Congress leader DK Shivakumar on Thursday moved the Delhi High Court for bail in connection with the money laundering case.

Shivakumar`s legal team approached the High Court after his earlier bail plea was dismissed by a special court in Delhi on Wednesday.

The special court had dismissed his bail plea stating that the Karnataka Congress leader is "not entitled to bail" at this stage.

The bail plea was rejected by special court judge Ajay Kumar Kuhar, who said that investigation agency must get a free and fair chance to reach a logical conclusion.

The court added that the "accused is not entitled to bail" at this stage of the investigation, adding that the Enforcement Directorate arguments had presented some crucial documents and list of 317 alleged bank accounts of the accused.

The court had also directed the Tihar jail authorities to take care of his all medical issues and take him to Ram Manohar Lohia, Safdarjung and AIIMS hospitals if needed.

Shivakumar, who is currently lodged in Tihar Jail under judicial custody of Enforcement Directorate, sought bail on health grounds. However, the ED opposed the bail stating that the accused may influence witness and tamper proofs.

DK Shivakumar is currently lodged in Tihar Jail under judicial custody of ED till October 1.

The Central government on Wednesday notified that the Unlawful Activities (Prevention) Tribunal has upheld that there is "sufficient credible material and grounds" to declare Jammu and Kashmir Liberation Front (JKLF-Y), a faction headed by Yasin Malik, as an "unlawful association".

The incumbent government had in March earlier this year declared the faction as an unlawful association, following which a tribunal, headed by Justice Chander Shekhar was constituted to adjudicate the same.

The tribunal, in its order on September 20, held that the activities of the faction are "disruptive in character, which threatens the sovereignty and territorial integrity of India".

"The Central government had sufficient credible material and grounds for taking action for declaring 'JKLF-Y' as an 'unlawful association'. It is held that there is 'sufficient cause' to confirm the notification of the act declaring 'JKLF-Y' to be an 'unlawful association'," Justice Chander Shekhar stated in the order.

The order stated that the faction has been acting "in collusion with other similar groups to disrupt peace and harmony in Jammu and Kashmir.

To substantiate its contention before the tribunal, the Central government had submitted a list of 98 FIR filed against the faction.

"A careful perusal of the FIRs brought on record makes it apparent that the association has been actively indulging in and supporting anti-national activities," Justice Shekhar stated.

The tribunal observed that there is sufficient noticeable credible material including the FIRs coupled with corroborative intelligence inputs which justified the action taken by the government.

"Even in cases where FIRs are lodged for slogan shouting, the contents of the slogan are a direct affront to the sovereignty of the state and are undoubtedly anti-national, such protests can certainly not be a part of any democratic process," the order stated.

It asserted that there is a significant difference in protesting on an issue and protesting for "territorial sovereignty".

&nbsp;"There are statements attributed to Yasin Malik which are separatists in character and support extremism and militancy in Jammu and Kashmir. Such statements have the potential of instigating sentiments which ultimately become prejudicial to the territorial integrity and security of the country," it said.

The tribunal also rebutted the contentions put forth by the faction that the exercise of banning it is "vindictive in character or unconstitutional".

External Affairs Minister S Jaishankar on Wednesday called Pakistan a "challenging neighbour" and stressed while there is terrorism globally, there is no country in the world that sponsors terror consciously and deliberately against India.

"You have a neighbour who will not trade with you who will not allow you connectivity who has slowed down regionalism who filters people-to-people interaction. It is a very challenging neighbour," he said in an interactive session with Frank G. Wisner, a former US ambassador to India.

"You have terrorism in different parts of the world, but there is no part of the world where a country uses it consciously and deliberately as a large scale industry against its neighbour," the minister stressed.

<a href="https://www.wionews.com/south-asia/china-misread-indias-action-to-nullify-article-370-jaishankar-251943">Jaishankar </a>said that a country is ready to have a dialogue with their neighbour, but questioned that how India can have negotiations with a nation that is nurturing terror and following a policy of implausible deniability, in a reference to Pakistan.

"The issue is not whether to talk or not, everybody wants to talk to their neighbour. The issue is how do I talk to a country that is conducting terrorism and follows a policy of implausible deniability," he said.

He said he does not think that the fundamental issue between India and Pakistan is Kashmir.

"To my mind, the big challenge before us is if you have differences with a neighbour, how do you resolve it? Now, these differences are not normal because they are rooted in our history, which is not normal," Jaishankar remarked.

"Now all of that you could still handle if they do not do the one thing which is actually unacceptable &nbsp;to conduct terrorism, which in their eyes is a legitimate tool of statecraft as a way to pressure you to come to the negotiating table," he said, adding that it was not acceptable as a norm in international relations.

India has repeatedly maintained that dialogue with Pakistan will not be initiated until it takes concrete action against terror emanating from its soil.

Calling Pakistan "<a href="https://www.wionews.com/india-news/no-problem-talking-to-pakistan-but-have-problem-talking-to-terroristan-jaishankar-251859">terroristan</a>", Jaishankar on Tuesday had said that Islamabad has created an "entire industry of terrorism" to fuel unrest in Jammu and Kashmir and New Delhi cannot talk to a country that sponsors terror.

"They have to accept the model which they have built for themselves, no longer works. You cannot in this day and age, conduct policy using terrorism as a legitimate instrument of statecraft that is at the heart of the issue. We have no problem in talking to Pakistan, we have a problem talking to terroristan," the minister said during an interview with Asia Society Policy Institute's President Kevin Rudd.

India on Wednesday reiterated that its stance on Pakistan's efforts to combat terrorism has not changed and urged Islamabad to take concrete steps to tackle the menace.

"Our position on how the matter has to be addressed has been answered in the past and there is no change in that position." MEA spokesperson Raveesh Kumar told reporters at a special media briefing.

Prime Minister <a href="https://www.wionews.com/india-news/narendra-modi-holds-meetings-with-business-leaders-in-new-york-252095">Narendra Modi</a> said on Tuesday that India is not shying away from talks with Pakistan. He said that for India to initiate dialogue with Pakistan the latter country has to make efforts to combat terrorism.

Modi made the statement during the bilateral meeting with US President <a href="v">Donald Trump</a>."The Prime Minister made it clear (to Trump) that we are not shying away from talks with Pakistan, but we expect certain concrete steps to be taken by Pakistan before that, and we don't find any efforts by them," Foreign Secretary Vijay Gokhale had told reporters at a briefing after the bilateral meeting between the two leaders.

India raised the challenges it has been facing with regard to terror especially in Jammu and Kashmir for the last 30 years, Gokhale said.

New Delhi has repeatedly maintained that dialogue with <a href="https://www.wionews.com/india-news/pakistan-approaches-unsc-to-allow-release-of-monthly-expenses-for-terrorist-hafiz-saeed-committee-allows-request-252107">Pakistan </a>will not be initiated until it takes concrete action against terror emanating from its soil.

Kumar also reiterated India's stand on Kashmir issue that it is a bilateral matter between India and Pakistan and there is no scope for third-party mediation.

"Even yesterday, he (Trump) said that India and Pakistan should both agree for any kind of mediation. Our position is very clear, it has been articulated by the Prime Minister (Modi) earlier. That position remains," he said.

Tensions between India and Pakistan soared following New Delhi`s decisions to abrogate Article 370 which gave special status to Jammu and Kashmir. Pakistan has downgraded its diplomatic ties and suspended bilateral trade with India in the aftermath of the move.

India has maintained that its constitutional decisions on Kashmir are its internal matter a stance that has been supported by many countries around the world.

In a clear indication that judgment in Ayodhya dispute case is likely to be delivered before CJI Ranjan Gogoi's retirement in November, the Supreme Court on Thursday said that it cannot grant even a single extra day beyond October 18 to all petitioners to complete their submissions.

A five-judge Constitution bench, headed by Chief Justice Ranjan Gogoi said that it doesn`t want to give even "one day extra" beyond October 18 after it was apprised by the lawyers that their submissions will be completed by the said date in "all the possibilities and manner".

Today was the 32nd day of the day-to-day hearing on a batch of appeals filed by Muslim and Hindu parties challenging the 2010 Allahabad High Court judgment, which has ruled to divide the disputed site into three equal parts.

The bench will write the landmark judgement for ownership of 2.77-acre land once the arguments are concluded by lawyers of UP Sunni Waqf Board, Nirmoni Akhada and Ram Deity three parties in the case.

On September 18, the court said that arguments have to be completed by October 18 even as the mediation panel may continue its work under confidentiality.

"As per the estimate of tentative dates to finish the hearing in the case, we can say that the submissions have to be likely completed by October 18," Gogoi had said.

Earlier, the court had observed that the hearing of the appeals, which is at a very advanced stage, will continue without any interruption.

It is to be noted that CJI Gogoi is set to demit office on November 17 and he has to deliver the judgement before that as he had entirely heard the case from the beginning of the arguments.

The court had also said that simultaneously the mediation process can go along with the hearing and if an amicable settlement is reached through it, the same can be filed before the court.

The day-to-day hearing started on August 6 after a court-appointed mediation panel failed to resolve the dispute through an amicable settlement.

CBI officer Satish Dagar, who was investigating the corruption case against former special director Rakesh Asthana, has applied for voluntary retirement, CBI spokesperson said on Wednesday.

"CBI SP Satish Dagar has submitted an application for voluntary retirement from service (VRS) citing personal grounds," the CBI spokesperson said.

The agency had last year registered an FIR against Asthana for allegedly taking bribe from a person in exchange of ensuring relief in the case.

Following this, the Centre had sent the then CBI director Alok Verma and his deputy Rakesh Asthana on leave as they both levelled allegations of corruption against each other.

On May 31, the Delhi High Court granted the agency four months to complete the investigation in the case.

Dagar was made the investigating officer (IO) in the case, replacing A K Bassi who was transferred to Port Blair in "public interest" by acting CBI director M Nageswar Rao, who took charge after Verma was sent on leave.&nbsp;

External Affairs Minister S Jaishankar on Wednesday outlined that before the abrogation of Article 370 Jammu and Kashmir were in a mess while adding that the restrictions were imposed in the region to prevent loss of lives following the stripping of special status.

He said that the Indian government's first concern was to ensure that there was no loss of lives due to violence and demonstrations in the region post abrogation of Article 370.

"We had the experience of 2016 when a self-advertised terrorist cult figure called Burhan Wani was killed and after that, there was a spike in violence. Our intention was to manage the situation (post Article 370) without loss of life and restrictions were intended to do that," he said.

"As many as 42,000 people were killed in the last 30 years. Level of intimidation had reached a height where senior police officers were lynched on streets of Srinagar. Journalists who wrote against separatism were assassinated, military personnel returning home for Eid were kidnapped and killed. So, Pre August 5 Kashmir was in a mess. Difficulties in Kashmir did not start on August 5. It is supposed to be a way of dealing with those difficulties," the minister underlined.

<a href="https://www.wionews.com/india-news/no-problem-talking-to-pakistan-but-have-problem-talking-to-terroristan-jaishankar-251859">Jaishankar </a>said that the situation in the region has now stabilized and lots of restrictions have been rolled back including the operationalizing of landlines and mobile towers and resumption of economic activity.

"Particular efforts are being made to keep the supplies normal in the state. This is a harvest season for apples. Efforts are being made to procure apples so that farmers do not get victimized by these changes," he said.

He explained how Jammu and Kashmir acceded to <a href="https://www.wionews.com/india-news/clear-attempt-at-pandering-to-vote-bank-interests-india-condemns-labour-party-motion-on-kashmir-252103">India </a>after the country gained freedom in 1947 and the drafting of Article 370.

"The situation in Jammu and Kashmir was peculiar for a number of reasons as it was a border state but also they were themselves under attack at that time. They had the desire to extend the period of alignment with the rest of India in terms of the application of laws. The Constituent Assembly recognized that it was a special case at that time," he said in an interactive session with Frank G. Wisner, a former US ambassador to India.

"The only temporary article of the constitution was drafted which was called Article 370. At that time, it was numbered as 306a. After the Constitution was adopted, there was a series of presidential proclamations under that article that started aligning the state. In the last 70 years, you had 54 of these presidential proclamations," Jaishankar added.

Outlining the reasons for the problems faced in Jammu and Kashmir after Article 370 was adopted, the minister said that the presidential proclamations were very rapid in the initial years and there was a climate of intimidation and separatism in Kashmir.

"You did not have the economic activity in Jammu and Kashmir as compared to the rest of India. There were less job opportunities and there was a more sense of alienation, separatism and therefore, a climate of terrorism across the border. The state was in socio-economic terms less aligned with India. 100 important progressive laws of India did not apply to Kashmir," Jaishankar remarked.

The minister said that the temporary provision allowed a set of narrow elite to arbitrage Article 370 for monopolizing political power and creating a closed-loop politics.

"They had vested interests in keeping alive separatist sentiments. You had a situation where separatist political parties were openly allied with terror groups operating out of Pakistan. They had vested interests in keeping alive separatist sentiments," he said.

India has repeatedly maintained that constitutional changes made by its government on Kashmir are strictly an internal matter, a stance supported by several countries, including those from SAARC and Arab World.

Pakistan, on the other hand, has "condemned" the move and downgraded its bilateral ties with India. Islamabad has since resorted to anti-India rhetoric and has attempted to internationalize the Kashmir issue but to no avail.

Bangladesh Prime Minister <a href="https://www.wionews.com/south-asia/sheikh-hasina-expects-positive-response-from-india-over-unresolved-issues-including-teesta-249183">Sheikh Hasina</a>&nbsp;on Tuesday said that Mahatma Gandhi's love for common people and ideals of non-violence contributed to shaping Bangabandhu Sheikh Mujibur Rahman's vision of struggle and peaceful movement against oppression by the then Pakistani rulers against peace-loving Bengalis during the country's freedom struggle in 1971.

"Gandhi Ji's love for common people and ideals of non-violence contributed to shaping Bangabandhu Sheikh Mujib's vision of struggle, non-cooperation and peaceful movement against oppression and tyranny by the then Pakistani rulers against the peace-loving Bengalis," she said at the 'Relevance of Mahatma Gandhi in the Contemporary World'&nbsp;programme at UN headquarters here.

"He (Sheikh Mujib), however, declared the independence of Bangladesh on March 26, 1971, and called for armed struggle against the Pakistani military dictators when they unleashed an unprecedented genocide against the unarmed civilians in Bangladesh," she remarked.

The Supreme Court on Tuesday rapped all the social media platforms for not being able to establish the original sender of messages.&nbsp;
A bench headed by Justice Deepak Gupta expressed concern over WhatsApp's inability in tracing message sources, adding that unregulated online media was a major concern.&nbsp;

During the course of hearing, justice Deepak Gupta remarked, "It is dangerous the way the technology is going. After the last hearing, I researched and found I could buy an Ak-47 on the dark web and in 30 minutes".&nbsp;

There has been massive concern over the spread of fake news, the government has been attempting to enable tractability of such messages but online messaging services like WhatsApp have maintained that they cannot do much as the messages are end-to-end encrypted which disallows privacy invasion. Visibly angered justice Deepak Gupta said he has denounced the use of smartphones, "I was thinking of giving up my smartphone and going back to the old way".

Expressing concern over the spread of fake news, the apex court asked the Centre to file an affidavit within three weeks to come up with social media guidelines without compromising individuals' privacy and protecting the sovereignty of the State.

“The originator (of fake messages) must be traced. At the same time, the sovereignty of the nation and the privacy of individuals should be maintained," said the bench.

The court was hearing a petition filed by social media giant Facebook Inc. for the transfer of the cases from High Courts of Madras, Bombay and Madhya Pradesh to the Supreme Court which sought to link Aadhaar with social media accounts.

The Indian Air Force (IAF) has placed its airbases on orange alert based on intelligence inputs about a possible suicidal terror attack on them in and around Jammu and Kashmir.

According to top sources in the government, intelligence agencies have issued warning against a module of eight to 10 Jaish-e-Mohammed (JeM) terrorists who will possibly try to carry out a suicidal attack against air bases in and around areas of Jammu and Kashmir.

An orange alert has been sounded for Srinagar, Avantipur, Jammu, Pathankot, Hindan airbases after the monitoring of the terrorists` movements by the intelligence agencies.

The orange alert is the second-highest level of alert second only to Red alert which, if issued, would entail closing of schools and restriction on movements in airbases.

Senior officers are reviewing security arrangements round the clock to tackle the threat, sources said.

This came two days after Army chief Bipin Rawat said Balakot terrorists` camp in Pakistan, which was destroyed by the IAF in February, had been reactivated to send terrorists across the border in India in the backdrop of heightened tension between India and Pakistan over the abrogation of special status to Jammu and Kashmir.

Last month, Pakistan had, the government sources said, deployed its Special Service Group (SSG) commandos along the Sir Creek area in Gujarat.Security forces have eliminated several terrorists and foiled several infiltration bids over the past two months.&nbsp;

To mark the 150th birth anniversary of Mahatma Gandhi, a side event was held on Wednesday at UN office in Geneva during the 42nd session of the Human Rights Council.

Experts and diplomats shared a platform to discuss Gandhi's message of non-violence in the modern age.

The title of the theme was 'International Day of Non-Violence: Mahatma Gandhi's thinking and the University of Human Rights': In this period of global uncertainty, the multiplication conflicts, the threat of war, the destruction of the environment, natural disasters, the rise of hatred, violent extremism, xenophobia, religious intolerance, racism and racial discrimination; the Non-Violence advocated by Mahatma Gandhi remains forever a source of inspiration for the well being of humanity.

In his address, Shaibal Roy Chowdhury, Minister and Consul General of India in Geneva said, "It is a great pride for India that the UN has honoured the memory of our father of the nation by designating October 2 as the International Non-Violence Day".

"Mahatma Gandhi was born in India but he belongs to the entire humanity. His life and values inspire people across continents. The most influential Indian of the 20th century, Gandhi ji remains the benchmark against which we access our public functionaries, political ideas and government policies as well as hopes and aspirations of our country and our people," he said.

Sultan Chouzour, Ambassador, Permanent representative of Comoro's at the UN Geneva and Valeriane Bernard of Brahma Kumaris World Spiritual University UN Representative also attended the event to share their thoughts about Mahatma Gandhi.

Maroof Raza, a writer and commentator from India said, "India's respect for human rights and the respect for men and human being was reflected in its modern history when it went to East Pakistan following a major genocide by Pakistan Army."

He added, "The recent initiative against India that we were taking away human rights of the Kashmiri people by a closed-door meeting at UN Security Council did not come in for criticism from 13 at least of the 15 members of the UNSC because world today recognises India's solid credentials based on the Gandhian philosophy of respect for life, being, nature and even animals. So let us not only harp on human beings."

On the occasion, a book authored by Khalid Jehangir, a Kashmiri was also launched.

The book titled "They snatched my playground" is a personal narrative of journalist-turned-BJP leader from Kashmir about his life in the Valley. It also talks about terrorism and politics in Kashmir, and the silent majority whose voices are rarely heard.
