Three leaders of a group behind Hong Kong's Tiananmen vigil were charged Thursday with inciting subversion following an earlier police raid at the museum the group ran commemorating Beijing's deadly crackdown in 1989.

The city's police charged Hong Kong Alliance as an organisation, its chairperson Lee Cheuk-yan, vice-chairman Albert Ho — both veteran pro-democracy activists who have been jailed — and vice-chairwoman Chow Hang-tung, who was arrested on Wednesday, of "incitement to subversion", according to the group.

The alliance, officially named the Hong Kong Alliance in Support of Patriotic Democratic Movements of China, is the latest target of a sweeping national security law that Beijing imposed on the city last year to quash dissent after huge and often violent democracy protests.

On Thursday afternoon, officers from the newly created national security unit were seen carting away documents and exhibits from the now-shuttered June 4 museum which is run by the group.

The items included a giant logo of the museum, a paper model of the Goddess of Democracy — a symbol of the 1989 pro-democracy student movement in Beijing — and photos of the huge annual candlelight vigils Hong Kongers hosted for Tiananmen's victims, as well as dozens of boxes of materials.

The museum raid followed security police's arrests of Chow and three other leaders of the alliance. A fifth member of the group was arrested Thursday.

They were initially arrested for "failing to comply with notice to provide information" — an offence that carries six months in prison if convicted.

However, the force later added an allegation against Chow and charged her with incitement to subversion — an offence with a maximum penalty of ten years in jail -- along with Lee and Ho.

They will appear in court on Friday morning for the hearing.

Hong Kong police confirmed the charges Thursday, and added in a statement they had frozen HK$2.2 million in assets belonging to the alliance.

'Foreign agent'

Last month, police ordered the group to hand over financial and operational details, accusing it of working as a "foreign agent".

The request included the personal details of all members since its founding in 1989, all meeting minutes, financial records and any exchanges with other NGOs advocating democracy and human rights in China.

But alliance members have refused, calling the request illegal and arbitrary.

The United States Secretary of State Antony Blinken said the arrests were "politically motivated" and constituted a "blatant abuse" of the law by those in power.

"Hong Kong authorities must end ongoing threats against civil society and individuals with differing political viewpoints," Blinken said on Twitter.

China's Ministry of Foreign Affairs in Hong Kong hit back at the US criticism on Thursday, asking Washington to stop attacking the national security law and refrain from interfering in the city's affairs.

Many members of the alliance are already in jail on national security charges or other protest-related offences.

'Truth to power'

Thursday's raid came on the same day 12 democracy activists, including the alliance's jailed vice-chairman Ho, pleaded guilty to unauthorised assembly charges over the Tiananmen vigil in 2020, the first one banned by authorities since 1990.

In his mitigation speech, Ho said he rejected the accusation that they are foreign agents, saying the alliance was formed by local democratic groups supporting democracy protesters in Beijing.

They were "driven by our consciences" to "remember the lesson of history speaking truth to power," he said, explaining why it was important for Hong Kongers to continue remembering Tiananmen.

The vigils were once one of the most visible symbols of the city's political plurality but have been banned over the last two years.

China is rapidly remoulding Hong Kong in its own authoritarian image.

Dozens of democracy figures have been arrested on national security charges and an official campaign has been launched to purge the city of anyone deemed "unpatriotic".

Yeung Sum, a former lawmaker and one of the 12 democracy activists who pleaded guilty Thursday, said Hong Kong would continue to fight for democracy.

"The June 4 candlelight vigil may be banned forever... but the flowers of liberty will blossom regardless of the storm. Hong Kong people will continue to seek our way to democracy and freedom."

Hong Kong Tiananmen vigil leaders charged with 'inciting subversion'

The group behind the annual Tiananmen Square memorial vigil in Hong Kong on Sunday said that it will not cooperate with police conducting a national security investigation into the group’s activities, as they termed it as an abuse of power.

The police notified the Hong Kong Alliance in Support of Patriotic Democratic Movements of China last month that it was under investigation for working for foreign interests, an accusation that it had denied.

Chow Han Tung, vice chairwoman of the alliance, at a news conference said, "This is a really bad precedent of the national security (police) abusing the power by arbitrarily labelling any civil organisation as a foreign agent".

Group behind Hong Kong’s Tiananmen vigil denies foreign ties

The Hong Kong media group owned by jailed tycoon Jimmy Lai said on Sunday that it aimed to go into liquidation. The announcement said that board of directors of Next Digital Ltd had resigned to facilitate the process.

Next Digital was the publisher of Apple Daily, the popular pro-democracy newspaper that was closed in June after its newsroom was raided by police officers.

The company's assets were frozen as part of the national security investigation and its shares have been suspended from trading since June 17.

In a filing to the Hong Kong bourse late on Sunday, Next Digital said the best interests of shareholders, creditors, employees and other stakeholders will be served by an orderly liquidation.

Ip Yut Kin had tendered his resignation as a non-executive director and chairman, while Louis Gordon Crovitz, Mark Lambert Clifford and Elic Lam have tendered their resignations as independent non-executive directors, the company said.

The company CEO has resigned in July. He was arrested at the time of the raid on Apple Daily office

Next Digital said it hoped the resignations of the remaining board members will result in liquidators being allowed by the Hong Kong government to authorize payments that directors were banned from approving, including for creditors and for former staff.

It also said it hoped that liquidators will be able to conclude value-creating transactions that would generate funds to benefit creditors.

The company said the Hong Kong government has never indicated which articles published by Apple Daily allegedly violated the national security law, and the uncertainty created a climate of fear, resulting in many resignations including those responsible for the regulatory compliance duties of the publicly traded company.

"We observe that the events affecting the company and its people following the invocation of the National Security Law occurred despite there having been no trials and no convictions," it said. "Under this new law, a company can be forced into liquidation without the involvement of the courts."

"As Apple Daily often observed, Hong Kong people have a collective memory of what life was like elsewhere when freedom of speech was denied: No other rights are safe," it said.

Critics of the national security law, introduced in June 2020, say it has been used to muzzle dissent and erode fundamental freedoms, including those of the media, in the former British colony that returned to Chinese rule in 1997.

The seven pro-democracy activists have been accused and plead guilty of organising and inciting other to conduct illegal assembly in the city on October 20, 2019. The ‘illegal assembly’ was attended by tens of thousands of locals who took to the streets to protest against the rising control of China on Hong Kong and the new security law imposed by China.

Demonstrators were met with tear gas and water cannons which were used by the local police to disperse the crowd.

Hong Kong: 17 pro-democracy activists jailed for 16 months

Hong Kong will scrutinise past films for national security breaches under a tough new censorship law announced on Tuesday in the latest blow to the financial hub's political and artistic freedoms.

Authorities have embarked on a sweeping crackdown to root out Beijing's critics after huge and often violent democracy protests convulsed the city two years ago.

A new China-imposed security law and an official campaign dubbed "Patriots rule Hong Kong" has since criminalised much dissent and strangled the democracy movement.

Authorities previously announced in June that the city's censorship board would check any future films for content that breached the security law.

But on Tuesday they unveiled a new hardened censorship law which would also cover any titles that had previously been given a green light.

"Any film for public exhibition, past, present and future, will need to get approval," commerce secretary Edward Yau told reporters.

Hong Kong's national security law bans anything authorities deem to be secession, subversion, terrorism or collusion with foreign forces.

Almost all those arrested under the law so far are democracy activists and a legislative brief given to reporters on Tuesday specifically mentioned recent documentaries that "glorified" or "incited" protests.

The new law must be approved by the city's legislature -- a near certainty, given it has been purged of any opposition over the last year.

The maximum sentence for showing illegal films will be increased to up to three years jail and a HK$1 million ($130,000) fine.

Titles deemed a national security risk by censors will not be able to appeal via the usual channels.

Instead they will have to launch a judicial review in Hong Kong's courts, a long and costly legal procedure.

Authorities can also revoke viewing licenses of venues that show titles deemed "contrary to the interests of national security".

The law will bring Hong Kong much closer to the Chinese mainland, where films are rigorously vetted and only a handful of Western movies or documentaries see a commercial release each year.

Hong Kong historically boasted a thriving film scene and for much of the latter half of the last century, Cantonese cinema was world-class.

The city still maintains some key studios, a handful of lauded directors and a thriving indie scene, but new political red lines are being drawn each month.

The announcement of Tuesday's new censorship law came as Hollywood star Nicole Kidman is filming an Amazon-funded series in the city based on a book about the gilded lives of the city's "expats".

Authorities allowed Kidman and her film crew to skip quarantine, sparking public anger last week.

A council member of a professional group of solicitors in Hong Kong on Saturday dropped his bid to seek re-election next week, citing fears for his safety and that of his family.

Tuesday's elections to the Law Society, a professional body and regulator for 12,000 solicitors, come as critics say the legal system in the global financial hub faces pressure from a China-imposed national security law.

Although officials in Hong Kong and Beijing have rejected these concerns, the normally low-key polls have drawn unusual levels of scrutiny from pro-Beijing media and senior city officials.

Candidate pulls out of Hong Kong lawyers' group election over safety fears

Two Hong Kongers accused of being part of a group that campaigned for international sanctions against China pleaded guilty under the city's national security law on Thursday in a case that is linked to jailed pro-democracy media tycoon Jimmy Lai.

China imposed the sweeping security law on Hong Kong last year to wipe out dissent after the financial hub was rocked by huge and often violent democracy protests.

More than 130 people, including many of the city's best-known democracy advocates, have since been arrested under the law.

Democracy activist Andy Li, 31, and paralegal Chan Tsz-wah, 30, admitted to a charge of "colluding with foreign forces to endanger China's national security" on Thursday.

Prosecutors said they were part of a group that organised the publishing of adverts and articles in overseas newspapers calling for sanctions against China.

Both were in custody ahead of their plea.

Little has been heard in open court about the case against the duo but they are part of a group of people linked to jailed pro-democracy media tycoon Lai who faces the same national security charge.

Authorities have accused Lai, 73, of running a "criminal syndicate" that lobbied for international sanctions against China over its crackdown in Hong Kong.

At Thursday's hearing, prosecutors read out a summary of the allegations against the two defendants.

In it they accused Lai, and his American aide Mark Simon, of being "masterminds and financial support behind the scene and at the highest level of the syndicate".

Chan allegedly delivered Lai and Simon's instructions to Li.

Simon left Hong Kong last year and has previously described the prosecution against Lai and others as a political witch hunt against Beijing's critics.

Lai's popular newspaper Apple Daily closed down in June after authorities used the security law to freeze its assets over the content of the tabloid's reporting.

Li was one of 12 Hong Kongers who made a failed attempt to flee the city by speedboat for Taiwan last summer.

Also read | Watch: Taliban members break into laughter when asked about democracy and female politicians Authorities have accused Lai, 73, of running a "criminal syndicate" that lobbied for international sanctions against China over its crackdown in Hong Kong. They were intercepted by the Chinese coast guard and held in detention until their conviction at a closed hearing for illegal border crossing. The group were eventually returned to Hong Kong custody. Hong Kong: Activists plead guilty to 'national security' charge over sanction calls

Hong Kong leader Carrie Lam may warned that Hong Kong government may cut ties with one of the city's key legal profession associations if it gets involved in politics. This is being seen as her latest warning to civil society groups.

Her comments have come in the run up to August 24 elections for five seats on the council of Hong Kong's Law Society. It is a professional association and regulator for Hong Kong's 12 thousand solicitors.

In April, Lam had said that the government could intervene if necessary in the Bar Association for barristers, whose chairman Paul Harris has been labelled an "anti-China" politician by top Beijing officials after he criticised jail terms handed to some pro-democracy politicians.

Although the Law Society is seen as more conservative than the Bar Association, debates in its recent elections have focused on a more liberal agenda. This year, four of the candidates are considered outspoken, raising fears among some government officials of a political agenda.

"If the Law Society’s professionalism is trumped by politics, the government will consider cutting ties with it," Lam told reporters at her regular weekly news conference.

The Law Society said it remained politically neutral.

"We are in constant communication with relevant governmental departments, expressing opinion to improve the practice environment and regularly responds, from the legal perspective, to consultations on different issues," Law Society President Melissa Pang said.

The Bar Association did not immediately respond to Reuter's request for comment. It has said it is not a political organisation.

Hong Kong leader warns solicitors' group to stay out of politics

Pro-Beijing candidates are running uncontested for most seats in a Hong Kong election committee tasked with choosing the city's leader, with the pro-democracy camp almost absent, government announcements showed on Friday.

The Sept. 19 vote for the committee is the first election since China overhauled Hong Kong's electoral system in May to ensure the former British colony is run by "patriots" loyal to Beijing.

After the one-week nomination period ended on Thursday, the government said it had received just 1,056 nominations for the 980 seats open to competition.

A new committee which can disqualify candidates is tasked by law to work closely with Chinese security authorities to vet contenders for the election committee as well as the leadership election in 2022.

The composition of the election committee is the latest blow to the opposition movement which has seen scores of members arrested, jailed or flee Hong Kong since Beijing imposed a national security law on the city last year.

Membership of the committee for 117 community-level district councillors dominated by democrats was scrapped and more than 500 seats designated for Chinese business, political and interest groups were added.

Representation from professional subsectors that traditionally had a bigger pro-democracy presence, including legal, education, social welfare, medical and health services, was diluted by the addition of ex-officio members which reduced the number of elected seats.

Twenty-three of the 36 subsectors that are open for contest, totalling about 600 seats, will not see any competition because the number of candidates matched the number of seats, suggesting coordination of nominations.

CHANGE OF GUARD

About 70% of the nominees were new faces who did not feature in the last two polls for the committee, which will have 1,500 members instead of the previous 1,200, Reuters calculations based on the election committee website showed.

China had promised universal suffrage as an ultimate goal for Hong Kong in its mini-constitution, the Basic Law, which also states the city has wide-ranging autonomy from Beijing.

Democracy campaigners and Western countries say the political overhaul moves the city in the opposite direction, leaving the democratic opposition with the most limited space it has had since the handover in 1997.

Many of the city's prominent tycoons, including Hong Kong's richest man Li Ka-shing, will not be on the election committee for the first time, as Beijing seeks to rebalance power from big conglomerates to small businesses.

Li, of Cheung Kong Holdings, together with other property moguls, Lee Shau-kee of Henderson Land, both 93, and Henry Cheng, 74, of New World Development, withdrew from the race, although their sons will retain the seats they already hold.

The election committee will elect 40 seats in the revamped Legislative Council in December, and choose a Hong Kong chief executive in March, 2022.

First Hong Kong election under revamped system to be largely uncontested

Hong Kong's population declined by 1.2 percent in the last year, including nearly 90,000 more residents departing than moving to the city, figures released Thursday showed, as Beijing cracked down on dissent and the pandemic kept the finance hub sealed off.

The population decrease continues the largest decline since the city began keeping comparable records in 1961 and comes during a period of intense political turmoil.

Mid-year population estimates for 2021 showed Hong Kong's population stands at 7,394,700 -- a decrease of 87,100 (1.2 percent) from the same time last year.

End of year figures for Hong Kong in 2020 also showed a 1.2 percent decline, and Thursday's numbers suggest there has been no respite in the drop-off.

Hong Kong had only once before recorded a year of population decline, by 0.2 percent after the SARS epidemic in 2003.

The city houses a rapidly ageing society with deaths over the last year outstripping births by 11,800.

But the government data also revealed a new cause for population decline -- more residents leaving than arriving.

The figures showed a net outflow of 89,200 Hong Kong residents for the period.

That is over four times higher than the 20,900 outflow recorded for the same mid-year period in 2020.

In 2018 and 2019, Hong Kong recorded an inflow of 8,500 and 23,000 respectively.

Hong Kong has kept coronavirus infections low by closing itself off to non-residents for most of the pandemic.

The move has kept people safe but crippled the travel industry and made it difficult for both residents and expats to see loved ones overseas.

Thousands of Hong Kongers have also packed their bags to escape a broad crackdown on dissent in response to huge and often violent democracy protests two years ago.

Over the spring and summer, the airport witnessed frequent tearful farewells as residents boarded flights, mostly to Britain, which has said it will offer a pathway to citizenship for many Hong Kongers in response to Beijing's crackdown.

The Hong Kong government does not keep official statistics for how many have left the city for good, but figures point to some sort of exodus taking place.

Around 1,500 Hong Kongers on average were leaving via the airport each day in July, up from around 800 in the first half of the year and despite the pandemic throttling international travel.

Early withdrawals from the city's mandatory pension fund -- which can only be made when someone departs permanently -- have also soared in the last 12 months.

Hong Kong's government has repeatedly brushed off the departures, saying many will one day return and those who leave can be replaced with Chinese mainlanders.

Hong Kong previously saw large numbers of residents depart in the run-up to the 1997 handover to China and after Beijing's deadly 1989 Tiananmen crackdown.

However, the overall population did not decline and many returned.

Hong Kong saw net outflow of 90,000 residents over the last year

China's anti-sanctions law will be implemented in some form in Hong Kong, the city's leader confirmed Tuesday, a move that will add fresh regulatory pressure on international companies in the finance hub.

Beijing's legislature passed the law in June in response to Western penalties that were imposed following crackdowns in Hong Kong and Xinjiang.

Its powers include denying visas, deportation, or seizing assets of those who formulate or comply with sanctions against Chinese businesses or officials.

Foreign companies can be sued in Chinese courts for applying sanctions and the law can also be wielded against family members.

Rumours that China was planning to extend the law to Hong Kong have swirled for days ahead of next week's meeting of the Chinese legislature after state media said some unidentified new measures were being planned for Hong Kong and Macau.

On Tuesday, Hong Kong's chief executive Carrie Lam confirmed Beijing had consulted her on adding the law to the city's mini-constitution, known as the Basic Law.

"The purpose of the anti-sanctions law is to defend our country's sovereignty, security and development interests," she told reporters.

Lam said her advice had been for Hong Kong to pass its own legislation.

But she said Beijing could also impose the measures directly like it did with a sweeping national security law last year that snuffed out dissent.

"Some foreign forces, foreign governments and western media will definitely stir up this issue, hoping to weaken our status as a financial centre or the outside world's confidence in Hong Kong," she said.

"Local legislation can allow us to better clarify the law's framework and procedures and fit it better to Hong Kong's legal system."

Relations between China and major Western powers have deteriorated in recent years, squeezing companies that operate in both markets.

The United States has imposed a series of sanctions on Chinese and Hong Kong officials, including Lam. China has responded with its own reciprocal measures.

International companies face being punished by each side if they adhere to either sanctions regime.

A bank that refuses to implement US sanctions, for example, could find itself cut off from access to the dollar. But those that adhere could find themselves in hot water with Beijing.

Hong Kong's new national security law makes it illegal to comply with foreign sanctions. So far prosecutors have not brought any national security cases against international companies in Hong Kong.

Expanding China's anti-sanctions law to Hong Kong would increase the suite of tools at the disposal of both prosecutors and Chinese companies to pursue international companies deemed to be complying with foreign sanctions.

Hong Kong leader Carrie Lam backs China's anti-sanctions law

Hong Kong's justice secretary said on Sunday that a mainland Chinese law to counter foreign sanctions could also be adopted in the China-ruled city by writing it into Hong Kong's mini-constitution, pending a decision by the Chinese parliament.

Justice Secretary Teresa Cheng's comments are the strongest official indication so far that Hong Kong would embrace the mainland law, passed in June to counter foreign sanctions as the US and EU step up pressure over trade, technology, Hong Kong and Xinjiang.

Under the law, individuals or entities involved in making or implementing discriminatory measures against Chinese citizens or entities could be put on an anti-sanctions list by relevant departments in the Chinese government.

Cheng wrote in an official blog entry that the "most natural and appropriate way" to introduce the anti-sanctions law into Hong Kong would be to add it to an annex of the Basic Law, or Hong Kong's mini-constitution.

She added that such a move needed first to be approved by the highest organ of China's parliament, the National People's Congress. Local media have reported that a decision would likely be made during a meeting in Beijing on Aug 17-20.

Critics have warned that the anti-foreign sanctions law could undermine Hong Kong's reputation as a global financial hub, and tarnish sentiment among foreign firms.

Hong Kong minister signals path to adopting China anti-sanctions law

President Joe Biden announced Thursday that Hong Kong citizens currently in the United States who fear for their safety amid the political crackdown back home will receive temporary safe haven.

Biden said the move recognizes "the significant erosion" of rights and freedoms in Hong Kong by the Chinese government.

"By unilaterally imposing on Hong Kong the Law of the People's Republic of China on Safeguarding National Security in the Hong Kong Special Administrative Region, the People's Republic of China has undermined the enjoyment of rights and freedoms in Hong Kong," he said in a statement.

Biden cited the "politically motivated arrests" of more than 100 opposition politicians, activists and protestors on charges under the national security law, including allegations of secession, subversion and terrorist activities.

More than 10,000 others have been arrested in relation to anti-government protests, he said.

The new decision allows Hong Kong residents currently in the United States to remain for 18 months and to be allowed to work.

President Joe Biden announced Thursday that Hong Kong citizens currently in the United States who fear for their safety amid the political crackdown back home will receive temporary safe haven. Biden said the move recognizes "the significant erosion" of rights and freedoms in Hong Kong by the Chinese government. Biden offers Hong Kongers in US safe haven

Hong Kong's anti-corruption watchdog on Monday charged a singer and prominent pro-democracy activist, Anthony Wong, with "corrupt conduct" at a 2018 election rally, the latest legal action against dissent by authorities in the Chinese-ruled city.

The Independent Commission Against Corruption (ICAC) said in a statement that Wong had provided "entertainment to induce others to vote" for pro-democracy activist Au Nok-hin in a 2018 legislative council by-election.

"At the rally, Wong performed two songs on stage. At the end of the performance, he appealed to the participants of the rally to vote for Au at the election," the ICAC wrote, adding he had breached the Elections Corrupt and Illegal Conduct Ordinance.

If convicted, he could be jailed for up to seven years and fined HK$500,000 ($64,000), the ordinance says.

Wong, 59, who first came into the public limelight with pop duo, Tat Ming Pair, in the 1980s, could not immediately be reached for comment.

Au, who went on to win the election, was also charged. Both are due to appear in court on Thursday to plea.

Au was not available for comment. He was jailed for 10 months jail in April for organising an unauthorised assembly.

Au was also arrested with 46 other prominent democrats this year for alleged conspiracy to commit subversion under a sweeping national security law introduced in June last year to outlaw secession, subversion, terrorism and foreign collusion.

Hong Kong authorities arrest pro-democracy singer Anthony Wong for ‘corrupt conduct’

On Thursday, a radio Hong Kong host went on trial under an old colonial law for sedition. This was the first time the law had been used since the city's handover to China as authorities criminalised dissent.

In the past twelve months, prosecutors have taken out this decades-old law that in the past was rarely used, and is charging activists like Tam Tak-chi, 48, with sedition.

The online talk show host, known as 'Fast Beat' is accused of eight counts of sedition for anti-government slogans he wrote or uttered between January and July of last year.

Further charges include inciting unlawful assembly and disorderly conduct.

The law under which Tam is charged differs from the national security law enacted last year in Hong Kong, which has been utilised to prosecute dissidents as well.

A first offence of sedition carries a sentence of up to two years in prison, while an offence under the national security law carries a harsh sentence of up to life in prison.

The act had not been used for decades, since the time of Hong Kong's 1997 handover and was a largely forgotten relic among the statute books of a city that had emerged as a regional centre of free speech.

The law was drafted by British colonial rulers in 1938 and has been widely criticised for being anti-free speech.

According to Hong Kong law, sedition encompasses any words that cause "hatred, contempt, and discontent" towards the government or "create discontent among the residents."

Tam's trial opened on Thursday with prosecutors reading those slogans as well as some pro-democracy speeches he made speckled with colourful Cantonese curse words.

The slogans that incited this crackdown included "Liberate Hong Kong, revolution of our times", "Corrupt cops, all of your family go to hell", "Disband Hong Kong police, delay no more" and "Down with the Communist Party of China".

For Hong Kong, the trial is a landmark because it will establish a precedent for what political views and phrases will be deemed illegal as China attempts to suppress dissent following huge and violent protests two years ago.

Tam's trial was delayed until the verdict from the higher court was announced on Tuesday.

On Tuesday, one of the first cases under Hong Kong's new national security law resulted in the conviction of a former waiter on charges of inciting secession and terrorist activity.

In this trial, it was determined that "Liberate Hong Kong, revolution of our time" was secessionist and hence a national security offence.

In the current climate, with China reshaping Hong Kong into an authoritarian state, and the newly created national security police unit has led to the revival of this colonial-era sedition law.

Earlier this week, five members of a pro-democracy Hong Kong union were arrested on sedition charges. Three of them have been charged and are now in custody. The union published books about sheep to defend their village from wolves.

A Hong Kong court convicted a former waiter of terrorism and inciting secession on Tuesday in the first trial conducted under a national security law that was imposed by China to stamp out dissent.

The watershed ruling lays down a new marker in the city's changing legal landscape and confirms certain slogans are now outlawed in the international finance hub.

Tong Ying-kit, 24, was charged with terrorism for driving a motorbike into three police officers and secession for flying a protest flag during a rally on July 1 last year, the day after the national security law was enacted.

The flag read "Liberate Hong Kong, revolution of our times", a ubiquitous slogan during the huge and often violent pro-democracy protests that convulsed the city two years ago.

The 15-day trial was heard without a jury -- a significant departure from Hong Kong's common law tradition -- and was decided by three judges handpicked by the city's leader to try national security crimes.

In a written ruling, the judges said the flag's slogan was "capable of inciting others to commit secession".

The charge of terrorism was met because crashing his motorbike into police officers "seriously jeopardised public safety or security".

Tong will be sentenced at a later date, and faces up to life in prison.

The ruling has profound implications for future national security cases.

More than 60 people have been charged under the law, including some of the city's best-known democracy activists such as Jimmy Lai, owner of the now-shuttered Apple Daily newspaper.

Most are now in jail awaiting trial.

Slogan now illegal?

Legal analysts said Tuesday's ruling showed Hong Kong's judiciary is adopting a broad interpretation of the security law and that the courts would become more like those in authoritarian mainland China, especially for political cases.

"The whole system, from the administration to the law enforcement to the judiciary, has reached an alignment," Eric Lai, an expert on Hong Kong's legal system at Georgetown Law School, told AFP.

Surya Deva, an expert at City University of Hong Kong's law school, told AFP that "all institutions and legal processes will be geared to achieve certain pre-defined outcomes" in national security-related cases.

In mainland China, opaque courts answer to the Communist Party and conviction is all but guaranteed, especially in political or national security cases.

Hong Kong maintains an internationally respected common law system that is the bedrock of its business-hub status.

Days of Tong's trial were spent on the flag, with university professors called by both sides to explain the slogan's meaning.

Defence experts argued the slogan meant many things to different people in what was a leaderless protest movement that included a broad spectrum of views, from people advocating genuine independence to those wanting greater democracy and police accountability.

The prosecution argued that the slogan had clear separatist connotations and that Tong's decision to drive his bike into the police met the security law's definition of terrorism.

Legal firewall toppled

Tong's case was unusual in that he was one of the only people arrested under the security law who was accused of an explicitly violent act.

The vast majority of those awaiting prosecution were arrested for expressing political views that authorities say are now illegal.

Democracy activists and many Western nations say the security law is reshaping Hong Kong in China's authoritarian image.

China says it was needed to restore stability after 2019's protests.

The security law has since radically transformed the political and legal landscape of the city, which China promised could keep key liberties and autonomy after its 1997 return from British colonial rule.

China has jurisdiction over some cases, toppling Hong Kong's legal firewall, and has allowed its security agents to operate openly in the city for the first time.

It also allows for cases to be tried by judges instead of juries and bail is largely denied for those arrested.

Tong pleaded not guilty to all charges and did not take the stand during the trial.

Hong Kong court convicts man in first national security trial

Three Hong Kong judges are expected to deliver a verdict on Tuesday in the trial of the first person charged under the national security law, a landmark case with implications on how the legislation reshapes the city's common law traditions.

Former waiter Tong Ying-kit, 24, has pleaded not guilty to charges of terrorism and inciting secession, as well as an alternative charge of dangerous driving causing grievous bodily harm. The acts he is accused of occurred on July 1, 2020, shortly after the law was enacted.

Tong is accused of driving his motorcycle into three riot police while carrying a flag with the protest slogan "Liberate Hong Kong, revolution of our times," which prosecutors say is secessionist.

The main charges could lead to a prison term of several years to life, while the alternative charge could be punished by up to seven years in prison.

His trial was presided over by judges Esther Toh, Anthea Pang and Wilson Chan, picked by city leader Carrie Lam to hear national security cases. Their verdict is expected at 3 pm local time (0700 GMT).

Tong's case is seen by pro-democracy activists and human rights groups as a departure from Hong Kong's common law traditions, as he was denied bail and a jury trial.

It is also a test of the limits of free speech in the former British colony, as the prosecution and defence argued over the meaning of the slogan, which was ubiquitous during Hong Kong's mass 2019 protests.

The governments in Beijing and Hong Kong have said repeatedly the security law was necessary to bring stability after the often-violent 2019 protests and that the rights and freedoms promised to the city upon its return to Chinese rule in 1997 remain intact.

The law, imposed by Beijing in June 2020, punishes what China sees as subversion, secession, terrorism and collusion with foreign forces.

US President Joe Biden had said the situation in Hong Kong has been "deteriorating" even as State Department spokesman Ned Price had said that national security law continues to undermine healthy business in Hong Kong. The United States had also accused China of carrying out hacking in March of Microsoft Exchange. Meanwhile, Hong Kong police said five members of Hong Kong union that published children's books about sheep trying to hold back wolves from their village have been arrested for sedition. The latest US-China sanctions come as US deputy secretary of state Wendy Sherman prepares to travel to China over the weekend amid growing friction between the two sides. (With inputs from Agencies)

China imposes sanctions on US individuals, entities over Hong Kong row

A court in Hong Kong on Thursday handed prison sentences to seven men for their role in attack on pro-democracy protesters, reporters and bystanders in 2019. The incident had occurred at the height of anti-government protests. The attack had taken place on July 21 in Yuen Long district.

The attack was carried out by more than 100 people wearing white T-shirts and wielding sticks and poles. This was one of the most violent scenes of the 2019 unrest.

Police in Hong Kong had received a lot of criticism for their alleged sluggish response to the incident. There were allegations that some of them even colluded with gangsters suspected of carrying out the attack.

Police have rejected those accusations, blaming the slow response partly on protests elsewhere draining resources.

Wong Ying-kit, Ng Wai-nam, Tang Ying-bun, Choi Lap-ki and Tang Wai-sum were found guilty of rioting as well as wounding with intent or conspiracy to wound with intent and sentenced to up to 7 years, the maximum penalty the District Court could give for the crimes.

Lam Koon-leung and Lam Kai-ming, who unlike the other five had pleaded guilty to rioting, received a sentence of 4 years and eight months.

In handing the sentences, Judge Eddie Yip described the crimes as "mob justice which caused panic among the general public."

The sentences marked the first convictions of any of the white-shirted attackers.

About a dozen people supporting those sentenced unfurled a banner outside the court reading, "They were forced to guard the homeland and were severely sentenced, where is the justice? Injustice will be vindicated."

Hong Kong's legislature, which has no opposition party, begins discussions on Wednesday on privacy laws tackling "doxxing behaviour" that some technology giants fear are so broad and vague that they could hamper operations in the city.

City authorities have unveiled plans to pass a new law targeting "doxxing", the act of publishing someone's private details online so they can be harassed by others.

But the broad wording of the proposed legislation has spooked major tech companies who fear they could be held liable and their employees prosecuted for users' content.

Chief Executive Carrie Lam had brushed off a warning by major tech companies including Google, Facebook and Twitter that they may quit the financial hub if authorities push ahead with a new privacy law.

Critics of the legislation, including human rights and tech industry groups, say the measures could be used to protect those in power and target civil society. Supporters say the legislation was long overdue to counter a problem festering since the city's 2019 mass pro-democracy protests.

Doxxing, publicly releasing private or identifying information about an individual or organisation, came under scrutiny after details about police and judges were released online following the protests.

Some officers' home addresses and children's schools were exposed by anti-government protesters, leading to threats.

The government, which has pushed Hong Kong onto an increasingly authoritarian path since Beijing imposed a sweeping national security law in 2020, faces no official opposition after democratic lawmakers resigned en masse last year in protest at the disqualification of colleagues.

That means the law could be passed quickly, empowering the Office of the Privacy Commissioner for Personal Data to investigate and prosecute doxxing.

Violators include anyone who discloses an individual's personal data without consent "with an intent to cause specified harm or being reckless" about the harm caused.

"Specified harm" includes harassment, threat, intimidation, bodily harm, psychological harm, causing the victim to be concerned about safety, and others. Violators could face fines of up to HK$1 million ($128,736) and five years in prison.

The commissioner can apply for a warrant to enter and search premises and seize materials for investigation, and can access electronic devices without a warrant. It can also issue notices to remove content or block access to that content, anywhere in the world.

Asia Internet Coalition, an advocacy group that includes Google, Facebook and Twitter, warned in a June 25 letter to the commissioner that tech companies could stop offering their services in Hong Kong if authorities went ahead with the changes.

The coalition said the measures were "not aligned with global norms and trends," and that any legislation that could curb freedom of speech "must be built upon principles of necessity and proportionality."

"The government's interpretation of doxxing is not necessarily the same as that of technology companies," an executive at one of the tech companies told Reuters on condition of anonymity because of the sensitivity of the matter.

Privacy Commissioner Ada Chung has said she had met representatives of the coalition this month. They had "clarified" that they remained committed to Hong Kong and doxxing was a matter of serious concern, she said.

Representatives from Facebook and Twitter referred Reuters to the Asia Internet Coalition letter, and said their companies had nothing to add for now. Google did not immediately respond to requests for comment.

The government has said that doxxing acts "weaponise personal data, and have caused great harm in the society in recent years."

City leader Carrie Lam has said she was confident officials would be able to "allay concerns" raised by online platforms.

Between June 2019 and April 2021, the commissioner received more than 5,700 doxxing-related complaints, the government said. Police arrested 17 people on suspicion of doxxing during the period, two of whom have been convicted, it said.

What is Hong Kong's controversial 'anti-doxxing' privacy bill?

Hong Kong's public broadcaster recently banned all references to Taiwanese government, ordering staff to not refer to Taiwan's leader as "president" and to avoid using the word "government" in fresh guidelines.

The new directives are in line with mainland China's rhetoric towards Taiwan, which it sees as its own territory. The country has not shied away from claiming that it may bring Taiwan under its control using force if required.

Currently, China is in the process of remoulding the official functioning of Hong Kong, hoping to sync it with the Communist Party of China's goals. Although still a semi-autonomous city, a lot of democratic freedoms guaranteed in Hong Kong have been curtailed under the security laws that were enforced after violent protests against Chinese influence on the city.

Now, RTHK - a news channel run by the government is falling in line with China's national media which is heavily censored.

The memo sent to RTHK staffers was accessed by AFP on Tuesday, which mentioned a series of new directives for everyone working at RTHK, especially in regards to Taiwan.

Taiwan is officially known as the Republic of China and is home to 23 million people. As opposed to China, Taiwan is a self-ruled democracy.

The memo in question referred to certain terms as "inappropriate" including "Taiwan's president" and "Taiwan government" in all output related to radio and television broadcasts, along with digital content.

"Inappropriate terminology such as 'country', 'Republic of China', 'ROC'... must not be used when referring to Taiwan. Under no circumstances should Taiwan be referred to as a sovereign state or perceived as one," AFP quoted the memo as saying.

A former editor of the now-defunct Apple Daily pro-democracy newspaper, Lam Man-Chung was arrested on Wednesday by Hong Kong national security officers, weeks after the paper was forced to dissolve when authorities froze its assets.

Since authorities launched a broad probe into the 26-year-old publication founded by jailed media mogul Jimmy Lai Chee-Ying last month, Lam is the ninth top corporate official to be arrested.

It was forced to close after the arrests and the freezing of millions of dollars in assets.

In a statement, police said they had arrested a 51-year-old former newspaper editor for "collusion with foreign forces", a national security crime.

After its top leadership was jailed and its assets were frozen under the security law, Apple Daily, an outspoken supporter of democracy, published its final edition last month.

Lam was the editor in charge of the final edition, which marked the end of the paper's 26-year history.

Apple Daily's reporting and editorials, according to authorities, endorsed calls for international penalties against China, a political stance that is now illegal under the new security law.

Jimmy Lai, the tabloid's owner, is wrongfully imprisoned on charges of collusion, along with two other executives who have been granted bail.

Following months of anti-government protests in 2019, Beijing last year imposed a sweeping national security law in the semi-autonomous city that critics say restricts the freedoms promised to the former British colony that is not found on mainland China. More than 100 pro-democracy supporters have been arrested, and many others fled abroad.
