

Several members of the ruling Imran Khan regime have questioned the severity of Nawaz Sharif’s medical condition.

Faisal Vawda, a minister in the ruling PTI government tweeted saying, 'Nawaz seen leaving the country on his feet, wearing a suit....instead of prayers, flowers were showered on him.'

Fawad Chaudhry, another minister in the Imran Khan administration taunted Nawaz Sharif saying it seemed that the former premier got better as soon as he stood on the plane’s walkway.

When asked about the jibes being aimed at Sharif, a PML-N Senator, Pervaiz Rashid said that the party would issue a response soon but didn’t feel the need to counter the allegations immediately.

The three-time Prime Minister was recently given the go-ahead to fly out of the country by the Lahore High Court to seek treatment abroad.

Sharif, who was tried and convicted by Pakistan’s Accountability Court, is said to be suffering from multiple ailments, including a critically low platelet count due to prolonged kidney disease.

Former Pak PM Nawaz Sharif to leave on Tuesday to London for treatment

Pakistan Prime Minister Imran Khan has said that he holds no grudge against Nawaz Sharif and that the ailing former premier's health is more important than politics.

Khan's remark, on Friday, came a day after PML-N chief Shehbaz Sharif warned that he would hold the former responsible in case anything happened to his brother as his administration was "dilly-dallying on the removal of Nawaz's name from the no-fly list", Express Tribune reported.

Presiding over a meeting of the PTI core committee, the prime minister said that his government had facilitated Sharif at every forum on humanitarian grounds and had also come up with a legal option to strike his name off the Exit Control List (ECL).

He also said that the government had no issues if the Sharif family opted to approach the court instead of furnishing an indemnity bond for the removal of the former prime minister's name from the ECL.

Pakistan's Interior Ministry on Wednesday had decided to grant Sharif a "one-time" permission to travel abroad for medical treatment for four weeks provided that he submits an indemnity bond of Rs 7 billion. The decision, however, was snubbed by the PML-N and challenged in the Lahore High Court on Friday.

On the same day, the High Court admitted a plea seeking the removal of Sharif's name from the no-fly list unconditionally.

Khan, however, regretted that the Sharif family was "playing politics" on the 69-year-old politician's health. He said that Sharif's health was deteriorating and his family's first priority should be to take him abroad for treatment instead of wrangling over the issue of the indemnity bond.
