In more trouble for senior Congress leader P Chidambaram who could be arrested, the Delhi High Court on Tuesday dismissed the anticipatory bail plea of senior Congress leader P Chidambaram observing that he is the "key conspirator" in the INX Media case.

Shortly after the order delivered by Justice Sunil Gaur, a six-member team of CBI officials went to the Jor Bagh residence of the former Union Minister, apparently to arrest him, but returned as he was said to be not there.

A last-ditch attempt to get a stay of the order was made by Chidambaram's lawyer Dayan Krishnan who sought a stay for three days so that they could appeal against it.

The judge said he would consider but later rejected it. Top lawyers Kapil Sibal and Abhishek Manu Singhvi rushed to the Supreme Court and appeared before the court of Chief Justice Ranjan Gogoi who told them to move the senior-most judge on Wednesday morning.

"Facts of the case prima facie reveal that the petitioner (P Chidambaram) is the kingpin i.e. the key conspirator in this case," the Justice Sunil Gaur stated in the order.

He said that the gravity of the offence and evasive replies to the questions prompted the court to deny the pre-arrest bail to the former union finance minister.

The court said that it is preposterous to say prosecution of Chidambaram is baseless, politically motivated and an act of vendetta.

"Simply because Chidambaram is a Member of Parliament, would not justify the grant of pre-arrest bail to him," the order stated.

"This grant of bail in cases like instant one will send a wrong message to the society, stated the order.

"It cannot be forgotten that the petitioner was the Finance Minister at the relevant time and had given FDI clearances to INX Media group for receiving overseas funds to the tune of Rs 305 Crore," it read.

Taking note of "huge magnitude of conspiracy angle", the judge observed that it would be premature to jump to a conclusion that provisions of Prevention of Money Laundering Act (PMLA) would not imply.

The court said that the law enforcement agencies cannot be made "ineffective" by putting legal obstacles of offences in question.

"It was pertinently observed that the economic crimes of such mammoth scale are craftily planned and executed," the order said.

The Congress leader will, however, approach the Supreme Court tomorrow seeking a stay of the order and also to challenge it.

In 2007, the Central Bureau of Investigation (CBI) had registered an FIR alleging irregularities in the Foreign Investment Promotion Board (FIPB) clearance given to INX Media to the tune of Rs 305 crore in 2007 when Chidambaram was the Union Finance Minister.

Based on the FIR, the Enforcement Directorate (ED) had filed a Prevention of Money Laundering Act (PMLA) case against him.

Chidambaram has denied the charges and said the case against him was political motivated.

Chidambaram's son Karti has also been named in the two cases. He was arrested on February 28, 2018, by the CBI and was later released on bail.

The ED had attached properties belonging to him. On July 4, a Delhi court had allowed Indrani Mukerjea, the former head of the INX Media, to turn an approver in the CBI case.

The agency had submitted that it has come across evidence in the form of conversations which only Indrani Mukerjea is privy to and will help consolidate the case.

In a bid to quell any discontent over taking members from other parties ahead of the crucial assembly elections in four states, BJP president Amit Shah has asked the state in-charges to be cautious over the admission process.

Sources said this follows unease among the party workers over unbridled admission of workers from other parties that could affect the interest of those in the organisation for long, especially in the election-bound states.

The decision was taken at a high-level meeting chaired by party president Amit Shah here on Tuesday.

BJP Working President JP Nadda and BJP National General Secretary (Organisation) B L Santosh were also present in the meeting attended by election in-charges of the states of Haryana, Jharkhand, Maharashtra, and Delhi.

The sources also said that any decision on workers and members from other parties joining BJP might be taken close to the Assembly elections.

The meeting also decided that election in-charge of states, assistant election in-charges and state in-charges of all the poll-bound states must sit together and chalk out an election roadmap.

Further, it decided that Jharkhand will also hold "Janadesh Yatra" similar on the lines of Maharashtra and Haryana. Assembly polls in Maharashtra, Haryana, and Jharkhand are slated for later this year. Polls in Delhi are scheduled to take place in February next year.

After a meeting with his Bangladesh counterpart A K Abdul Momen, External Affairs Minister S Jaishankar on Tuesday said there is "no change" in India's position on the proposed Teesta water-sharing agreement between New Delhi and Dhaka.

"We have a position. We have a commitment to that position. There is no change," he told the media after his meeting with Momen at the state guest house Jamuna, reported Dhaka Tribune.

Sharing of water of the Teesta River, which originates from Sikkim and flows through West Bengal to merge with the Brahmaputra in Assam and Jamuna in Bangladesh, is the most contentious issue between New Delhi and Dhaka. While Bangladesh has demanded 50 per cent of the river's water supply from December to March, India has claimed a share of 55 per cent.

'No change' in Teesta water-sharing agreement with Bangladesh: S Jaishankar

The Supreme Court on Tuesday issued notices to the Centre, Twitter, Google, and YouTube on a plea filed by Facebook seeking transfer to the court petitions pending before different high courts, demanding to interlink of Aadhaar database with social media profiles.

Several petitions are pending before Madras, Bombay and Madhya Pradesh High Courts seeking their direction for the interlinking of Aadhaar data with social media accounts for identity authentication.

A bench of Justice Deepak Gupta and Justice Aniruddha Bose said the Madras High Court shall continue hearing the pleas but shall not pass any order.

The apex court will further take up the matter for hearing on September 13.

The petition was filed by the social media giant last week. Facebook and WhatsApp told the bench that the matter should be adjudicated by it and sought transfer of petitions pending before high courts to the top court as any order passed against them will have global ramifications.

Senior advocate Mukul Rohatgi, appearing for Facebook, argued that the issue is of such a magnitude that only the top court should take a decision on it.

"It affects the privacy of the whole nation. This is the policy matter," he said.

Rohatgi further argued that any order passed by the high courts will have wider ramifications as Facebook is a global entity and it has to abide by laws of different nations.

Senior advocate Kapil Sibal, appearing for WhatsApp, told the court that the Central government is concerned about the messaging platform's end-to-end encryption and it is looking into it to frame some guidelines.

"While the government is dealing with this matter, let all the pleas come here. This can't be decided by high courts, it's a policy issue and should be decided by the Supreme Court. These are very serious issues," Sibal added.

Attorney General KK Venugopal, appearing for the Tamil Nadu government, contended that 18 hearings have taken place on the petitions in the Madras High Court and the judgement would come in another month.

"Facebook should not object to it," he said.

Citing the example of the controversial Blue Whale challenge, he argued that social media platforms should provide details about the origin of a message.

"Online games like the Blue Whale caused deaths in India because service providers did not provide details of the 'originator'. We had a serious situation during the Blue Whale game. Government of India struggled to find out about its originator, some said it's from Russia. Government is not equipped to detect the originator," Venugopal said.

He further said, "It is pertinent for social media platforms to share data with law enforcement agencies to ensure criminal activities like abetment to suicide or call for violence inter alia, through these platforms is curbed."After hearing the arguments, the bench said that a balance has to be struck between the protection of people's privacy online as well as a mechanism to identify people who commit an online criminal offence."

There is a conflict between the right to privacy and the duty to prevent crimes online. There is no doubt that there has to be a balance between the two," the court observed.

INX Media case: Delhi HC denies anticipatory bail to P Chidambaram

A Delhi court on Tuesday deferred to August 29 the hearing on the Enforcement Directorate's plea seeking cancellation of bail of Rajiv Saxena, accused-turned-approver in the AgustaWestland money laundering case.

Counsel for Saxena Geeta Luthra filed the reply on the agency's application and informed Special Judge Arvind Kumar that the Supreme Court will take up on August 26 a petition of the ED challenging a Delhi High Court order allowing her client to travel abroad.

The ED had on July 15 approached Kumar's court cancellation of the bail granted Saxena on February 25.

The agency has alleged that despite turning an approver, he has been in touch with other persons who are involved in the case.

Saxena has a mala fide intent to shield other accused persons and prevent a successful prosecution, the agency has submitted.

The ED has stated he failed to join the investigation citing frivolous reasons after being called by it around 25 times.

Without intimating the investigation officer, Saxena left for Mumbai as he had checked out of the address known to the agency, the plea has contended.

"It is now clear that he has hidden his role and culpability in the case. He has acted in bad faith and contrary to the condition, he provided selective evidence with regard to other persons. He willfully failed to disclose all the facts within his knowledge and give documentary evidence in his possession in a clear attempt to shift liability," the ED counsel has said.

The Central Bureau of Investigation and the ED had earlier issued summonses to Saxena to join the probe.

The Dubai-based businessman was extradited to India on January 31 in connection with the Rs 3,600-crore scam case relating to the purchase of 12 VVIP helicopters from AgustaWestland.

On Monday, Sonowal voiced hope that the process of the final NRC publication will turn out to be peaceful with support from Union Home Minister Amit Shah and people of the state. "We believe that the publication of the final National Register of Citizens (NRC) will be peaceful. Union Minister Amit Shah is providing us with all possible help and support," he said. On July 24, the Centre informed the Rajya Sabha that over 41 lakh people have been found ineligible for inclusion in the draft NRC in Assam. The deadline for the final list of NRC is August 31. The NRC aims to separate "genuine" citizens from "illegal immigrants". The government has maintained that its intention is to ensure no illegal immigrant is registered under the NRC and no genuine citizen is left out of it. (With inputs from agencies)

"We have seen their deployment. Indian Air Force is always cautious. We are responsible for air defence and we are always alert," Dhanoa told media persons here when asked about the situation at the Indo-Pak border.

He said that the Air Force is prepared "not only when any enemy fighter comes in but we also keep an eye on civilian aircraft so that incidents like Purulia airdrop do not happen".

Indian and Pakistani forces have exchanged heavy fire several times after the government repealed Article 370 of the Constitution which gave special status to Jammu and Kashmir and bifurcated the state into two Union Territories - Jammu and Kashmir, and Ladakh. There were also reports of military movement along the Line of Control (LoC) in Pakistan. Army Chief General Bipin Rawat had last week termed the movement as "normal".

"Everybody took precautionary deployments and movement of precautionary resources and one should not be too concerned about them as they were normal," Rawat had said.

Pakistan Prime Minister had earlier this month threatened India, saying "incidents like Pulwama are bound to happen again and that Pakistan will fight till the last drop of blood if a war ensues".

Air Chief Marshal BS Dhanoa on Tuesday emphasised the need to develop indigenous defence equipment for self-reliance.

He added that India cannot depend on imports alone for its defence needs.

He, however, said that some high-end weapons and systems need to be imported to "win war" till we build long term ability to manufacture state-of-art defence equipment.

"We can't wait for indigenous technology to replace obsolete warfighting equipment, neither will it be prudent to import every defence equipment from abroad. What we are doing is replacing our high-end obsolete weapons with indigenously developed ones. This has boosted our in-house defence manufacturing," he said at an event here.

He added that "We need some high-end technology items which we have to import to win war" and that "it will make a balanced Air Force with the long term ability to develop and manufacture state-of-art aircraft and systems".

The Air Chief said that indigenisation needs to continue to ensure self-reliance in manufacturing defence equipment.

Giving an insight of the indigenisation projects, he said: "There are presently 11 projects, out of which project sanction order has been issued to multiple development agencies for two projects including Infrared Search and Tracking for air platform."

Remaining nine projects are at stages of acceptance of necessity and finalisation of PSQRs and feasibility study, he said.

Dhanoa said that 95 per cent of components that go into an aircraft in IAF's Base Repair Depots (BRD) are produced from indigenous sources.

He also said that the Air Force is sponsoring the development of Biojet fuel to power its aircraft.

The Air Chief said that several indigenously developed radars, aircraft, bombs and missiles have been inducted by the Indian Air Force.

"We started with 1000 pound bombs, then indigenously manufactured 250 and 450 kg bombs. We are testing anti-tank missile i.e. HELINA, Astra air-to-air missile and Gautam and Gaurav laser-guided bombs," he said.

He further said that the force will soon induct light combat helicopters developed indigenously and said that induction of multirole fighter aircraft such as Rafale fighter jets have enhanced the global influence capabilities of the IAF.

Union Defence Minister Rajnath Singh on Tuesday said that in order to modernize the Indian Air Force there is a need to develop indigenous technology in the defence sector and reduce dependence on foreign manufacturers.

While speaking at the seminar on 'Modernization and Indigenization Plans of Indian Air Force' in New Delhi, the Union Minister said, "There is a sizeable dependency on foreign equipment manufacturers for their subsystems and components. The need of the hour, therefore, is to progressively reduce dependence on foreign manufacturers and develop comprehensive capabilities ourselves."

He also stated that the defence firms of the country have a huge opportunity in contributing to the domestic market in addition to the exports. Singh also voiced Centre's desire to encourage private industry investment in the defence sector.

"For the participation of Indian companies in the defence sector, a slew of measures have been put in place for the investment by private players. Up to 49 per cent of investment is allowed through automatic route and 100 per cent via government route on case to case basis."

"Also, a number of policies have been introduced for the development of defence infrastructure and promote indigenous development. In pursuit of Make In India, M&M is the most preferred category for procurement and it is expected to promote indigenously designed products to bring significant development in defence, research and development," he added.

"We have just approved the proposal for providing test facilities of government entities to the private defence sector. A formal order on the same will soon be issued. This has removed various bottlenecks which used to come in way of using test facilities by private entities," Singh further stated.

The Union Defence Minister also urged the original equipment manufacturers (OEMs) to establish manufacturing facilities for their products in India and invest in the country through Foreign Direct Investment, joint ventures or via defence offset route.

He also informed the gathering that the Central Government has revised defence product list for the purpose of issuing industrial licenses under the Industries Development and Regulation Act, 1951.

"Testing equipment, production of equipment have been removed from the list. This has certainly reduced the entry barriers for the industry, especially the small and medium segment. The initial validity of the industrial license has also been increased from 3 years to 15 years with a provision to the further extend it by 3 years on case to case basis," he added.

Singh also mentioned about Balakot airstrike and stated, "Indian Air Force is a technologically advanced and extremely potent force, the recent offensive strike against terrorist outfits in our neighbourhood speaks volumes about the reach and lethality of the formidable arm of the Indian Armed Forces."
