This aligns with central government guidelines, which clearly state that Aadhaar is not to be used as evidence for establishing birth information in any legal or official matter. 

According to the directive, Certificates issued only based on Aadhaar are to be cancelled immediately, and original documents must be recovered from beneficiaries. 

If a beneficiary cannot be traced or fails to surrender the certificate, police assistance must be sought, and the individual may be declared absconding.

The Budget also proposed to make PAN and Aadhaar interchangeable and allow those who do not have PAN to file income tax returns by simply quoting their Aadhaar number and also use it wherever they are required to quote PAN. Sitharaman said more than 120 crore Indians now have Aadhaar and the proposal aims at ease and convenience of taxpayers.

At the same time, pre-filed tax returns will be made available to taxpayers which will contain details of salary income, capital gains from securities, bank interests, dividends and tax deductions. "This will not only significantly reduce the time taken to file a tax return, but will also ensure accuracy of reporting of income and taxes," said Sitharaman.

The Judges also raised questions about why the business hours of liquor shops were not limited between 2 pm and 10 pm (the existing working hours are from 12 noon to 10 pm). Why not shut down the bars that are attached to these outlets, asked the judges.&nbsp;

These questions were raised given that school students and those below the legal age for alcohol consumption were able to purchase liquor from the state-run outlets. They also made a mention of how this could lead to a rising in illegal activities and road accidents. The judges also pointed out that various crimes took place at the bars attached to TASMAC outlets. The case has been adjourned and the Managing Director of TASMAC is required to file his reply before March 12th.&nbsp;

Attorney General K K Venugopal was referring to the written replies of UIDAI CEO Ajay Bhushan Pandey to the queries posed by the petitioners, opposed to the Aadhaar scheme and its enabling 2016 law, before a five-judge Constitution bench headed by Chief Justice Dipak Misra.

He said that school authorities can act as introducers to get children, between the age group of 5 to 15 years, enrolled for Aadhaar with the parental consent. Responding to a query whether a child, after attaining the age of 18 years, can opt out, the top law officer told the bench, also comprising justices A K Sikri, A M Khanwilkar, D Y Chanadrachud and Ashok Bhushan, that it is not permissible under the Aadhaar Act, 2016.

“However, residents have the option of permanently locking their biometrics and only temporarily unlocking it when needed for biometric authentication as per Regulation 11 of the Aadhaar (Authentication) Regulations, 2016,” he said. The lawyers for the petitioners had given a list of queries to the UIDAI CEO after he had concluded his PowerPoint Presentation (PPT) to allay apprehensions with regard the Aadhaar scheme.

In response to the query as to what were the Aadhaar authentication failure rates in the states and at the national level, Venugopal said the UIDAI cannot provide authentication failure rates at the state level since it does not track the location of the authentication transactions. Referring to the data, he further said that the biometric failure rates are at 6 per cent for fingerprints and 8.54 per cent for iris at the national level.

“It must be stated that authentication failures do not mean exclusion or denial from subsidies, benefits or services since the requesting entities are obliged under the law to provide for exception handling mechanisms,” he said. In response to a question as to how a leprosy patient or a person, who does not have a mobile number, is being enrolled for Aadhaar, the top law officer said, “Aadhaar enrolment is done for all residents, even of residents with leprosy. Biometric exception process is defined in the UIDAI resident enrolment process.

“In the case of a leprosy patient, who may not be able to do fingerprint authentication, iris authentication can be used for update (and the mobile number added). This was the reason for multi-modal enrolment and authentication being selected for use in Aadhaar.” As part of the exception handling mechanism, the UIDAI has already implemented a digitally signed QR code into eAadhaar which allows agencies to verify the Aadhaar card in an offline manner and trust the data, he said.

Venugopal said that as on March 21, the total number of biometric de-duplication rejections that have taken place are 6.91 crore. “This figure merely pertains to number of applications which have been identified by the Aadhaar de-duplication system as having matching biometrics to an existing Aadhaar number holder… “It is highly improbable for the biometrics to match unless the same person has applied again. There are a number of reasons why the same person might apply more than once.,” he said.

Venugopal said, “For instance, many individuals innocently apply for enrolment multiple times because of the delay in getting their Aadhaar cards due to postal delays, loss or destruction of their cards or confusion about how the system works.” Those whose enrolments have been rejected for any reason and who do not have Aadhaar can re-enrol and obtain it, he said, adding that rejection of enrolments did not mean that a person will never be able to get it.

Significantly, the latest development comes a day after a&nbsp;pregnant woman was denied admission in a hospital in Gurgaon for not furnishing her Aadhaar card.

UIDAI has taken a serious note of some of the cases reported in media recently in which it is claimed that the want of Aadhaar has resulted in the denial of essential services like hospitalisation or medical help by some lower level staffs causing grave inconvenience to people. While real facts behind such claims of denial are being investigated by the concerned agencies and strict action will be taken in case denial has occurred.&nbsp;

UIDAI said in a statement here today that the Government is sensitive to the fact that NO emergency services such as hospitalisation, etc., be denied for the want of any document whatsoever including Aadhaar. Aadhaar is meant to bring transparency and accountability in public service deliveries through effective use of technology and it should not be misused and made an excuse to any denial in the services.

The Cabinet Secretariat has issued instructions&nbsp;dated 19th December&nbsp;2017 to ensure that bonafide beneficiaries are not deprived of their due benefits as alternative provisions have been made in the Aadhaar Act, 2016.

Recent cases of denial of services like hospitalisation by the medical staff due to the lack of Aadhaar card has become a major concern for the UIDAI department.

UIDAI further explained that there are detailed guidelines issued for exception handling mechanism for extending benefits to beneficiaries who do not possess Aadhaar or in cases where Aadhaar authentication is not successful due to any reason. UIDAI is again writing a letter to the Chief Secretaries of all the States/UTs to ensure that Section 7 of Aadhaar Act, 2016 is implemented in its true letter and spirit for all the schemes at the ground level in service deliveries to beneficiaries so that no denial happens due to want of Aadhaar.

&quot;Aadhaar enables people to establish their identity so that they receive their entitlements and exercise their rights without any fear of being excluded.&nbsp;However, there have been some media reports that some service providers are denying essential and other services for want of Aadhaar. Such violations are punishable under respective laws of the land. Under no circumstance, anyone can be denied a service just because he/she doesn&#39;t have an Aadhaar,&quot; the statement said.&nbsp;

On Friday, an incident was reported from Gurgaon&rsquo;s Civil Hospital where a pregnant woman was denied admission and she gave birth outside the doors of the hospital. The Hospital has suspended a doctor and a nurse for the alleged lapse and ordered an enquiry into the incident.

The Supreme Court on Wednesday pulled up the Uttar Pradesh government for moving a petition to make Aadhaar card mandatory for individuals seeking entry at night shelter.

&quot;What happens to people who don&#39;t have Aadhaar? Do they not exist for the government of India?&quot; the court asked Uttar Pradesh government.

The bench told Additional Solicitor General (ASG) Tushar Mehta, who was appearing for Uttar Pradesh, that the authorities should keep in mind that this matter related to human beings.

&quot;There are a few things. We are talking about human beings who have no place to stay. Those who have no place to stay have to be given place to live,&quot; the court said.

ASG Mehta said the state was alive to the situation and was doing its best to provide shelter to urban homeless. He clarified that it was not correct to say that those who do not have Aadhaar do not exist, as they have other identification cards like voter IDs which contain their address.

During the hearing, ASG Mehta referred to the vision document prepared by Uttar Pradesh government to deal with the issue of urban homeless and said that as per 2011 census, there were around 1.80 lakh urban homeless in the state.

He said a scientific study was going on to get the latest figure but the vision document has been prepared keeping in mind the data of 1.80 lakh such persons in the state.

The bench also asked the state about the funds given to it by the Centre under the scheme.

Earlier, it was reported that people seeking night shelters in Hyderbad were not allowed to enter unless they presented Aadhaar card as identity proof.

Interestingly, there is no order either by the government or Supreme Court that makes Aadhaar compulsory. In December 2017, the Supreme Court passed an order extending the deadline to link Aadhaar with various schemes and said it will take up the issue of its constitutional validity in January this year.

Facebook has started an Aadhaar based feature on its platform, wherein it is asking new users in India to use the same name as displayed on their Aadhaar card while signing up for a new account.

The&nbsp;move is aimed to&nbsp;curb the number of fake accounts on the social media platform that has over 241 million users in the country, making India the second largest market for Facebook after the US.

The government has withdrawn the December 31 deadline for mandatory quoting of national biometric identifier Aadhaar and PAN for certain financial transactions like opening of a bank account.

The new rule notified in the Gazette modifies the Prevention of Money Laundering Act of 2002 to replace the requirement of submitting &quot;the Aadhaar number and Permanent Account Number by December 31, 2017&quot; with a provision saying &quot;submit the Aadhaar number, and Permanent Account Number or Form No. 60, by such date as may be notified by the Central Government&quot;.

While the 12-digit Aadhaar is issued by the Unique Identification Authority of India (UIDAI), PAN is allotted by the Income Tax Department. Form 60 is a declaration filed by an individual or a person (not being a company or firm) who does not have a PAN and who enters into any specified transaction.

Tuesday&#39;s notification by the Department of Revenue in the finance ministry effectively paves the way for extending the deadline for mandatory quoting of Aadhaar for activities like the opening of a bank account.

This is in line with the Centre last week informing the Supreme Court that it is willing to extend till March 31 the deadline fixed for mandatory linking of Aadhaar to avail various services and welfare schemes.

On December 7, the deadline for linking PAN with Aadhaar was extended by three months to March 31, 2018.

Under the PMLA, Aadhaar, PAN and other official documents are required to be obtained by banks and financial institutions from anyone opening a bank account as well as for any financial transaction of Rs 50,000 and above.

The notification issued on Tuesday stated that accounts where Aadhaar and PAN are not furnished by the date notified by the government will cease to be operational.

If the account holder &quot;fails to submit the Aadhaar number and PAN by such date as may be notified by the central government, the said account shall cease to be operational till the time the Aadhaar number and Permanent Account Number are submitted by the client&quot;, it said.

The Prevention of Money Laundering Act (PMLA) forms the core of the legal framework put in place by India to combat money laundering and generation of black money.

The PMLA and its rules impose an obligation on reporting entities like banks, financial institutions and intermediaries to verify the identity of clients, maintain records and furnish information to the Financial Intelligence Unit of India (FIU-IND).

As per Rule 9, every reporting entity shall at the time of commencement of an account-based relationship identify its clients, verify their identity and obtain information on the purpose and intended nature of the business relationship. 
Intermediaries like stockbroker, chit fund company, cooperative bank, housing finance institution and non-banking finance companies are also classified as reporting entities.

The broad rule also applies to all cash dealing of more than Rs 10 lakh or its equivalent in foreign currency, cash transactions where forged or counterfeit currency notes have been used and all suspicious dealings.

All cross-border wire transfers of more than Rs 5 lakh in foreign currency and purchase and sale of immovable property valued at Rs 50 lakh or more also fall under this category, according to the reporting rules.

Aadhaar-PAN linking: Government extends deadline to March 31

While it still remains compulsory to link your 12-digit Aadhaar number to bank accounts, PAN cards, government services and cell phone services, an interim relief comes through as the central government on Thursday informed the Supreme Court that it was willing to extend this year&#39;s deadline from December 31, 2017, to March 31, 2018.

The Supreme Court is now scheduled to hear the Aadhaar card case next week. Attorney General K K Venugopal informed a bench headed by Cheif Justice Dipak Misra that the Centre was willing to extend the deadline.&nbsp;

On October 25 this year, the Supreme court had said that the deadline for compulsory linking of Aadhaar to receive benefits of government schemes has been extended till March 31, 2018, for those who do not have the 12-digit unique biometric identification number. Senior Supreme Court lawyer Shyam Divan had mentioned before the top court about the expiration of the deadline this month and that the petitioners should be granted an interim relief in the form of an extended deadline.

The deadline for linking Aadhaar to cellphone numbers remains the same -- that is on February 6, 2018.

Although the deadline has been extended, it is important for users to be informed about the entities that must be linked to their Aadhaar before the deadline expires; these would include cell phone numbers, UAN number, PAN, insurance policies, ration card and bank account.&nbsp;
