Asian American workers in the tech industry have filed a series of lawsuits against what they say is ‘systemic bias’ in Silicon Valley, which prevents them from reaching managerial and senior executive roles. Through the lawsuits, the workers have demanded that major tech companies make policies and put systems in place to track the rates of promotion among Asian American employees.

A USA Today report quoted Asian American worker Vaishnavi Jayakumar, originally from Singapore, as alleging that she was discriminated against on a racial basis at Meta where she was ‘layered’ under less experienced white workers.&nbsp;

“I've never felt more keenly that as an Asian woman, I'm destined to be a worker, I'm not destined to be a leader,” USA Today quoted Jayakumar as saying in an interview. “And that's an awful feeling,” she added.

<h2>Are Asian Americans really discriminated against?</h2>

An analysis done by USA Today found that while Asian Americans were most likely to be hired for professional roles, they were the least likely of all to reach the managerial and senior roles with more power. 
 
This is glaringly visible in companies like Meta, where Asian Americans make up 46 per cent of the total workforce, but just 27 per cent of executives. White employees, on the other side, make up just 39 per cent of the total workforce but occupy 58 per cent of total executive roles.

Buck Gee, an executive adviser to Ascend Foundation, the nation’s largest network of Asian American professionals, said, “The tech industry has made progress in becoming more racially diverse in its workforce but has made virtually no progress in becoming more racially equitable in its leadership pipeline.”

<h2>False perception about Asian Americans</h2>

The lawsuits highlight that there is a false perception in the corporate space that Asian Americans generally don’t face discrimination. But, Pawan Dhingra, president of the Association for Asian American Studies and a professor at Amherst College, says, “The economic realities for Asians and Asian Americans vary greatly, particularly for those in low-wage and low-opportunity jobs on H-1B visas.”

The county asked for $50 billion in current damages from the Heat Dome and $1.5 billion for future damages as excessive heat, drought, wildfires, and smoky skies become more common. The county also asked for a much higher amount for a long-term abatement fund to upgrade its infrastructure.&nbsp;

"This is an event that is directly attributed to the impacts that we are seeing on our climate because of the actions of fossil fuel companies and their agencies that have been pressing for decades to deny climate science," County Chair Jessica Vega Pederson told AFP.&nbsp;

Multnomah County has named several oil firms in their lawsuit, including ExxonMobil, Shell, Chevron, and BP. It has&nbsp;also mentioned the American Petroleum Institute, Western States Petroleum Association and McKinsey &amp; Company. In 2021, the county recorded high temperatures causing the death of 69 people, extensive property damage, and significant expenditure of taxpayer money.

The record-breaking heat wave caused a maximum temperature of 49.6 degree&nbsp;Celsius in Lytton, British Columbia and baked the western United States and Canada. Around 1,400 people died during the heat wave. According to an analysis by the World Weather Attribution group, the phenomenon was impossible without human-caused climate change.&nbsp;

As per the lawsuit, the Heat Dome was a "direct and foreseeable consequence" of the decision of oil companies to sell too many products over the last six decades.&nbsp;

An ExxonMobil spokesperson has responded to the lawsuit and said, "Suits like these continue to waste time, resources, and do nothing to address climate change." He added, "This action has no impact on our intention to invest billions of dollars to leading the way in a thoughtful energy transition that takes the world to net zero carbon emissions."

As per the reports by Bangkok Post, Chevron lawyers called such lawsuits "counterproductive distractions from advancing international policy solutions". 
 
"The federal Constitution bars these novel, baseless claims that target one industry and group of companies engaged in lawful activity that provides tremendous benefits to society," the Chevron counsel stated.&nbsp;

In his opening statement, Roger Sullivan, an attorney for the young plaintiffs, from non-profit Our Children’s Trust, reportedly listed the costs and consequences of Montana’s fossil fuel-friendly policies which he said are also in violation of the state constitutional provision that guarantees a right to a “clean and healthful environment.”

The trial is set to go on for two weeks and is being presided over by District Judge Kathy Seeley who the 16 young plaintiffs and their attorneys will try to convince that the state policies which supposedly favour fossil fuels not only endanger their health and livelihoods but also threatens the future generations.

It is also worth noting that the lawsuit centres around the state’s constitutional right to a “clean and healthful environment.” In line with this, Sullivan also said that Montana’s ongoing permitting of polluting fuels like coal and gas is contributing to a global crisis including, “heat, drought, wildfires, air pollution, violent storms, loss of wildlife, watching glaciers melt.”&nbsp;

The lawyer for the plaintiffs also went on to argue that because of these effects, the young people he represents are disproportionately suffering psychologically and healthily. Speaking on behalf of the plaintiffs, Sullivan said they felt a sense of “betrayal,” with some expressing reluctance to have their own children because they fear the world they would grow up in.

He also claimed that the state had pursued a ruinous energy policy which led to the release of 166 million tonnes of carbon dioxide into the atmosphere annually, which is equivalent to the emissions of countries like Argentina, the Netherlands, or Pakistan.

<h2>Montana youth testify in court</h2>

One of the plaintiffs, a 19-year-old Montana resident, Grace Gibson-Snyder told the court that the smoke from wildfires which have worsened due to climate change and became a “defining experience” of her playing soccer in high school.&nbsp;

She spoke about how her hometown Missoula was regularly shrouded in smoke which forced cancellations of soccer practices and kept her teammates with asthma away from the field. “It’s not pleasant,” said the 19-year-old, as quoted by The Associated Press. She added, “It’s so uncomfortable as you’re breathing deeper and deeper.”

Meanwhile, the 22-year-old lead plaintiff Rikki Held also spoke about how climate change has affected the conditions on her family’s ranch in eastern Montana. Droughts have left “skinny cows and dead cattle” while wildfires make ash fall from the sky, said Held, speaking about the wildfires in 2021.&nbsp;

She said that wildfires had burned some 70 miles (113 kilometres) of power lines in her town which led to a month-long power cut and choked the air “all summer”. The incident also triggered mass evacuations and impacted the family’s motel business.&nbsp;

However, she remains optimistic. “We have the technology and knowledge, we just need empathy and willingness to do the right thing,” said Held. Notably, the trial is expected to see testimonies from all but the four youngest plaintiffs.&nbsp;

Montana Assistant Attorney General Michael Russell said that the state produces “minuscule” emissions and that the harms alleged by the plaintiffs can’t be traced to specific actions by state officials.

“Climate change is a global issue that effectively relegates Montana’s role to that of a spectator,” said Russell. He also said the trial “will hear lots of emotion, lots of assumptions, accusations... and notably fear about what the future may hold, including sweeping and dramatic assertions of doom that awaits us all,” but the reality is “far more boring” than what the youth have claimed.&nbsp;

According to Russell, Montana’s greenhouse gas emissions are decreasing and the plaintiffs are not challenging policies that would, if invalidated, meaningfully change the state’s impact on the climate.&nbsp;

The constitutional provision that the case is centred around is a part of the Montana Environmental Policy Act, which Russell has said is a “procedural” law which requires environmental reviews of any big projects in the state but does not mandate specific outcomes.

<h2>What do we know about the lawsuit?</h2>

The landmark trial that began on Monday is being closely watched since it could potentially set a legal precedent in climate change-related lawsuits. This comes as while there are several constitutional climate cases filed on behalf of youth plaintiffs across the US it is the first case to head to trial.

The case, Held v. Montana, was first filed in 2020 by plaintiffs who were aged between two and 18, at the time, and it finally went to trial three years later. The lawsuit has sought to declare that the state’s policies violate their rights and hope to set a legal precedent, as per their lawyers, which would encourage lawmakers to take action to fight climate change.&nbsp;

The lawsuit claims the government’s “systemic authorization, permitting, encouragement and facilitation” of fossil fuel use is exacerbating the climate crisis. Meanwhile, the US state has repeatedly sought to delay or dismiss the case calling it “meritless” and a publicity stunt aimed at “shutting down responsible energy development in our state.”

The state had also argued that the issue would best be addressed through the political process and not the courts. Notably, plaintiffs had originally sought an injunction which would force the state to develop a remedial plan or policies to reduce emissions, however, their bid was rejected by Judge Seely in 2021.&nbsp;

Judge Seeley said that she could rule that the US state’s climate change exception in its environmental law is at odds with its constitution but cannot tell the legislature how to remedy the violation. Therefore, the plaintiffs are now seeking financial compensation, but rather a declaration that their rights are being violated.

Wilson claims that after the company provided Boeing with the designs for a unique torque wrench,&nbsp;the latter cancelled the former’s contract. However, according to Wilson, Boeing continued to use its intellectual property without “full instructions” on how to build or install it.&nbsp;

Wilson has accused Boeing of creating “critically deficient in quality and performance,” versions of their design, adding that these “mismatched” tools may have caused or contributed to dangerous leaks which had delayed the launch of the SLS rocket, reported Sky News.&nbsp;

The lawsuit also said that Boeing was able to earn billions of dollars in revenue because of the “infringement of Wilson’s trade secrets.” It added that Boeing must turn over “all revenues and profits Boeing has obtained as a result.”&nbsp;

The lawsuit then claims that &nbsp;Boeing went on to blame the leaks which could endanger astronauts on Wilson’s design. “Boeing has not only stolen our intellectual property and damaged our company's reputation but has used the technology incorrectly and at the expense of astronauts' safety, which is beyond despicable,” said founder and president, David Wilson, as quoted by Sky News.&nbsp;

However, this is not the only project that two aerospace companies had collaborated on and in relation to a somewhat similar allegation Wilson said Boeing stole trade secrets related to bolt installation tools for its 787 Dreamliner aircraft which the Colorado-based company was asked to design in 2012.

Five users of TikTok in the US have filed a lawsuit in a federal court to overturn the statewide ban imposed on the video-sharing app in Montana, saying the restriction violates their right to free speech.

Taking to Twitter, Gianforte said that the ban has been endorsed by him to "protect Montanans' personal and private data from the Chinese Communist Party". TikTok is owned by Chinese company ByteDance and has been facing a firestorm of criticism over storing in China the private data on users. 
 
The lawsuit filed by the content makers states that national security power is being exercised by the state which only the federal government has power to wield and hence, it is violating people's right to free speech in the process.

District Judge Lewis Kaplan said he would give Trump until 5:00 pm (local time) on Sunday to ask to reopen his case for the sole purpose of personally testifying. Trump’s lawyer had previously said the former president has decided against testifying.&nbsp;

However, as of Thursday, the former president’s lawyer has rested his case without calling any other witnesses. During the hearing, a social media and marketing expert hired by Carroll told jurors that it would cost the former president up to $2.8 million to repair the reputational damage of his statements against her.&nbsp;

The excerpt from the October video deposition also shows that Trump also mistook Carroll for an ex-wife, when he was shown a black-and-white photograph where he was seen speaking to people at an event, reported Reuters. “It’s Marla,” Trump said, referring to his second wife Marla Maples.&nbsp;

He also went on to call Carroll’s lawyer, “You’re a political operative also. You’re a disgrace,” in the deposition taken at his Mar-a-Lago estate in Palm Beach, reiterating his previous statement and calling Carroll’s allegations politically motivated.&nbsp;

‘Access Hollywood’ tape

The tape, which came to light in 2016, caught Trump in conversation with Billy Bush, an Access Hollywood TV show personality. In it, the businessman, in a very graphic manner, boasts about how celebrities like him can grope women without waiting for consent.&nbsp;

Last month, a federal judge ruled that the tape can be used by the columnist in her lawsuit accusing Trump of rape. Carroll is suing Trump for battery and defamation in a civil trial.&nbsp;

The former magazine advice columnist, who first publicly aired her allegations against Trump in 2019, has accused the former president of raping her at Bergdorf Goodman, a luxury department store based on Fifth Avenue in Midtown Manhattan, New York.&nbsp;

In his order, Judge Kaplan had written, “In this case, a jury reasonably could find, even from the Access Hollywood tape alone, that Mr Trump admitted in the Access Hollywood tape that he in fact has had contact with women’s genitalia in the past without their consent, or that he has attempted to do so.”

A British man was left stranded in the Philippines after his cruise liner left the&nbsp;port without him. Christopher Chapel invested about $21K&nbsp;in what he thought would be a memorable, around-the-world voyage. The 72-year-old did find it to be a memorable trip, but for very different reasons.

Chapel reportedly started feeling ill and queasy midway through the cruise, according to a report in Ladbible. He went to see the doctor on board the cruise liner, who advised him to get tested if he wanted to stay.

Chapel got off the cruise&nbsp;at the Philippines and got&nbsp;himself evaluated. He was happy to learn that his symptoms were simply those of a heatstroke, but by the time he returned, the ship had left without him.

Chapel and his niece called the cruise line and trip insurance, who informed them that his condition was critical and that he would not be permitted to return. He was likewise found unsuitable to fly to Manila.

As a result, the 72-year-old had to go by boat from the Philippine island of Palawan to Manila. He arrived in the UK on April 7, over a month after getting off from the cruise ship for his testing.

"It seems like a comical mix-up. The person who sent me away from the ship didn't even examine me and must have known that the hospital tests would have taken longer than the ship would be at the port,” Chapel told Ladbible.

"They have failed in their duty of care, first by leaving me on the island and now with all this secrecy about my health,” he added.

<h2>Abandoned while snorkelling</h2>

Last month, something very similar happened to a Californian couple.&nbsp;Newly-weds Alexander Burckle and Elizabeth Webster were on a snorkelling excursion in Hawaii when their tour company abandoned them and they had to swim half a mile to safety.

They eventually&nbsp;filed a lawsuit against the tour company, Maui Sail Company, for the incident and the resulting emotional suffering. They&nbsp;demanded&nbsp;$5 million in damages for general damages and emotional trauma.&nbsp;

They were told that the boat would be anchored in a particular spot for an hour before moving on to the next location during the 10 a.m. snorkelling adventure. Soon after they entered the ocean, the water became "choppy."&nbsp;

They discovered the boat had deserted them after battling the waves for 15 minutes.

Speaking to Insider, the couple’s lawyer said that the tour company failed to set "boundaries for snorkelling,&nbsp;identify a lifeguard for the excursion or make sure that the snorkelers had a buddy system."

According to their lawsuit, despite the crew members doing three headcounts, they failed to account for the missing couple and went away. The dehydrated and terrified honeymooners were forced to swim to shore, where they were eventually assisted by an island resident.

Prosecutors said that the boy, whose identity was not publicly disclosed, will not be facing criminal charges. However, they did not clarify if adults will be charged or not.

Superintendent George Parker III was fired after the shooting took place. The school's assistant principal Ebony Parker resigned.

The attorney, representing the parents of the boy, said that they were “committed to responsible gun ownership and keeping firearms out of the reach of children” and had tried to implement the same with the firearm used, which belonged to the student's mother.

The family further said that the boy had a severe disability and was receiving treatment for mental health. In the lawsuit, attorneys representing Zwerner said the defendants were aware that the boy “had a history of random violence” at home and school. The boy had once also “strangled and choked” his kindergarten teacher.

“All defendants knew that (the boy) attacked students and teachers alike, and his motivation to injure was directed toward anyone in his path, both in and out of school, and was not limited to teachers while at the school,” said the lawsuit.

Alice said that she was only 11, but he wanted her to look as young as she could.

She said he was very particular about the way she looked in the video and forced her to send him images, and used to tell her to wear a ponytail to the left side of her head.&nbsp;

"He was able to manipulate me immediately. Very quickly, I was being forced to do things that a child should not have to do."

The man&nbsp;was able to coerce her to send intimate images and convinced&nbsp;Alice that she was complicit in making and sharing child abuse sexual material.

The fear of arrest kept Alice quiet.

With Ryan behind the bars, Alice is going after Omegle to fight a case, and this would be the first tech case where a platform is put on trial for the way it is built.&nbsp;

The legal team for the platform argued in court that the website is not to be blamed for what happened to Alice and other girls, and denied that it is a haven for predators.&nbsp;

The case is still on, Alice's legal team said that she wants Omegle to close down.

A man from Singapore has sued a woman seeking 3 million Singaporean dollars (US $2.26m) in damages after she said that she saw him only as a friend.

The man, K Kawshigan, has claimed that Nora Tan’s actions caused him trauma and damaged his “stellar reputation”.

According to court documents, he has sought compensation to cover loss in earnings and investments, as well as “rehabilitation and therapy programmes to overcome the sustained trauma”. &nbsp;Moreover, he has accused Tan of "allegedly defamatory remarks and negligent conduct”, the Metro newspaper reported.

The defamation case brought by Kawshigan, who is a director at a drone company, will be heard on February 9.

He first filed a case against Tan in January at a magistrates court for $16,624 after claiming that she did not sustain an agreement to improve their relationship, say reports.

The judgment found Kawshigan had an "ulterior motive of vexing or oppressing the defendant|, and the case was just a "calculated attempt to compel engagement" from Tan, according to the Guardian.

Tan met Kawshigan in 2016, and problems began to arise in 2020 when they became “misaligned” about how they saw their relationship.

“While the defendant only regarded the claimant as a ‘friend’, he considered her to be his ‘closest friend’,” the court papers said.

According to the judgement, the woman sought their interactions to be reduced, which caused displeasure to the claimant, who felt this would constitute “taking a step back in their relationship”.

The woman emphasised the need for boundaries and urged him to be “self-reliant”.

The latest lawsuit was initiated in July 2022, in which the man is claiming damages “for allegedly defamatory remarks and negligent conduct”.

Donald Trump is suing Watergate scandal-famous writer Bob Woodward for exposing his interview tapes to the public and alleging that Woodward did not provide him permission to use the tapes for an audiobook.

The former US president filed a lawsuit against Woodward, the publisher Simon &amp; Schuster, and its parent company Paramount Global on Monday for publishing the audio recordings of the conversations that took place between December 2019 and August 2020.

In the complaint, Trump said that he had merely agreed to be taped for a book Woodward was writing, not for a series of interviews. "Rage" by Woodward was released in September 2021.&nbsp;

Earlier, landlord Columbia REIT 650 California LLC sued the microblogging site while claiming Twitter defaulted rent.

Now, in the latest lawsuit, another landlord, SRI Nine Market Square LLC, alleged that Twitter failed to make payments of about $3.4 million in rent for the month of December in addition to a similar payment for January. Along with the rent payments, the landlord is not also seeking other damages.

The complaint was filed Friday in San Francisco Superior Court wherein the landlord said it drew on Twitter’s letter of credit to try to make up for the missed payments however there is still an outstanding due left to be paid for a whopping sum of $3.4 million.&nbsp;&nbsp;

Columbia REIT 650 California LLC, is also seeking damages which include the back rent, in addition to attorney fees and other costs. In 2017, Twitter agreed to a seven-year lease for the facilities. In the first full year, the monthly rent was $107,526.50 (£89,646) and steadily grew to $128,397 (£107,045) in the seventh year.

On 16 December, the landlord at 650 California Street, which is not Twitter's primary office in San Francisco, sent the social media firm notice that it would be in default if it did not make payment within five days. The complaint claims that five days passed without payment.

Earlier in October 2022, Musk paid $44 billion (£37 billion) for Twitter, and the firm is also responsible for paying the buyout's interest obligations of around $1 billion a year. Musk's Tesla shares, which have lost more than half of their value since he acquired Twitter, are responsible for the majority of his fortune.

Since April, when he began accumulating shares of Twitter, he has sold approximately $23 billion (£19 billion) of the electric car company's stock to pay for the acquisition. According to Forbes, he has even lost his title as the richest person in the world. Twitter did not comment on the controversial rent dues for its San Francisco buildings.&nbsp;

After this, Carlsen even made it clear that he won't play against Neimann; with the latter filing a lawsuit against the veteran player, Chess.com and others (of libel, slander and unlawful boycott and tortious interference of Niemann’s business).

Now, the Carlsen vs Neimann legal saga has got murkier with the latter accusing Carlsen of paying another grandmaster Aryan&nbsp;Tari to shout “Ukse Hans” meaning&nbsp;“Cheater Hans” during the&nbsp;closing ceremony of the European Club Cup on October 9, 2022.&nbsp;

The latest submission to the district court of Missouri states, "To ensure that he inflicted the maximum possible damage to Niemann and his career, Carlsen, in the days and weeks that followed the Sinquefield Cup, deployed a more covert defamatory campaign against Niemann, designed to bolster Carlsen’s more high-profile defamatory accusations within the chess community."

"In Carlsen’s malicious defamatory campaign against Niemann, Carlsen went as far as paying Aryan Tari €300 to scream ‘Ukse [sic] Hans’, Norwegian for ‘Cheater Hans’, from the stands at the closing ceremony of the European Club Cup on October 9, 2022, which was attended by many of the world’s most prominent chess players and heard by many of its fans."

The US Supreme Court allowed WhatsApp, a messaging app owned by Meta Platforms Inc., to proceed with a lawsuit against Israel's NSO Group on Monday, claiming it installed spy software on 1,400 people, including journalists, human rights activists, and dissidents, by exploiting a bug.

“Today’s decision clears the path for lawsuits brought by the tech companies as well as for suits brought by journalists and human rights advocates who have been victims of spyware attacks,” Carrie DeCell, a senior staff attorney, representing journalists in a separate lawsuit against NSO Group, said on Monday.

The appeal NSO made of a lower court's decision to allow the litigation to proceed was denied by the justices. Due to its role as an agent for undisclosed foreign governments when it installed the "Pegasus" spyware, NSO had contended that it was exempt from legal action.

The administration of President Joe Biden had urged the court to dismiss NSO's appeal, pointing out that the US State Department has never in the past acknowledged a private organisation functioning as an agent of a foreign state as being entitled to immunity, Reuters reported. At the time when the Department of Justice argued that “NSO plainly is not entitled to immunity here.”

On Monday, Meta, which also owns Facebook, applauded the Supreme Court for rejecting what it called a "baseless" petition.&nbsp;

“NSO’s spyware has enabled cyberattacks targeting human rights activists, journalists and government officials,” Meta said in a statement, according to Al Jazeera. “We firmly believe that their operations violate US law and they must be held to account for their unlawful operations.”

Accusing NSO of illegally accessing WhatsApp servers six months prior to the installation of the Pegasus software on victims' mobiles, WhatsApp sued NSO in 2019 and sought an injunction and damages.

Only law enforcement organisations are permitted to purchase the item, according to the company, which does not name its clients, adding that all the sales are authorised by Israel's Ministry of Defense. It has no influence over how the technology is used once it has been purchased, it further said.

The Israeli company issued a statement following the SC’s decision on Monday, saying, “We are confident that the court will determine that the use of Pegasus by its customers was legal.”

Apple, the manufacturer of the iPhone, also filed a lawsuit against the NSO Group, alleging that the company broke into its products and violated the user terms and services agreement.

Employees of NSO have previously been referred to as "amoral 21st-century mercenaries" by Apple.

Both lawsuits are based on a study carried out last month. Heavy metal content in popular chocolate bars was analysed in this study. California's Maximum Allowed Dose Level (MADL) was set as a benchmark for this study.

It was found that only five chocolate bars popular in the US had acceptable level of heavy metals. Two dozen others exceeded the permissible limits.

It was found that Trader Joe's dark chocolate with 72 per cent cocoa had high levels of lead. Another variant was found to contain high levels of lead and cadmium.
