Indian Supreme Court on 27 April continued the 6th day of hearing before the Constitution Bench to decide on the legality of same-sex marriages in the country. During the hearing, Chief Justice of India DY Chandrachud made a profound argument saying that there is no bar in Indian legislation from having any form of ceremony and therefore, the larger question is about legal recognition of the marriage.

"In other words, suppose a same sex couple says that we're inviting a group of 25 friends and we will have a marriage ceremony. In law, there is no prohibition. You also agreed to that. Somebody may have reception, ceremony," CJI Chandrachud said.&nbsp;

The bench comprised Chief Justice DY Chandrachud, and Justices Sanjay Kishan Kaul, S Ravindra Bhat, Hima Kohli, and PS Narasimha.

Upon CJI's argument, Justice Kohli submitted, "What you're saying is that there could be a right to cohabit and give it a name of relationship which is sanctified but that will have no obligations on state to recognise it statutorily."

CJI DY Chandrachud urged Justice Kohli to go step by step on the argument. "Once you recognise that there is a right to cohabit, then it is the obligation of the state that all social impact of cohabitation has legal recognition."&nbsp;

The arguments also centered briefly around the notice provision in marriages in general. For context, the Supreme Court on 20 April said the Special Marriage Act's requirements for a 30-day advance notification of desire to marry were deemed to be deeply patriarchal and to subject vulnerable couples to societal "invasion."

"Just that matter about notice provision. That is capable of being handled by any other bench. Issue applies equally to heterosexual &amp; same sex couples," CJI said Thursday.&nbsp;

Incest not uncommon in the world and world over it is prohibited...Suppose a person is attracted to his sister, can they say we are consenting adults, we're entering into activities privately and we claim our right of autonomy, choice. Based on that very argument can someone not challenge this definition (of prohibited degrees)? Why this restriction? Who are you to decide with whom?" SG said in the court during the hearing.

Responding over this Chief Justice of India DY Chandrachud remarked, "That will be far-fetched." "We used to treat even this as far-fetched," the SG replied.

CJI said, "Sexual orientation or your autonomy as an individual can never be exercised in all aspects of marriage including the entry into marriage, the prohibited relationships, the grounds on which marriage can be dissolved...these are all subject to regulation by law. So these are very far fetched for anybody to even argue before us that orientation is so absolute that I can therefore commit an act of incest. No court will ever countenance this."

Same-sex marriage in India: CJI Chandrachud says 'no bar in our law to having any form of ceremony'

Pakistan's upper house on Thursday approved a set of legislation that limits some key powers of the Supreme Court’s chief justice. The Supreme Court Practice and Procedure Bill 2023 was passed with 60 votes in favor, while the bill was opposed by 19 senators from the main opposition Pakistan Tehreek-e-Insaf (PTI) party and the religiopolitical Jamaat-e-Islami, who called it "unconstitutional."

Chief Justice of India DY Chandrachud said on Saturday (March 18) that there was absolutely no pressure from the Indian government on how to decide cases. He was speaking at India Today Conclave 2023.

“In my 23 years as a judge of high court, as a CJI of high court, and judge of the Supreme Court, no one has told me to decide a case in a particular way. We are so clear in the principles we follow. I would not even speak to a colleague presiding over a case and ask them what is going on in that particular case. There are some lines we draw for ourselves,” he said, as quoted by India Today.

“There is absolutely no pressure from the Executive,” he said.

CJI Chandrachud spoke on several issues during the event. One of them was the Collegium system that appoints the judges.

Justice Chandrachud put up a stout defence of the Collegium system of judges appointing judges to higher courts, just hours after Law Minister Kiren Rijiju at the same forum again criticised the selection process, asserting that as per Constitution, the appointment of judges is the duty of the government. Rijiju also said the appointment of judges was not a judicial work but "purely administrative in nature".

Justice Chandrachud's predecessor Justice UU Lalit also supported the Collegium process, saying it was the "ideal system" while another former CJI S A Bobde favoured primacy of judiciary but was of the view that the government's opinion was vital. The two former CJIs were also speaking at the same event.

"As the Chief Justice, I have to take the system as it is given to us... I am not saying every system is perfect but this is the best system we have developed. The object of this system was to maintain independence which is a cardinal value.We have to insulate the judiciary from outside influences if the judiciary has to be independent. That is the underlying feature of Collegium," Justice Chandrachud said.

No pressure from government while deciding cases: CJI Chandrachud

Justice DY Chandrachud was sworn in as the 50th Chief of Justice of India (CJI) in New Delhi on Wednesday. President Droupadi Murmu administered the oath of office at a ceremony in Rashtrapati Bhavan.

Justice Chandrachud, who succeeds Justice Uday Umesh Lalit, will lead the apex court for two years, until November 10, 2024. Justice Lalit helmed the top post for a short tenure of 74 days.

Born to 16th CJI late Yeshwant Vishnu Chandrachud on November 11, 1959, DY Chandrachud was elevated as a Supreme Court judge on May 13, 2016. This is the first instance of a father and son occupying the highest seat of justice.

Justice Chandrachud has done his graduation in Economics from Delhi University’s (DU) St Stephen's College and got his LLB degree from Campus Law Centre, DU, before going to Harvard for his doctorate.

Dhananjaya Yeshwant Chandrachud graduated with his LLB from Delhi University and went on to study at Harvard after earning the Inlaks Scholarship from where he earned his Masters in Law (LLM) and Doctorate in Juridical Sciences at Harvard (SJD). According to media reports, his father, Justice Yeshwant Vishnu Chandrachud was the 16th CJI and the longest-serving CJI in Indian history having served more than seven years from 1978 to 1985.&nbsp;

During his address, he said, "I have always believed that the role of the Supreme Court is to lay down law with clarity, and consistency and the best way to do it is to have larger benches as early as possible where the matter is registered to such benches so that issues get clarified immediately, the matter has consistency and people are well aware of what are contours of peculiar positions of law. We will strive hard to always have at least one Constitution Bench functioning all throughout the year."&nbsp;

Air pollution situation 'very serious’ in New Delhi, says India's CJI NV Ramana

The President of India Ram Nath Kovind has appointed Justice NV Ramana as the next Chief Justice of India (CJI).

He will be the 48th Chief Justice of India. The president appointed him by accepting the recommendation made by the outgoing CJI SA Bobde, who is retiring on April 23.

As the CJI, Justice Ramana will have a term till August 26, 2022.

Justice Nuthalapati Venkata Ramana was born in an agrarian family on August 27, 1957, in Ponnavaram village of the State of Andhra Pradesh.

He also functioned as Acting Chief Justice of Andhra Pradesh High Court from March 10 to May 20, 2013.

A bench headed by Chief Justice SA Bobde asked if it`s a registered association.

The association has filed a plea seeking direction to the Centre to form a scheme to disburse interest-free loans up to Rs 20 lakh to lawyers.

"We want to know about the Association, is it a registered Association, is it a one-man show, who is running it. We have to know all this because it is an Article 32 petition," the bench said.

The counsel appearing on behalf of the petitioner said that all members in the Association are from the Bar.

"Petitioner`s members are the regular practitioner of the Supreme Court having more than 10 years experience. The member of this association is the real face of this institution, who argues before this Court. They are coming from across the country and started practice, after purchasing their offices and houses. They have taken loan for offices and houses," the plea stated.

"In the present pandemic situation normal work of the courts is suspended from the last 6 months and further there are no chances to start the work smoothly, consequently, petitioners are unable to pay the monthly installment of the loan amount of their offices and housing loan, therefore, petitioner seeks indulgence of this court for direction to give relaxation in payment of monthly installment as well as for the direction to the respondent (Centre, RBI, and UCO Bank) to give interest-free loans up to Rs 20 Lakhs," it added.

To this, the CJI said "We are glad you are doing good work but we want to know about the Association."

Chief Justice Sharad Arvind Bobde on Tuesday said that the Constitution of India is based on plurality and popularity through which a billion voices speak.

"Our Constitution is based on plurality, popularity. Through our Constitution, a billion voices speak and articulate many things," Chief Justice Bobde spoke at a special function organised by the Supreme Court Bar Association (SCBA) on the Constitution day.

He said that over the years, the Constitution has facilitated a "social revolution".

The Constitution Day is celebrated to mark the adopting of the Indian Constitution by the Constituent Assembly on this day in 1949.

It came into force on 26th January 1950, marking the beginning of a new era in the history of the Indian Republic.

The day was first celebrated in 2015 as a mark of tribute to India's first Law Minister Bhim Rao Ambedkar, who played a pivotal role in the drafting of the document.

The declaration regarding it was made by Prime Minister Narendra Modi on October 11, 2015, while laying the foundation stone of Statue of Equality in Mumbai.

The Constitution of India, one of the longest written Constitutions of the world, constitutes of a Preamble, 22 parts with 395 articles and 8 schedules.

Wellbeing is not only restricted to physical well-being but also mental. It is important for members of the Bar and Bench."

"For 19 years I was a judge and the memories of being an advocate are fresh in my mind. I was part of the Bar for 22 years, so believe me when I say I know it all," he said.

New CJI, Bobde, has succeeded Justice Ranjan Gogoi who retired on November 17 after remaining in office for over 13 months.

Bobde was elevated as a judge of the Supreme Court of India on April 12, 2013. He will retire as CJI on April 23, 2021.

In 2018, former CJI Ranjan Gogoi had dismissed the idea of a fixed tenure for CJIs.

Gogoi had stated that there were some norms associated with judges'&nbsp;elevation especially with respect to their seniority. Gogoi further added that it may not be a good idea to deny a person the chance of becoming the CJI merely because his tenure would be short.

In 2014, the law commission had recommended fixing the term of the CJI, describing it as a necessary step required for the overhaul of judicial appointments.&nbsp;

Later in 2012, Arvind Bobde was elected as the chief justice of Madhya Pradesh High court. In the next year, he was given a chance to become a judge of the Supreme Court.&nbsp;

In his tenure of being a judge, he was a part of many landmark cases. He was apart of a five-judge constitution bench in which he suggested to put the curtain down on the Ayodhya land dispute and nine-judge of the top court in which he protected the fundamental rights of India.

Justice Sharad Arvind Bobde also headed a three-member in-house committee which gave a clean chit to our Ex-chief Justice Gogoi on a sexual harassment case.&nbsp;

Justice Bobde was also a part of the three-judge bench which took place in 2015, clarified that no citizen of India without an Aadhar card can be denied basic government services. &nbsp;

Last month, Justice Bobde advocated the usage of high-end technology including Artificial Intelligence (AI) in courts.

"Justice delivery system is good, it might require some minor changes, including the use of technology like artificial intelligence," Justice Bobde had said.

Aggarwal then approached the Central Information Commission (CIC) which asked the apex court to disclose information on the ground that the Chief Justice of India's office comes within the ambit of the Act.

In January 2009, a plea was moved in the Delhi High Court against the CIC order but the same was upheld.

He was designated as a senior advocate in 1998. Justice Bobde was elevated to the bench of the Bombay High Court on March 29, 2000, as an Additional Judge.

He was sworn in as Chief Justice of Madhya Pradesh High Court on October 16, 2012.

In April 2013, he was elevated as a judge of the Supreme Court of India on April 12, 2013. Justice Bobde will retire on April 23, 2021.
