The Supreme Court Wednesday allowed Karti Chidambaram, son of senior Congress leader P Chidambaram, to travel abroad after depositing Rs 10 crore with its registry.

The apex court asked Karti to appear before the Enforcement Directorate on March 5, 6, 7 and 12 for questioning in connection with the INX Media and Aircel Maxis cases, saying "don't play around with the law".

"You go wherever you want to go, between February 10 to 26 but you must cooperate with the investigation," a bench headed by Chief Justice Ranjan Gogoi said.&nbsp;

"Please tell your clients that he will have to cooperate. You have not cooperated. We wanted to say a lot of things. We are not saying them right now," the bench said.

Besides asking Karti to deposit Rs 10 crore with the secretary general of the Supreme Court, the bench also asked him to file an undertaking that he would return and cooperate with the investigation.

Karti has sought permission to travel abroad from February 10 to 26 and again from March 23 to 31.

The bench was hearing Karti's plea seeking permission to travel to France, Spain, Germany and the United Kingdom for the next few months for international tennis tournaments organised by a company called 'Totus Tennis Ltd' having its registered office in the UK.

INX media case: ED attaches Karti Chidambaram’s assets worth Rs 54 crore in India, UK, Spain

A Delhi court today granted seven weeks to the CBI to obtain sanction to prosecute former Union minister P Chidambaram and other serving or former public servants in the Aircel-Maxis deal case.

The court pulled up the agency for filing the charge sheet without proper sanction and told the CBI that if required documents are not filed by November 26, the next day of hearing, the court may take appropriate action.

"You (CBI) should not have filed the charge sheet. It is only increasing the pendency of the court. A lot of time of the court has been wasted due to this," Special Judge O P Saini said.

The agency had on July 19 filed a charge sheet against the Congress leader, his son Karti, ten individuals including public servants and six companies as accused in the case.

The judge allowed the CBI's request for grant of some time after senior advocate Sonia Mathur, representing the agency, informed the judge that sanctions are awaited.

"If the sanction is not received, appropriate actions will be taken," the court said.

"Granting of sanction is under active consideration of the government," Mathur said.

Chidambaram's name is among the persons against whom sanction for prosecution from authorities concerned was awaited.

The court also adjourned a money laundering case, which is an off-shoot of the Aircel-Maxis deal case, against Karti and others, after Mathur and advocates N K Matta and Nitesh Rana requested an adjournment on behalf of the Enforcement Directorate (ED).

The ED had on July 13 filed a charge sheet against Karti and others for the alleged offence of money laundering.

However, the former Union minister was not arrayed as an accused in the case.

In the case filed by CBI, Mathur told the court that the agency was expecting sanctions for prosecution from authorities concerned in about four weeks.

The counsel told the court that there were serving public servants and some retired ones against whom the sanctions would be needed before proceeding with their prosecution in the case.

The CBI had filed the charge sheet for the alleged offences of criminal conspiracy under the Indian Penal Code (IPC), public servant taking illegal gratification, punishment for abetting this offence and public servant committing criminal misconduct under the Prevention of Corruption Act.

If convicted, the offences entail a maximum punishment of seven years.

The agency has alleged that when foreign investment in Aircel by Malaysian telecom major Maxis was cleared by the finance ministry in March 13, 2006, a payment of Rs 26 lakh was made by Aircel to Chennai-based Advantage Strategic Consulting, officials said.

It is alleged that Advantage Strategic Consulting was indirectly controlled by Karti and had raised an invoice on March 29, 2006 against which Aircel made a payment on April 1, 2006.

The CBI has alleged that Chess Management Services Holding Ltd, a company in which Karti is promoter and director, also received Rs 87 lakh in several installments from an associate company of Maxis, they said.

While the payment of Rs 26 lakh to Advantage Strategic Consulting was shown as fee for market research, Rs 87 lakh to Chess Management was shown as fee for a software, the CBI had alleged in the charge sheet.

During investigation, the agency had asked Chess Management officials and Karti to produce the software which was allegedly provided to Maxis for a fee but they could not produce any such software, they said alleging that it was a bribe for the clearance of foreign investment proposal which was laced with several irregularities.

The agency said this is a fresh charge sheet in the matter even as it stems from the FIR related to Aircel-Maxis deal registered in 2012 in which the then telecom minister Dayanidhi Maran and others have been charged and later discharged by a trial court. The CBI has filed an appeal against the court order.

The officials said this is a completely separate aspect of the case related to clearance of now defunct Foreign Investment Promotion Board (FIPB), under Finance Ministry, to the foreign investment clearance of Maxis in Aircel.

Among others listed in the charge sheet are the then secretary (economic affairs) Ashok Jha, the then additional secretary Ashok Chawla, the then joint secretary in finance ministry Kumar Sanjay Krishna, and the then director in the ministry Dipak Kumar Singh.

The agency has also named in the charge sheet former CEO of Aircel V Srinivasan, nephew of Chidambaram A Palaniappan who was also the promoter of Chess Management Services, Malaysian nationals Ananda Krishnan Tatparanandam, Augustus Ralph Marshall, both linked with Maxis, one S Bhaskaraman, and the then under secretary in the ministry Ram Sharan.

The six companies listed as accused are Chess Management Services Holding Ltd, Chennai-based Advantage Strategic Consulting Pvt Ltd and Malaysian companies Astro All Asia Networks, Maxis Mobile, Bumi Armada Berhad and Bumi Armada Navigation.

Court grants time to CBI for obtaining sanction to prosecute Chidambaram in Aircel-Maxis case

Though the name of P Chidambaram, who was also questioned recently by the CBI and the ED in the INX media and the Aircel-Maxis money laundering cases respectively, was mentioned in the charge sheet, the Congress veteran has not been arrayed as an accused in the probe report which would now be considered by the court on July 4.

The ED filed the charge sheet before Additional Sessions Judge Ruby Alka Gupta for consideration and subsequent issuance of summons to the accused including Karti.

Reacting to the filing of the charge sheet, which is called prosecution complaint in official parlance, P Chidambaram said that it would be "vigorously contested" before the special court.

"The complaint filed by ED against Karti Chidambaram and others is seriously flawed. Since the matter is in Court, I shall not make a public comment. The complaint will be vigorously contested before the Special Court," the former minister tweeted.

The ED probe report said the payments of Rs. 26 lakh to Advantage Strategic Consultancies Private Limited (ASCPL) and Rs. 90 lakh to Chess Management Services Pvt Limited (CMSPL) respectively were made as alleged bribe money by parent company of Aircel Ltd, namely Aircel Televentures Ltd (ATVL) and Maxis and its associate Malaysian companies respectively.

Referring to contents of the charge sheet, special public prosecutors Nitesh Rana and NK Matta said that Karti Chidambaram was controlling ASCPL and CMSPL, the alleged beneficiaries of bribe amount of Rs. 1.16 crore, and Karti Chidambaram was trying to project this as untainted money.

The probe agency also made clear that it may file supplementary charge sheets in the case which apparently keeps open the chances of arraying more persons as accused.

Apart from Karti Chidambaram, the agency has also named ASCPL and its directors Padma Bhaskararamana and Ravi Viswanathan, and CMSPL and its director Annamalai Palaniappa in the charge sheet under section 4 (punishment for money laundering) of the Prevention of Money Laundering Act (PMLA).

"Investigation carried out under the PMLA so far as revealed that Karti P Chidambaram is linked with individuals and companies involved in financial transaction and companies holding such companies as per diagram...

"Investigation has revealed that ASCPL and CMSPL are controlled and owned by Karti Chidambaram and his close associate S Bhaskararaman. The investigation has further revealed that ASCPL received money from ATVL, parent company of Aircel Ltd., in close proximity to receipt to FIPB (Foreign Investment Promotion Board)," the charge sheet, filed through advocate AR Aditya, said.

It alleged that Karti Chidambaram received Rs. 26 lakh from ATVL in ASCPL, on April 11, 2006, immediately after the approval under the head of payment of consultancy services, it said.

"Similarly CMSPL received an amount of approximately USD 2,02,447 between period 2007-11 against invoices raised between 2007-09. The payments were received from Maxis and its associates in the guise of charges for a software which was designed for use by an Indian company and could not at all of any use by a Malaysian company," it said.

The ED had registered the case under the sections of PMLA on February 7, 2012 on basis of an FIR registered by the CBI.

It said that during the investigation it was found that ASCPL was already in a financial transaction with the other companies namely Chess Healthcare Care Solutions Pvt LTD, M/s Chess Management Services Pvt LTD (CMSPL) and M/s Halidon Marketing Pvt LTD since the financial year 2005-06.

The agency said that a total of Rs. 1.16 crore allegedly belonging to Karti Chidambaram has already been attached by it so far.

The agency mentioned that the former Union minister's son has been linked with various individuals and companies involved in the Foreign Investment Promotion Board (FIPB) approval given to the Aircel-Maxis deal.

&nbsp;It also alleged that Karti Chidambaram was in the process of alienating the property involved in the money laundering in order to frustrate the proceedings under PMLA.

The agency told the court that it might file a supplementary charge sheet in the case.

The court has already granted interim protection from arrest till July 10 to Karti Chidambaram in two cases filed by the CBI and the ED in 2011 and 2012, respectively in the Aircel-Maxis matter arising out of 2G spectrum cases, while his anticipatory bail plea is pending before the court.

He said, “This should have been done much earlier but few officers of the Central Bureau of Investigation were helping Chidambaram, even a few ministers were helping him, but now the Prime Minister has stopped all these. The CBI and the ED have been asked not to entertain any interference from anyone and take their own decisions.”

“After the charge sheet will be filed against Karti, another will be issued against Chidambaram. Chidambaram will again have to appear before the ED, he keeps on lying but gets caught.” P. Chidambaram’s son Karti was arrested on February 28 at the Chennai airport upon his return from the United Kingdom, for his alleged role in the case. Currently, Karti is on bail too. Aircel-Maxis case: ED to file charge sheet against Karti Chidambaram tomorrow

Former finance minister P Chidambaram was questioned by the CBI for nearly four hours today in connection with alleged irregularities in clearances to foreign investments in INX media during his tenure.

The agency has alleged irregularities in the clearance of foreign investment in INX media, a venture promoted by former media baron Peter Mukerjea and his wife Indrani, both probed by the CBI in connection with the murder of their daughter Sheena Bora, sources said.

After coming out of CBI headquarters here, Chidambaram said he had appeared before the CBI and the FIR did not contain any allegations against him.

"Questions and answers were based on the files of FIPB. Hence there was little to add to the record," the Congress leader said on Twitter.

INX media case: P Chidambaram files anticipatory bail in Delhi High Court

The Supreme Court on Friday allowed Karti Chidambaram, son of senior Congress leader P Chidambaram, to travel to offshore locations in United Kingdom, Germany and Spain with certain conditions, including that he would not open or close a bank account abroad.

Karti, who has been facing probe in various corruption cases, was allowed to go abroad from May 19 to 27 by a bench headed by Chief Justice Dipak Misra.

The bench, also comprising Justices A M Khanwilkar and D Y Chandrachud, said "he (Karti) shall not open or close any overseas bank account" and not enter into any property transaction abroad.&nbsp

It asked Karti to furnish an undertaking before it, saying he would follow the conditions and apprise it about the flight details and date of arrival back to India.

The court also made it clear that its permission to Karti to travel abroad should not be used in any court of law for grant of statutory and regular bail in any other offence.

The bench told Karti that he would cooperate in investigation and hand over passport to investigation agency, that is the Enforcement Directorate, on return.

The Supreme Court on Monday suspended further hearing on an alleged money laundering case filed against Karti Chidambaram till April 27, reports said.&nbsp

With this ruling, the interim protection previously granted to Karti, who cannot be arrested by the Enforcement Directorate (ED) till the next date of hearing, is extended.

The ED is looking to remand the political heavyweight into its custody and for further investigation over his alleged involvement in the INX Media PMLA case and the Aircel-Maxis case.

Karti sought to strike down ED's power of arrest under section 19 of the PMLA, besides seeking quashing of the enforcement case information report (ECIR) and the probe being carried out by the agency.

Mukerjea-owned INX Media Ltd had allegedly paid bribes to get a Foreign Investment Promotion Board (FIPB) approval which was facilitated by former finance minister P. Chidambaram's son Karti Chidambaram.

Mukerjea was sent to CBI custody earlier this week. On Wednesday, <a href="http://cmsuat.wionews.com/india-news/inx-media-case-cbi-to-move-plea-to-record-peter-mukerjeas-statement-before-court-126685">the CBI was to move a plea seeking permission to record Mukerjea's statement before the court</a> in connection with the aforementioned case, as per provisions of Section 164 of the Code of Criminal Procedure (CrPC).

Karti Chidambaram was granted bail on March 23 by the Delhi High Court against a surety of Rs 10 lakh.&nbsp;

A Delhi court on Saturday granted anticipatory bail to Karti Chidambaram, son of finance minister P Chidambaram, in the Aircel-Maxis case in which he is an accused.

The Enforcement Directorate had opposed Karti&#39;s anticipatory bail plea in Patiala House Court saying that the bail granted will hinder the probe against him.

Karti stands accused of money laundering in the Aircel-Maxis transaction, a part of the bigger 2G spectrum case.

The ED case pertains to the Foreign Investment Promotion Board (FIPB) approval granted in 2006 by his father, then finance minister P Chidambaram.

The agency said FIPB approval in the Aircel-Maxis FDI case was granted in March, 2006 by the then FM even though he was competent to accord approval on project proposals only up to Rs 600 crore and beyond that it required the approval of the Cabinet Committee on Economic Affairs (CCEA).

Chidambaram has previously denied the allegations against Karti.

The Enforcement Directorate also alleged that Karti had &quot;disposed&quot; of a property in Gurgaon, which he had allegedly rented out to a multinational company &quot;to whom foreign direct investment (FDI) approval had been granted in 2013&quot;.

It charged that Karti had &quot;also closed certain bank accounts and attempted to close other bank accounts in order to frustrate the process of attachment&quot; under the Prevention of Money Laundering Act.

The Supreme Court on Thursday gave interim protection to Karti Chidambaram from arrest in connection with the INX Media case, news agency ANI reported.

Karti cannot be arrested until March 26 by the Enforcement Directorate (ED).

The Thursday order was regarding the ED case pending in Delhi High Court in relation to the adjudication of the probe agency&#39;s power to arrest Karti Chidambaram under Prevention of Money Laundering Act (PMLA).

The extension comes as a relief to Karti after the probe agency on March 13 moved the apex court against the high court order, which had granted him relief.

Karti, son of former finance minister P. Chidambaram, is being investigated by the Central Bureau of Investigation (CBI) and ED for his alleged role in the INX Media case.

He is in judicial custody till March 24.

The high court on March 9 restrained the ED from arresting Karti Chidambaram till March 20 after he claimed the probe agency could not conduct the investigation without registering a formal case.

Karti Chidambaram and his father have dismissed the case as a political vendetta. The CBI and ED said Karti Chidambaram helped the INX Media Ltd get around foreign investment regulations in return for a bribe.(ANI)

The investigating agency alleged that to wriggle out of the situation without any punitive action, INX Media entered into a criminal conspiracy with Karti.

INX Media case: Karti Chidambram's chartered accountant Bhaskararaman gets bail

The Supreme Court will hear the ED&#39;s plea challenging the Delhi High Court order granting interim protection to Karti Chidambaram, son of Congress leader P Chidambaram, in a money laundering case related to the INX Media corruption matter on March 15.

A bench comprising Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud today considered the Enforcement Directorate&#39;s submission for urgent hearing of its appeal and said it would be heard day after tomorrow.

Advocate Rajat Nair, appearing for the probe agency, mentioned the ED&#39;s appeal for urgent hearing.

On March 9, the Delhi High Court gave Karti Chidambaram a breather in a money laundering case and restrained the ED from arresting him till March 20.

A CBI court yesterday sent Karti Chidambaram to judicial custody till March 24. The court also refused his plea for urgent hearing on his bail plea which was already listed for March 15.

Following the high court order, he cannot be arrested by the ED if the CBI court grants him bail on March 15.

Karti Chidambaram has approached the high court to strike down the powers of arrest of the ED under Section 19 of the Prevention of Money Laundering Act (PMLA) as unconstitutional and in violation of Article 14 and 21 of the Constitution, which deal with the rights of people for equality before law and protection of personal liberty.

The plea sought quashing of the enforcement case information report (ECIR) and probe by the ED for the offences under the PMLA.

It sought quashing of the probe by the ED, alleging that it was contrary to the procedure established by law and violates Karti Chidambaram&#39;s fundamental rights.

The ED had registered a case against Karti Chidambaram and others in May last year. It had registered an ECIR, the ED&#39;s equivalent of an FIR, against the accused named in the CBI complaint. These accused included Karti Chidambaram, INX Media and its directors, Peter and Indrani Mukerjea.

The Supreme Court will hear the ED's plea challenging the Delhi High Court order granting interim protection to Karti Chidambaram, son of Congress leader P Chidambaram, in a money laundering case related to the INX Media corruption matter on March 15.
