On India's Constitution Day, Prime Minister Narendra Modi spoke on dynastic politics and&nbsp;said that parties being ruled by single family for generations were&nbsp;not good for healthy democracy.

"Party for the family, by the family...do I need to say more? If a party is run by one family for many generations, then, it isn`t good for a healthy democracy," said PM Modi at an event on Constitution Day in the Central Hall of the Parliament.&nbsp;

"The spirit of the Constitution has also been hurt, every section of the Constitution has also been hurt, when political parties lose their democratic character in themselves. How can the parties which have lost their democratic character protect democracy?" said the Prime Minister.&nbsp;

He further slammed the dynastic politics prevalent in the country.&nbsp;

"On the basis of merit, more than one person can go in politics from one family and this will not make the party family-oriented. But one family is in politics generation after generation," the Prime Minister added.&nbsp;

He paid tribute to Mahatma Gandhi and all those who fought during India`s independence struggle.

"Constitution Day is the day to salute this House, where many of India`s leaders brainstormed to give us the Constitution of India. We also pay tribute to Mahatma Gandhi and all those who fought during India`s independence struggle," he said.

In India, Constitution Day is celebrated on November 26 each year. The day marks adoption of the Indian Constitution by the Constituent Assembly on November 26, 1949.

The Constitution Day was first celebrated in 2015 as a mark of tribute to India`s first Law Minister Bhim Rao Ambedkar, who played a pivotal role in the drafting of the document.The Constitution of India, one of the longest written Constitutions of the world, constitutes of a Preamble, 22 parts with 395 articles and eight schedules.

Stressing on 'One Earth, One Health' vision of collaborative approach in dealing with Covid virus, Prime Minister Narendra Modi said India is ready to produce over 5 billion coronavirus vaccine doses by the end of next year to help the world in the fight against the pandemic.

Speaking in his intervention at the session on “global economy and global health” at G20 Summit session in Rome on Saturday, Modi also flagged the issue of facilitating international travel and talked about the mechanism of mutual recognition of vaccine certification as a means of achieving this, Foreign Secretary Harsh Vardhan Shringla said, briefing reporters on PM’s engagements.

PM Modi invited G20 countries to make India their partner in economic recovery and supply chain diversification. He also brought out the fact that despite challenges posed by the pandemic, India continued to be a trusted partner in the context of reliable supply chains, Shringla said.

Noting that the WHO approval for the emergency use authorisation for India's indigenous vaccine, Covaxin,&nbsp;is pending, Modi suggested that a nod for the jab will help India assist other countries.

A technical advisory group of the UN health agency will meet on November 3 to conduct a final "risk-benefit assessment" for Emergency Use Listing of Covaxin. Bharat Biotech's Covaxin and AstraZeneca and Oxford University's Covishield are the two widely used vaccines in India.

Shringla said that Prime Minister Modi expressed satisfaction over the G20’s decision to come up with a 15 per minimum corporate tax to make the global financial architecture more “just and fair”.

The decision is aimed at ensuring that companies pay a certain amount of tax in the countries they are located in.

Shringla said that Pope Francis accepted PM Modi's invitation to visit India.

Speaking of the Vatican visit, Shringla said, “The last papal visit to India was in 1999 when Pope John Paul II visited the country. Pope Francis has accepted PM Modi's invitation. In his own words, he said: “You (PM Modi) have given me the greatest gift. I am looking forward to visiting India". Pope Francis has accepted the PM Modi invitation and looking forward to visit India.”

Indian PM Narendra Modi Reaches Rome for G20 summit, pays tribute to Mahatma Gandhi

Prime minister Narendra Modi will be representing India at the 16th G20 summit in Rome, it will be the eight summit that PM Modi will be attending, he will be discussing a range of issues from combating China, climate change to pitching for a global approach for dealing with the situation in Afghanistan.

India’s Prime Minister Narendra Modi on Thursday addressed the 18th ASEAN-India Summit where he touched upon a range of key issues, including COVID-19 pandemic, South China Sea issue, and stressed how ASEAN members play an important role in India’s vision for the Indo-Pacific.

Addressing the leaders via video conferencing, Modi said, “In 2022, our partnership would complete 30 years. India will also complete 75 years of its Independence. I am delighted that we will celebrate this important milestone as ASEAN-India Friendship Year.”

Modi stressed that the unity and centrality of ASEAN has always been a priority for India.

Commenting on the COVID-19 pandemic, he said, “Due to COVID19, all of us had to face a lot of challenges. This challenging time was also a test of the India-ASEAN friendship. Our mutual cooperation in COVID-19 era will keep strengthening our relations in the future and form a base for goodwill between our people.”

Later in a press briefing, Ministry of External Affairs Secretary (East) Riva Ganguly Das said PM Modi has invited the ASEAN members to join the Indo Pacific Initiative (IPOI).

“The adoption of the joint statement on ASEAN outlook on Indo-Pacific and India's Indo-Pacific oceans initiative is one of the very major highlights of this summit. We have built upon the convergences that exist between the AOIP as the ASEAN Outlook on the Indo-Pacific and our own Indo-Pacific initiative IPOI,” she said.

When she was asked whether issues like the South China Sea and Afghanistan were discussed, Das said, “The East Asia summit exchanged views on the regional and international seas. Highlighting the Afghanistan situation, PM (Modi) talked about the terrorism issue and called for a zero-tolerance to terrorism.”

She said a series of activities will be conducted to commemorate the 30 years of the ASEAN-India partnership.

“The leaders of India and ASEAN have declared the year 2022 as ASEAN-India Friendship Year as it marks 30 years of ASEAN-India partnership. A series of activities will be conducted around the year to commemorate this,” Das said.

South China Sea, Indo-Pacific find mention during Indian PM Modi’s meet with ASEAN leaders

The Indian government has defended in the Delhi High Court the legal validity of its new IT rule requiring messaging apps, such as WhatsApp, to trace&nbsp;the first originator of the information, saying that the law empowers it to expect such entities to create safe cyberspace and counter illegal content either themselves or by assisting the law enforcement agencies.

The government said that Section 87 of the Information Technology Act gave it the power to formulate Rule 4(2) of the Intermediary Rules -- which mandates a significant social media intermediary to enable the identification of the first originator of information in legitimate state interest&nbsp;of curbing the menace of fake news and offences concerning national security and public order as well as women and children.

In its affidavit filed in response to WhatsApp's challenge to the rule on the ground that breaking the encryption invades its users&nbsp;privacy, the Centre has claimed that platforms monetise users&nbsp;information for business/ commercial purposes are not legally entitled to claim that it protects privacy.

Petitioners (WhatsApp and Facebook), being multi-billion dollar enterprises, almost singularly on the basis of mining, owning and storing the private data of natural persons across the world and thereafter monetizing the same, cannot claim any representative privacy right on behalf of the natural persons using the platform,&nbsp;said the affidavit filed by Ministry of Electronics and Information Technology.

WhatsApp collects users&nbsp;personal information and shares it with Facebook and third-party entities for business/commercial purposes (WhatsApp's privacy policy of 2016 and its 2021 update). In fact, the regulators of various countries dearly hold that Facebook should be fixed with accountability for its services and data management practices,&nbsp;it added.

The government&nbsp;said reasons regarding 'technical difficulties cannot be an excuse to refuse compliance to the law of the land and if a platform does not have the means to trace the first originator&nbsp;without breaking the encryption then it is the platform which ought to develop such mechanism&nbsp;in larger public duty.

The Rule does not contemplate the platforms breaking the end-to-end encryption. The Rule only contemplates the platform to provide the details of the first originator by any means or mechanism available with the platform. If the platform does not have such means, the platform ought to develop such mechanism considering the platforms widespread prevalence and the larger public duty, the affidavit said.

The government said if the intermediary is not able to prevent or detect the criminal activities happening on its platform, then the problem lies in the platform's architecture and the platform must rectify their architecture and not expect the change of legislation. Reasons regarding 'technical difficulties' cannot be an excuse to refuse compliance to the law of the land.

In August, a bench headed by Chief Justice DN Patel had sought the Centre's stand on WhatsApp petition challenging new rule on the ground it violates the right to privacy and is unconstitutional.

WhatsApp's parent company Facebook has also mounted a similar challenge to the rule.

In its plea, WhatsApp had said that the traceability requirement forced it break end-to-end encryption&nbsp;and thus infringe upon the fundamental rights to privacy and free speech of the hundreds of millions of citizens using its platform to communicate privately and securely.

The Centre, in its response, has said that the petition by WhatsApp is not maintainable as a challenge to the constitutionality of any Indian law is not maintainable at the instance of a foreign commercial entity. 
It further claimed that Rule 4(2) is an embodiment of competing rights of citizens of India&nbsp;and aims to preserve the rights of vulnerable citizens within the cyberspace who can be or are victims of cyber-crime.

The government said there are checks and balances to ensure that the rule is not misused or invoked in cases where other less intrusive means are effective in identifying the originator of the information. 
The identification of the first originator pertains only to viral content relating to heinous crimes, as specified in the rule, and not identifying all users or citizens, it said.

If the IT Rules 2021 are not implemented the law enforcement agencies will have difficulty in tracing the origin of fake messages and such messages will percolate in other platforms thereby disturbing peace and harmony in the society further leading to public order issues,&nbsp;the affidavit said.

The government has also said that in case of any legal proceeding having any message on the platform as evidence, WhatsApp would lose the defence of 'intermediary protection' but it does not mean that WhatsApp will be held guilty and its officials would be legally responsible.

The courts can include WhatsApp as a respondent and consider 'Contributory Negligence' and 'Vicarious liability on WhatsApp and its executives' (under Section 85). Such liabilities will fructify only when such a case comes up and WhatsApp is named as an entity that it is sufficiently proved that it has contributed to the commission of the crime,&nbsp;it added.

The government also said that the Supreme Court itself had asked the Central government to take all the steps necessary to identify persons who create and circulate electronic information&nbsp;about certain offences such as sexual abuse.&nbsp;
