Though the prosecution "tried", it failed to prove any "politician-police" nexus in the alleged fake encounter case of Sohrabuddin Shaikh, his wife Kausar Bi and his aide Tulsiram Prajapati, a special CBI court had said while acquitting all the 22 accused on December 21.

Special CBI Judge S J Sharma had acquitted all the accused due to insufficient evidence while expressing sorrow over the loss of three lives.

"I have no hesitation to conclude that the evidence which has been laid and adduced and discussed and appreciated vividly, though the prosecution has tried, it failed to prove any politician-police nexus," he said.

The remarks were part of the 358-page judgement. Copy of the full judgement was only made available on Monday.

The court stated that the CBI probed the alleged fake encounter killings with a 'pre-conceived and premeditated' theory to implicate political leaders.
Of the 22 accused who were acquitted, 21 were junior-level police officials from Gujarat and Rajasthan police.

The court has noted in its judgement that it was incumbent on part of the prosecution to procure sanction from appropriate authority to prosecute the 21 accused as they were all government servants.

"The 21 accused were certainly acting in the discharge of their official duties. The 21 accused were doubtlessly public servants when the alleged offence is alleged to have been committed," the judgement said."

In such circumstances, it was necessary for the investigation agency to obtain the sanction of competent authority before filing charge sheet. In absence of the sanction, the accused are entitled for acquittal," the court said.

According to the CBI, the police officials were part of teams which abducted and killed Shaikh, his wife and Prajapati in staged encounters.

The court said there was nothing to show that service weapons of the accused policemen were used in the killings.

The three victims who were returning to Sangli in Maharashtra from Hyderabad in a bus were taken into custody by a police team on the intervening night of November 22-23, 2005. The couple was taken in one vehicle and Prajapati in another.

The CBI had said Shaikh was killed on November 26, 2005, allegedly by a joint team of Gujarat and Rajasthan police, and Kausar Bi three days later.
Prajapati, who was lodged in Udaipur Central Jail, was killed in an encounter on the Gujarat-Rajasthan border on December 27, 2006, the investigation agency had alleged.

The court also noted that the prosecution had failed to prove that Prajapati was killed in a fake and staged encounter.

"No doubt that Tulsiram Prajapati suffered a homicidal death," the court said.

It added that statements of witnesses on Prajapati escaping from the custody of Rajasthan police in December 2006 appeared "cogent and convincing".
The court noted the evidence showed that there was an incident of cross firing between Prajapati and a police team.

The CBI had charged 38 persons, including BJP chief Amit Shah, who was the then Gujarat home minister, Gulabchand Kataria, the then Rajasthan home minister, and senior IPS officers like D G Vanzara and P C Pande in the case.

The prosecution examined 210 witnesses, of which 92 turned hostile.

Shah was arrested in the case in July 2010, but released on bail by the Gujarat High Court in October that year. He was discharged by the CBI court in December 2014.

The December 21 verdict was Judge Sharma's last judgement of his career. He is set to retire on December 31.

Telangana is a role model for the cause of farmers and it is at the top in Gross State Domestic Product in the country with revenue growth of 29.97 per cent for the financial year 2018-19, said the state Chief Minister K Chandrasekhar Rao on Monday here, adding that state government would spend Rs 10 lakh crore in the agriculture sector.

Conducting a high-level review meeting at Pragathi Bhavan on various aspects of the food processing industry, KCR stated: "Telangana is a role model for the cause of farmers and it should be at the top among other states in the country and it is at the top in GSDP" in the country with revenue growth of 29.97 per cent for the financial year 2018-19 ."

Stressing that there is a need for effecting change in certain traditional habits of farmers, KCR said, "There is a need to overcome the difficulties arising out of non-availability of appropriate statistical data pertaining to food and agriculture sectors, and greater results could be achieved if farmers are brought into the organised sector. The state is required to be divided into crop colonies and the entire crop produced by farmers shall be sold on demand."

The Chief Minister further said that rectification and purification of land records have been done and the extent of agriculture land is identified, and now we need to ensure minimum support price for the agriculture products.

Highlighting the needs to educate farmers to achieve better results, KCR asserted, "Traditional habits of farmers can be changed through a cooperative model and by bringing the farmer into organised sectors."

KCR also outlined that the farmers of the state should grow vegetables in the urban agglomeration by next rainy season since the government is getting water under Kaleshwaram project.

"In the next two year, most of the irrigation project will be completed bringing more than a crore of acres under cultivation," he said.

"These days every product is being adulterated if we can establish a brand name to products produced through government-sponsored food processing units and create confidence among the buyers then it will yield good results," KCR added.

Emphasising that it is the beginning of a revolution in food processing, KCR said, "The government is ready to spend any amount of money for learning, and for successful food processing units, officers should visit foreign countries to learn the best practices."

In a first, lakhs of women stood should-to-shoulder across the national highways in Kerala, creating a 620 km-long human 'wall' from the northern end of Kasaragod to the southern tip here on Tuesday as part of a state-sponsored initiative to uphold gender equality.

The event comes days after thousands of devotees lit 'Ayyappa Jyothies' (lighting of sacred lamps) and lined up from Hosangadi in Kasargod to Kanyakumari, vowing to protect the age-old customs and traditions of Sabarimala.

On Tuesday, women from various walks of life -- writers, athletes, actors, politicians and techies, government officials and homemakers -- stood across the highways crisscrossing through the 14 districts in the state as the event commenced at 4 pm.

Expressing solidarity, thousands of men also lined up parallel forming a second human 'wall'.

The 'Women's wall' was conceived in the backdrop of frenzied protests witnessed in the hill shrine of Lord Ayyappa at Sabarimala after the CPI(M)-led LDF government decided to implement the Supreme Court verdict, allowing all women to pray at the Ayyappa shrine.

The event is part of an initiative to protect secular values, gender equality and to spread a message against those trying to push society into the dark ages, organisers of the programme said.

Before the formal start of the event, Chief Minister Pinarayi Vijayan garlanded the statue of social reformer 'Ayyankali'.

CPI(M) politburo member Brinda Karat and CPI leader Annie Raja also paid floral tributes at the statue.

Vijayan had earlier expressed confidence that women, cutting across lines of caste and religion, would join the 'wall' to save Kerala from being "dragged back into the era of darkness."

CPI(M) state secretary Kodiyeri Balakrishnan had earlier said that 50 lakh women were expected to take part in the event.

Health minister K K Shylaja led the 'Women's Wall' at Kasaragod and Karat was the last person at the end at Vellayambalam here.

School students were given half-day holiday, while universities postponed exams scheduled for Tuesday.

The government employees and Technopark employees were allegedly asked to take part in the event, which the main opposition Congress-led UDF dubbed "caste wall" and "wall of contradictions".

The participants began lining up at the designated centres since 3 pm. A rehearsal was also held.

The 'wall' was formed at 4 pm, with participants taking a pledge to uphold gender equality and renaissance values.

The campaign was suggested at a meeting called by the LDF government following massive protests by right-wing parties and a section of devotees over the government's decision to implement the September 28 apex court order, allowing women of all ages to offer prayers at Sabarimala.

In a first, lakhs of women stood should-to-shoulder across the national highways in Kerala, creating a 620 km-long human 'wall' from the northern end of Kasaragod to the southern tip here on Tuesday as part of a state-sponsored initiative to uphold gender equality.

Vijayan had earlier expressed confidence that women, cutting across lines of caste and religion, would join the 'wall' to save Kerala from being "dragged back into the era of darkness." CPI(M) state secretary Kodiyeri Balakrishnan had earlier said that 50 lakh women were expected to take part in the event. A latest study in Bengaluru by Redseer Consulting has quantified the loss being caused to the IT sector due to employee's lifestyle habits. According to the survey, the city's IT sector is losing 24,000 crores annually due to bad lifestyle choices.

Sedentary lifestyle and stress have often been termed as the big devils of the corporate sector around the world. In an attempt to quantify the monetary loss caused by lifestyle-related problems in the IT sector in Bengaluru, a consulting firm in the city carried out a survey across ten Information Technology firms. The figures are astounding.

According to the study, the 50 billion dollar IT industry of Bengaluru could be losing as much as 3.5 billion dollars or Rs 24000 crore due to employees health and lifestyle habits.

Of this, physical inactivity and emotional and mental health contribute to almost 50 per cent of the productivity loss.

''The biggest finding of the report is the contribution of 'emotional and mental health' to the loss of productivity. We believe that companies should take initiatives to help employees reduce mental stress through specific programs which will reflect in higher productivity,'' says Ujjwal Chaudhry, Associate Director of Redseer Consulting.

Employees in the 30-40 age group were found to be contributing to 42 per cent of the productivity loss with health-related issues and those in the 20-30 age groups were found to be contributing to 30 per cent of the loss with poor diet, says Aruna Prasad, a city-based nutritionist.

Every second or third client that Prasad attends to is from the corporate sector.

''Most of these clients have issues because of the wrong lifestyle they have led all these years. But they assume that it is because age is catching up. Just becayse someone is 30, they need not have to have gut issues or put on weight.’ says Aruna.

The respondents were analysed on five different parameters - Physical inactivity, Emotional and Mental Health, Physical Health, Poor diet and substance abuse.

25 per cent of the respondents were contributing to the productivity loss by physical inactivity, 23 per cent through emotional and mental health, 21 per cent through physical health, 18 per cent through poor diet and 13 per cent through substance abuse.

However, keeping note of the growing rate of obesity and sedentary lifestyle in the corporate sector, some companies have started incorporating measures. With in-house gyms, wellness centres, nutritionists and healthier eating options, companies are attempting to change the trend.

''Physical Inactivity contributes to majority share of overall cost to IT industry resulting from productivity loss. We believe that there is an initial threshold among employees for physical activity and thus companies can partner with fitness players who can involve employees to reduce the threshold’, says Chaudhry.

Fahad Khalid, an IT professional in the city, has managed to maintain a better work-life balance thanks to the facilities provided by his organisation. ‘We have our own in-house fitness centre. It makes it convenient for the employees to form a routine with the workout.
They can go for yoga or kickboxing at any point during the day. There is also healthier food being provided in the cafeteria. We also have frequent sports challenges and competitions every month to motivate employees and better their productivity’ says Fahad.

While the survey in question was restricted to the Bengaluru IT sector, the same can probably be applied to employers across the board.

Sedentary lifestyle might not just be costing employee health, but could be taking away a considerable chunk of productivity away from the companies.

The commission, headed by Justice (retired) J N Patel, was set up on February 9 last year and had eight sittings in Pune and Mumbai so far, he told PTI.

Apart from Justice Patel, a retired judge of the Calcutta High Court, the other member in the judicial commission is Sumit Mullick, Maharashtra Chief Information Commissioner.

A sum of Rs 62 lakh has been provided so far for expenses incurred by the commission, Patil said.

While it was given four months time to probe the incident, its tenure was later extended by a year.

On January 1 last year, the event to mark the 200th anniversary of the 1818 Bhima Koregaon battle in Pune district was marred by violence, allegedly provoked by right-wing groups, resulting in the death of one person and extensive damage to public property.

'Wall of Kindness' warms up Jammu and Kashmir

"Come back before sunrise, irrespective of the success or failure of the mission". This was the message of Prime Minister Narendra Modi to the Indian Army Special Forces' commandos who went across the Line of Control (LoC) on September 28, 2016 to carry out surgical strikes at terrorist camps in Pakistan-occupied-Kashmir.

Modi, while revealing details of the military action for the first time, told ANI in an interview that the date of the attack was changed twice, keeping in mind the safety and security of the troops.

The strikes were carried out days after terrorists attacked an Army camp in Uri in Kashmir, killing 20 soldiers. The Prime Minister said the surgical strikes were planned as there was a "rage" building up within him as well as the Army after soldiers were burnt alive in the terror attack in Uri.

"I gave clear orders that whether you get success or failure, don't think about that but come back before sunrise. Don't fall for the lure and prolong it (the operation)," he said, turning a bit emotional while discussing that operation.

Emphasising that he was determined to see that none of the soldiers died in the operation, he said he had told them that they must return before sunrise even if they fail. The Prime Minister revealed that he was keeping tab of the risky operation throughout the night and was getting live information.

"I knew it was a big risk. I never care about any political risk to me. The biggest consideration for me was the safety of our soldiers," he said.

He said he didn't want any harm to come to the commandos who were "willing to sacrifice their lives on our word." The Prime Minister disclosed that the commandos for the operation were chosen carefully and then imparted special training. Whatever equipment was required, it was arranged for them, he said.

He said he was "anxious" throughout the time the soldiers were on the other side of the LoC and the moments became "extremely difficult" when the information flow stopped for about an hour in the morning.

"In the morning, information flow stopped, for an hour. My anxiety increased. Even one hour after sunrise. That time was extremely difficult for me... Then came the information that they have not reached back yet but two-three units have reached the safe zone, so don`t worry. But I said I won`t be fine till the last man returns," Modi said.

On politicisation of the surgical strikes, the Prime Minister said it was not done by the government but by opposition parties, which "raised questions" over the military action and cited the Pakistani version to "lend weight to their doubts".

The Prime Minister said that even before the country was informed about the strikes, Pakistan was told about it.

"An Army officer apprised the nation (India) of the operation. That information was given to Pakistan as well... But it is unfortunate for the country that the same day (of the surgical strike), leaders of some parties raised doubts over the surgical strikes," Modi said.

"It was necessary for Pakistan to speak like this (to deny), to keep their morale intact. But what Pakistan was saying, was being said here too. To lend weight to their views, they were citing Pakistani version. Politicisation started from that point," he added.

Delhi CM and AAP supremo Arvind Kejriwal in a series of tweets post surgical strikes raised doubts over the veracity of the Government`s claims.

Kejriwal said that Pakistan had invited foreign journalists to view their side of the border to ascertain claims of a surgical strike. "BJP I believe you. But international media publishing Pak propaganda that no strike took place.

Lets expose Pak propaganda," tweeted Arvind Kejriwal on October 4th, 2016.PM Modi added that the opposition leaders were speaking "rubbish" and "those who raised doubts over the Army action, were wrong and such politicisation should not have happened".

Modi said lauding the valour of soldiers from all operations including the 1962 war with China was the duty of the government and citizens.

"If we don`t hail the valour of those who stake their lives for the country, then who will? So praising the Army should not be considered as politicisation," he said.

The Prime Minister was asked whether the objectives of the surgical strikes were met, considering that cross-LoC attacks still continue in Kashmir.

In response, he said he would not like to discuss the issue in open domain.

But then he went on to add, "Ek ladai se Pakistan sudhar jayega, yeh sochne mein bahut badi galti hogi. Pakistan ko sudarne mein abhi aur samay lagega (It will be a big mistake to think that Pakistan will start behaving after one fight. It will take a long time for Pakistan to start behaving).

Talking about the Uri attack, Modi said, "That incident made me restless and there was rage within me. I had gone to Kerala and made a mention of this. Because I could not stop myself.

Modi said that while talking to the Army, he realised that they wanted justice for their martyred soldiers and the government gave them the "free hand" to plan and execute the surgical strikes.

Special training was imparted to the commandos and secrecy was maintained."The topography and obstacles were kept in consideration... It was a learning experience for me as well," Modi said.

In September 2016, terrorists of Pakistan-based Jaish-e-Mohammed entered the Army camp in Uri near the Line of Control and killed 20 soldiers in the attack.

In retaliation, the Indian Army troops including the commandos from various units of the Para (Special Forces) units deployed in Jammu and Kashmir carried out raids across the border on multiple targets.

All these targets were launch pads for terrorists for infiltrating into Jammu and Kashmir for carrying out attacks against military and civilian targets.

Though the security forces are not sure about the exact number of casualties on the Pakistan side but based on post-operation intercepts and movements, it is believed that it had suffered around 50 casualties including its regular Army soldiers who were deployed for protecting the terror camps.

From the Indian side, only one soldier had suffered injury due to a personnel mine explosion while returning from the operation.

Surgical strikes decision was a 'big risk' but I was more concerned about safety of soldiers: PM Modi

The filing of claims and objections to decide the fate of 40 lakh people whose names were excluded from the draft list (released on July 30 last) had begun on September 25, 2018 and ended on December 15 that year.

The Supreme Court had pushed the date to December 31, 2018 after the Assam government sought extension of the last date following demands for it by various local organisations.

Reports appearing in a section of media claimed around 30 lakh people had filed claims for inclusion by Monday evening, when the deadline for the Claims and Objections' round ended.

The claims and objections were earlier scheduled to be filed in August, but the Supreme Court reprimanded the NRC Coordinator and Registrar General of India for announcing the dates without the Standard Operating Procedures (SOP) being approved and directed them to refrain from talking to the media.

The National Register of Citizens (NRC) is being updated under the direct monitoring of the Supreme Court.

The second and complete draft of NRC was released on July 30, 2018 that included the names of 2.9 crore people out of the total applications of 3.29 crore.

A fortnight ahead of the 'Kumbh Mela', the Centre has approved the renaming of Allahabad as Prayagraj as sought by the Uttar Pradesh government, officials said Tuesday.

The decision came more than two months after the state government, headed by Chief Minister Yogi Adityanath, took the decision to rename the historic city as Prayagraj.

The central government has given its consent for renaming of Allahabad as Prayagraj about 10 days ago, a home ministry official said.

The 'Kumbh Mela' in Prayagraj will start on January 15 on 'Makar Sankranti' and will conclude on March 4 on 'Maha Shivaratri'.

The central government has given consent to the renaming of at least 25 towns and villages across the country in the past one year. The renaming proposal of UP's Faizabad district as Ayodhya is yet to be received from the state government.

A proposal to rename West Bengal as 'Bangla' is pending as the Ministry of External Affairs is understood to have expressed its reservation over the new name, as it sounds similar to Bangladesh. A decision in this regard is expected soon as the general election in the neighbouring country concluded on Sunday.

The Union Home Ministry considers the proposals of name change according to the existing guidelines in consultations with agencies concerned.

It gives its approval to the change of name of any place after taking no-objections from the Ministry of Railways, Department of Posts and Survey of India. These organisations have to confirm that there is no such city, town or village in their records with a name similar to the proposed one.

For changing the name of a village or town or a city, an executive order is needed. The renaming of a state requires amendment of the Constitution with a simple majority in Parliament.

Terming Government's flagship scheme Ayushman Bharat a 'game changer' in healthcare, Finance Minister Arun Jaitley Tuesday said, as many as 6.85 lakh poor patients have been provided free hospital treatment in the first 100 days of the launch of the programme.

He further said, on an average 5,000 claims are being settled every day since its roll out on September 23, 2018.

"Once awareness of the scheme increases, It is anticipated that in the next few years, almost 1 crore plus families will benefit each year," Jaitley said in a Facebook post titled '100 days of Ayushman Bharat'.

The total number of hospitals covered by this scheme are both Government hospitals and private hospitals presently numbering 16,000 and increasing steadily. More than 50 per cent of the implementing hospitals are in the private sector.

Jaitley said in the first 100 days, 6.85 lakh patients have been provided hospital treatment and 5.1 lakh claims have availed of the scheme, for which payment has been released.

Prime Minister Narendra Modi in September launched the Ayushman Bharat Pradhan Mantri Jan Aarogya Yojana which aims to provide a coverage of Rs 5 lakh per family annually, benefiting more than 10.74 crore poor families or over 50 crore people for secondary and tertiary care hospitalisation through a network of empanelled health care providers Jaitley said this scheme is a "game changer" in healthcare and will cover 40 per cent of country's population which cannot afford to pay their medical bills.

"Many people from the weaker sections avoided hospital treatment in order to avoid the burden of an unbearable payment. Today 40 per cent of India's poorest are assured of a treatment in a hospital at the cost of public expenditure," he said.

He said although government employees, armed forces personnel and some corporate employees have healthcare support facilities, but 62.58 per cent of the Indian population has to pay their healthcare bills themselves and most find it unaffordable.

He said the launch and implementation of the scheme, which is cashless and paperless, has been relatively problem free.

For the third consecutive day, the air quality in the national capital was in the severe category on Tuesday.

According to the Central Pollution Control Board (CPCB) data, the overall air quality index (AQI) in the national capital on New Year's Day was 404, while the Centre-run System of Air Quality and Weather Forecasting (SAFAR) recorded an AQI of 405, both of which are under the 'severe' category.

Nineteen areas in Delhi recorded 'severe' pollution, while 14 witnessed 'very poor' air quality, the CPCB data showed.

Ghaziabad and Noida recorded 'severe' air quality, while in Faridabad and Gurgaon recorded it was in the 'very poor' category.

The overall PM2.5 level (fine particulate matter in the air with a diameter of less than 2.5 micrometers) was recorded at 280 and the PM10 level at 465 in Delhi, the CPCB said.

The SAFAR has said the air quality would improve slightly "provided that no additional local emissions are added on New Year eve".

"Any new trigger in terms of additional local emission, particularly from open fire, pyrotechnic display and fossil fuel burning may make air heavier and thick with low ventilation, and may lead to rapid deterioration in air quality to severe-plus range," the SAFAR said.

But despite warnings, several instances of firecracker bursting, before and after the time limit fixed by the apex court, were observed in Delhi-NCR during New Year celebrations.

The SAFAR said the air quality in Delhi is likely to remain in the 'severe' zone for the next two days as weather conditions are more adverse now.

"The deterioration in speed of moisture-laden wind from west may become fatal at this stage and any new trigger, in terms of local emission, particularly from open fires, firecrackers and (burning of) fossil fuels will fast deteriorate the air quality and keep it in the 'severe' category," it said.

The India Meteorological Department (IMD) and SAFAR said the air quality is likely to remain in the 'severe' category owing to low wind speed, which is highly unfavourable for dispersion of pollutants.

The authorities warned that moderate fog and emissions during night hours may result in deterioration of the air quality and this situation may prevail till Wednesday.

The SAFAR also pointed out that a consistent day-night trend is being observed for the past week.

"During night, a combination of calm wind and colder condition is elevating the pollution level. In many locations, 24-hour rolling average (AQI) is touching 'severe' levels for a few hours, whereas during the day wind is picking up speed slightly and temperature is increasing to keep the level in the 'very poor' range," it said.
