Two days after the Indian Navy’s underwater remotely operated vehicle (UROV) spotted the body of a second miner at 280ft inside the rat hole mine in Meghalaya’s East Jaintia Hills district, a platoon of the army was deployed in the search operations on Tuesday.

“The army is setting up a camp near the site to assist Navy in miners rescue operations. This is only administrative support to Navy for efficient, smooth and round the clock operations in case need be,” said an official involved in the search operations.

Sources reveal that Army will not be directly involved in conducting the search operations but will only provide logistical and administrative support to the Indian Navy, Odisha Fire Services Department officials and NDRF who are primarily conducting the search operations.

This decision comes in the wake of the Indian Navy’s ROV (remotely operated vehicle) spotting the body of a second miner on January 26, however, the body could not be retrieved despite efforts in the last two days.

Today, the Indian Navy and other agencies will begin search operations again with the help of Army at the site.

The first body of a miner was retrieved 42 days after they were trapped inside the mine.

On December 13, as many as 15 miners were trapped inside the 370-feet deep rat-hole mine after water from the nearby Lytein river flooded it.

Indian Navy, NDRF, Odisha Fire Services Department and Meghalaya government’s disaster management group were pressed into the rescue operations.

However, it took a month for the high powered pumps from Coal India and Kirloskar Brothers to arrive at the spot and engage in the rescue operations.

The Madras High Court Monday dismissed as withdrawn a plea moved by two accused in the Kodanad heist and murder case seeking to dispense with their appearance before a trial court in connection with the case.

The two accused, K V Sayan and Valayar Manoj, decided to withdraw the plea as Justice Anand Venkatesan refused to accept their contention seeking quashing of summons issued by the Nilgiris trial court.

"When the accused has been enlarged on bail based on the undertaking that they would abide by the conditions imposed by the trial court how can they move such a plea seeking to quash the summon directing their appearance.

"Moreover, the case is in the chargesheet stage, such relief cannot be given at this crucial stage of the case," the judge added.

According to the petitioners, they have appeared before the trial court on more than 20 occasions and demanding any further appearance was unnecessary.

However, refusing to accept their contention, the court said when the trial is on, a journalist was circulating video clippings containing videos of the accused.

"This creates a doubt whether the accused are trying to divert the progress of the case," the court added.

Samuel Mathew, former Tehelka managing editor had on January 11 released a 16-minute video in which the two accused in the case, had allegedly linked chief minister K Palaniswami to the case.

The High Court had on January 23 granted an interim injunction restraining Mathew and six others from making any statement linking Palaniswami to the case.

On April 23, 2017, the security guard of the Kodanad estate, former chief minister J Jayalalithaa's retreat home in Nilgiris district, was murdered in a robbery attempt by a 10-member gang.

It emerged during the probe that Jayalalithaa's former driver C Kanagaraj and Sayan had allegedly plotted the crime.

A total of 10 people were arrested in the case and a charge sheet was also filed.

Citizenship Bill: PM says BJP will always protect interests of Assam

The Supreme Court was informed Monday that the body of a person, among the 15 miners trapped for over a month inside a flooded illegal coal mine in Meghalaya, has been retrieved while another body has been spotted by the Indian Navy.

A bench of Justices A K Sikri and S Abdul Nazeer was told by the lawyer appearing for the petitioner who has filed public interest litigation (PIL) seeking urgent steps for rescuing the miners trapped in the rat-hole mine since December 13 last year, that its de-watering was necessary to retrieve the bodies.

The Centre told the apex court that a body was recovered on January 24 during the rescue operation and on January 26, the Navy personnel spotted the second body at about 280 feet.

"Search for balance survivors/mortal remains is in progress," the Centre said in its report detailing the status of action taken by the authorities.
Senior advocate Anand Grover, appearing for petitioner Aditya N Prasad, said that 14 to 15 high-powered water pumps were required to de-water the mines.

"Without de-watering the mines, they (authorities) cannot have access to the bodies," he said, adding that equipments of the Indian Army were needed in the rescue operation.

Solicitor General Tushar Mehta, appearing for the Centre, told the bench that Army personnel were already involved in rescue operation along with officials of the National Disaster Response Force (NDRF), Indian Navy and other agencies.

He said the suggestions given by Grover on the ongoing rescue operation would be duly considered by the authorities.

The bench has posted the matter for further hearing on February 4.

The illegal mine is located at Ksan in Meghalaya's East Jaintia Hills district, about 3.7 km deep inside a forest and can be accessed after crossing three streams. It was flooded when water from the nearby Letein river gushed into it.

Rat-hole mining involves digging of narrow tunnels, usually three-four feet high, for workers to enter and extract coal. The horizontal tunnels are often termed "rat holes" as each just about fits one person.

In its status report filed in the top court, the Centre said that crores of litres of water has been pumped out from the mine and remotely operated vehicles (ROVs) of the Indian Navy were already working in the rescue operation.

"Underground ROVs being operated in adjacent mines, systematically searching and sanitising them one by one. So far, two adjacent mines have been searched and declared clear," the report said.

It said Indian Air Force aircraft were also deployed for a rescue operation.

The status report said that Meghalaya government is undertaking search and rescue operations and the Centre is supplementing the efforts by providing all necessary logistic support.

Last week, the state government had told the top court that on January 16, the ROV of Indian Navy had detected a body at a depth of 210 feet in the flooded mine and efforts were being made to retrieve it but could not be completed as the body parts started disintegrating.

On January 11, the Centre had told the court that it has to "believe in miracles" for the 15 miners to come out alive.

The apex court had earlier expressed dissatisfaction over the steps taken by Meghalaya government to rescue these miners and had said "prompt, immediate and effective" operation was needed to rescue them as it was a matter of life and death.

George Fernandes had been studying to become a Roman Catholic priest when he found himself drawn to trade union politics. He went on to become one of the leading lights of the socialist movement of India's 1970's.

He won his first Lok Sabha election in 1967. He organised a nationwide railway strike in 1974.

He was jailed during the Emergency and charged with conspiring to blow up railway tracks. He won Bihar's Muzaffarpur Lok Sabha seat in the 1977 elections from jail, and was made industries minister in the Janata Party government.

He also served as railway minister in the VP Singh government, and as defence minister in the Atal Bihari Vajpayee government.

He was also the founder of the Samata Party.

From novice priest to socialist firebrand, trade union leader to wanted man on the run — here are five interesting facts about George Fernandes.

Sent to become a priest, he became a trade union leader

Fernandes was born in Mangaluru in 1930 and was training to be a Roman Catholic priest when he got attracted towards trade union politics. In 1949, he moved to Bombay where he joined the socialist trade union movement. Becoming a trade union leader, Fernandes organised many strikes and bandhs in Bombay in the 1950s and 1960s while working with the Indian Railways. In 1974, he organised a nationwide railway strike, when he was President of the All India Railwaymen's Federation where the entire nation was brought to a halt.

George the Giant Killer

Fernandes's first shot at glory came in 1967 when the flamboyant politician was offered a ticket by the Samyukta Socialist Party to contest the general elections. He stood against the veteran Congress leader SK Patil and defeated the Congress strongman in his Bombay South parliamentary constituency. After his victory, he earned the nickname “George the Giant Killer".

Became a Sikh man, recited Gita during the Emergency

Sporting a turban and a beard, George Fernandes assumed the guise of a Sikh man to evade arrest during the Emergency and recited the Gita to inmates while being imprisoned in Tihar Jail in that era, according to a colleague of the veteran socialist leader, who was arrested along with him.

"Police were on the lookout for us. But, we not only went into hiding but continued to operate. To escape arrest, George had assumed the avatar of a Sikh man, with a turban and a beard, and had grown long hair. He used to call himself 'Khushwant Singh' after the noted author," a fellow jail inmate of Fernandes's said.

The most enduring image of the Emergency

Fernandes in handcuffs raising his hand in defiance became one of the most enduring images of the Emergency era. The emergency was in effect from June 25, 1975, until it was withdrawn in March 1977.

Drove out Coca-cola

During his tenure as Union Minister for Industries, he drove American multinationals IBM and Coca-Cola out of the country, due to investment violations. George Fernandes came up with a policy for multinational industries requiring them to find Indian partners. Many agreed, but Coca-Cola refused as it had to share its secret recipe with its Indian partner.

Tourists stuck in Chakrata, Dehradun

Prime Minister Narendra Modi has not taken a day’s leave during his tenure so far, Union Culture Minister Mahesh Sharma claimed as he took a swipe at Congress President Rahul Gandhi and his mother and UPA Chairperson Sonia Gandhi for their vacation in Goa.

The Gandhis’ trip, described as a “private visit” by the party, came into the public domain when Rachna Fernandes, a local resident, posted a photo of herself with Rahul Gandhi and said she was “awed by his charm and modesty”.

In response to a question by reporters on the trip. Sharma said, “Our Prime Minister has not taken leave even for one day during his four-and-a-half-year tenure.

(Whereas) it is a matter of research where these people go when they are on vacation.”

Accusing the Congress of double standards, Sharma said the party wants to portray itself as a national party, but it essentially remains a “mother-son party”.

“On one hand they say they want to remove corruption and on the other hand have become icons of corruption. On one hand, they talk of security of women and on the other behave in this manner,” Sharma said, referring to an incident in which former Karnataka chief minister Siddaramaiah was caught on video involved in a verbal spat with a woman during a public interaction in Mysuru. In the video which has gone viral, the Congress leader is seen snatching the microphone from her and in the process, taking off her dupatta.

The Union minister further alleged that the Congress President was “immature” and that “no one takes him seriously” and said that the opposition party does not want strong governments to be formed in states. “It is because of this that when these people who talk of gathbandhan (alliance) and mahagathbandhan (grand-alliance), even their so-called allies are not ready to stand with them,” said Sharma. “For them the betterment of the family, their party and personal gains are more important than the betterment of the country,” he said.

Uber will now remove riders who despite repeated warnings misbehave or damage the driver or co-passengers property, as per the updated community guidelines of the ride-hailing giant.

The US-based company has also added a 'Driver Safety Toolkit' - designed on the lines of a similar offering for riders - to offer a suite of in-app safety features for its driver-partners in India.

"Courtesy matters. Riders are expected to exercise good judgment and behave decently towards other people in the car when riding with Uber... Riders may lose access to Uber if they don't meet the star rating requirements set out in the community guidelines," Uber Head of Cities (India and South Asia) Prabhjeet Singh told PTI.

Singh explained that the company will now start removing from its platform those riders who despite repeated warnings flout Uber's community guidelines. These riders will be given enough notifications before they are removed from the platform, and the number of such riders would be "handful", he said.

"We have updated Uber's community guidelines which extend the same behavioural standards to the riders that Uber has for the driver partners. Even though a vast majority of riders will not be affected by this update, it reminds a select few what behaviour is expected of them while using the app," Singh added.

Some of the reasons for losing access to Uber would include damage to drivers' or other passengers' property, use of inappropriate and abusive language or gestures, unwanted contact with the driver or fellow passenger after the trip is over, and breaking the local law while using Uber.

"If we are made aware of these kinds of problematic behaviour, we will contact you so we can investigate them. Depending on the nature of the concern, we may put a hold on your account during our investigation. If the issues raised are serious or a repeat offence or you refuse to cooperate, you may lose access to Uber," the guidelines said.

It added that any behaviour involving violence, sexual misconduct, harassment, discrimination, or illegal activity while using Uber can result in the immediate loss of access to the account.

These steps have been taken to strengthen the safety of the drivers on Uber's platform and to foster an environment of mutual respect between riders and driver-partners, Singh said.

"There can be no Uber without driver partners - they are at the centre of Uber's business... We have been focussing our efforts on developing products that increase transparency, accountability, and safety for all our stakeholders -- driver-partners as well as drivers," he added.

For driver-partners, Uber is rolling out an emergency button and the 'share trip feature' as part of the driver safety toolkit. Singh clarified that the share trip feature for drivers will allow them to share their locations with friends and family, but no details of the rider will be shared as part of this.

Uber, which is locked in an intense battle with Ola for leadership in markets like India and Australia, has about three lakh driver-partners in India.

The US-based company saw its revenue grow manifold from India business to Rs 21.5 crore, while net profit was at Rs 19.6 lakh in the fiscal ended March 2018. Uber has previously stated that it remains committed to investing in India ? which is among its top markets.

Social activist Anna Hazare has announced that he would launch a hunger strike from Wednesday over the "non-fulfilment" of assurances by the Centre and the Maharashtra government on the appointment of Lokpal and passage of Lokayukta Act in the state respectively.

In his letter to Chief Minister Devendra Fadnavis, dated January 28, Hazare said he would launch the agitation in his village Ralegan Siddhi in Ahmednagar district of Maharashtra.

Meanwhile, the Fadnavis Cabinet Tuesday decided to bring the office of Maharashtra Chief Minister under the jurisdiction of Lokayukta.

Maharashtra Minister Girish Mahajan, who has been acting as an emissary between the government and the activist, urged Hazare to cancel the agitation, claiming that almost all the demands made by the activist have been fulfilled.

Hazare, however, said he would not call off the agitation till the Lokayukta Act becomes a reality.

Apart from the appointment of Lokpal at the national level and Lokayukta in states, Hazare has been demanding implementation of the Swaminathan Commission recommendations and some electoral reforms.

"It has been five years since the Lokpal Act was passed. Yet the Narendra Modi government has not appointed Lokpal...Lokayukta Act has not been passed in Maharashtra for four years," Hazare observed in his letter dated January 28.

The activist said the chief minister had mediated when he had launched the agitation at Ramlila Maidan in Delhi in March last year.

Hazare said he had withdrawn that agitation after the central government had assured in writing that it would fulfil the demands.

"Nine months have passed, yet the demands have not been fulfilled. Hence, I will be on hunger strike in my village Ralegan Siddhi on January 30," Hazare said in the letter.

Mahajan urged Hazare not go ahead with the agitation saying almost all the demands he had raised were fulfilled.

"His first demand was implementing Swaminathan Commission recommendations, that farmers should get 1.5 times MSP. I think that demand has been fulfilled," Mahanjan told reporters here.

Speaking in Ahmednagar, Hazare welcomed the government's decision to set rolling the process to appoint Lokayukta.

"I thank them on behalf the people for taking the decision to the appointment of Lokayukta through the Constitutional process. But that does not mean I will not stage hunger strike tomorrow. The agitation will go on until the act is in place," Hazare added.

In Delhi, an eight-member search panel formed to select members of anti-corruption ombudsman Lokpal Tuesday held its first meeting, nearly four months after it was set up by the Modi government.

The committee, headed by former Supreme Court judge Ranjana Prakash Desai, is understood to have discussed modalities related to the appointments of the chief and members of Lokpal.

Provoking India yet again, Pakistan foreign minister Shah Mahmood Qureshi on Tuesday had a telephonic conversation with Pakistan-backed-separatist leader Mirwaiz Umar Farooq, who heads All Parties Hurriyat Conference in the Valley.

The development comes even as Pakistan on one side has been claiming it wants peace with India through the opening of Kartarpur corridor while on the other hand harassing Indian diplomats and killing Indian fisherman.

Reacting to the development, top sources while speaking to WION said, "such an attempt by the Pakistan foreign minister is a regressive step and is contrary to the overall perception which Pakistan leadership is trying to create. It reflects duplicity in Pakistan leadership's approach."

The action by the Pakistan foreign minister Qureshi also shows divergence in Pakistani leadership with Pakistani Prime Minister Imran Khan talking peace while foreign minister coming out with a "googly" comment soon after the groundbreaking ceremony of Kartapur corridor on Pakistani side in November last year.

Sources said, "Media antics of its leadership cannot divert attention from the fact that Pakistan's establishment hands are stained with the blood of innocent Indians, including in J&K and in territory under its illegal occupation."

Earlier this month Pakistan PM Imran Khan had said,"we are trying to have a dialogue. Trying to move towards friendly a relationship with India." But the developments of Tuesday can create an adverse situation.

This comes even as India has been raising the issue of terror emanating from Pakistan, something that has been a cause of worry for Afghanistan also.

The National Green Tribunal Tuesday expressed dissatisfaction over the cleaning of river Yamuna and directed Delhi, Haryana and Uttar Pradesh governments to submit a performance guarantee of Rs 10 crore each within a month.

A bench headed by NGT chairperson Justice Adarsh Kumar Goel directed the state governments to furnish a performance guarantee with the Central Pollution Control Board (CPCB) to ensure there was no further lapse in this regard.

The tribunal also warned that chief secretary of all the three states would be personally liable for any non-compliance.

The green panel made it clear that the amount will be forfeited if the work was not carried out as per the recommendations of the monitoring committee constituted by it and asked the panel to expeditiously submit its final report.

It directed that steps be taken by the three states at the earliest for disposal of municipal solid waste, cleaning of drains and ensuring cleaning of garbage.

The order came after perusing the interim report filed by the monitoring committee comprising retired expert member B S Sajwan and former Delhi chief secretary Shailaja Chandra.

The monitoring committee in its action plan submitted has recommended a study to assess the environmental flow of the Yamuna river for the stretch between Hathanikund and Okhla.

It said the river was "fighting to stay alive" and it would not be possible to rejuvenate it unless minimum environmental flow was provided.

With regard to idol immersion, the committee has asked the authorities in the city to look for the possibility of creating artificial ponds and pits in various localities.

The NGT had earlier asked the Haryana and Uttar Pradesh governments to consult the members of the monitoring committee appointed by the tribunal for constituting their own full-time committees.

The tribunal had expressed displeasure that despite its specific order, the status of the compliance was unknown, and said there appeared to a failure of the authorities in performing their duties, thus undermining the rule of law.

The green panel had said pollution in the Yamuna was of serious concern as it was highly contaminated with industrial effluents and sewage.

It had also asked the Haryana pollution control board to conduct a study of water quality and the flow of Yamuna at the point it enters Haryana, and submit the list of industries located in the catchment area.

The green panel had noted that almost 67 per cent of the pollutants that enter the Yamuna would be treated by two sewage treatment plants at Delhi Gate and Najafgarh under the first phase of the Maili se Nirmal Yamuna Revitalisation project.

Government not touching disputed land: BJP on Centre's plea in Supreme Court on Ayodhya

As the United States and Taliban plan an expected pact that can pave way for American withdrawal from the south Asian country after 17 years, many including New Delhi are keenly watching the developments that can have huge ramifications.

New Delhi has been playing an important role as a development partner in the war-torn country and has provided aid worth more than $3 billion besides constructing the Afghan Parliament and the India Afghan friendship dam in western Herat province.

While New Delhi has not officially reacted, former Indian ambassador to Afghanistan, Amar Sinha has said the clock could be turned back.

Speaking to WION he said, "On the face of it this agreement has the flavour of being pushed by an impatient Washington on the one hand, and a patient and confident Rawalpindi on the other. In the process, interests of Afghan civilians and the democratic constituency built over the last 18 years is being sacrificed. The clock is being turned back."

Sinha added, "We have seen only the outlines of a framework agreement and have also heard US Special Representative say that "nothing is agreed till everything is agreed". But we all know "the devil is in the details."

Sinha along with India's former High Commissioner to Pakistan TCA Raghava represented India "non-officially" at the Moscow talks on Afghanistan last year. Taliban was also present at the talks.

In January, alone a number of ministerial meets happened between India and Afghanistan.

The Afghan National Security Advisor Hamdullah Mohib was in Delhi in early January and India's external affairs minister Sushma Swaraj met the Afghan foreign minister Salahuddin Rabbani in Samarkand, Uzbekistan a few weeks ago on the sidelines of the first India-Central Asia dialogue.

Meanwhile, calling the pact a "big deal" since it represented the "first formal attempt to chart a way forward", Michael Kugelman South Asia senior associate at The Wilson Center suggested caution when it comes to dealing with Taliban.

He said, "There have been many meetings between the US and Taliban in the past, but not until now have they formally pledged to address each other’s demands. Could all this progress come crashing down? Certainly. At the end of the day, if the Taliban doesn’t like what’s on the table, it could easily break off the dialogue and fully redirect its attention to the battlefield. That’s why the talks that take place in the coming days will need to be carried out carefully."

On India, Kugelman said "these talks are a reminder" that New Delhi's say in Afghanistan's future, "at least for now, is limited."

Explaining further, he said "India is a key regional player" but for now "it is left on the outside looking in and hoping that the result, whatever it is, doesn’t risk further instability for its Afghan friend."
