In a move that may impact the operations of no-frill carriers IndiGo and GoAir which operate the A-320 neo planes, the Delhi High Court today directed the Directorate General of Civil Aviation (DGCA) to state on affidavit that the remaining fleet of aircraft of this model, which have not yet been grounded, were safe and airworthy.

According to aviation regulator DGCA, IndiGo and GoAir together have a total of 45 A320 neo aircraft, of which 14 have been grounded till date due to engine trouble.

The direction from a bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar came on a plea which has sought the grounding of all the A320 neos till the aviation regulator certified that they are safe to fly.

The petitioner, Kerala-based lawyer Yashwanth Shenoy, told the court that in the past 18 months, there have been around 100 engine failures in these aircraft, despite which the DGCA has ordered grounding of only 14 of them while the remaining continue to ferry passengers.

He also claimed that these aircraft are not allowed in the US or the European airspace pursuant to the air worthiness directives issued by the European Aviation Safety Agency (EASA).

DGCA, on the other hand, opposed the petitioner's contention, saying that the engine failure problem occurred in 14 A 320 neo aircraft which had recently undergone a modification and therefore, they were grounded.

The regulator said that a conscious decision was taken to ground only the modified planes while allowing the remaining to fly.

The court observed that it was a matter of public knowledge that several A320 neos were grounded, one as recently as on March 18 and added, "Let DGCA say they are safe".

The bench issued notice to DGCA directing it to file an affidavit stating its satisfaction, according to the Aircraft Rules, regarding the safety and airworthiness of the A320 neos.

It said the affidavit should be signed by an officer not less than the rank of Joint DG and listed the matter for further hearing on April 6.

On March 16, the court had refused to grant Shenoy's main prayer to ground all the A320 neo aircraft operated by the IndiGo and GoAir.

Today, it said his petition be treated as an application in a PIL he has filed for removal of high rise buildings from around Indira Gandhi International (IGI) Airport on the ground that such structures are obstacles for aircraft taking off and landing at the aviation hub.

No-frill carrier IndiGo has moved the Supreme Court challenging a Delhi High Court order that it cannot claim monopoly over Terminal-1 (T-1) of the IGI Airport here, which cannot be given exclusively to it.

The airline's appeal against the February 13 order of the division bench of the High Court has been filed and is likely to be taken up for hearing on February 23.

A larger bench of the High Court had upheld the decision of the single judge order observing that the decision of Delhi International Airport Ltd's (DIAL) to partially shift IndiGo operations from T-1 to T-2 cannot be said to be unreasonable only because it may operate harshly against that airline.

"If we may twist the American idiom, 'my way or the highway' to fit the present context, then IndiGo cannot be heard to say that it is either their way or the runway.

The High Court had turned down the suggestion of IndiGo that T-1 be dedicated exclusively for its use and low-cost carrier SpiceJet be asked to move its entire operations to T-2, and had said this sprang from IndiGo's own commercial considerations and not made in the larger public good.

It had said SpiceJet was as much a business rival of IndiGo as GoAir was a competitor of these two private carriers. IndiGo may be on top of the heap if the volume of passenger traffic is seen, but this would not entitle it to claim monopoly over T-1 to the exclusion of the rest, it had added.

The Delhi High Court on Tuesday accepted the orders of the Delhi International Airport Ltd (DIAL) to partially shift IndiGo and SpiceJet from IGI airport's terminal T-1 to T-2. The decision came after the High court upheld a previous judgment pronounced by a single judge on December 20, 2017. A bench of Justices Hima Kohli and Rekha Palli, however, directed IndiGo and SpiceJet to approach DIAL within one week. The airport regulator shall in another week decide when the airlines have to shift their operations. The bench also said that if the airlines failed to approach DIAL, the airport regulator was free to send them a communication about shifting of their services. The high court's decision came on IndiGo and SpiceJet's plea challenging its single judge order of December 20 last year, upholding DIAL's decision to partially shift the operations of private carriers IndiGo, GoAir and SpiceJet from Terminal-1 (T-1) to Terminal-2 (T-2) at the IGI Airport. On October 21 last year, DIAL had asked the three airlines to shift their flights to and from Delhi to Mumbai, Kolkata, and Bengaluru to T-2 from January 4. All other flights of the airlines would continue to operate from T-1, the airport operator had said. While upholding DIAL's decision, the single judge had given the airlines time till February 15 to partially shift their operations. GoAir shifted all its operations to T-2, saying partial shifting of its operations would "kill" it as it was a smaller airline.

The CEO and president of the airline Aditya Ghosh has asked all his employees to stay calm

Days after the release of the video showing the alleged manhandling of an indigo passenger, the flight staff are now experiencing a huge public relations crises. Passengers at various airports are walking up to the boarding gate/ladder point and questioning the staff "Aaj kitne logo ko maara?" (How many did you hit today?), said an employee. The hardest hit are the ground staff. In a letter sent to employees, the CEO and president of the airline Aditya Ghosh has asked all his employees "to stay calm". In the email to employees, he said: "Stay calm, not to get provoked and don't get drawn into any argument." Copy of the email sent by CEO and president of the airline Aditya Ghosh. (WION Web Team) × The complaints from employees are coming from all across the airports. Besides this, the employees are also getting tagged on various social media memes. An IndiGo staff allegedly manhandled a passenger at Delhi's Indira Gandhi International Airport on October 15. The video of the ground staff of IndiGo Airways manhandling the passenger went viral on social media. IndiGo director Aditya Ghosh had blamed the sacked "whistleblower" for manhandling the passenger after a verbal altercation. In a report to the civil aviation ministry, he mentioned that the staff was trying to prevent the passengers and was only 'doing its job'. "The ex-employee, Montu Kalra who was terminated and is claiming to be the 'whistleblower', is the one you can hear shouting in the video and instructing the other two colleagues, who were junior to him, to prevent the customer from boarding the bus and to hold him back at the ramp itself." The incident unfolded when 6E 487 flew into Delhi from Chennai. Soon after alighting from Airbus A-320, Rajiv Katiyal, a passenger, got into an argument with some ground staff employees and he allegedly abused them. This led to a confrontation even though no one is clear about the reason behind the argument. After the argument, Katiyal was not only stopped by the ground staffers from boarding the bus, which was taking the passengers to the terminal but was allegedly manhandled.
Indigo airlines has expressed "unsolicited interest" in the Air India disinvestment process, India's Civil Aviation Ministry said on Thursday.

IndiGo President Aditya Ghosh wrote a letter to Civil Aviation Minister Ashok Gajapathi Raju soon after the Cabinet gave an in-principle approval for Air India's disinvestment last week.

"Many other private players, both domestic and international, have approached us. The first formal expression of interest is from IndiGo," Minister of State for Civil Aviation Jayant Sinha said.

In the letter, Indigo said it was interested in buying out the international operations of Air India and its low-cost wing, Air India Express.

If that was not possible, it would like to buyout the entire Air India flight operations, including domestic flights, Aditya Ghosh said in the letter.

"Indigo airlines has written a letter to the Civil Aviation Ministry showing unsolicited expression of interest in Air India disinvestment process, Ministry of Civil Aviation Secretary RN Choubey confirmed.

If IndiGo has approached the government "post-haste", it means the market sees it as an asset of tremendous value, Choubey added.

India on Wednesday gave approval to privatise Air India, the first step of a process that could see the government offload an airline struggling to turn a profit in the face of growing competition from low-cost rivals.

The first step taken by the Cabinet will be to form an Alternative Mechanism headed by the finance minister and including the civil aviation minister and various other ministers. The body will look into the treatment of Air India's unsustainable debts, hiving off certain assets to a shell company and the de-merger and strategic disinvestment of three profit-making subsidiaries.

It will also decide on the quantum of disinvestment in Air India and the universe of bidders.

Top officials said the government's decision to look at ways to privatise Air India is in line with its efforts in the past two years for a turnaround of the Rs 52,000 crore debt-ridden airline, which is surviving on a bailout package of Rs 30,000 crore approved in 2012.

"The present management has been able to bring about a turnaround in the airline. From Rs 105 crore operating profit in 2016, Air India is now at an unaudited operational profit of Rs 220 crore," Choubey said.

He said its losses were down from Rs 3,900 crore to Rs 3,300 crore.

"Now there is an airline worth looking at and it is a cash positive airline operationally. Once we handle the issue of debt it is a valuable airline," Choubey said.

If IndiGo has approached the government "post-haste", it means the market sees it as an asset of tremendous value, Choubey added.

As the group of ministers prepares Air India's future plans they will invite inputs from various stakeholders, including former civil aviation ministers.

Asked whether air travellers should book their flights for holidays planned next year, minister Jayant Sinha said.

"All commitments and contracts will be fully honoured, including those made to passengers, employees and financial institutions".

The Centre on Friday will announce a draft rule for a 'no-fly list' for unruly passengers in the aftermath of the debacle surrounding Shiv Sena MP Ravindra Gaikwad, who assaulted an Air India staffer onboard a plane. The Civil Aviation Requirements (CAR) are being amended by the Directorate General of Civil Aviation (DGCA) to facilitate such a list, the ministry of civil aviation said in a letter to Air India CMD, making an appeal to him to lift the ban on Gaikwad. The no-fly list has been amended by Air India from the day Gaikwad hit 62-year-old R Sukumar with his slipper. The following day, the Federation of Indian Airlines, which has Jet Airways, SpiceJet, IndiGo and GoAir as its members, made the announcement. The draft will be made public by aviation minister Ashok G Raju and his deputy Jayant Sinha. For effective implementation, the Centre is likely to make some identification mandatory - either Aadhaar or passport number - while booking even domestic tickets. The draft will give about a month for the public to comment. The aviation ministry will then take some time to study them and come out with the final CAR. As per the IATA, in 2015, there were 10,854 reported cases of unruly behaviour by the passengers across airlines worldwide, which translate into one incident for every 1,205 flights. (ANI)
