The Supreme Court on Wednesday adjourned the pleas against the appointments of the chief election commissioner (CEC) and election commissioners (EC) under the 2023 law.
A bench of Justices Surya Kant and N Kotiswar Singh indicated that the matter would be listed after the Holi festival break due to paucity of time. However, no date was fixed for hearing the matter.
Advocate Prashant Bhushan, appearing for petitioner NGO Association for Democratic Reforms, said it was an important issue which required an urgent consideration.
He said the matter involved a short legal question -- whether the 2023 Constitution bench verdict should be followed for the appointment of the CEC and ECs through a panel involving the Prime Minister, Leader of Opposition and the Chief Justice of India or the 2023 law, which excludes the CJI from the panel.

At around 3 pm, Justice Surya Kant told Bhushan that he would be sitting in a special bench and the court had numerous matters listed before the Holi break.
Bhushan requested the matter to be listed on any day in the coming week and assured the petitioners would not take more than an hour to advance submissions.
Advocate Varun Thakur, appearing for petitioner Jaya Thakur, also mentioned the matter for an urgent hearing saying it was "very important for the survival of democracy".
Justice Surya Kant said, for the court, all matters were equally important and no single matter was superior to others.
Earlier, solicitor general Tushar Mehta, appearing for the Centre, expressed his inability to address the court on the issue saying he was appearing before the Constitution bench headed by Chief Justice Sanjiv Khanna on the issue of arbitration.

On February 18, the top court said it would take up on "priority basis" the pleas against the appointments of the CEC and ECs under the 2023 law.
Bhushan said the government by appointing the new CEC and EC under the 2023 law was making a "mockery of democracy".
On February 17, the government appointed EC Gyanesh Kumar as the next CEC. Kumar is the first CEC to be appointed under the new law and his term would run till January 26, 2029, days before the EC is expected to announce the schedule of the next Lok Sabha election.
Vivek Joshi, a 1989-batch Haryana-cadre IAS officer, was appointed as an election commissioner.
Born on May 21, 1966, Joshi (58) would serve in the poll panel till 2031. According to the law, a CEC or an EC retires at 65 or could have a tenure in the poll panel for six years.
On February 12, the top court fixed February 19 to hear pleas against the appointment of the CEC and EC under the 2023 law saying if anything happened in the interregnum, the consequences were bound to follow.
It said the issue would be decided on merit and finally.
Bhushan referred to the 2023 verdict, saying it held that the election commissioners had to be selected for appointment by an independent panel comprising the prime minister, Leader of Opposition and Chief Justice of India.
On March 15, 2024, the top court refused to stay the appointments of the new ECs under the 2023 law which excluded the CJI from the selection panel and deferred the hearing on a batch of pleas against the appointments.
The apex court told the petitioners that the March 2, 2023 verdict directed for the three-member panel comprising the Prime Minister, Leader of Opposition and the CJI to operate till Parliament enacted a law.
The apex court's verdict held that leaving the appointment of the ECs and CEC in the hands of the executive would be detrimental to the health of the country's democracy and the holding of free and fair elections.
The NGO challenged the CJI's exclusion and said the election commission should be insulated from "political" and "executive interference" for maintaining a healthy democracy.
ADR's plea alleged the verdict was overruled by the Centre without removing its basis and the composition of the selection committee under the new law which amounted to excessive interference of the executive in the appointments and was detrimental to the independence of the poll panel.
Former IAS officers Gyanesh Kumar and Sukhbir Sandhu were recommended to be appointed as ECs in 2024 by a selection panel chaired by Prime Minister Narendra Modi under the new law.

<h2>Who is Sukhbir Singh Sandhu?</h2>

Former bureaucrat, Sandhu is a retired IAS officer of the Uttarakhand cadre 1988 batch.&nbsp;

Born in 1963, he was appointed as the chief secretary of Uttarakhand at the time when Pushkar Singh Dhami took over as the CM of the state in the year 2021. He retired from the post on January 31, 2024.

Sandhu is learnt to have overseen the ideation for the implementation of the Uniform Civil Code in the state.&nbsp;

An MBBS from the Amritsar Medical College, Sandhu has served as the chairperson of the National Highways Authority of India (NHAI) and has also served as additional secretary, of the Department of Higher Education, Ministry of Human Resource Development.&nbsp;

He holds a degree in law and also has a master's degree in history from Guru Nanak Dev University.

He has also authored papers on topics like 'Municipal Management and Capacity Building' and 'Urban Reforms'.

He was conferred with the President's Medal for his significant contributions during his tenure as Commissioner of the Municipal Corporation in Ludhiana.

India's opposition party Congress, reacting over India's Election Commissioner Arun Goel's resignation, expressed "deep concern" over the sudden step and warned against the dangerous trend of independent institutions' systematic erosion in the country.&nbsp;

The party warned that if this trend is not halted, democracy will be supplanted by dictatorship.&nbsp;

Congress President Mallikarjun Kharge, in a post on X, said, "Election Commission or Election OMISSION? The sudden resignation of India's Election Commissioner Arun Goel days before the announcement of Lok Sabha election dates has raised many eyebrows.

On Saturday (Mar 9), Arun Goel resigned days before the schedule for the 2024 Lok Sabha elections was to be announced.

He was to remain as the Election Commissioner till December 5, 2027, and would have taken the place of Chief Election Commissioner (CEC) after the retirement of incumbent Rajiv Kumar in February of next year.

The Election Commission of India consists of a poll panel that has three members. One of the position was vacant, and with&nbsp;Goel's resignation,&nbsp;Kumar&nbsp;remains the only person&nbsp;on the poll panel.&nbsp;

Shiv Sena (UBT) MP Sanjay Raut, also raised question on the unexpected resignation and said that the Election Commission of India is not an autonomous watchdog anymore.&nbsp;

"Whether the ECI exists or not, it has no meaning especially after how it has given orders under BJP's pressure in the cases of Shiv Sena and NCP splits, completely in violation of the 10th schedule," said Raut. The bill cleared by Rajya Sabha included critical amendments like the retention of CEC, EC status at par with the judges of the Supreme Court and upgradation of the search committee.

It also inserted a new clause to safeguard them the court cases while releasing their official duties.

While the bill was passed by a voice vote, the members of the opposition argued that the suggested measure subjugates the poll authority to the Executive and also violates the Constitution.&nbsp;

The bill was cleared after Union Law Minister Arjun Ram Meghwal's response who said that the Election Commission will continue to "work independently" and that bill had been brought after a judgement by the Supreme Court.

Congress MP Randeep Surjewala called the bill an attack on the democracy saying that the autonomy, fearlessness and fairness of India's democracy and electoral machinery have been crushed by a bulldozer.

"Modi government has attacked the democracy of India. The autonomy, fearlessness and fairness of India's democracy and electoral machinery have been crushed by a bulldozer," Surjewala said.

"The Modi Government is passing a law in Rajya Sabha today to make the Chief Election Commissioner and Election Commissioners of the Election Commission of India, a 'pawn Election Commissioner'," he added.

He also slammed the Modi government saying that this bill had turned the literal meaning of EC from 'Electoral Credibility' to 'Elections Compromised'.

"They will appoint a Chief Election Commissioner and Election Commissioners of their own choice. They will run their Election Commission as per their desire. They will prepare an electoral list as per their desire...This is perhaps one of the biggest blows to democracy hurled by the Modi government in the last 9 years...We will take it to the end and the struggle will continue from Parliament to the streets," he added.

Rajya Sabha passes bill to regulate appointment of CEC, election commissioners; opposition walks out

The Prime Minister Narendra Modi-led government has proposed a bill in the parliament that seeks to remove the Chief Justice of India from the selection committee that appoints the country's top election officers.

Under the new bill, the Chief Election Commissioners and Election Commissioners shall be selected by a panel consisting of the prime minister, the Leader of the Opposition, and a Union Minister nominated by the prime minister.

The legislation&nbsp;titled ‘The Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Bill, 2023’, was introduced by Law Minister Arjun Ram Meghwal in the Rajya Sabha (upper house) amid din over protests in Manipur.

It will be tabled on Friday (Aug 11) for discussion.

If passed in both Rajya Sabha and the Lok Sabha, the central government can pick and choose any official as per its wishes and scuttle the judiciary’s chances of having a say in the appointment process.

<h2>Oppn condemns proposed bill</h2>

The opposition pointed out that this will affect the neutrality of the Election Commission (EC) as the selection panel would effectively have two members of the Bhartiya Janata Party —&nbsp;the prime minister and the cabinet minister.

The Congress criticised the bill, terming it as "another attempt to control important institutions".

"The PM will appoint a Union Cabinet Minister to replace the CJI as a member of the selection committee to recommend a Chief Election Commissioner. The Opposition leader will be a member but is bound to be outnumbered. This is yet another way to control an institution that must be independent," Congress MP Sushmita Dev said.

Delhi Chief Minister Arvind Kejriwal also raised the same concern, saying that it will influence the fairness of elections.

It is a very dangerous situation if the prime minister does not follow the Supreme Court," Kejriwal said on X.

The move comes at a time when the present Election Commissioner Anup Chandra Pandey is all set to vacate the office next year, possibly days before the announcement of dates for the 2024 general election.

Also, the legislation might trigger a fresh face-off between the Supreme Court and the government, as it falls in contravention to the top court's ruling in March that the selection panel should comprise the prime minister, the Leader of the Opposition (LoP) in Lok Sabha and the CJI.

The court had said the order would hold good until a law was made by the parliament.

According to Article 324(2) of the Constitution, the president appoints CEC and ECs after receiving advice from the Council of Ministers, which also includes the prime minister.

The article states that CEC and ECs would be appointed as per the said procedure until the parliament enacts a law fixing the criteria for selection, conditions of service and tenure. However, no such law has been enacted for the purpose.

The petition seeks a fair and transparent procedure for the appointment of CEC and ECs.

Reacting to the plea, a five-judge Constitution bench headed by Justice K M Joseph on Tuesday said that there needs to be a system in place so that the "best man" is selected as the CEC, and added that the government pays only "lip service" to the independence of Election Commissioners.

Justice K M Joseph criticised the Union government over the short tenure of CECs, saying, "Their (CECs) tenure is highly truncated and known from the very beginning… In this way, this so-called independence that you pay lip-service to, I am sorry to say, is completely destroyed by getting this kind of a term.”&nbsp;

Justice Joseph said it has been 72 years since the Constitution was adopted but still there is no law on the appointment of election commissioners, despite being envisaged in the Constitution.

The court pointed out that the "situation on the ground is alarming" and that it wants a CEC like late T N Seshan, who is known for bringing key electoral reforms as the poll panel chief from 1990 to 1996.

“There have been numerous CECs and T N Seshan happens once in a while. We do not want anyone to bulldoze him. Enormous power has been vested on the fragile shoulder of three men (CEC and two election commissioners). We have to find the best man for the post of CEC," the court said.

The government's counsel, Attorney General for India R Venkataramani, argued that the Centre was in favour of appointing the “best man”, but raised doubts on how it can be done.

"There is no vacuum in the Constitution. Election commissioners are presently appointed by the president on the aid and advice of the council of ministers," he said.

The Law Ministry issued a notification announcing his appointment.

Chandra, 61, will have to resign from CBDT, where he is serving, before joining the poll panel.

He will assume his new charge on Friday.

Since Chandra has expertise in taxation and investigation, he could help the poll panel in election expenditure by political parties and candidates, a senior EC official felt.

Before Chandra, T S Krishnamurthy was the other IRS officer to be appointed as election commissioner. He went on to become the chief election commissioner in 2004.

Chandra was appointed as CBDT chief in November, 2016 and has since been given two extensions. He was due to retire in May.

When Om Prakah Rawat retired as chief election commissioner in November, 2018, Arora, then an election commissioner, took over as the chief of the poll panel. After Rawat's retirement, there was a vacancy in the election watchdog which has now been filled.

While Arora and Lavasa are 1980 batch IAS officers, Chandra is also from the 1980 batch, but from IRS.

Chandra will retire in May, 2022 on turning 65. Lavasa would retire a few months later in October, 2022. CEC Arora has a tenure till April, 2012.

The CEC or an EC can have a tenure of six years or hold office till the age of 65 years, whichever is earlier. The convention is to appoint the senior-most election commissioner as chief election commissioner.

Chandra completed his B Tech from Roorkee University and LLB from Dehradun and joined Indian Revenue Service in 1980.

He has served in Uttar Pradesh, Rajasthan, Delhi, Gujarat and Mumbai and has worked in the areas of international taxation and investigation at various places.&nbsp;

He was commissioner of Income Tax (Appeals) International Taxation at Delhi.&nbsp;

Before being appointed chairman of CBDT, he was member (Investigation) in the Board.&nbsp;

A delegation of senior BJP leaders have decided to meet Chief Election Commissioner on Monday to register a complaint&nbsp;about West Bengal government blocking rallies of senior party leaders in the state.

The move has come after the West Bengal government led by <a href="http://www.wionews.com/india-general-elections-2019/yogi-adityanath-addresses-rally-in-west-bengal-via-audio-link-after-his-chopper-was-denied-permission-194825">Mamata Banerjee denied permission</a> for the landing of Uttar Pradesh chief minister Yogi Adityanath's chopper in the state on Sunday.

Following the denial, Adityanath addressed rallies&nbsp;via&nbsp;video&nbsp;link at&nbsp;Raiganj and&nbsp;Balurghat in the state.

"The TMC government didn't allow me to come and meet you all. That is why I had to resort to Digital India of Modi-ji to address you. This TMC government is anti-people, anti-democratic and have compromised with national security," PTI quoted Adityanath as saying.

Om Prakash Rawat has been appointed as the new Chief Election Commissioner, succeeding incumbent Achal Kumar Jyoti to the post, while ex-finance secretary Ashok Lavasa will be the new election commissioner.

Both of them will take charge from January 23.
