For Indian students planning to study in the US, a Democratic victory in the midterm elections offers a possible counterweight to Donald Trump’s immigration agenda. But it is unlikely to bring any immediate relief to those worried about student visas, post-study work opportunities and the prospect of staying in the country after graduation.Democrats have taken control of both the House of Representatives and the Senate. The shift gives them greater room to question the administration’s immigration decisions and challenge proposals affecting international students. Trump, however, remains in office, and his administration will continue to oversee visa and immigration policy.The concern is particularly significant for Indian students, many of whom see the opportunity to work in the US after graduation as an important part of their education plans.According to the Institute of International Education’s Open Doors 2025 report, the number of Indian students in the US stood at 363,019 during the 2024-25 academic year. As many as 143,740 were on Optional Practical Training (OPT), up 47.3 per cent from the previous year. OPT allows eligible international students to work in jobs related to their field of study for up to 12 months after graduation. Those with qualifying STEM degrees can seek an additional 24 months.<h2>A $70,000 proposal adds to uncertainty</h2>In a proposed rule published on October 8, the Department of Homeland Security proposed a $70,000 fee for an F-1 student's first participation in OPT and $30,000 for any subsequent OPT participation. Under the proposal, the institution recommending the student would be responsible for paying the fee. However, universities could pass some of the additional cost on to students or employers.The public comment period closes on November 9. The proposed fees are not yet in force. DHS will review the submissions before deciding whether to issue a final rule, which, under the proposal, would take effect 60 days after publication.Democrats could use their new congressional majority to summon administration officials, question the financial implications and press for changes. But they cannot simply strike down the proposal through a change in congressional control.<h2>The H-1B question is far from settled</h2>For many Indian graduates, OPT is a stepping stone to an H-1B visa, which allows them to continue working in the US through employer sponsorship. The prospect of securing one has become another source of uncertainty amid the administration’s immigration restrictions.The green-card backlog is a separate concern. Indian professionals face particularly long waits for employment-based permanent residency, partly because US law generally limits each country's share of family-sponsored and employment-based immigrant visas to 7 per cent of the annual combined total.Student visa figures offer another indication of the difficulties facing Indian applicants. An analysis of US State Department data by Abroad Brief found that the US issued 30,317 F-1 student visas to Indian nationals in 2025, down from 76,695 in 2024. The decline was particularly sharp between May and August, when issuances fell from 58,694 to 22,149.For Indian students, the election result may have changed the political equation in Washington, but the uncertainty around studying and working in the US remains. A Democratic majority could put pressure on the Trump administration over its immigration decisions, particularly the proposed OPT fees and employment visa restrictions. Whether that pressure leads to any change is another matter.The new Congress takes office on January 3, 2027. Until then, students waiting on visa decisions or preparing to enter the US will have little choice but to follow developments closely. The bigger question is whether the Democrats will use their new power to challenge policies that could make studying and working in the US more difficult for international students.

Indian students in US: Will Democrats challenge Trump’s proposed OPT fees and visa policies after midterm win?

The Donald Trump administration is considering charging international graduates USD 100,000 for a chance to obtain post-graduation employment in the United States, reports suggest. According to a Wall Street Journal report, America may require foreign university graduates to pay the whopping amount for access to the Optional Practical Training (OPT) programme. This move could significantly raise the cost of studying in the United States for Indian students, who make up the largest international student community in the country.While the proposal has not been officially announced, it has already sparked concern among universities, employers and students because of the central role OPT plays in helping foreign graduates transition from education to employment.Also read | <a href="https://www.wionews.com/india-news/india-avoids-higher-us-tariff-secures-lower-10-rate-here-s-how-1784854529326">India avoids higher US tariff, secures lower 10% rate. Trump to charge foreign students $100,000 for a shot at a US job? Here's why Indian students should be worried

Amid global turmoil in West Asia and elsewhere, Indian students pursuing higher education in the United States are now facing mounting financial pressure. A weaker rupee, geopolitical tensions and rising travel costs are increasingly making overseas education increasingly expensive for the millions of Indian students who go abroad to pursue higher education every year. For many aspiring students, the dream of an international degree remains alive, but as the rupee continues to weaken and global uncertainties deepen, financing that dream is becoming increasingly difficult.<h2>How many Indian students go abroad for higher education?</h2>According to data from the Ministry of External Affairs (MEA) in 2025, over 1.2 million Indian students enrolled in higher education overseas; the year before this number stood at 1.33 million. A quick look at MEA data shows that while the overall number remains high, outbound enrolments have seen a year-on-year decline. The reason for this decline: uncertainty surrounding global mobility, stricter visa rules, policy caps, and economic volatility.Also read | <a href="https://www.wionews.com/india-news/cywyddau-who-is-shrey-parikh-indian-origin-teen-wins-america-s-biggest-spelling-competition-takes-home-50-000-prize-scripps-national-1780033420442">'Cywyddau': Who is Shrey Parikh? The company noted that international education is no longer just about securing university admission. Instead, it has become a lengthy process involving financial planning, funding challenges and uncertainty even before students arrive on campus.According to data from Prodigy Finance's earlier research, more than 79 per cent of Indian students planning to study abroad come from Tier 2 and Tier 3 cities. Of this, nearly 60 per cent belong to modest-income households where parents often make significant financial sacrifices to support their children's education ambitions, said the lender.<h2>Falling rupee causes headache for parents</h2>The pressure has become more visible as the Indian rupee faces depreciation against the US dollar, increasing the cost of tuition fees, accommodation and day-to-day living expenses for students studying overseas. Already this year, the rupee has depreciated by 7.04 per cent. The rupee opened the year trading at approximately ₹89.50–₹89.90 per US Dollar in January but repeatedly hit record lows every month between January and May. On May 19, 2026, it touched an all-time low of ₹96.56.Also read | <a href="https://www.wionews.com/india-news/neet-ug-paper-leak-scandal-army-may-help-conduct-re-exam-for-first-time-suggest-reports-1780025143224">NEET-UG paper leak scandal: Army may help conduct re-exam for first time, suggest reports</a>Sonal Kapoor, Global Chief Business Officer at Prodigy Finance, said students should carefully evaluate how they finance their education in the current environment. Rupee slide, wars and more: Indian students in US battle currency crisis no one prepared them for | WION Horizons

More and more Indian students in the United States are taking up babysitting jobs as they feel the heat of the cost of living crisis and other part-time job opportunities get scarce. According to a Times of India report, the students are taking off-campus jobs even if it’s illegal, to make ends meet.

Babysitting jobs have become a hot topic especially among girls, due to a safe environment and additional perks like food, accommodation or both. The trend is more visible among students from&nbsp;Telangana and Andhra Pradesh, and they are mostly catering to Indian families based in the US. The pay scale varies from place to place but is generally low due to an oversupply of job seekers.

According to a report by Open Doors 2024, there are approximately 39,000 Indian students in Texas, 20,000 in Illinois, 13,500 in Ohio, and 7,000 in Connecticut, and 50 per cent of them are Telugu-speaking.

The matter was raised during the India-US foreign office consultations between Foreign Secretary Harsh Vardhan Shringla and the US Under Secretary of State for Political Affairs David Hale on Tuesday.&nbsp;

Assuring New Delhi, sources said, the US side took note and said they will keep the best interests of the students in mind and would try and mitigate the impact.&nbsp;

The Indian government readout of the talks said,"discussed ways to further enhance mutually beneficial trade and people-to-people ties, including through visa facilitation for students and professionals."&nbsp;

This action will majorly impact Indian students. More than 200,000 Indian students are currently pursuing various courses in the US, which form the second highest number of foreign students after Chinese students.

The release from the US immigration and customs enforcement said,"Active students currently in the United States enrolled in such programs must depart the country or take other measures, such as transferring to a school with in-person instruction to remain in lawful status."

"If not, they may face immigration consequences including, but not limited to, the initiation of removal proceedings."

Detailed implementation guidelines are yet to come out.

India raises foreign student visa issue with US

Thousands of foreign students in America are angry and frustrated.

First,&nbsp;the&nbsp;pandemic&nbsp;locked them up in their room, now they face deportation.

The&nbsp;government has decided, if classes go online, students must leave. Harvard University and several other colleges say they will reopen campuses, but hold classes online.&nbsp;

The foreign students are a tormented lot for no fault of their own and weighing some tough questions in their anxious minds.

All F-1 and M-1 visa holders are in the spotlight. Regular academic students hold an F-1 visa. Those pursuing non-academic and vocational courses have the M-1visa. These&nbsp;visas will be deemed invalid if the students are attending online classes.

<div class="videoWrapper trancodeVideo"><iframe allowfullscreen="" autoplay="1" class="includeVideo" frameborder="0" height="350" src="https://www.wionews.com/videos/gravitas-us-orders-foreign-students-to-leave-311460/embed" style="width:100%;max-width:560px;" width="560"></iframe></div>

The students are now grappling for options. A student must shift to a college which&nbsp;offers&nbsp;in-person classes such students can remain in the US. Also, the&nbsp;question being raised is which students will be the worst affected.

At least 1.2 million foreign students are studying in 8,700 colleges across the United States of these the Chinese students form the largest group along with 360,000 Indians who will be the second worst-affected. Over 250,000 students from South Korea, Saudi Arabia and Canada will be also be affected. The question on most students mind is if they can return to finish the course, assuming that they are sent home.

The students have been asking will they be allowed to return? The answer is no, not unless the student provides proof that lessons will be held inside a classroom. The rule applies to new students too if classes are online -- student visas won't be issued.

And the other question is how will the students leave the US?

Nearly 90 per cent of these foreign students are still in the United States if they go back home, it will be hard for them to return as routine visa processing has been suspended at the US embassies and consulates worldwide.

International travel restrictions are in place in many countries and commercial flight options are limited even if colleges shift to classroom-based teaching in the coming months' travel restrictions will make it difficult for students to return.

The other question is about fees which have already been paid. Online classes do not mean lower tuition fees. Foreign students pay more than American citizens. They make up less than 6 per cent of a class but contribute over 10 per cent of the revenue. Last year foreign students contributed over $40 billion to American colleges. Harvard University president Larry Bacow says he is very concerned by the decision to deport students.

Colleges might take the government to court as they are lobbying to get the decision revoked. America's COVID-19&nbsp;cases are close to 3 million but colleges want to retain students. The new rule could force them to open up, worsening America's health crisis.

US fake university row: India monitoring situation closely

As many as 211,703 Indian students are currently studying in various American universities, a latest official report has said.

India ranks second in number of foreign students studying in the US. China tops the list with 377,070 students.

In its latest biannual report on international student trends, 49 per cent of the F and M student population in the United States hailed from either China (377,070 students) or India (211,703 students), and interest continues to grow.

Over the reporting period, both China and India saw proportional growth between 1 and 2 per cent, with China sending 6,305 more students and India sending 2,356 more students.

It is this level of participation from China and India that makes Asia far and away the most popular continent of origin. In fact, 77 per cent of all international students in the US call Asia home, said the Student and Exchange Visitor Program (SEVIS) report of the US Immigration and Customs Enforcement's (ICE) Homeland Security Investigations.

According to the report, despite steady growth from the two most populous nations, there was a slight decrease in the number of Asian students coming to study in the United States over the reporting period.

The sharp decline in the number of students from Saudi Arabia (-9,971), South Korea (-5,488), and Yemen (-396) outweighed the rapid growth in the number of students coming from Pakistan (+448), Burma (+206) and Cambodia (+109).

During the reporting period, the total number of SEVIS records for active F and M students decreased by 0.5 per cent, from 1,208,039 in March 2017 to 1,201,829 in March 2018.

The J-1 exchange visitor population increased by four per cent from 201,408 in March 2017 to 209,568 in March 2018.

The J-1 visa offers cultural and educational exchange opportunities in the United States through a variety of programs overseen by the US State Department.
