Trump may face another indictment over mishandling of classified documents found at Mar-a-Lago

A 2021 audio recording of Donald Trump acknowledging that he kept a confidential Pentagon document after exiting from the office is in possession of federal prosecutors, CNN quoted citing officials in knowledge of the matter.

The US-based news outlet said that it did not hear the audio recording, but cited the official to suggest that Trump deliberately kept confidential information beyond his time as the president. The classified documents detail a "potential attack on Iran."

The recording is believed to be about two minutes long, with the sources telling CNN that it was a small part of a much longer meeting that took place in July 2021 at Trump's golf club in Bedminster, New Jersey.

It is being reported that several attendees at the July meeting did not have the necessary security clearance to be privy to discussions about the classified material.

The audio recording includes comments by Trump discussing his desire to publicly share information about the potential Iran attack, but acknowledging that he could not declassify the information at that point since he was no longer president, according to CNN's sources.

Special counsel Jack Smith, who has been leading the Department of Justice’s investigation into Trump, has been focused on the meeting as part of the criminal investigation into the 45th president’s handling of national security secrets.

Official sources believe that this recording would serve as an “important” piece of evidence in a possible case against Trump, who has repeatedly asserted he could retain presidential records and “automatically” declassify documents.

Trump’s spokesperson reacts

Reacting to the report, a Trump spokesperson said in a statement: “Leaks from radical partisans behind this political persecution are designed to inflame tensions and continue the media’s harassment of President Trump and his supporters. It’s just more proof that when it comes to President Trump, there are absolutely no depths to which they will not sink as they pursue their witch hunts.”

The Department of Justice began investigating Trump's mishandling of documents publicly in August 2022, when FBI agents raided the former US president’s Mar-A-Lago home in Florida to uncover a trove of documents, many of which were classified.

Federal investigators have already asked high-level witnesses about the Iran document in front of a federal grand jury.

Recently, a report by the Wall Street Journal noted that Smith, who is nearing the end of his testimony and evidence-gathering phase into Trump's handling of classified documents, is nearing a decision on whether or not to bring criminal charges against the former president.

The Air Force spokesperson without naming the officers said the operation commander and detachment commander of the 102nd Intelligence Wing had been benched, pending further investigation. "The commander of the 102nd Intelligence Wing at Otis Air National Guard Base, Massachusetts, has suspended the commander of the 102nd Intelligence Support Squadron pending further investigation into the unauthorised disclosure of classified information," the Air Force spokesperson said. "This means that both the squadron's state Air National Guard operational commander and current federal orders administrative commander have been suspended pending completion of the Department of the Air Force Inspector General Investigation. According to reports, Teixeira leaked highly sensitive information including details about troop movement in Russia’s war with Ukraine. Teixeira said in the chat group that he was able to access the documents because he worked on a “military base". The accused was referring to the 102nd Intelligence Wing at Otis Air National Guard Base where he was assigned the task to manage and troubleshoot computers and communications systems for the Air Force. For the first time since these records were made public earlier this week, former vice president Mike Pence said he accepts "full responsibility" for the existence of sensitive documents in his Indiana home.

In his first public comments since classified documents were found at his residence in Indiana, the former United States Vice President Mike Pence said on Friday (January 27) that he takes “full responsibility” for the incident. This comes days after media reports first emerged that dozens of documents marked classified were discovered at Pence’s residence in Indiana by his lawyers on January 16. However, the former VP’s legal counsel at the time had said that Pence was “unaware” of the existence of the papers in question which have since been handed over to the FBI.

While speaking about the economy and promoting his new book “So Help Me God” at Florida International University, Pence said, “Let me be clear: Those classified documents should not have been in my personal residence…Mistakes were made, and I take full responsibility.” A total of four boxes containing copies of administration paper documents found at Pence’s Indiana residence are said to be from his time as the vice president from 2017 to 2021 when Donald Trump was the president, reported the Associated Press.

A lawyer of the former United States Vice President Mike Pence discovered at least a dozen documents marked classified at his residence in Indiana, last week (January 16) which have since been handed over to the FBI, first reported by CNN. Since the discovery, Greg Jacob, Pence’s legal counsel, wrote two letters to the National Archives and said that the former VP was “unaware” of the existence of the documents in question and will “cooperate fully” for the inquiry. This comes as incumbent President Joe Biden and former President Donald Trump are under investigation by the Department of Justice investigation (DOJ) for retaining classified documents from their time in office. The ghosts of January 6 Capitol rioting came back to haunt former US President Donald Trump on Saturday. The US Department of Justice appointed Jack Smith, a war-crimes specialist, to investigate Trump's role in January 6 rioting on the Capitol and his handling of sensitive government documents at his Florida residence. The development comes less than 72 hours after Donald Trump announced his third bid for the White House in 2024. Trump clarified that he has not done 'anything wrong' and that it's a 'political witch-hunt' against him.

'I have done nothing wrong': Trump after DOJ appoints special counsel in Jan 6, classified documents cases

The FBI has been reviewing documents that were retrieved from Donald Trump's Florida mansion earlier this month. On Monday, attorneys for the former US president requested that the FBI suspend its review of the documents so that an impartial special master can be appointed to examine the data.

The request was contained in a federal lawsuit, the first from Trump's legal team in the two weeks following the search, which broadsides the FBI investigation into the finding of secret documents at Mar-a-Lago and foreshadows arguments his attorneys will likely make as the investigation develops.

It comes as The New York Times reported that since Trump left office, the government has retrieved more than 300 documents marked classified from Mar-a-Lago, including more than 150 that were found by the National Archives in January and were a contributing factor in the criminal probe.

The 8 August search, during which the FBI claimed to have retrieved 11 sets of secret papers from Mar-a-Lago, is described as a "shockingly aggressive move" in the lawsuit. Additionally, it claims that the search is excessively broad, that Trump is entitled to a more thorough explanation of the documents that were taken from the house, and that the FBI and Justice Department have long treated him "unfairly."

“Law enforcement is a shield that protects America. It cannot be used as a weapon for political purposes,” the lawyers wrote Monday. “Therefore, we seek judicial assistance in the aftermath of an unprecedented and unnecessary raid” at Mar-a-Lago.

Trump claimed that "ALL documents have been previously declassified" in a separate statement, but he has not offered any proof to back up that assertion. He further claimed that the data had been "illegally seized from my house." In a succinct three-sentence statement, the Justice Department argued in opposition, pointing out that the search had been approved by a federal judge after the FBI had demonstrated probable cause that a crime had been committed.

The motion asks for the appointment of an independent special master who would be entrusted with reviewing the documents retrieved from Mar-a-Lago and excluding those that fall under the presidential privilege, a legal doctrine that allows presidents to keep some communications from being made public.
