Not a single toilet was constructed in the national capital since the inception of the Swachh Bharat Mission two-and-half years ago, with funds to the tune of Rs. 40.31 crore for this purpose lying "idle", the CAG said today.

According to a report by the Comptroller and Auditor General or CAG tabled in the Delhi Assembly, the AAP-led government did not allocate the mission funds to implementing agencies as per their requirements.

It said the implementing agencies, including all three Municipal Corporations of Delhi or MCDs and the Delhi Urban Shelter Improvement Board or DUSIB, received a total of Rs. 40.31 crore under the Mission including Rs. 10.08 crore as state share, but the entire fund remained unutilised as of March 2017.

"NDMC, SDMC and DCB did not assess the requirement of household toilets, but the Mission funds totalling Rs. 16.92 crore was released to them for construction of household toilets," the CAG report said.

The auditing body said the DUSIB, responsible for making slums and JJ clusters in the city open defecation free or ODF, did not receive the state share from the Delhi government.

"The DUSIB received (as in January 2016) an amount of Rs. 6.86 crore, including the state share of Rs. 1.71 crore (25 per cent of the total cost) against Rs. 41.49 crore required by them.

"Though the body actively followed up with the Government of National Capital Territory of Delhi (GNCTD) for state share (60 percent) for construction of community toilets, the GNCTD did not release the same during 2016-17. Therefore, DUSIB refunded the entire fund of Rs. 6.86 crore it received under the Mission," the CAG said in its report.

"Not a single toilet was constructed under the Swachh Bharat Mission in two and half years since its inception on October 2, 2014. All the fund totalling Rs. 40.31 crore allocated for this purpose is idling in banking as the monitoring and evaluation mechanism prescribed in the scheme was not worked upon.

"This shows that the GNCTD did not give adequate importance to the implementation of the Swachh Bharat Mission Scheme," the report said.

The CAG also added that beneficiaries of unauthorised colonies were not considered for construction of household toilets under the Mission, which means "most of the habitats known for lack of toilet facilities were excluded from the Mission at the planning stage itself".

The Delhi High Court today closed the Rs 10 crore defamation suit filed by Union minister Arun Jaitley after Delhi Chief Minister Arvind Kejriwal apologised to him.

Jaitley had filed this second defamation suit after Kejriwal's former lawyer Ram Jethmalani allegedly "abused" him in open court during the proceedings of the original defamation suit against the Aam Aadmi Party chief and five other party functionaries.

Justice Manmohan allowed the settlement application jointly filed by Jaitley and Kejriwal and disposed of the suit following the AAP chief's apology, which was accepted by the BJP leader.

The court accepted the written undertaking and statement of both the leaders and decreed the suit in accordance with the settlement application.

During the hearing, advocate Anupam Srivastava, appearing for Kejriwal, told the court that the matter was settled and Jaitley accepted the apology tendered by the AAP leader.

Senior advocate Rajiv Nayyar and advocate Manik Dogra, representing Jaitley, also said the dispute was settled by the parties.

The court noted that the settlement application was signed by the leaders as well as their advocates who undertook that their clients would abide by the undertaking given.

Another bench of the high court is scheduled to hear during the day Jaitley and Kejriwal's settlement application in the first defamation suit.

Kejriwal had on March 19 opposed in the High Court the second Rs 10 crore defamation suit filed against him by Jaitley over the use of an objectionable word by Jethmalani. He claimed that he had never instructed his then counsel to use any scandalous words against the minister during a recording of evidence.

During the cross-examination of the minister on May 17 last year before Joint Registrar, Jethmalani had used a term Jaitley found objectionable.
AAP leaders had accused the BJP leader of corruption as the president of the Delhi and District Cricket Association (DDCA), a post he had held from 2000 to 2013.

Jaitley, who had denied all allegations levelled by the AAP leaders in December 2015, had filed a civil defamation suit seeking Rs 10 crore damages from Kejriwal and five other leaders of his party, claiming they had made "false and defamatory" statements in the case involving DDCA, thereby harming his reputation.

Kejriwal apologises again, Arun Jaitley refuses to roll back defamation case

The Congress on Friday said it would fight the office-of-profit case involving 20 AAP MLAs in the Election Commission of India (ECI) again, after the Delhi High Court set aside their disqualification and asked the poll panel to hear the matter afresh.

The party also said that the AAP MLAs should resign on "moral ground" and seek re-election, as had been done by former Congress president Sonia Gandhi who resigned from the Lok Sabha following a similar controversy.

"We will fight it out in the EC again as these 20 MLAs have enjoyed perks. High Court has not disputed or denied this. The High Court has just asked Election Commission of India (ECI) to look at it again in the light of natural justice!" Congress's Delhi unit president Ajay Maken tweeted.

He claimed that the AAP government itself had admitted before the Election Commission that a huge amount was spent on office, furniture, transportation and perks for these MLAs who worked as parliamentary secretaries.

The high court termed the EC's recommendation on disqualification as "vitiated", and noted that there was violation of natural justice and no oral hearing was given to the MLAs before disqualifying them as legislators of the Delhi Assembly.

"We respect today's judgement of the high court, but we would like to raise some important questions," Congress spokesperson Sushmita Dev told reporters.

"Both the BJP and the AAP are now in the same boat. The rules of natural justice have been upheld, but just like the AAP has made an absolute mockery of the laws, the BJP is flouting every rule in Manipur," she alleged.

Recalling Gandhi's resignation following the office of profit controversy and her contesting again and winning, Dev said the BJP and the AAP were guilty of not upholding constitutional laws.
"We demand that the 12 MLAs BJP in Manipur resign immediately, as well as the 20 MLAs AAP in Delhi," she said.

She alleged that 12 MLAs, including 8 from BJP, 3 from NPF and an independent MLA were appointed as parliamentary secretaries after the last assembly election. After a Supreme Court order in July 2017, any person having held such position must be disqualified.

"However, all the 12 MLAs are continuing in complete violation of the law," she alleged.

Dev alleged that the BJP was the "master of defections and not elections", as it had consistently and repeatedly flouted the constitutional provisions while forming governments in Arunachal Pradesh, Goa, Manipur and Meghalaya.

"The BJP had committed daylight robbery of majority mandate in Goa, Manipur and Arunachal Pradesh. Political muscle, coercion and money moved swiftly by the BJP to further its agenda of usurping power," she alleged.

A Delhi court has reserved its order on framing of charge against Aam Aadmi Party lawmaker Alka Lamba, accused of allegedly trespassing and vandalising a shop in the city and obstructing the police from performing their duty in 2015.

Metropolitan Magistrate Abhilash Malhotra reserved the order after hearing the arguments of the police and the MLA's counsel on the point of charge. It is likely to pronounce the order next week.

An FIR was lodged against the MLA from Chandni Chowk on August 10 2015, a day after she had received head injuries in a stone-pelting attack during her anti-drug campaign in Delhi's Kashmere Gate area.

The case was registered at the Kashmere Gate Police Station on a complaint by traders including the proprietor of a sweet shop, Shiv Mishthan Bhandar, after a video clip emerged in which she was allegedly seen vandalising shops along with some of her supporters.

Lamba was earlier summoned as accused in the case by the court which had taken cognisance of a charge sheet filed by the police against her.

She was chargesheeted for alleged offences under sections 186 (obstructing public servant in discharge of public functions), 353 (assault or criminal force to deter public servant from discharge of his duty), 427 (mischief causing damage to property), 451 (house-trespass) and 34 (common intention) of the IPC.

The charge sheet said that on August 9, 2015, Lamba along with some other persons committed trespass in the shop and threw a cash bill machine, vandalised the counter and obstructed and deterred the police personnel present there.

According to the police, the CCTV camera footage recovered from the shop showed Lamba toppling the billing machine while one of her colleagues was seen pushing everything from a table and jostling with the policemen.

The politician had claimed that the 30-second CCTV footage was shot after she was attacked.

Delhi sealing drive: AAP, Congress, BJP leaders meet Supreme Court-appointed committee

Punjab Congress leader Navjot Singh Sidhu today said AAP convener Arvind Kejriwal had "murdered" his party in the state by apologising to SAD leader Bikram Singh Majithia.

The Delhi chief minister had yesterday apologised to Majithia for accusing him of being involved in the drug trade in Punjab, saying he had learnt that his allegations were unfounded.

"Today AAP has been murdered in Punjab by Kejriwal," Sidhu told reporters here.

Kejriwal's apology also drew flak from his party's leaders and MLAs in Punjab, who said they were "stunned" by the move and "disappointed" as he had not kept them in the "loop".

"His statement finishes the existence of AAP in Punjab. It is as if their existence has been wiped out today. Why? Because he was the man who used to say he will get Majithia arrested...," the Punjab Tourism minister said.

Kejriwal has betrayed the people. How will AAP leaders now speak against drugs when their own leader has "meekly surrendered", Sidhu said.

Hitting out at the Delhi chief minister, he said, "Man like coward Kejriwal dies everyday for fifty times. But a brave man dies only once in life."

This is a psychological death of the party. Kejriwal has decimated the AAP in Punjab, Sidhu claimed.

"Initially, he tried to run the party (in Punjab) from Delhi through remote control. Today, he is a helpless gambler," he alleged.

V K Jain, the advisor to Delhi chief minister Arvind Kejriwal, has resigned citing personal reasons and family commitments, days after he was questioned by police in connection with the alleged assault on Chief Secretary Anshu Prakash, sources said today.

"Jain has resigned from the post of advisor to the Delhi chief minister citing personal reasons and family commitment," one of the sources told PTI.

He has submitted his resignation letter in the Chief Minister's Office (CMO) and sent a copy to the lieutenant governor, the source added.

He was appointed to the post in September last year, days after he had retired as the CEO of the Delhi Urban Shelter Improvement Board (DUSIB). The board is chaired by Kejriwal.

Jain had not been coming to the CMO since the incident and had gone on a week-long medical leave, the sources said.

Prakash was allegedly assaulted by AAP MLAs during a meeting at the chief minister's residence in the evening of February 19.

The Delhi Police had last week told a court that during interrogation, Jain disclosed that AAP MLAs Prakash Jarwal and Amanatullah Khan surrounded the chief secretary and saw them assaulting him at Kejriwal's residence.

However, Jain had earlier said that he did not see anything as he had gone to the washroom at the time of the incident.

The alleged assault on Prakash took place in the presence of Kejriwal and his deputy Manish Sisodia.

In solidarity with Prakash, IAS and Delhi, Andaman and Nicobar Islands Civil Services (DCS) officers have not been attending meetings with AAP ministers, and only maintaining written communication with them.

The joint forum of the Delhi government employees has demanded action against Kejriwal and Sisodia in connection with the case.

The government has decided to go forward with Delhi Metro’s phase IV project and rapid rail system connecting the national capital with Meerut, Union minister Hardeep Singh Puri has said.

The AAP government had in May 2016 given in-principle approval but the Union housing and urban affairs ministry returned the file, saying it needed to get financial approval first. The Delhi government did not respond since then.

Puri said the government can’t let commuters’ interest suffer if the Delhi government failed to approve projects.

“We are finding a solution. The solution is where we are not getting support from the Delhi government over the metro projects, we have decided that we will do it ourself. Rail corridors, we will do on our own? If they (Delhi government) are not willing to approve a project or provide funding, we are finding out the solution for it,” he told reporters here yesterday.

Last year, Puri had reportedly said the delay had pushed the cost of Metro Phase IV by Rs 12,000 crore, adding that the cost of Delhi-Meerut Rapid Rail Transit project had also gone up by Rs 1,000 crore.

The 104-kilometre network proposed in phase 4 will connect Mukundpur with Saket and will benefit south Delhi residents. It has been pending with the Delhi government for over two years.

Puri said if the Delhi government did not cooperate, the Centre will also implement the high-speed rail corridor between Delhi and Ghaziabad.

Highlighting his ministry’s achievement in the last six years, the Union minister said the contentious issues related to the Rohini residential scheme, launched in 1981 by the Delhi Development Authority (DDA), has been resolved and the process for allotting the pending plots will be completed by the month-end.

Talking about the sealing drive in the city, he said amendments in Master Plan 2021 will be notified soon after filing an affidavit regarding it in the Supreme Court.

The former IFS officer said in the last six months, 13 states/UTs have become open defecation free, thus bringing the total open defecation free (ODF) states count to 14.

He added that 1,310 cities have been declared ODF during the same period, taking the total tally of ODF cities to 2,322.

Aam Aadmi Party (AAP) Uttam Nagar's MLA Naresh Balyan has been booked for saying that officers obstructing public work "should be beaten up", police said on Sunday.

Balyan had said that officers like him (Chief Secretary Anshu Prakash) should be beaten up for obstructing the public work.

"Whatever happened to the Chief Secretary (Anshu Prakash)... I say they should be beaten up, they should be thrashed... whoever obstructs the work being done for the common man, should be meted out the same treatment," Balyan, a legislator from Uttam Nagar, had said at a public rally on Friday.

Balyan, however, said that his words were misconstrued and that he only meant that the public had the right to beat up erring public servants.

An FIR under relevant IPC sections was filed against Balyan at the Dabri police station in Dwarka yesterday, based on a complaint of a policeman, who was on duty when the MLA made the remarks at JJ Colony, Bindapur, on February 23, a police officer said.

The comment came days after Chief Secretary Anshu Prakash alleged that he was beaten up by AAP MLAs Amanatullah Khan and Prakash Jarwal in the presence of Kejriwal at the Chief Minister`s residence on Monday night, where he had been called for an emergency meeting.

Delhi: FIR filed against AAP MLA Naresh Balyan for saying officers 'should be beaten up'

After the Delhi Police searched chief minister Arvind Kejriwal's residence, a leader of the ruling Aam Aadmi Party (AAP) accused it of acting like a bully at the behest of the Centre and said the action was aimed at "insulting and humiliating" Arvind Kejriwal.

The Delhi Police had conducted a search at the Delhi chief minister's residence saying its demand for the CCTV footage of the alleged incident of assault on Chief Secretary Anshu Prakash by AAP MLAs had not been met.

AAP leader Ashutosh claimed the police had initially requested the video from the PWD department but did not take it.

In a veiled reference to the BJP, AAP MP (Member of Parliament) Sanjay Singh said it was "unfortunate" that some "dictators" and people with a mentality of "hooligans" had captured power, be it Gujarat, Haryana, Maharashtra,
Rajasthan or Madhya Pradesh.

"The dadagiri (bullying) by the Delhi Police at Arvind Kejriwal's residence is being done at the behest of the BJP. The Delhi Police is a mere puppet but the Centre is resorting to such dadagiri to dismiss the Delhi government," Sanjay Singh said.

The AAP MP equated the Delhi Police with "Dhristashtra", the blind king in epic Mahabharat who turned a blind eye to his sons' vices, stating that the law and order enforcement agency had not even bothered to take action in cases involving assault on Delhi minister Imran Hussain and Delhi Dialogue Commission vice-chairman Ashish Khetan.

Sanjay Singh also posted pictures of injured AAP workers who were allegedly beaten up by police in Lucknow for protesting the dictatorial action led by the Narendra Modi-led BJP government against Arvind Kejriwal.

Sanjay Singh said the AAP will protest outside district headquarters and state capital headquarters to protest the sending of police team to the Delhi chief minister's residence.

In a press conference, the AAP showed a two-and-half-minute clip where senior police officials are seen inside the residence of the chief minister, purportedly asking questions about the wall paint of the room.

"The police team went inside the chief minister's residence only to humiliate and insult him (Arvind Kejriwal)," AAP leader Ashutosh told the press.

AAP counsel JS Joon who is the defence lawyer for party MLAs Amantullah and Prakash Jarwal, arrested for allegedly assaulting the chief secretary, said there should have been a prior notice before entering the residence of the chief minister.

"Such questions (on details of painting done at the chief minister's residence) are ridiculous and preposterous," the AAP counsel said.

Meanwhile, AAP MLA Naresh Balyan said today that the chief secretary deserved to be beaten in this manner.

"What happened with the chief secretary, the false allegation that he levelled, I am saying that such officials should be beaten up. Those who stop the work of the common man should be treated in this manner only," Naresh Balyan said while addressing a rally in the capital's Uttam Nagar.

Sanjay Singh also posted pictures of injured AAP workers who were allegedly beaten up by police in Lucknow for protesting the dictatorial action led by the Narendra Modi-led BJP government against Arvind Kejriwal. pic.twitter.com/dz6WN93iJV — AAP Uttar Pradesh (@AAPUttarPradesh) February 23, 2018 × Sanjay Singh said the AAP will protest outside district headquarters and state capital headquarters to protest the sending of police team to the Delhi chief minister's residence.

AAP slams Centre, Delhi Police for search at Kejriwal's home

In the last 24 hours, things have dramatically changed in Delhi. Delhi's Chief Secretary alleged that he was beaten by Aam Aadmi Party MLA's, assaulting him in front of the Chief Minister. After this incident, it has turned into a battle between bureaucracy and Kejriwal government. On Tuesday, Delhi police filed an FIR after getting a written complaint from Delhi Chief Secretary Anshu Prakash.

Within few hours, the Delhi police arrested AAP's Deoli MLA Prakash Jarwal. Police had also been looking for another MLA named Amanthullah Khan, from Okhla, but failed to get him. But by the afternoon,Amanthullah Khan surrendered in Jamia Nagar police station.

After taking both the MLA's into custody, the police produced them in the court. Delhi Police wanted two days custody for both of them but the court dismissed the police's plea for custodial interrogation of AAP MLAs Amanatullah Khan and Prakash Jarwal. Delhi court rejected the plea for police custody, saying the two legislators were ready to cooperate and join the investigation.

While all these things were happening, Delhi IAS, DANICs and DASS association sought time from President Ramnath Singh. The Association wanted to brief him about the incident and wanted him to look into this matter. But they couldn't get time from President yesterday. But association hopes to get time on Thursday. Apart from this, the association also held a meeting with all his stakeholders in Chanakyapuri.

In this meeting, many retired and serving Delhi Government IAS and DANICS officers took part. At the meeting, all the stakeholders decided not to attend any meeting called by the Delhi government till Arvind Kejriwal apologises for the incident and action is taken against the MLAs involved. Same was decided at past meetings too. Meanwhile, Delhi IAS Association is getting support from many state IAS Associations that include Uttar Pradesh, Telangana, Karnataka etc.

Tuesday, after this alleged attack on Chief Secretary, a meeting was called in Delhi Secretariat. In this meeting, the chief secretary and all the other officers decided to report this matter. The IAS officers association also met Home Minister Rajnath Singh and LG Anil Baijal to lodge a protest over the alleged assault. A delegation of IAS, DANICS and subordinate services of Delhi government called on Home Minister Rajnath Singh and termed the alleged manhandling of Prakash a "pre-planned and pre-meditated" attack.

On Wednesday, the IAS association took out a candlelight march at Rajghat to protest the incident in which not only serving IAS, DANICs, and DASS cadre employees participated but many retired officers took part as well.

Opinion: How it is turning out to be a bureaucracy vs. Kejriwal fight in Delhi

The Aam Aadmi Party (AAP) on Wednesday questioned: Why has Delhi Chief Secretary not been arrested?

AAP`s question came after Delhi Police detained its Deoli MLA Prakash Jarwal in connection with an alleged altercation between him and Delhi Chief Secretary Anshu Prakash.

AAP Councillor Prem Chauhan said, "He (Prakash Jarwal) went to police station earlier in the day and met Station House Officer (SHO). What was the need of detaining him in a hurried manner in the night?

"He questioned why police did not arrest the chief secretary as the same complaint was also lodged against him."We lodged the same complaint against the chief secretary. Has he been arrested? Is he above the democracy? He also comes under the ambit of law. When action was not taken on our complaint then why such swift action has been taken on his complaint," the AAP councillor questioned.

He said that when Jarwal along with a colleague was going to attend a marriage, the police stopped his vehicle near Khanpur traffic signal and detained him at around 11 p.m. on Tuesday."He (Jarwal) is not a criminal. When we are cooperating then the police could have waited till next morning. Instead of detaining him, he could have been summoned for questioning. Jarwal`s colleague informed us about the incident," the AAP councillor said.

He demanded the police to reveal where they have kept the MLA."We are running from one police station to another police station, but could not meet our MLA. He is not a terrorist. Police should at least tell us where they have kept Jarwal," Chauhan said.

He also informed that Jarwal lodged a complaint against the chief secretary with the SC/ST commission as well as with the Sangam Vihar police station. The MLA, in his complaint, alleged that the chief secretary passed casteist comments against him during the meeting at Chief Minister Arvind Kejriwal`s residence.

Earlier in the day, the Chief Secretary lodged a police complaint and alleged that he was manhandled at Kejriwal`s residence by two lawmakers of the ruling AAP - Ajay Dutt and Prakash Jarwal.

The Chief Secretary said that he was attacked in the presence of the Chief Minister after being summoned for discussions on Aadhaar -related problems.

The Delhi Police today got a jolt with a court here rejecting its plea for custodial interrogation of AAP MLAs Amantullah Khan and Prakash Jarwal, arrested in connection with the "highly sensitive" case of alleged assault on Delhi Chief Secretary Anshu Prakash.

The two MLAs were sent to judicial custody in Tihar Jail till tomorrow when the court would hear their bail pleas, as the police sought time to reply on them.
The court said the ground for judicial custody are justified as there are numerous cases against the accused MLAs.

Metropolitan Magistrate Shefali Barnala Tandon directed the concerned Deputy Commissioner of Police to personally monitor the case as it is "highly sensitive".

The court refused the plea of the Delhi Police to quiz them in custody for two days, saying that the legislators were ready to cooperate and join the investigation.

In its order, the court recorded the submission of the defence counsel that medical examination (MLC) was conducted on Prakash after the lodging of the FIR and nothing was to be recovered from the MLAs. It also noted that the MLAs were ready to cooperate and join investigation whenever required.

“It was submitted that MLC (of Prakash) was conducted after registration of FIR and nothing has to be recovered from the accused. They have submitted it is a political gimmick. The police custody application is dismissed,” the court said.

The development came as a setback to the bureaucrats as, earlier in the day, top officers from IAS and DANICS cadres sought an appointment with President Ram Nath Kovind, seeking action against those involved in the alleged attack on the chief secretary.

Yesterday, a delegation of IAS and Delhi and Andaman Nicobar Island Civil Services (DANICS) officers met Home Rajnath Singh and apprised him of the situation in Delhi.

The two MLAs were produced before the court amid tight security as a large number of AAP workers and lawyers were also present there.

While Jarwal, an MLA from Deoli, was arrested last night, party legislator from Jamia Nagar, Khan, was taken into custody this afternoon.

The two have been arrested in connection with the alleged assault on the bureaucrat during a meeting at Chief Minister Arvind Kejriwal's residence on the night of February 19.

During the hearing, public prosecutor Atul Srivastava sought two days police custody of both the MLAs saying they had committed a serious crime of assaulting and humiliating the senior-most officer of the state.

Due to this, the officer has sustained serious injuries and the medical examination report has also been submitted in this regard, he said.

He said a total of 11 persons were involved in the incident and the two MLAs have to be confronted with other accused to unearth the larger conspiracy. The role of the other accused, who are yet to be arrested, also needed to be ascertained, the prosecutor said.

He also alleged that it was a serious case of assault and both the MLAs were not cooperating in the probe.

Srivastava claimed that Anshu Prakash was intimidated by the accused and none of the MLAs present there came forward to save him.

Advocate B S Joon, appearing for both the MLAs, opposed the application for police custody and said they were ready to cooperate in the probe. He said the charge of assaulting public servant was invoked in the FIR without conducting the MLC of the bureaucrat.

Both of them are public representatives and not hardened criminals, Joon said, adding “this is a fallout of power struggle between the Centre and the NCT of Delhi.”

He further submitted that as per the footage of the CCTV installed at the chief minister’s house, the chief secretary’s vehicle entered and exited within 7 minutes and 8 seconds.

In his complaint, Chief Secretary Anshu Prakash had alleged that he was sitting on a sofa flanked by Khan and another AAP MLA during the February 19 night meeting, and without provocation, the two legislators "started hitting and assaulting" him "with blows on head and temple". The Aam Aadmi Party (AAP) has denied the allegations.

A case has been registered at Civil Lines Police Station in north Delhi on the complaint filed by the chief secretary.

Khan alleged that the chief secretary was acting at the behest of the BJP and "the incident is a pretext to dismiss the AAP government" and the police was working under pressure of the Union Home Minister.

Prakash, on the other hand, claimed that he was questioned about the AAP government's media publicity during the meeting, while the AAP functionaries said he was called to discuss complaints on ration distribution.

The chief secretary in his complaint alleged that the assault was "premeditated" and a "conspiracy" of all those present. Police have filed the FIR including the charge of criminal conspiracy in it.

According to reports, people were are facing difficulties in procuring commodities from fair price shops under Delhi government's Aadhaar-based distribution move which was taken up last month. The Aadhaar-based e-PoS machines make use of Aadhaar biometric identification to make sure that a ration card-holder gets his/her allotted share of grains. The decision was taken in the cabinet meeting headed by Chief Minister Arvind Kejriwal earlier today. Deputy Chief Minister Manish Sisodia reasoned the implementation of the electronic Point of Sale (e-PoS) devices by the Ration Department to differ with the government's move of online ration distribution in 2,254 fair price shops. Sisodia noted that the "faulty implementation of the system" has resulted in problems for the locals who were not able to get their ration.

High Court to hear plea filed by disqualified AAP MLAs

Justice Rekha Palli allowed the MLAs to withdraw their plea, terming it "dismissed as withdrawn".

Advocate Manish Vashisht, appearing for one of the AAP MLAs, told the court that a notification has been issued on January 20 by the government after the President accepted the poll panel's recommendation.

Taking the submission on record, the court continued with its January 19 interim order giving no protection to the aggrieved legislators.

In its opinion sent to the President, the EC had said that by being parliamentary secretaries, they held office of profit and were liable to be disqualified as MLAs of the Delhi Assembly.

In their pleas, the legislators had sought a stay on the proceedings before the EC as well as any communication to the President by the poll panel.

They had contended that no hearing on the merits of the case had taken place before the EC, nor was any opportunity granted to the petitioners before the poll panel. They had also claimed that no evidence was led by complainant Prashant Patel.
