'Serious threat to democracy': India to soon introduce regulations to curb deepfake menace

<p>In a blow to Chinese short video app TikTok, the Indonesian government on Wednesday banned e-commerce transactions on social media platforms. The country's Trade Minister Zulkifli Hasan made the announcement saying the government was attempting to protect offline merchants, marketplaces and small businesses.&nbsp;</p>

<p>Hasan said the predatory pricing on social media platforms had been threatening the livelihood of small and medium-sized enterprises that could not compete with the monopolistic policies.&nbsp;</p>

<p>"This trade regulation has been in force (since yesterday)," said Hasan, adding that&nbsp;“the connection [between social media and e-commerce] must be separated so that the algorithm is not all controlled” and this “prevents the use of personal data” for business purposes.</p>

<p>The regulation effectively means that social media companies will not be able to conduct direct transactions on the platform albeit only promote the products on the platforms.&nbsp;The social commerce platforms have a week to comply with the new rule, according to Hasan.</p>

<p>Additionally, the new regulation mandates that e-commerce platforms in the country&nbsp;set a minimum price of $100 for certain items that are directly purchased from abroad.&nbsp;</p>

<p>“Social commerce was born to solve a real world problem for local traditional small sellers, by matching them with local creators who can help drive traffic to their online shops,” a TikTok spokesperson said.&nbsp;</p>

<p>“While we respect local laws and regulations, we hope that the regulations take into account its impact on the livelihoods of more than 6 million sellers and close to 7 million affiliate creators who use TikTok Shop,” they added.</p>

<p>As per the new system, which will be implemented on October 1, vehicles will be assigned a rating of one to five stars based on crash tests, including crashes from the front and side, and other safety parameters.&nbsp;</p>

<p>The rating will help buyers make an informed decision about the vehicle as well as encourage car makers to upgrade their safety standards, officials have said previously.&nbsp;</p>

<h2><strong>How will the new law work?</strong></h2>

<p>The measures, which have been in discussion since 2021, but gained momentum after the emergence of popular AI chatbots like the ChatGPT, would classify the systems based on AI based on the four levels of risk, which range from minimal to unacceptable.</p>

<p>The law is aimed at protecting people from social scoring systems that can judge them based on their appearance or their behaviour, and applications which can engage in vulnerable people's subliminal manipulation.&nbsp;</p>

<p>The officials are also considering the predictive policing tools, that use data to forecast potential perpetrators of crimes in future, as a no-go, while the ban on remote facial recognition and biometric identification in public has been widened by the lawmakers.&nbsp;</p>

<h2><strong>What will happen to ChatGPT?</strong></h2>

<p>The majority of systems, based on AI, which has already become a part of the everyday lives of people, including video games, spam filters or text generators such as ChatGTP, &nbsp;have been kept in the low- or no-risk category.</p>

<p>"We don't want mass surveillance, we don't want social scoring, we don't want predictive policing in the European Union, full stop. That's what China does, not us," said Dragos Tudorache, a Romanian member of the European Parliament who is co-leading its work on the AI Act.</p>

<p>Companies found violating the laws will have to pay fines of up to €30 million ($33 million) or 6 per cent of their annual global revenue, which can go up to billions in the case of tech giants like Google and Microsoft.</p>

<p>The 27 member states of the EU will enforce the rules, which lawmakers believe will be seen as a constructive framework by the powerful AI developers within which they can further develop the technology.<br />

Generative AI developers will be required to submit their systems for review before releasing them commercially.</p>

<p>"We as a union are doing something that I think is truly historic, which is to bring about rules and guardrails for the evolution of a technology that has a lot of potential for good in our economies," lawmaker Tudorache said while speaking to DW.&nbsp;</p>

<p>"At the same time, we see more and more risks. What we're doing with this legislation is to try and curtail these risks, mitigate them and put very clear rules in place that will ensure transparency and trust," he added.</p>

<h2><strong>What will be the next steps?</strong></h2>

<p>The new AI laws of the EU still need final approval from national parliamentarians and member states, which is not likely to happen till 2025.&nbsp;</p>

<p>"It's true that these laws will not come into effect by the elections next year, but we have other rules that are already in place. But if we craft this legislation right, if we articulate the obligations and the rights in these regulations the right way, they will stand the test of time. We are not regulating the technology itself, we are regulating the use of technology – and that transparency is the same and it's going to be the same now or in five years' time," said Tudorache.<br />

This comes as multiple prominent figures in the industry have sounded the alarm over how quickly AI is becoming accessible to the public and called on lawmakers and governments to regulate it.&nbsp;</p>

<h2><strong>Bengio feels ‘lost’ over his life’s work</strong></h2>

<p>During the interview with the United Kingdom-based media outlet, Bengio said that he felt “lost” over his life’s work. “It is challenging, emotionally speaking, for people who are inside (the AI sector),” said the second of the so-called three “godfathers” of AI, who has sounded the alarm.</p>

<p>Bengio is also known for his significant contribution to the industry and raised concerns over the speed at which it is developing. He added, “You could say I feel lost. But you have to keep going and you have to engage, discuss, encourage others to think with you.”</p>

<h2><strong>Who are these ‘bad actors’?</strong></h2>

<p>Speaking about the “bad actors” who could get a hold of the technology, the Canadian professor told BBC that it could be “military, it might be terrorists, it might be somebody very angry, psychotic.” He added, “And so if it’s easy to programme these AI systems to ask them to do something very bad, this could be very dangerous.”</p>

<p>Similar concerns were raised by another “godfather” of AI, Dr Geoffrey Hinton, who in a separate interview earlier this month confirmed that he quit his role at Google and spoke about the “dangers” of the technology he helped develop. “I console myself with the normal excuse: If I hadn’t done it, somebody else would have,” Hinton told the New York Times.&nbsp;</p>

<h2><strong>Bengio calls for more regulations</strong>&nbsp;</h2>

<p>Bengio echoed similar calls that the companies building powerful AI products require oversight by the government and told BBC that they should be audited. “Governments need to track what they're doing, they need to be able to audit them, and that's just the minimum thing we do for any other sector like building aeroplanes or cars or pharmaceuticals,” the Canadian professor told the UK-based media outlet.&nbsp;</p>

<p>Turkey, a nation known to pride on its cultural values, is set to impose strict regulations on social media, ending an era of free speech rights.</p>

<p>On Thursday, Turkey will be imposing new social media regulations for social media platforms such as Facebook and Twitter that will place various new regulations on the social media giants.</p>

<p>President Recep Tayyip Erdogan's ruling party AKP proposed the new regulations in the Parliament, which is also being seen as a crackdown on all opposing media.</p>

<p>If the platforms fail to remove the 'offending' content within 48 hours, the companies will face advertising bans and&nbsp;fines of up to 40 million Turkish lira ($5.1 million). More importantly, they will also be subjected to&nbsp;bandwidth reductions of up to 90 per cent, which makes the platforms effectively unusable.</p>

<p>Calling it a qestionalable decision, Facebook's human rights officer Iain Levine took to twitter to condemn this move. "Turkey's new social media law raises many concerns re human rights," he tweeted.</p>

<p>For the past couple of days now, the media has been making a big hype of the Global Entrepreneurship Summit (GES). On the front page of every newspaper, and on every news channel, Ivanka Trump is the main story. However, like everything else that involves politics and politicians, it is all show and no substance. Modi and Ivanka smiled for photographs, there was a <a href="http://indianexpress.com/article/business/startups/when-pm-narendra-modi-ivanka-trump-global-entrepreneurship-summit-launched-mitra-the-made-in-india-humanoid-robot-4960043/" rel="nofollow">robot that can greet people</a> and make small talk, and a whole lot of speeches were given.</p>

<p>But let us look at the stated goals of the summit, and what it does to achieve those goals.</p>

<p><strong>Empowering Female Entrepreneurs</strong></p>

<p>The first aim is to encourage women to start their own business. Currently, <a href="https://thewire.in/34430/women-run-14-of-indian-businesses-most-self-financed/" rel="nofollow">only about 14 per cent of the businesses in India is run by women</a>, of which 83 per cent&nbsp;is just one woman businesses, with no other staff.</p>

<p>What did the summit do to enable female entrepreneurship? It consisted of numerous master classes, where industry veterans told their own stories of how they started out, the mistakes they made along the way, and useful things they learnt. While it is nice to know tips and tricks, one cannot really use them unless they have both the skills and the capital to start their own business.</p>

<p>Where do they get those skills and capital? Majority of the entrepreneurs initially work for someone else, learning essential skills on the job, which they later apply in their own ventures. Earnings from a job also help them accumulate some of the capital necessary for starting out on their own. This is where the crux of our problem lies.</p>

<p>India has so few female entrepreneurs simply because it has a very low proportion of women in the labour market. The female labour force participation rate is <a href="https://data.worldbank.org/indicator/SL.TLF.CACT.FE.ZS?locations=BD-IN-CN" rel="nofollow">only 27</a>&nbsp;per cent. If women cannot get the experience and skills that come only from having a job, they will not be able to start their own businesses.</p>

<p>The question, then, is why do women not get jobs? Sure, there is some stigma to women working outside their homes, but that can&rsquo;t explain the entire shortfall in female labour force participation. If stigma were the explanation, developing countries similar to India, such as Bangladesh and China, for instance, would also see this problem. But in Bangladesh, 43 per cent of the women find work, as do 63 per cent in China.</p>

<p>What is it that Bangladesh and China have, but India does not? The answer is large, labour intensive manufacturing sectors, which all countries at a similar level of development have. India famously skipped the manufacturing part, and jumped from agriculture, directly to the service sector.</p>

<p>The service sector creates relatively few high skill jobs. It cannot create the crores of jobs required for India&rsquo;s men and women. I have on <a href="https://fee.org/articles/what-marx-could-teach-obama-and-trump-about-trade/" rel="nofollow">numerous</a> <a href="https://fee.org/articles/governments-destroy-jobs-not-automation/" rel="nofollow">occasions</a> <a href="https://fee.org/articles/the-ease-of-doing-business-index-is-fraught-with-flaws/" rel="nofollow">described</a> how India&rsquo;s complex labour laws prevent a large industrial base from developing. Having too many labour laws makes it unprofitable to hire workers. As a result, what little manufacturing takes place in this country <a href="http://www.drnarendrajadhav.info/drjadhav-data_files/Published%20papers/Size%20and%20Capital%20Intensity%20in%20Indian%20Industries.pdf" rel="nofollow">relies heavily on machinery</a>, and not labour.</p>

<p>With regards to women specifically, there are numerous regulations that hurt their chances at employment. <a href="http://www.lawyersclubindia.com/articles/Protection-of-women-under-the-labour-laws-6511.asp" rel="nofollow">There are several</a> labour laws that were passed with the noble intention of helping women. The law mandates paid maternity leave, having a cr&egrave;che facility if the firm employs more than 30 women, places restrictions on the hours women can work and the maximum workload they can take on, among other things.</p>

<p>All of this means that it is cheaper for employers to hire a man than a woman, for the same job, and save on the additional costs of maternity leave, babysitting and so on. The law effectively forces employers to discriminate against women, and hire men wherever possible.</p>

<p>If the government were really serious about encouraging female entrepreneurship, they would first get rid of all the unnecessary regulations that create hurdles to finding jobs. Until then, only women from rich families who could afford a good education for them will benefit from such events.</p>

<p><strong>Key Sectors</strong></p>

<p>The government wanted to promote a few key sectors in this summit. While I&rsquo;m no fan of this central planning mindset, where the government decides which sectors are important, that&rsquo;s a story for another time. For now, let us look at just two of these sectors and whether or not the summit will really help them.</p>

<p>The first is health and life sciences. Given the government&rsquo;s tendency to impose price controls on medicines and medical equipment, there is little incentive for entrepreneurs to enter the market. When government recently capped the price of stents, manufacturers <a href="http://www.moneycontrol.com/news/business/abbott-to-withdraw-two-of-its-latest-generation-coronary-stents-from-india-2263509.html" rel="nofollow">pulled out their latest models</a> from the market or <a href="http://www.livemint.com/Companies/iAGkqzuwIU0ecePeRd0epJ/Citing-price-controls-Abbott-says-wont-launch-newest-coron.html" rel="nofollow">refused to launch them at all</a>. This ended up hurting patients, who now have fewer choices. Unless government stops meddling in the healthcare market, summits like this are meaningless.</p>

<p>Media and entertainment are cited as another important sector. Of course, the first problem is the rampant censorship done by the government. Another problem is again, price controls. In some states, like Tamil Nadu, <a href="http://www.livemint.com/Consumer/JZeGqCCmBIkcJf8x72XAYI/Tamil-Nadu-film-theatres-in-distress-over-GST-corporation-t.html" rel="nofollow">movie ticket prices are capped by the government</a>. When it comes to television, entertainment channels are not allowed to charge more than Rs 12 per month as subscription fees. If the government prevents producers from making a return on their investment, <a href="http://www.hindustantimes.com/opinion/why-are-indian-news-channels-so-disappointing/story-cDuiuycQiJDwIV1ZTxmeVK_amp.html" rel="nofollow">they have no reason to produce good movies and television</a>.</p>

<p>The government does not need to do more to promote female entrepreneurship or better healthcare or media and entertainment. On the contrary, as we have seen so far, government intervenes too much in the market, preventing these sectors from flourishing and women from succeeding. Instead of wasting time with these summits, the government would be wise to deliver on its promises and get rid of unnecessary and burdensome regulations.</p>

Excessive and unnecessary regulations imposed by the government have been discouraging female entrepreneurs

For the past couple of days now, the media has been making a big hype of the Global Entrepreneurship Summit (GES). On the front page of every newspaper, and on every news channel, Ivanka Trump is the main story. However, like everything else that involves politics and politicians, it is all show and no substance. Modi and Ivanka smiled for photographs, there was a robot that can greet people and make small talk, and a whole lot of speeches were given. But let us look at the stated goals of the summit, and what it does to achieve those goals. Empowering Female Entrepreneurs The first aim is to encourage women to start their own business. Currently, only about 14 per cent of the businesses in India is run by women, of which 83 per cent is just one woman businesses, with no other staff. What did the summit do to enable female entrepreneurship? It consisted of numerous master classes, where industry veterans told their own stories of how they started out, the mistakes they made along the way, and useful things they learnt. While it is nice to know tips and tricks, one cannot really use them unless they have both the skills and the capital to start their own business. India has so few female entrepreneurs simply because it has a very low proportion of women in the labour market. × Where do they get those skills and capital? Majority of the entrepreneurs initially work for someone else, learning essential skills on the job, which they later apply in their own ventures. Earnings from a job also help them accumulate some of the capital necessary for starting out on their own. This is where the crux of our problem lies. India has so few female entrepreneurs simply because it has a very low proportion of women in the labour market. The female labour force participation rate is only 27 per cent. If women cannot get the experience and skills that come only from having a job, they will not be able to start their own businesses. The question, then, is why do women not get jobs? Sure, there is some stigma to women working outside their homes, but that can’t explain the entire shortfall in female labour force participation. If stigma were the explanation, developing countries similar to India, such as Bangladesh and China, for instance, would also see this problem. But in Bangladesh, 43 per cent of the women find work, as do 63 per cent in China. India skipped the manufacturing part, and jumped from agriculture, directly to the service sector. × What is it that Bangladesh and China have, but India does not? The answer is large, labour intensive manufacturing sectors, which all countries at a similar level of development have. India famously skipped the manufacturing part, and jumped from agriculture, directly to the service sector. The service sector creates relatively few high skill jobs. It cannot create the crores of jobs required for India’s men and women. I have on numerous occasions described how India’s complex labour laws prevent a large industrial base from developing. Having too many labour laws makes it unprofitable to hire workers. As a result, what little manufacturing takes place in this country relies heavily on machinery, and not labour. With regards to women specifically, there are numerous regulations that hurt their chances at employment. There are several labour laws that were passed with the noble intention of helping women. The law mandates paid maternity leave, having a crèche facility if the firm employs more than 30 women, places restrictions on the hours women can work and the maximum workload they can take on, among other things. All of this means that it is cheaper for employers to hire a man than a woman, for the same job, and save on the additional costs of maternity leave, babysitting and so on. The law effectively forces employers to discriminate against women, and hire men wherever possible. If the government were really serious about encouraging female entrepreneurship, they would first get rid of all the unnecessary regulations that create hurdles to finding jobs. Until then, only women from rich families who could afford a good education for them will benefit from such events. Given the government’s tendency to impose price controls on medicines and medical equipment, there is little incentive for entrepreneurs to enter the market. × Key Sectors The government wanted to promote a few key sectors in this summit. While I’m no fan of this central planning mindset, where the government decides which sectors are important, that’s a story for another time. For now, let us look at just two of these sectors and whether or not the summit will really help them. The first is health and life sciences. Given the government’s tendency to impose price controls on medicines and medical equipment, there is little incentive for entrepreneurs to enter the market. When government recently capped the price of stents, manufacturers pulled out their latest models from the market or refused to launch them at all. This ended up hurting patients, who now have fewer choices. Unless government stops meddling in the healthcare market, summits like this are meaningless. Media and entertainment are cited as another important sector. Of course, the first problem is the rampant censorship done by the government. Another problem is again, price controls. In some states, like Tamil Nadu, movie ticket prices are capped by the government. When it comes to television, entertainment channels are not allowed to charge more than Rs 12 per month as subscription fees. If the government prevents producers from making a return on their investment, they have no reason to produce good movies and television. <p>FCC Chairman Ajit Pai, a Republican appointed by President Donald Trump in January, said the regulatory agency will vote at a December 14 meeting on his plan to rescind the so-called net neutrality rules championed by Democratic former President Barack Obama that treated internet service providers like public utilities.</p>

<p>Pai said the action would remove heavy-handed internet regulations. Critics said it would let internet service providers give preferential treatment to some sites and apps and allow them to favor their own digital content.</p>

<p>The Obama-era rules, aimed at giving consumers equal access to web content, barred broadband providers from blocking or slowing down access to content or charging consumers more for certain content.</p>

<p>The FCC action was a clear victory for big internet service providers such as AT&amp;T Inc, Comcast Corp, and Verizon Communications Inc, which favored a repeal.</p>

<p>Companies including Google parent Alphabet Inc, Facebook Inc, online shopping company Amazon and video streaming service Netflix Inc had urged Pai not to rescind the rules.</p>

<p>With three Republican and two Democratic commissioners, the FCC is all but certain to approve the repeal.</p>

<p>Trump, a Republican, expressed his opposition to net neutrality in 2014 before the regulations were even implemented, calling it a &ldquo;power grab&rdquo; by Obama.</p>

<p>Pai said his proposal would prevent state and local governments from creating their own net neutrality rules because internet service is &ldquo;inherently an interstate service.&rdquo; The preemption is most likely to handcuff Democratic-governed states and localities that could have considered their own plans to protect consumers&rsquo; equal access to internet content.</p>

<p>&ldquo;The FCC will no longer be in the business of micromanaging business models and preemptively prohibiting services and applications and products that could be pro-competitive,&rdquo; Pai said in an interview, adding that the Obama administration had sought to pick winners and losers.</p>

<p>&ldquo;We should simply set rules of the road that let companies of all kinds in every sector compete and let consumers decide who wins and loses,&rdquo; Pai added.</p>

<p>FCC Commissioner Jessica Rosenworcel, a Democrat, said Pai&rsquo;s proposal &ldquo;hands broadband providers the power to decide what voices to amplify, which sites we can visit, what connections we can make, and what communities we create. It throttles access, stalls opportunity, and censors content.&rdquo;</p>

<p>Tom Wheeler, who headed the FCC under Obama and advocated for the net neutrality rules, called the planned repeal &ldquo;a shameful sham and sellout. Even for this FCC and its leadership, this proposal raises hypocrisy to new heights.&rdquo;</p>

<p>AT&amp;T, Comcast, and Verizon have said that repealing the rules could lead to billions of dollars in additional broadband investment and eliminate the possibility that a future presidential administration could regulate internet pricing.</p>

<p>Comcast said no matter what the FCC decided it would &ldquo;not block, throttle or discriminate against lawful content.&rdquo; AT&amp;T said all major companies have publicly agreed to honor net neutrality and a company &ldquo;that is so foolish as to seek to engage in gatekeeping will be quickly and decisively called out.&rdquo;</p>

<p><strong>HEAVY COSTS</strong></p>

<p>Verizon said it believed the FCC &ldquo;will reinstate a framework that protects consumers&rsquo; access to the open internet, without forcing them to bear the heavy costs from unnecessary regulation.&rdquo;</p>

<p>The planned repeal represents the latest example of a legacy achievement of Obama being erased since Trump took office in January.</p>

<p>Trump has abandoned international trade deals, the landmark Paris climate accord and environmental protections, taken aim at the Iran nuclear accord and closer relations with Cuba, and sought repeal Obama&rsquo;s signature healthcare law.</p>

<p>The Internet Association, representing major technology firms including Alphabet and Facebook, said Pai&rsquo;s proposal &ldquo;represents the end of net neutrality as we know it and defies the will of millions of Americans.&rdquo;</p>

<p>Pai&rsquo;s proposal would require internet service providers to disclose whether they allow blocking or slowing down of consumer web access or permit so-called internet fast lanes to facilitate a practice called paid prioritization of charging for certain content. Such disclosure will make it easier for another agency, the Federal Trade Commission, to act against internet service providers that fail to disclose such conduct to consumers, Pai said.</p>

<p>A U.S. appeals court last year upheld the legality of the net neutrality regulations, which were challenged in a lawsuit led by telecommunications industry trade association US Telecom.</p>

<p>The group praised Pai&rsquo;s decision to remove &ldquo;antiquated, restrictive regulations&rdquo; to &ldquo;pave the way for broadband network investment, expansion and upgrades.&rdquo;</p>

<p>The FCC&rsquo;s repeal is certain to draw a legal challenge from advocates of net neutrality.</p>

<p>New York Attorney General Eric Schneiderman, a Democrat, said he has been investigating for six months who provided significant numbers of fake public comments to the FCC in its review of net neutrality rules, corrupting the process.</p>

<p>US President Donald Trump met with a dozen American manufacturers at the White House on Monday, pledging to slash regulations and cut corporate taxes, but warning them he would impose taxes on imports if they move production outside the country.</p>

<p>Trump, who took office on Friday, promised to bring manufacturing plants back to the United States - an issue he said helped him win the November 8 election - and has not hesitated to call out by name companies that he thinks should bring outsourced production back home.</p>

<p>He asked the group of chief executives from companies including Ford, Dell Technologies, Tesla and others to make recommendations in 30 days to stimulate manufacturing, Dow Chemical CEO Andrew Liveris told reporters.</p>

<p>Trump, a Republican who took over from former Democratic President Barack Obama, was expected to sign executive orders later on Monday to renegotiate the free trade agreement between the United States, Canada and Mexico, and to formally withdraw the United States from the 12-nation Trans-Pacific Partnership.</p>

<p>The new president told the CEOs that he would like to cut corporate taxes to the 15 per cent to 20 per cent range, down from current statutory levels of 35 per cent - a pledge that will require cooperation from the Republican-led US Congress. But he said business leaders have told him that reducing regulations is even more important.</p>

<p>&quot;We think we can cut regulations by 75 per cent. Maybe more,&quot; Trump told business leaders.</p>
