Diamantaire Mehul Choksi, accused in the multi-crore Punjab National Bank scam, is a "fugitive and absconder", the Enforcement Directorate told the Bombay High Court on Monday.

The agency, in its affidavit, sought dismissal of two petitions filed by Choksi one against a plea for him to be declared a fugitive economic offender and the second to permit him to cross-examine those persons on whose statements the ED is relying on to declare Choksi a fugitive economic offender.

The ED, in its affidavit submitted on Monday to a division bench headed by Justice IA Mahanty, said Choksi is accused of siphoning and laundering money to the tune of Rs 6,097 crore in the PNB scam, and despite having issued summons directing him to appear before the agency, he has said he does not intend to cooperate with the probe.

"He is a fugitive and absconder. He has deliberately and intentionally evaded from appearing before the investigating agency even after a special court has issued non-bailable warrants against him. This shows that he does not have any regard for the law of the land," the affidavit said.

"It is apparent that the applicant (Choksi) has left India to avoid criminal prosecution for the offence of money laundering under the provisions of the Prevention of Money Laundering Act and continues to refuse to return to India to face criminal prosecution," it said.

It added that Choksi has already taken citizenship of Antigua which clearly shows that he has no intention of returning to India to cooperate with the probe.

The agency further said that under the Fugitive Economic Offender Act, if the fugitive appears in person before the court then the proceedings can be terminated. However, it said, if the person fails to do so the court can declare him a fugitive economic offender and can confiscate his properties.

"The sole purpose of the Act is to compel the fugitive to return to India and face the proceedings initiated against him," the affidavit said.

The Act was introduced as an effective, expeditious and constitutional way to stop offenders from running away, it added.

The high court will take up the petitions for hearing on Tuesday.

Choksi, in his plea, claimed he was unable to return to India due to persistent health problems.

To this, the ED said it was merely a facade and that Choksi can seek treatment for his health problems in India.

Choksi and his nephew Nirav Modi are wanted by the ED and the CBI for allegedly defrauding the PNB to the tune of Rs 13,400 crore, in collusion with a few of its employees.

The ED had filed an application before a special Prevention of Money Laundering Act court, seeking for Choksi to be declared a "fugitive economic offender" for evading summons to appear before the agency and for his properties be confiscated under the provisions of the Fugitive Economic Offenders Act, 2018.

Choksi had then filed an application before the lower court, seeking for the ED's plea to be dismissed.

When the lower court rejected his application, Choksi approached the high court in April this year.

Delhi Chief Minister Arvind Kejriwal on Monday announces free travel for women in all Delhi Transport Corporation (DTC) buses, metro and cluster buses.

Addressing a press conference in Delhi, Kejriwal announced, "On all DTC buses, cluster buses and metro trains women will be allowed to travel free of cost so that they have safe travel experience and can access modes of transport which they were not able to, due to high prices."

Kejriwal also said that the move will also encourage women to use more public transport services.

However, the subsidy will not be imposed on anyone.

"Subsidy won't be imposed on anyone. There are several women who can afford these modes of transport. Those who can afford can purchase tickets, they do not need to take subsidy," Kejriwal said.

"We encourage those, who can afford, to buy tickets and not take subsidy so that others could benefit," Kejriwal added.

Kejriwal further informed that one week of time has been given to the officials to make a detailed proposal for both DTC and Delhi Metro on how and when can this be implemented.

"We are making an effort to start this within 2-3 months. We're also seeking suggestions from people, regarding implementation."

While allowing free travel in DTC and cluster buses run by the Delhi Integrated Multi-Modal System(DIMTS) may not be difficult, it will be "challenging" to do so in metro trains, transport officials said in a PTI report

The Delhi government and the Centre are 50:50 equity partners in the Delhi Metro Rail Corporation.

Meanwhile, the move has received a mixed response from women travellers.

New Telecom Minister Ravi Shankar Prasad Monday assumed charge at his Ministry and held a detailed discussion with senior officials and heads of telecom PSUs.

BJP MP Sanjay Dhotre, Minister of State for communications, also took charge at the Ministry.

Senior officials of Telecom Ministry and heads of state-owned telecom corporations -- Bharat Sanchar Nigam Ltd, Mahanagar Telephone Nigam Ltd and Telecommunications Consultants India Ltd (TCIL) were also present on the occasion.

Prasad's stature in the Modi 2.0 government has got bigger and he has regained the telecom ministry, adding it to his heavyweight portfolio of IT as well as Law and Justice.

In telecom, an industry which is in throes of financial distress but, at the same time, rolling up its sleeves for 5G play in the global arena, Prasad's top priorities will be to find ways and means to set the sector back to its growth trajectory.

High on agenda also will be nurturing the telecom PSUs - BSNL and MTNL - back to health, particularly given the recent challenge they faced in payment of staff salaries.

A four-time Rajya Sabha MP, Prasad, has in the past, played a key role in driving the momentum of Narendra Modi government's flagship programmes including Digital India and also led the charge on several initiatives to galvanise electronics and mobile handset manufacturing in the country.

Under his watch, the mobile phone and component manufacturing units in India increased to 268 in the last 3-4 years resulting in estimated employment for 6.7 lakh people (direct and indirect).

An Indian rescue team has been sent to search for eight missing climbers who had been trying to climb the summit of Nanda Devi, the second-highest peak in India, and were probably hit by a large avalanche, two state government officials said.

The officials said that they had been told that those missing include climbers from Britain, the United States, Australia and India.

The rescue effort began on Saturday when the climbers failed to return to base camp. It may take days to trek to the area where they were last known to have been, said Vijay Kumar Jogdanda, the top civil servant in Pithoragarh district of Uttarakhand.

Others in the group, who had turned back earlier, told officials late on Friday that their fellow climbers had not returned to base camp as planned, Sanjay Gunjiyal, the inspector general of police at the Uttarakhand State Disaster Response Force, told Reuters.

Rescue operations which began on Saturday were called off in the evening due to harsh weather conditions and would resume on Sunday, Gunjiyal said, adding that an air force helicopter will be used for aerial reconnaissance on Sunday. Helicopters may not be able to land anywhere in the area, given the terrain.

The climbers went missing on the Indian side of the Himalayas near the end of a climbing season that has been particularly deadly this year.

At least nine people have died on the Nepalese side of Mount Everest so far this year, the deadliest climbing season on the peak since 2015.

Indian and international news reports said that the team was led by British guide Martin Moran. On the Facebook page of his Moran Mountain company, the last public entry appears to be on May 22.

It says that the Nanda Devi team had reached their second base camp at 4,870 metres, their home for the next week.

"After a recce of the route, they will be making a summit attempt on an unclimbed peak at 6477m. In the words of (US rock climbing pioneer) Royal Robbins, 'A first ascent is a creation in the same sense as is a painting or a song'. Foreign Minister S Jaishankar on Sunday said the Central government "respects all languages" and "no language will be imposed," while stating that all stakeholders - general public and state governments - would be consulted before taking a final call on the three-language norm.

"Secondly, Prime Minister Narendra Modi and our government have decided that we will respect all Indian languages with full power and develop them. There shouldn't be any controversy over this matter," he said.

Several political parties had warned the Centre of a language war over 'attempts' to impose Hindi. Leaders cutting across party lines in Tamil Nadu have said the state has a history on the language issue and would not tolerate any imposition.

News brief: Big stories of the day

Amid talks of cabinet expansion to save the government in Karnataka, Chief Minister H D Kumaraswamy Saturday met the Congress-JD(S) coalition coordination committee chief Siddaramaiah and held discussions.

"Both leaders have met on cabinet issue and have held discussions. Whether it is expansion or reshuffle, it may take place only after June 4," official sources said.

The Congress in Karnataka over the last couple of days had gone into a huddle to avert a potential existential crisis to the one-year-old coalition ministry and discussed the possible cabinet rejig to address the dissent within.

Kumaraswamy had also held discussions with Congress president Rahul Gandhi in Delhi.

Coalition leaders were initially unable to reach consensus on whether to go in for cabinet expansion by filling three vacant posts or reshuffle by asking a few ministers to step down and make way for the disgruntled lawmakers.

CLP leader Siddaramaiah, however, had indicated that reshuffle was on the cards.

According to party sources, there are talks about first filling three vacant posts and then going in for reshuffle if the need arises.

Meanwhile, Independent MLA Nagesh and KPJP MLA R Shankar also met Siddaramaiah on Saturday and held discussions.

There are reports that in case of cabinet expansion they are likely to be inducted into the Ministry.

During the meeting, Siddaramaiah is said to have asked both legislators not to fall prey to any attempts by the BJP to woo them.

On Wednesday reports and pictures of Nagesh and Shankar meeting rebel Congress MLA Ramesh Jarkiholi, who is allegedly hobnobbing with the BJP, had added to the coalition's worry.

Shankar was inducted into Kumaraswamys cabinet but was subsequently dropped during the reshuffle in December last year, following which both of them had withdrawn their support from the government and sided with BJP.

Coalition worries have multiplied after the BJP's spectacular win with 25 of the 28 Lok Sabha seats in its pocket, leaving a mere one seat each to the Congress and JDS, which, despite a joint fight, were swept away by the Modi wave.

Also, growing unrest within the party and threat by Ramesh Jarkiholi to quit Congress along with other MLAs have worried the leadership as it would trigger a number game in the assembly.

The talk about cabinet reshuffle or expansion has also given rise to a number of aspirants within the party.

Of the total 34 ministerial positions in Karnataka, the Congress and JD(S) have shared 22 and 12 respectively.

Currently, three posts are vacant, two from JD(S) and one from Congress.

However, allaying fears that the BJP was trying to weaken the JD(S)-Congress government in Karnataka, the saffron party's state president B S Yeddyurappa Friday had said central leaders have asked the state unit not to indulge in any activity to "destabilise" it.

Amid talks of cabinet expansion to save the government in Karnataka, Chief Minister H D Kumaraswamy Saturday met the Congress-JD(S) coalition coordination committee chief Siddaramaiah and held discussions.
