India: J&K officials barred from using WhatsApp, Gmail for official communication

<p>The Competition Commission of India (CCI) has imposed a fine of ₹213.14 crore ($25.4 million) on Meta over the 2021 privacy policy update of WhatsApp.&nbsp;</p>

<p>According to the CCI, users in India should not be forced to agree to share their WhatsApp data with other Meta companies or products for purposes unrelated to WhatsApp services. The commission said, "WhatsApp will not share user data collected on its platform with other Meta Companies or Meta Company Products for advertising purposes, for a period of 5 (five) years from the date of receipt of this order."</p>

<p>The CCI said that Meta, through WhatsApp, holds a dominant position in the market for over-the-top (OTT) messaging apps on smartphones in India. "Furthermore, it was also found that Meta holds a leading position compared to its competitors in online display advertising in India," CCI said in a press release.</p>

<p>The issue began in January 2021, when WhatsApp introduced updated terms of service and privacy policies. The in-app notification informed users that starting February 8, 2021, they would need to accept the updated terms, requiring them to consent to expanded data collection and mandatory data sharing with Meta companies, to continue using the app.</p>

<p>The CCI noted that under WhatsApp's earlier privacy policy from 2016, users could choose whether or not to share their data with Facebook. However, the 2021 update removed this choice, making data sharing with Meta mandatory for all users. This left users with no option but to accept the terms if they wanted to continue using the platform.</p>

<p>The watchdog concluded that this "take-it-or-leave-it" approach amounted to imposing unfair conditions under the Competition Act. "Given the network effects and lack of effective alternatives, the 2021 update forces users to comply, undermining their autonomy, and constitutes an abuse of Meta's dominant position," the CCI said.</p>

<p>The commission further added that allowing WhatsApp to share user data with Meta companies for non-WhatsApp-related purposes created barriers for competitors. "Sharing of WhatsApp users’ data between Meta companies for purposes other than providing WhatsApp Service creates an entry barrier for the rivals of Meta and thus, results in denial of market access in the display advertisement market," the CCI added.</p>

<p>Unredacted court documents released on Thursday (Nov 14) show that NSO Group, the company behind the Pegasus spyware, admitted to developing exploits to hack into the phones of around 1,400 WhatsApp users in 2019. This operation, according to WhatsApp, violated both federal and state laws.</p>

<p>The information came to light as part of a lawsuit WhatsApp filed against NSO Group in 2019. The lawsuit reveals how NSO, an Israeli cyber-surveillance company, operates its Pegasus spyware on behalf of government clients. Last week, a federal judge in California ordered the release of previously redacted details from the case.</p>

<h2><strong>1,400 WhatsApp users targeted by Pegasus over two weeks in 2019</strong></h2>

<p>The unredacted documents included sworn statements from NSO employees, which became public for the first time on Thursday. WhatsApp initiated its lawsuit after discovering that 1,400 users, including journalists and activists, had been targeted by Pegasus over two weeks in 2019. The app is now asking the court to rule on the case, while NSO is opposing this request. Spyware is considered one of the most advanced hacking tools available.</p>

<p>Pegasus, described as "zero-click" spyware, can infiltrate devices without requiring users to interact with a suspicious link or file.</p>

<p>In the court filings, WhatsApp explained how NSO carried out these attacks. NSO employees reportedly reverse-engineered WhatsApp's code and created their own system, called the "WhatsApp Installation Server" (WIS), to send messages through WhatsApp servers. These messages triggered Pegasus spyware to install on the targeted devices. WhatsApp argues that this method violated American laws and the app’s terms of service.</p>

<h2><strong>'NSO’s operations violated US law'</strong></h2>

<p>A WhatsApp spokesperson said that the newly released evidence “shows exactly how NSO’s operations violated US law and launched their cyber-attacks against journalists, human rights activists and civil society.” They added, “We are going to continue working to hold NSO accountable and protect our users.”</p>

<h2><strong>NSO, not its clients, operates its spyware</strong></h2>

<p>According to depositions, NSO’s customers didn’t operate the spyware themselves. An NSO employee said that the customer “only needed to enter the target device’s number and ‘press Install, and Pegasus will install the agent on the device remotely without any engagement.’”</p>

<p>“The rest is done automatically by the system,” the NSO employee said. "In other words, the customer simply places an order for a target device’s data, and NSO controls every aspect of the data retrieval and delivery process through its design of Pegasus," the WhatsApp filing said.</p>

<h2><strong>Princess Haya's case</strong></h2>

<p>In one of the filings, WhatsApp pointed to a case where Pegasus was used to spy on Dubai’s Princess Haya and others connected to her. <p>SP Oswal, the CEO of India's largest textile group Vardhaman, is the latest victim of cyber criminals who extorted 70 million rupees from him in an elaborate scheme that put him in a so-called 'digital custody'. Two people have been arrested from the eastern state of Assam in this connection and most of the money recovered.</p>

<p>Speaking to Indian media, 82-year-old Oswal said the fraudsters posed as Indian regulators, investigative agency sleuths, police, and the Chief Justice of India in a fake 'Supreme Court hearing' over Skype, to make him pay for a 'money laundering' case in which he was, according to them, a co-accused along with Jet Airways founder Naresh Goel.<br />

<p>The lid was blown on the fraud after Oswal, the recipient of one of India's top civilian honours the Padma Bhushan, refused to pay more money, and filed a police case and told the fraudsters he would rather die in police custody.</p>

The Ludhiana Police on Sunday (Sep 29) arrested two suspects from Assam. Seven other suspects, from states including West Bengal and Delhi, have been identified. Some 52 million rupees have been recovered from the fraudsters' accounts.</p>

<p>"My ordeal is nothing short of a movie script to make others aware of such fraudsters,” Indian Express newspaper quoted him as saying.</p>

<h2><strong>Here is what happened to SP Oswal</strong></h2>

<p>In the first call on August 27, a fraudser posing as Telecom Regulatory Authority of India official asked him to press nine to prevent disconnection from telecom services. He pressed nine. Then a cyber criminal posing as an official from the Central Bureau of Investigation (CBI)&nbsp;called him about his suspected involvement in the money laundering case against Naresh Goel.</p>

<p>Oswal, who told the paper that he never met Goel in his life, said the fraudsters sent him documents with Mumbai police insignia.</p>

<p>Then the 'CBI team' took him into 'digital custody over Skype' after sending him an order to this effect on his WhatsApp.</p>

<p>"They repeatedly told me not to share anything with anyone as it would be a violation of surveillance rules and I could be imprisoned for three to five years. They started my digital surveillance...and said I could not leave the house without their permission. I never used Skype, nor knew how to. They created my Skype account and started digital surveillance," he was quoted as saying.&nbsp;</p>

<p>Then he was made to appear for a fraudulent Supreme Court hearing over Skype in which one criminal even posed as India's chief justice. “He banged the hammer on the table twice and said ‘Order, Order, please present your case’. I thought he was actually Justice [CJ] Chandrachud as they claimed,” Oswal said.</p>

<p>"They do and say things in such a way that one gets manipulated and believe what they are saying is true. They used to keep me under surveillance even in the night and I was told to keep my phone on the bedside and keep Skype on. I would not get proper sleep as someone watched over me all the time,” Oswal told the newspaper.</p>

<p>After the staged court hearing, a copy of the order was shared on WhatsApp, directing him to transfer money to a so-called Secret Supervision Account.&nbsp;</p>

<p>Oswal made the transactions in order to avoid being arrested.&nbsp;</p>

<p>On August 29, he went out for a hopsital visit, and spoke to a colleague about what happened to him in the preceding two days. The colleague said it was a fraud.</p>

<p>"Later when I confronted the accused as they asked for more money, they threatened me with immediate arrest. They also sent a fake arrest warrant issued by ED Mumbai ordering my arrest within two hours. I said I would prefer to die in police custody but won’t transfer more money,” Oswal told the paper.</p>

Speaking to Indian media, 82-year-old Oswal said the fraudsters posed as Indian regulators, investigative agency sleuths, police, and the Chief Justice of India in a fake 'Supreme Court hearing' over Skype, to make him pay for a 'money laundering' case in which he was, according to them, a co-accused along with Jet Airways founder Naresh Goel. Watch: Digital arrest: The growing threat of cyberattacks × The lid was blown on the fraud after Oswal, the recipient of one of India's top civilian honours the Padma Bhushan, refused to pay more money, and filed a police case and told the fraudsters he would rather die in police custody. Seven other suspects, from states including West Bengal and Delhi, have been identified. Some 52 million rupees have been recovered from the fraudsters' accounts. "My ordeal is nothing short of a movie script to make others aware of such fraudsters,” Indian Express newspaper quoted him as saying. Here is what happened to SP Oswal In the first call on August 27, a fraudser posing as Telecom Regulatory Authority of India official asked him to press nine to prevent disconnection from telecom services. He pressed nine. Then a cyber criminal posing as an official from the Central Bureau of Investigation (CBI) called him about his suspected involvement in the money laundering case against Naresh Goel. Oswal, who told the paper that he never met Goel in his life, said the fraudsters sent him documents with Mumbai police insignia. Then the 'CBI team' took him into 'digital custody over Skype' after sending him an order to this effect on his WhatsApp. "They repeatedly told me not to share anything with anyone as it would be a violation of surveillance rules and I could be imprisoned for three to five years. They started my digital surveillance...and said I could not leave the house without their permission. I never used Skype, nor knew how to. They created my Skype account and started digital surveillance," he was quoted as saying. I thought he was actually Justice [CJ] Chandrachud as they claimed,” Oswal said. "They do and say things in such a way that one gets manipulated and believe what they are saying is true. They used to keep me under surveillance even in the night and I was told to keep my phone on the bedside and keep Skype on. I would not get proper sleep as someone watched over me all the time,” Oswal told the newspaper. After the staged court hearing, a copy of the order was shared on WhatsApp, directing him to transfer money to a so-called Secret Supervision Account. Oswal made the transactions in order to avoid being arrested. On August 29, he went out for a hopsital visit, and spoke to a colleague about what happened to him in the preceding two days. The colleague said it was a fraud. "Later when I confronted the accused as they asked for more money, they threatened me with immediate arrest. They also sent a fake arrest warrant issued by ED Mumbai ordering my arrest within two hours. I said I would prefer to die in police custody but won’t transfer more money,” Oswal told the paper. Supriya Sule on Sunday announced that her phone and WhatsApp had been hacked. She urgently requested that people refrain from calling or texting her.

Indian lawmaker Supriya Sule's WhatsApp hacked

<p>In order to counter the frequent internet blackouts in the country, Pakistan has reportedly developed and tested a messaging app called 'Beep', designed for secure communication among officials. The new platform is being dubbed as an alternative to WhatsApp and would help federal officers stay connected even when the internet is down.</p>

<p>Beep has been exclusively developed in Pakistan and has been undergoing 'successful' trial runs since 2023 when the then-IT minister, Syed Aminul Haque first revealed plans for the app.&nbsp;According to reports, the Pakistani&nbsp;government is now planning to roll out the application for all its employees within the next 45 days.</p>

<p>Shaza Fatima Khwaja, the state minister for information technology and telecommunication, said 'Beep' would help ensure “data privacy and protection” in government communications.</p>

<p>“We have developed an application focused on secure and unified communication among government officials. The purpose of Beep Pakistan is to protect our privacy and data,” Khwaja was quoted as saying by <em>Al Jazeera</em>.</p>

<p>The minister added that the government hopes to roll out the app for citizens at a later stage.&nbsp;</p>

<p>"The design of the application is robust enough to offer it to the general citizens of Pakistan at later stages if desired," said Khwaja.&nbsp;<br />

<h2><strong>Internet blackouts in Pakistan</strong></h2>

<p>Pakistan is notorious for routing internet blackouts which the government justifies as a security measure. In the lead-up to the general elections, earlier this year, internet services were heavily curtailed in different parts of the country.&nbsp;</p>

<p>Former prime minister Imran Khan claimed the internet disruptions were a way for the ruling class to cull dissent while facilitating vote rigging.&nbsp;&nbsp;</p>

<p>Users across the country have lodged complaints with the&nbsp;Pakistan Telecommunication Authority (PTA), the country’s top telecom regulator, about routine internet throttling. Netizens complain that social media platforms such as X, Facebook and Instagram become nightmare to open while multimedia content on WhatsApp becomes barely accessible during the blackouts.&nbsp;</p>

<p>Notably, Pakistani authorities have been on the fence about WhatsApp and the security the Meta-owned platform provides after&nbsp;nearly two dozen federal officials were targeted by Pegasus, a spyware developed by the Israeli cybersecurity firm NSO, in 2019.</p>

<p>The government had instructed officials at the time to avoid using WhatsApp to send confidential material that could cause harm to the country if it got in the wrong hands.&nbsp;</p>

In order to counter the frequent internet blackouts in the country, Pakistan has reportedly developed and tested a messaging app called 'Beep', designed for secure communication among officials. The new platform is being dubbed as an alternative to WhatsApp and would help federal officers stay connected even when the internet is down. Beep has been exclusively developed in Pakistan and has been undergoing 'successful' trial runs since 2023 when the then-IT minister, Syed Aminul Haque first revealed plans for the app. According to reports, the Pakistani government is now planning to roll out the application for all its employees within the next 45 days. Shaza Fatima Khwaja, the state minister for information technology and telecommunication, said 'Beep' would help ensure “data privacy and protection” in government communications. “We have developed an application focused on secure and unified communication among government officials. The purpose of Beep Pakistan is to protect our privacy and data,” Khwaja was quoted as saying by Al Jazeera. The minister added that the government hopes to roll out the app for citizens at a later stage. "The design of the application is robust enough to offer it to the general citizens of Pakistan at later stages if desired," said Khwaja. The popular messaging platform WhatsApp has threatened to quit India. The WhatsApp's parent company meta is challenging a new Indian law that requires tech companies to share user data with the government. Watch in for more details!

WhatsApp: We will exit India if forced to break encryption

WhatsApp, the popular messaging service, which over the years has become an integral part of everyone's phone and online presence, on Thursday (Apr 25) threatened to quit India. In a submission before the Delhi High Court, WhatsApp said that if it is compelled to break message encryption on its platform, it "goes".

Why has WhatsApp threatened to exit India? | WhatsApp challenges Indian IT rules,2021

<p>WhatsApp, the popular messaging service, which&nbsp;over the years&nbsp;has become an integral part of everyone's phone and online presence, on Thursday (Apr 25) threatened to quit India. In a submission before the Delhi High Court, WhatsApp said that if it is compelled to break message encryption on its platform, it "goes".</p>

<h2><strong>IT Rules and Encryption</strong></h2>

<p>The submission as per reports was made as the court heard submissions moved by WhatsApp and Facebook challenging India's newly amended IT rules. They allege that the new rules violate the right to privacy and are unconstitutional.</p>

<p>"As a platform, we are saying, if we are told to break encryption, then WhatsApp goes," submitted WhatsApp's lawyer, as per media reports.</p>

<p>Previously, the Centre had told the Delhi High Court that WhatsApp and Facebook, which monetise users' information for business purposes, were not legally entitled to claim that they protect users' privacy.</p>

<p>However, WhatsApp contends that the rules were introduced without due consultation.</p>

<p>Opposing WhatsApp and Facebook's petition, the Indian Ministry of Electronics and Information Technology (MeitY) in an affidavit claimed that WhatsApp has already violated the fundamental rights of the users in India by denying them any dispute resolution rights in the country.</p>

<p>The ministry also contended that if the IT Rules 2021 are not implemented, law enforcement agencies would have trouble tracing the origins of fake messages. It also said that such messages may then percolate to other platforms, disturbing peace and harmony in the society and triggering public order issues.</p>

IT Rules and Encryption The submission as per reports was made as the court heard submissions moved by WhatsApp and Facebook challenging India's newly amended IT rules. They allege that the new rules violate the right to privacy and are unconstitutional. "As a platform, we are saying, if we are told to break encryption, then WhatsApp goes," submitted WhatsApp's lawyer, as per media reports. However, WhatsApp contends that the rules were introduced without due consultation. Opposing WhatsApp and Facebook's petition, the Indian Ministry of Electronics and Information Technology (MeitY) in an affidavit claimed that WhatsApp has already violated the fundamental rights of the users in India by denying them any dispute resolution rights in the country. The ministry also contended that if the IT Rules 2021 are not implemented, law enforcement agencies would have trouble tracing the origins of fake messages. It also said that such messages may then percolate to other platforms, disturbing peace and harmony in the society and triggering public order issues. In a disturbing development, the said feature, as per a report, is returning pictures of a gun or a child with a gun when prompted with terms like "Muslim boy Palestinian", "Palestine" or "Palestinian". The feature is only available in limited locations, and hence couldn't be tested by WION.
