<p>Solicitor General Tushar Mehta on Thursday informed the Supreme Court that the Delhi Police have withdrawn the notification imposing a prohibitory order in the national capital.</p>

<p>Sunil, a priest of the famous Kalkaji Temple in Delhi and the Secretary of Manas Naman Sewa Society, who organises the grand Ramlila at the Satpula Ground in Chirag&nbsp;Dilli, filed the plea through advocate Prateek Chadha. He has challenged the Delhi Police Prohibitory Order banning assembly of five or more people from September 30 to October 5, saying that it will affect footfall during Dussehra and Navratri festivals. The petitioner said that the order would hinder religious celebrations during this period.</p>

<p>"The Ramlila and the fair around it see significant footfall each year during Dussehra and Navratri. Such festivities are organised in every nook and cranny of the city, and these were scheduled to commence on October 3, 2024. However, now, in light of the order assailed in this present petition, the commencement of these festivities across the city and long-standing traditions observed by innumerable residents of Delhi is in jeopardy for no constitutionally valid reason," the petition said.</p>

<p>In the plea, the petitioner sought quashing and setting aside of the order dated September 30, 2024, issued by the Commissioner of Police. Delhi Police exercising and enacting the powers under Section 163 of the Bhartiya Nagarik Suraksha Sanhita, 2023, prohibited the assembly of five or more unauthorised persons from September 30 to October 5. During this period, there is a prohibition on the assembly of five or more unauthorised persons, carrying of firearms, banners, placards, lathis, and so on and dharnas in public areas.</p>

<p>"The impugned order will have a significant effect on the ingress and egress of citizens wishing to enter the NCT of Delhi from other states," the petition said.</p>

<p>The reasons provided in the order do not relate to any emergency or unforeseen circumstance that necessitates the curfew sought to be imposed by the police, the petition said.</p>

<p>"The elections, amendments to the Waqf laws, as well as the upcoming festivals, are all well known to the public authorities in advance, and necessary security arrangements ought to be made for the same. The practice of invoking Section 163 of BNSS for such foreseeable scenarios, without a grave apprehension of security breaches or disruption of public order is unsustainable in light of the pronouncements of this Court," the petitioner said.</p>

<p>The CJI after discussing the matter, instructed the petitioner to remove retired Justice Gogoi's name from the petition.&nbsp;"The registry will look at the petition," he added.&nbsp;</p>

<p>The apex court also interjected to claim that 150 gm of semen was found, saying, "We have the actual autopsy report before us, and we know what the 150 gm refers to. Please don't use social media to make your arguments."</p>

<p>“It is like a mandir, masjid, gurudwara and girja (church). The judiciary is of the people, by the people and for the people... and the last frontier for getting justice and upholding constitutional rights," she further said and hailed CJI Chandrachud for initiating digitisation and e-laws in courts.</p>

<h2><strong>'Judges are servants, not masters of Constitution'</strong></h2>

<p>Addressing the event, CJI Chandrachud&nbsp;insisted on the commitment of courts to ensure diversity, inclusion, and tolerance. He&nbsp;elaborated on the notion of ‘Constitutional Morality’ as a restraining factor on the State that should derive from the Preambular values of the Constitution.</p>

<p>Underlining the country’s federal structure that’s “marked by a great deal of diversity”, Chandrachud focussed on the role of judges in “preserving the diversity of India.”</p>

<p>“I am reticent when people call courts a temple of justice. Because that would mean the judges are deities which they are not. They are instead servers of the people, who deliver justice with compassion and empathy,” he added.</p>

Justice PB Varale sworn in, bolsters Dalit representation in India's top court to 3 judges

<p>A judge in the Indian state of Uttar Pradesh has pleaded for euthanasia after alleging that she was sexually harassed at her workplace, media reports said on Thursday (Dec 14). In a letter addressed to Chief Justice of India (CJI) Dhananjaya Y Chandrachud which went viral on social media, the judge said she was sexually harassed by "one particular district judge and his associates."</p>

<p>"I complained to the Hon'ble Chief Justice, Allahabad, and the Administrative Judge (High Court Judge) in 2022. No action has been taken till date. No one even bothered to ask me: WHAT HAPPENED, WHY ARE YOU DISTRESSED?" she said.</p>

<p>The judge said she complained to the Internal Complaints Committee of the high court in July this year, adding it took six months and thousands of emails just to start an enquiry- which she called a farce and a sham.</p>

<p>On the 77th anniversary of Independence Day on Tuesday (Aug 15), Chief Justice of India DY Chandrachud announced the expansion of the Supreme Court’s infrastructure that will include the incorporation of four registrar courtrooms, 27 new courtrooms, and better facilities for lawyers and litigants.</p>

<p>Speaking about the overhaul of judicial infrastructure, Justice Chandrachud said the museum and the annex building will be demolished to create more courtrooms and bar rooms for the Supreme Court Bar Association (SCBA), Supreme Court Advocates-on-Record Association (SCAORA) and bar room for women lawyers.</p>

<p>"We need to overhaul judicial infrastructure at the earliest. We plan to expand the supreme court by constructing a new building to have 27 additional courtrooms, 4 registrar courtrooms and adequate facilities for lawyers and litigants. The museum and annex building will be demolished to create 15 courtrooms, SCBA, SCAORA Meeting rooms, women's bar rooms," the CJI said during Independence Day celebrations organised by the SCBA in the Supreme Court premises, according to Bar and Bench news outlet.</p>

<p>Justice Chandrachud said that a proposal in this regard was submitted to the central government and is awaiting nod from the Department of Justice.</p>

<h2><strong>CJI on arbitrary arrests</strong></h2>

<p>He also spoke about making the Indian judicial system more accessible and cost-effective for the people and banked on the potential use of technology to overcome procedural barriers to justice.</p>

<p>India's Supreme Court on Wednesday quashed the central government's ban on the telecast of the Malayalam language channel 'MediaOne', ruling that "national security claims can't be made out of thin hair." A bench headed by Chief Justice of India DY Chandrachud observed that the State can't impose unreasonable restrictions on the press as such an action would have chilling effects on press freedom.</p>

<p>The top court alleged that the State is using national security as a tool to deny citizens remedies that are provided under the law.</p>

<p>Born to 16th CJI late Yeshwant Vishnu Chandrachud on November 11, 1959, DY Chandrachud was elevated as a Supreme Court judge on May 13, 2016. This is the first instance of a father and son occupying the highest seat of justice.</p>

<p>Justice Chandrachud has done his graduation in Economics from Delhi University’s (DU) St Stephen's College and got his LLB degree from Campus Law Centre, DU, before going to Harvard for his doctorate.</p>

<p>Women cannot be treated as weaker or lesser, Chief Justice of India(CJI) Dipak Misra said while delivering the verdict on the entry of women at the Sabarimala temple.</p>

<p>A five-judge Supreme Court bench delivered its verdict on the entry of women aged between&nbsp;10 to 50 at the Sabarimala temple in Kerala.</p>

<p>The Supreme Court said the rule is against the article 14 and 25 of the Indian Constitution. "Constitutional morality is supreme,"&nbsp;the CJI said while reading out the verdict.</p>

<p>The bench comprises of Chief Justice Dipak Misra, Justices RF Nariman, AM Khanwilkar, DY Chandrachud and Indu Malhotra.</p>

<p>"Patriarchal notion cannot be allowed to trump equality in devotion," CJI Misra said. Sabarimala Temple practice violates the rights of Hindu women, Misra added.</p>

<p>The temple's authorities, however, said they will appeal to the Supreme Court for a review of the ruling ahead of its next period of opening of the temple, beginning October 16th.</p>

<p>"Banning entry of women to shrine is gender discrimination," the CJI asserted. Religion is a way of life basically to link life with divinity, he said.</p>

<p>CJI Dipak Misra read out the first of four set of verdicts in the Sabarimala shrine case. Justice Indu Malhotra has written separate dissenting verdict, the CJI said.</p>

<p>Justice R F Nariman, D Y Chandrachud concurred with the CJI.</p>

<p>Law and society are tasked&nbsp;to act as levellers,&nbsp;CJI said, adding,"devotion cannot be subjected to discrimination." Devotees of Lord Ayyappa do not constitute separate denomination, the CJI said.</p>

<p>The practice of exclusion of women of 10-50 age group cannot be regarded as essential religious practice, the CJI said while delivering the verdict.</p>

<p>Kerala law denies rights to women on the ground of physiological reasons, the CJI added.</p>

<p>The ban was challenged by the Indian Young Lawyers Association, among the petitioners who had filed the case in 2006 but it was taken up for hearing in January 2016.</p>

<p>The Kerala government had said earlier that it was not opposed to the "prayers of the petitioner". Kerala state minister K Surendran had said all women, irrespective of their age should be allowed to offer prayers at the Sabarimala Temple.</p>

<p>Last year, in October the Supreme Court bench had asked whether the traditional ban amounts to discrimination against women and violates their fundamental rights under the Constitution.&nbsp;</p>

<p>"Every woman is also the creation of God and why should there be discrimination against them in employment or worship," Justice DY Chandrachud, who is part of the five-judge constitutional bench had said.</p>

<p>Justice Chandrachud is part of the 5-judge constitution bench headed by Chief Justice of India Dipak Misra, which is hearing a batch of petitions challenging the constitutional validity of the Aadhaar scheme and its enabling law of 2016.</p>

<p>During the hearing, the bench, also comprising Justices AK Sikri, AM Khanwilkar and Ashok Bhushan, said Aadhaar authentication failures could create problems for those in need and some solution has to be found to address the issue.</p>

<p>Recalling his experience, Justice Chandrachud said "my mother, who was suffering from Alzheimer's disease, was entitled to family pension being the wife of a former Chief Justice of India (late Justice Y V Chandrachud).</p>

<p>"She had to give a thumb impression for authentication. I recall, every month the bank manager or his representative would come home and affix her thumb print on certain documents and only then could she get the pension", Justice Chandrachud said.</p>

<p>"So it (authentication) is a serious issue. It's not largesse. It is not charity...we have to find answers for these problems," he said, adding that there was a class of needy people who may not get the benefits due to authentication failures.</p>

<p>The top court judge was responding to the arguments of senior advocate Shyam Divan, appearing for former High Court judge Justice (Retd) K S Puttaswamy, who said a 90-year-old woman suffering from various ailments is being threatened that her bank account could be closed for non-authentication by Aadhaar.</p>

<p>Divan said that through that bank account, she was getting her pension and she uses that money for her treatment as she has no one else to look after her.</p>

<p>"There are numerous cases where the Aadhaar authentication failures of the elderly, people suffering from any disease or physical disability, leads to denial of benefits to those otherwise entitled to it," Diwan said.</p>

<p>He said in many villages, young people have now migrated to cities or nearby towns and only the elderly residing there were dependent on their pension or other grants. But due to Aadhaar authentication failure, they were not getting the benefits.</p>

<p>Divan sought to assail a World Bank report which had praised the Aadhaar project and which was relied upon by the government to bolster its case for the 12-digit unique identification number. He said the World Bank had partnered with a private entity for preparing the report titled 'Identification for Development'.</p>

<p>Divan claimed that the same private entity was also the company with which UIDAI had partnered to facilitate Aadhaar.</p>

<p>He said there were 144 notifications issued by various ministries and departments of the government which covered 252 schemes.</p>

<p>The senior lawyer concluded his rejoinder arguments saying that essential government schemes that apply to children or relate to citizen's rehabilitation, food, health and nutrition, should be excluded from the requirement of Aadhaar authentication.</p>

<p>The hearing remained inconclusive on Wednesday and will continue on Thursday.</p>

<p>On May 3, the centre had strongly defended its decision to seed Aadhaar numbers with mobile phones, telling the top court that it could have been hauled up for contempt if the verification of mobile users was not undertaken by it.</p>

<p>However, the court had said that the government had misinterpreted its order and used it as a "tool" to make Aadhaar mandatory for mobile users.</p>

<p>The petitioners had referred to the technical experts' views on the technical aspect of the Aadhaar architecture and said that a real time surveillance of citizens was possible.</p>

<p>For the first time in a democracy, something like CIDR has been implemented and the apex court has to balance the human rights and new technologies that is capable of being misused, they had said.</p>

<p>Earlier, the court also did not agree with the government's contention that the Aadhaar law was correctly termed as a Money Bill by the Lok Sabha Speaker as it dealt with "targeted delivery of subsidies" for which funds come from the Consolidated Fund of India.</p>

Citing mother's example, Supreme Court judge says Aadhaar 'serious issue'

<p>Dushyant Dave, the counsel for petitioners Bombay Lawyers Association who are demanding a Special Investigation Team (SIT) to probe the case, today objected to senior lawyer Harish Salve&#39;s presence. Dave argued that Salve has previously represented BJP chief Amit Shah - one of the accused who was later discharged - in the case and hence should stay aw.</p>
