Such travel advisories as per the BBC are typically reserved for countries like Uganda, Russia, or Egypt.&nbsp;

Talking to CBS news, a spokesperson for Global Affairs Canada pointed to the many laws enacted by US states targeting the transgender community.

"Since the beginning of 2023, certain states in the US have passed laws banning drag shows and restricting the transgender community from access to gender-affirming care and from participation in sporting events," said the spokesperson.

Addressing the government's decision to issue the advisory, Canadian Deputy Prime Minister Chrystia Freeland emphasised the importance of protecting "particular groups of Canadians".

She said that the government employed experts "to look carefully around the world and to monitor whether there are particular dangers to particular groups of Canadians".

However, as per BBC, she did not comment on whether discussions were held with the US government before implementing the advisory.

The ruling, as per Reuters, was not unexpected. Judge Hinkle had already issued a partial block on Florida's ban on gender-affirming care for individuals under 18 on June 6.&nbsp;

In his 54-page ruling, Judge Hinkle emphasised the reality of gender identity. He said that those who oppose transgender existence "tend to disapprove all things transgender and so oppose medical care that supports a person's transgender existence."

He also noted that gender identity is a real aspect of a person's life.

"The elephant in the room should be noted at the outset. Gender identity is real. The record makes this clear," he wrote in his ruling.

<h2>Anti-trans laws and the United States</h2>

Similar laws banning gender-affirming care have been blocked by district court judges in other states, including Alabama, Arkansas, Indiana, and Oklahoma.

According to the Human Rights Campaign, Republican lawmakers have however introduced over 500 bills restricting LGBTQ rights during the past legislative year, with more than 70 of them passing into law.&nbsp;

So far, 20 states have enacted laws banning gender-affirming care for minors. The sponsors of these laws claim that they aim to protect children who may be misled by parents and doctors and later regret their gender transition.

The plaintiffs in the case included two transgender adults, August Dekker and Brit Rothstein, as well as two transgender minors who filed under pseudonyms.&nbsp;

On the opposing side was the Florida Agency for Health Care Administration (AHCA) and its secretary, Jason Weida.

Medicaid, as per the US Department of Health and Human Services, &nbsp;is a joint federal and state programme that helps cover medical costs for some people with limited income and resources.

Judge Henkin found that the subsequent process was biased and aimed at justifying a predetermined outcome, rather than conducting a fair analysis of the evidence.&nbsp;As per him, the AHCA "retained only consultants known in advance for their staunch opposition to gender-affirming care."&nbsp;

Federal judge upholds transgender rights, strikes down Florida's Medicaid ban on healthcare

The Riigikogu or Estonian parliament, on Tuesday (June 20) approved a new law to legalise same-sex marriage, becoming the first Baltic nation to do so. This comes months after the incumbent Prime Minister Kaja Kallas’ liberal coalition government took office and nine years after the country recognised same-sex civil unions.&nbsp; 
 
The vote also makes&nbsp;Estonia the second central European country to pass laws legalising same-sex marriage, after Slovenia which passed&nbsp;an amendment allowing same-sex couples to marry and adopt&nbsp;last year.&nbsp;

<h2>What happened during the vote?</h2>

The vote on a marriage equality bill took place in Estonia’s parliament and passed with a majority of 55 votes in the 101-seat parliament with 34 votes against it. This came months after PM Kallas’ coalition of liberal and social democratic parties garnered a majority in the parliament back in March.&nbsp; 
 
Additionally, the incumbent&nbsp;government also survived a vote of no confidence that was tied to the amendments. While&nbsp;Estonia introduced same-sex civil unions back in 2014, it did not recognise&nbsp;adoption rights or&nbsp;parental recognition which comes with&nbsp;marriage. 
 
According to reports, there will be some 85&nbsp;amendments to the country's Family Law Act, while&nbsp;another legislation was&nbsp;introduced which would include&nbsp;same-sex marriage contracts. Additionally,&nbsp;words in the Family Law Act&nbsp;will also&nbsp;now be modified from&nbsp;"man and woman" to "two natural persons."&nbsp;

The law will come into effect&nbsp;in 2024. Notably, while same-sex marriage is legal in most countries across Western Europe that is not the case with former Soviet nations in central Europe. “My message (to central Europe) is that it’s a difficult fight, but marriage and love is something that you have to promote,” PM Kallas told Reuters, after the vote.&nbsp;

She added, “We have developed a lot in those 30 years since we have freed ourselves from the (Soviet) occupation. We are equals among same-value countries.” Meanwhile, two other Baltic nations, Latvia and Lithuania, have introduced bills to legalise same-sex marriage in their parliaments but are yet to move forward with any decision. &nbsp;

<h2>LGBTQ+ people in Estonia</h2>

According to the Estonian Human Rights Centre, attitudes towards LGBTQ+ people have changed dramatically since 2012. In the Baltic nation with 1.3 million people, at least 53 per cent of people supported same-sex marriage in a poll conducted by the rights centre&nbsp;earlier this year. Notably, the number was up from 34 per cent back in 2021 and also six per cent higher than last year.&nbsp;

However, nearly 40 per cent of Estonians still consider homosexuality unacceptable. The poll also showed that same-sex marriage was opposed by the country’s ethnic-Russian minority which makes up a quarter of the country’s population with less than half (40 per cent) supporting it.

The Ukraine war factor?</h2>

In an interview with the country’s broadcaster LRT, the president of Estonia’s parliament, Lauri Hussar suggested that the change in attitude towards the LGBTQ+ people can also be attributed to the war in Ukraine.&nbsp;

“I think the mood has changed also, because of what happened in Ukraine, because the war brought us to the real problems and what is really important for us,” said Hussar, as quoted by Euronews.&nbsp;

<h2>A watered-down bill</h2>

The original draft of the bill stated that discrimination based on sexual orientation and gender identity should be "not tolerated," but it was modified to "there should be no unfair discrimination." Critics argue that this change in wording implicitly allows for discrimination and bigotry.

"Although the original bill was not particularly significant, I believed it was better than nothing," said Takeharu Kato, a lawyer and member of the activist group "Marriage for all Japan," prior to the bill's passage. "But now I've started to think that having nothing at all might be better."

<h2>Same-sex marriage and Japan</h2>

Japan has faced pressure from other G7 nations, particularly the United States, to legalise same-sex marriage.&nbsp;

Economic leaders have expressed concerns that Japan's international competitiveness could be hindered without greater diversity, including representation for the lesbian, gay, bisexual, and transgender communities.

Public opinion polls indicate that approximately 70 per cent of the Japanese public supports same-sex marriage. However, Prime Minister Fumio Kishida's conservative ruling party opposes it. In February, Kishida dismissed an aide who made offensive remarks against same-sex marriage, generating widespread outrage.

In the Asia-Pacific region, approximately three-quarters of adults in Australia (75 per cent) and Japan (74 per cent) support legalising same-sex marriage. While Australia has already legalised it, Japan has yet to do so.&nbsp;

South Korea is currently debating the issue, and 40 per cent of South Koreans support legalising same-sex marriage, while 59 per cent oppose it. Indonesians showed strong opposition, with only five&nbsp;per cent supporting same-sex marriage.

The survey also found that in 12 countries, adults under 40 are more likely than older individuals to support same-sex marriage. Similarly, women in 14 countries expressed more support for legalising same-sex marriage compared to men. In 17 of the surveyed countries, individuals with higher levels of formal education were more likely to support allowing gays and lesbians to marry.

Experts say the bill is unlikely to pass as past efforts to get a green light on the same have met with opposition, especially from religious groups. They claim such moves would legalize homosexuality but it will help increase pressure on the government to expand the concept of a family.

The Tuesday ruling is seen by activists as a welcome step towards marriage equality in a nation where there exists no protection for same-sex unions.

Speaking to the press outside the court, the lead lawyer Yoko Mizutani said that the ruling has "rescued" them from the "hurt" of the last ruling on this issue.

"This ruling has rescued us from the hurt of last year's ruling that said there was nothing wrong with the ban, and the hurt of what the government keeps saying."

<h2>Past rulings on same-sex marriages in Japan</h2>

To date, Japan has had four rulings on the issue. The recent ruling by the Nagoya District Court is the second ruling to find a ban on same-sex marriages unconstitutional. Previously, in March 2021, a district court in Sapporo, the capital city of the northern Japanese island of Hokkaido in a similar ruling&nbsp;said that the ban was "unconstitutional".

Subsequently, in December of last year, a Tokyo court reiterated that while the ban was not "unconstitutional," the country's failure to legally protect same-sex partners creates an "unconstitutional situation".

<h2>Marriages and Japan</h2>

Japan is the only remaining G7 nation where same-sex marriage is banned. The Japanese constitution defines marriage as something based on "the mutual consent of both sexes".

Japan court 'rescues' nation's LGBT community from 'hurt', says ban on same-sex marriage 'unconstitutional'

In an unusual display of open disagreement, Canadian Prime Minister Justin Trudeau and his Italian counterpart Giorgia Meloni on Friday took public potshots at each other. The spat happened as the two world leaders were attending the Group of Seven (G7) leader summit in Japan's Hiroshima. The topic of this spat, as per reports, was LGBTQ rights.

The disagreement, as per Bloomberg, started when just ahead of closed-door talks, Trudeau criticised Meloni and Italy on camera.

"Canada is concerned about some of the positioning that Italy is taking in terms of LGBT rights, but I look forward to talking with you," said Trudeau.

Speaking in Italian, Meloni also said that after their talks he now probably understood that what gets written about her doesn't correspond to her reality.&nbsp;

As per a statement released by Justin Trudeau's office, the Canadian prime minister&nbsp;also raised his concerns about LGBTQ rights in Italy during the meeting. The statement added that the Italian prime minister had defended her government's position and stated that they were following court rulings related to LGBTQ matters.

While speaking to the press, Meloni pointed out that she hasn't changed any existing legislation on LGBTQ issues in Italy.

In March, Meloni's far-right-led government ordered city councils to stop the official recording of both parents in same-sex couples. Instead, they were instructed to only acknowledge the biological parent.

"This government is the maximum expression of homophobia."

"Meloni says that for a child to grow up well, they need a mother and father, even if decades of research say otherwise. It is insulting to hundreds of thousands of families with two same-sex parents," she said.

Italy's law doesn't recognise same-sex parents and Meloni has previously stated that every child is entitled to a mother and a father.

She also remarked that people identifying with a gender other than what was assigned to them at birth are victims of ideology. In a magazine interview in March, the Italian prime minister said "Being a man or a woman is rooted in who we are, and can’t be changed."

The idea was opposed by Congress-led Rajasthan and states like Andhra Pradesh, Assam, Uttar Pradesh, Maharashtra, Manipur&nbsp;and Sikkim demanded more time to examine the issue.&nbsp;

"We have received seven responses from state governments. Rajasthan has taken a position that they have examined and opposed it, while the rest say that this needs an expansive debate," said Solicitor General Tushar Mehta to the court.

Various religions and underlined Acts, which fall under the Constitution, were quoted by the opposing states to support their stand against same-sex marriage.

The Rajasthan government, opposing same-sex marriage's legalisation, said that people's sentiments were against homosexual marriages.

The provisions regarding marriage in Muslim Law, &nbsp;Special Marriage Act and Hindu Marriage Act were quoted by the government to justify its stand.

“Section 5 of the Hindu Marriage Act (HMA) states the essential conditions of marriage. These provisions make it clear that any matrimonial ceremony between a bride and a groom shall be valid only if the age of the groom is not less than 21 years and the age of the bride is not less than 18 years,” the state government said.&nbsp;

“In the Act, marriage between two persons of the opposite sex is considered valid, and the minimum age of separation has been fixed for them. Thus, marriage is a sacrament in Hinduism,” it further added.

“Son born from heterosexual marriages liberates 21 generations from sin - 10 from past generations and 10 from future generations - including self. Therefore, matrimonial belief in Hinduism is connected to the birth of a son. Marriage in Muslim law is considered a contract between man and woman," the government argued.

“Nikah (marriage) in Muslim law has three components 1. A willing couple 2. Witness, and 3. Mehr. The concepts of "mehr" and "iddat" also resolve that even in Muslim law, marriages are valid only between two persons of the opposite sex, where mehr is seen as a gift from the groom to the bride as a token of respect,” it said in its reply.&nbsp;

Meanwhile, the Asssam government said, “It may be said that even across cross-sections of societies, the legal understanding of marriage has been that of an agreement/contract between two persons of opposite genders."&nbsp;

A five-judge Constitution Bench which comprises Chief Justice of India DY Chandrachud, Justice Hima Kohli, Justice PS Narasimha, Justice Sanjay Kishan Kaul and Justice S Ravindra Bhat is listening to a batch of petitions related to ‘marriage equality rights' for LGBTQIA+ community.

Appearing for the Centre, Solicitor General Tushar Mehta told&nbsp;the court that the government remains positive about the idea of adopting administrative steps in this regard.&nbsp;

"The issue has some genuine human concerns and there were discussions on whether something can be done administratively. The government is positive. This would need coordination by different ministries. A committee headed by a cabinet secretary will be formed and suggestions given by the petitioners will be addressed," Mehta said.&nbsp;

Replying to this, CJI Chandrachud said, "The petitioners can submit suggestions between today and the next hearing so that they can apply their minds as well to it."

However, senior advocate Abhishek Manu Singhvi told the bench that the matter is very complicated and it needs interpretation of the law. Justice Ravindra Bhat stated, "Sometimes beginnings are small".&nbsp;

Justice SK Kaul further added, "This is without prejudice to everyone's rights, even if marriage rights are granted, there will be many changes required in the legislative and administrative domain. The government is not reluctant to solve the problems arising from gay companionship, just not the label of marriage."

Meanwhile, senior advocate Menaka Guruswamy, who is appearing for the petitioners, said, "I speak here mostly for young people in the small towns who want to be married. Please do not leave them."

Ahead of G7 summit, Japan's LGBTQIA+ community demand legalisation of same-sex marriage

As India debates whether same-sex marriage should be allowed legally, a child rights activist has come out against the move, and has said that such marriages will infringe upon the rights of the children and would deprive them of "at least one parent."

Talking to IANS, Kumar V Jahgirdar, founder and president of the Child Rights Initiative for Shared Parenting (CRISP) told IANS that "It is natural for any child to have a natural father and mother," and that with the proposed law India is "heading to the creation of a fatherless or motherless society."

He said that in a same-sex marriage, one person will be 'acting' as though they are "a father or mother respectively," but that in fact a child "raised by a same-sex couple is deprived of at least one parent."

"I hope the apex court takes this seriously and does not hamper child fundamental rights," he added.

The child rights activist also predicted that "children in same-sex marriage may feel a stigma that may end in drugs or school dropouts or land up in jail as a teenager."

He further said&nbsp;that if same-sex marriages are awarded a legal status, the "law will be unconstitutional and is not only against Indian social and cultural values but also in violation of basic human rights."

Jahgirdar claimed&nbsp;that the legalisation of same-sex marriages will further add confusion to the Domestic Violence Act that "is meant to protect women against men."

He also said that if the law is passed, rules regarding the custody of the child post-separation or divorce of the parents must be laid out. The custody of children and shared parenting in cases of separation must be ensured, he added.

The five-judge bench&nbsp;

The five-judge Constitution Bench, headed by Chief Justice of India (CJI) DY Chandrachud also comprised Justices S K Kaul, S R Bhat, Hima Kohli and P S Narasimha. During the hearing, the CJI said there is no such thing as an “absolute” concept of biological man and woman adding that “it’s not just a question of what your genitals are.”

The CJI has called the marriage issue one of “seminal importance”. The apex court on November 25 last year had sought the Centre’s response to separate pleas moved by two gay couples seeking enforcement of their right to marry and a direction to the authorities concerned to register their marriages under the Special Marriage Act.&nbsp;

However, the CJI had earlier said that the mandatory 30-day notice of a couple’s intention to marry under the previously mentioned act is “unconstitutional”. He stated, “Even in a heterosexual marriage, that you have to give notice and have people object to whether there should be a marriage or not is unconstitutional.”

Petitioners’ argument&nbsp;

Senior Advocate Mukul Rohatgi who presented the arguments from the petitioners said that those in same-sex relationships should also have equal rights similar to their heterosexual brethren.&nbsp;

Subsequently, referring to the 2018 ruling which struck down section 377 and decriminalised homosexuality, Rohtagi argued that the LGBTQ should also have the right to dignity and to the institution of marriage and family which is available to others.

He has also sought the provisions under the Special Marriage Act to read marriage between “spouse” instead of “man and woman”. Additionally, Senior Advocate Menaka Guruswamy, also arguing for the petitioners said that it is not only “a question of dignity but a bouquet of rights that LGBTQ people are being denied…like life insurance or medical insurance.”&nbsp;

This comes as the CJI asked the lawyers to steer clear of the personal laws as the court would focus on if the right can be conferred under The Special Marriage Act (SMA), 1954 as they have ‘broadly understood matter’.&nbsp;

Prior to the hearing, the government, on Monday, said that a court order recognising same-sex marriages would be virtually rewriting an entire branch of law. It has also argued how the court must refrain from passing such “omnibus orders”. Solicitor General Tushar Mehta, appearing for the government, reiterates its stance that the judiciary has no authority on the matter.&nbsp;

“This would be better if gone into by the parliament. The parliament has eminent parliamentarians. Parliamentary committees are not acting in the way we see parliament function. Committees have all parties as members,” said Mehta.&nbsp;

The CJI’s remarks about the notion of a biological woman or man not being absolute were also in response to Mehta’s statement when he said, “Societal acceptance of any relationship is never dependent on either the legislation or judgement. The legislative intent of the legislature throughout has been a relationship between a biological man and a biological female.”

The next hearing

The apex court will continue to hear petitioners on Wednesday and Thursday while the Indian government will present their arguments next week.&nbsp;

“A decision by the court in recognising the right of same-sex marriage would mean a virtual judicial rewriting of an entire branch of law. The court must refrain from passing such omnibus orders. Proper authority for the same is appropriate legislature...Given the fundamental social origin of these laws, any change in order to be legitimate would have to come from the bottom up and through legislation...a change cannot be compelled by judicial fiat and the best judge of the pace of change is the legislature itself,” stated the application.

A bench headed by Chief Justice D Y Chandrachud has taken note of the submissions of Solicitor General Tushar Mehta,&nbsp;who mentioned the plea to decide a preliminary issue.

"Yes, it will be listed tomorrow (April 18)," the bench also comprising justices P S Narasimha and J B Pardiwala said.

The BJP-led government questioned the maintainability of the petitions, saying that concept of same-sex marriages, if allowed, will cause complete havoc with the delicate balance of personal laws and accepted societal values.

The constitutional bench, which also comprises S K Kaul, S Ravindra Bhat, P S Narasimha and Hima Kohli, will hear the petitions on Tuesday which were referred to a larger bench for an authoritative pronouncement on March 13 by the CJI-led bench, saying it is a very seminal issue.

The hearing and the outcome are expected to have significant ramifications in India where the opinions of common people and political parties have been divergent.

All the petitions, which are strongly contended by the Centre, are now listed for hearing on 18 April 2023, as per Live Law portal.&nbsp;

Appearing for the petitioners, Dr AM Singhvi said, "Right to love makes us human". It should be extended in equal terms. You can extend it only on equal terms only if your lordships reads down the Special Marriage Act and other acts. It has to be read in such a way that terms such as man, woman are done away with."

Senior Advocate KV Vishwanathan said, "Transgender Protection Act exists even if the Centre says that we don't recognise such a union."&nbsp;

"This case is not about a transgender statute or the Hindu Marriage Act. What it is about is Article 21 and Article 19(1)(a). The right of choosing a partner is the right of expression, right of dignity. It's only a natural right, an assertion of a right. It has implications," he added.&nbsp;

Chief Justice of India, DY Chandrachud said, "We are not on arguments today but this will help everyone understand."

The apex court made the remarks to list all the pleas to a constitutional bench while hearing the clubbed petitions seeking the legal recogisition of same sex marriage in world's largest democracy.&nbsp;

During the hearing, Solicitor General Tushar Mehta,&nbsp;appearing for Centre, said in the apex court, “that the right to love, express and freedom of choice is already upheld, and no one is interfering with that right, but that does not mean conferring the right of marriage.”

SG Mehta said that the "moment marriage as a recognized institution comes between same sex, question will come on adoption and therefore Parliament will have to see the issue of psychology of child, which has to be examined whether it can be raised in such a way."

Supreme Court remarked that the adopted child of a gay or lesbian couple does not have to be gay or a lesbian. Centre has already voiced its strong opposition towards the petitions filed before the court where it said that the matter for legalization should not be dealt with the judiciary but the Indian Parliament.&nbsp;

The Centre in its affidavit, which came in response to the pleas, said that “recognised deviation…can occur only before the competent legislature”.&nbsp;

“Despite the decriminalisation of Section 377 of the Indian Penal Code (IPC), the Petitioners cannot claim a fundamental right for same-sex marriage to be recognised under the laws of the country,” the centre added.

If same-sex marriage is legalised in India, the country will become the second Asian nation to have done so. Taiwan was the first Asian nation to have legalised the same-sex marriage on 24 May in 2019.&nbsp;Indian SC in the year 2014 recognised transgender people as a "third gender."
