A judge in California, USA has ordered billionaire entrepreneur and Tesla CEO Elon Musk to be interviewed under oath about whether he made certain comments about Tesla's Autopilot features. The comments are being considered vital in relation to a lawsuit concerning death of an Apple engineer who died in a Tesla car crash in 2018.

Family of Walter Huang, the engineer has filed a lawsuit against Tesla in Santa Clara Superior Court. Tesla's lawyers have claimed that Musk can't recall the details of his statements that the plaintiffs want to ask him about saying that Musk is often the subject of 'deepfake' videos.

Huang’s family argues Tesla’s partially automated driving software failed. The carmaker contends Huang was playing a videogame on his phone before the crash and disregarded vehicle warnings.

Plaintiff attorneys sought to depose Musk regarding recorded statements that tout the capabilities of Autopilot. The ruling that Musk must testify was tentative, and a hearing was set for Thursday on whether to depose him. California judges often issue tentative rulings, which are almost always finalized with few major changes after such a hearing.

Musk will likely be asked about a 2016 statement cited by plaintiffs, in which he allegedly said: "A Model S and Model X, at this point, can drive autonomously with greater safety than a person. Right now.”

Tesla has claimed that Musk does not recall the exact statement he made.

In addition Musk, “like many public figures, is the subject of many ‘deepfake’ videos and audio recordings that purport to show him saying and doing things he never actually said or did,” Tesla said.

Judge Evette Pennypacker tentatively ordered a limited, three-hour deposition where Musk could be asked whether he actually made the statements on the recordings, and called Tesla’s arguments “deeply troubling.”

“Their position is that because Mr Musk is famous and might be more of a target for deep fakes, his public statements are immune,” Pennypacker wrote, adding that such arguments would allow Musk and other famous people “to avoid taking ownership of what they did actually say and do.”

The plaintiffs also claim that Musk finalized the details of a 2016 promotional video that states, “The car is driving itself." The video displayed some features that did not exist at the time, the plaintiffs said, citing multiple Tesla engineers.

The lawsuit is scheduled to go into trial on July 31, adding to growing legal and regulatory scrutiny over Tesla's Autopilot system.

A California state court jury on Friday found Tesla's Autopilot feature did not fail in what appeared to be the first trial related to a crash involving the partially automated driving software.

China warns US, South Korea against 'provoking confrontation' with North Korea

Biden-Yoon Meet: US, South Korea unveil new nuclear deterrence plan

US President Joe Biden and his South Korean counterpart Yoon Suk Yeol on Wednesday (April 27) announced a key agreement that underlined, once again, US support for South Korea. With nuclear-armed North Korea in mind, the two nations appeared to come closer as they have on number of occasions in past decades after the Korean War. Is this a start of a new chapter in politics in the Korean peninsula? By reaffirming its support to South Korea, has the US done something that threatens peace? Or will the agreement deter North Korea from its sabre-rattling? Let's take a look.

What is US-South Korea agreement about?

The agreement between the US and South Korea is being called 'Washington Declaration'. The agreement was made during South Korean Yoon Suk Yeol's state visit to Washington.

So what is this 'Washington Declaration'?

In short, the declaration boosts US nuclear umbrella over South Korea. Despite being a neighbour and an antagonist of nuclear-armed North Korea, the South does not have its own nuclear weapons.

On Wednesday, Biden said: "A nuclear attack by North Korea against the United States or its allies and partners is unacceptable and will result in the end of whatever regime were to take such an action."

Washington Declaration provides for regular deployment of a US nuclear submarine to South Korea. This is historic as deployment of a US nuclear submarine hasn't happened in South Korea since 1980s.

In return, South Korea has renewed its pledge that it will not develop nuclear weapons of its own.

However, there are no plans to station US tactical nuclear weapons in South Korea.

Additionally, the Washington Declaration paves the way to give South Korea greater insight and a voice in United States' nuclear planning with respect to containing North Korean moves. Both sides will form a Nuclear Consultative Group to exchange information about America's nuclear planning.

The situation with North Korea

Kim Jong Un-led North Korea has stuck to its sabre-rattling like it has done in the past. The severely impoverished country has spent a major chunk of its finances on development of missiles and even its nuclear weapons program.

According to information available in the public domain, North Korea launched around 90 missiles in the year 2022 alone. The number exceeds the previous peak in 2017. In that year, North Korea had launched 25 missiles.

In 2023, North Korea began firing missiles in February and the launches have continued in subsequent months.

Each of these missile launches have caused alarm in South Korea and the maximum number of tests reached in the year 2022 has caused concern among the South Korean public especially.

Mood of South Korean public

Continuous missile tests from North Korea is gradually making South Korean people opine that their country should develop own nuclear weapons and reduce dependence on the US for its nuclear protection. The United States is opposed to South Korea developing own nuclear weapons.

People who want South Korea to develop its own nuclear weapons include a group of increasingly vocal and influential academics, scientists and even members of South Korea's ruling party.

Another worry among the South Koreans is about a regime change in the US. They fear that if an isolationist leader like former president Donald Trump assumes power again, the defence assistance and cooperation from the US may dwindle.

There is already a precedent for this. Former president Trump spoke of need for South Korea to cough up billions of dollars for US forces involved in defending the country. Biden, when he took office, promptly corrected the course of US policy.

Another example of US abandoning an international treaty involves Iran nuclear deal. Former US president Barack Obama spent great political weight to strike a nuclear deal with Iran. Trump took the US out of the deal during his time in office.

Another worry among South Koreans appears to be a softened US stance towards North Korea. As North Korean missiles have grown in sophistication and range, they can reach US mainland and major cities. Will this factor deter US from taking a hard stance while dealing with North Korea? People in South Korea are wary, as reported in several media reports.

Is US-South Korea nuclear weapons deal going to silence wagging tongues?

"One thing was clear: there was an implied agreement that Seoul would not go nuclear," said Soo Kim, Policy Practice Area Lead at LMI Consulting and a former CIA analyst. Soo Kim was quoted by AFP.

"Seoul's nuclear ambitions have been capped."

Gi-Wook Shin, a Korea expert and sociology professor at Stanford University, told AFP that the declaration was "a step forward".

"I don't think this will be enough to appease a South Korean public that has increasingly demanded that Seoul develop nuclear weapons of its own," Shin said.

Effect on equations in Korean peninsula

China, the biggest backer of North Korea has not been pleased after US-South Korea agreement. It has warned US against "deliberately stirring up tensions, provoking confrontation and playing up threats".

China is at odds with the US over number of issues in this part of the world. Both the countries have repeatedly exchanged heated words over Taiwan and South China Sea.

Noselik claimed that despite the police' best efforts, the 84-year-old driver refused to stop despite the sirens. At 73rd Street and Sheridan Road, the van came to a halt. According to Noselik, the driver was attempting to get home, which wasn't too far off.

"He just thought he could make it home and it was just a poor decision, and you know obviously his vehicle was leaking something. Those sparks ignited whatever was leaking out of the vehicle," said Noselik.

In order to ensure the safety of other motorists, Noselik claimed that the driver has been flagged for a DMV driving review.

"We certainly don't want to deprive anybody of something that's so important to them. However, when it becomes a risk to public safety and to that person's own safety we do have to get involved and send a notice to the DMV," added Noselik.

What do to if a car catches fire?

It is imperative to be both mentally and physically prepared to deal with a situation of such nature. Here’s what you can do if a car catches fire.

Turn off the engine – The olfactory senses can typically spot warning signals of a possible fire. You might be able to smell the distinctive odour of a short circuit or burning plastic before the fire really breaks out. Any stench that is unfamiliar should be looked into right away. You don't have to wait till there is smoke and fire to act. You must safely stop your vehicle and turn off the engine if you think there might be a fire. You must remove it if you are using physical keys.

Exit the vehicle – Avoid taking the chance of trying to make decisions while driving. Within a few seconds, a car fire can spread rapidly. Therefore, be cautious to get out of the car as quickly as you can. Ask all additional passengers to get out of the car.

Use the fire extinguisher – Many nations have laws requiring that automobiles always have a fire extinguisher inside. You can use the fire extinguisher to put out a small fire that is unrelated to a fuel leak or battery pack. It would be best to avoid trying anything risky if there is a significant fire, though.

Maintain distance - Keep a safe distance away from the car because you never know when it can explode. Even if you are protected from the flames, flying debris can still seriously hurt you.

Call emergency services - Once you are securely outside the car, dial your neighbourhood emergency services. Give all the information required so that the right personnel and equipment can be sent to your location.

On being asked how many in the UK got the poison, Law said, “It will be literally in the hundreds. And they’ve all received it. We have had many, many customers in the UK who have purchased it.” “People in the UK have died, people in the US have died, people in Canada have died, and other parts of the world,” he added. The report said that Law is a former aerospace engineer and had spent six months in Coventry working on the Boeing 7E7 programme team for Dunlop Standard Aerospace. However, he was most recently employed as a chef in a hotel in Toronto. Citing sources, the Times reported on Tuesday that Law worked at the hotel after wanting a lifestyle change. But the hotel said that he was not an employee. Speaking to the publication, he said that he came up with the business after seeing his mother suffer greatly following a stroke. Law said that his father is religious and did not believe very much in euthanasia. “She was bedridden, couldn’t speak and they had to feed her through a tube to her stomach for over seven years. And that was very painful. Not only for her family but also very painful for me to witness," Law said. “This is why I created some avenue of escape, so that people if they are in such a circumstance, can undertake it either by themselves or by somebody else,” he added. The victims The Times report mentioned the names of some of the victims who took their lives after buying the poison. The oldest victim was 38 years oldest while the youngest was 17. In the UK, twenty-two-year-old Tom Parfett was one of the victims who bought the poison from Law's company. Tom's father David said that Law was the man that effectively "handed a loaded gun to my son." David said that Tom would still be alive if it wasn't for Law and the substance. David also pointed out that Law was knowingly supplying the substance for people to take their own lives and gained some kind of perverse pleasure from the knowledge that they were doing it. Michael Dunham, 38, Neha Raju, 23 and a 21-year-old student who was not identified- were all from the UK and died in the last 18 months after they bought poison from Law. The report also said that there were three deaths linked to Law in the US. One of the victims, Anthony Jones, 17, consumed the substance and ran to his mother shouting he wanted to live. However, he died shortly afterwards. WATCH WION LIVE HERE You can now write for wionews.com and be a part of the community. Share your stories and opinions with us here.

A New York jury heard arguments from Donald Trump's attorney on Tuesday that the advice columnist E Jean Carroll and other women planned to accuse the former president of rape because they "hate" him for winning the 2016 election.

The first day of a civil trial in a Manhattan federal court also heard that Carroll is suing Trump for battery and defamation "to clear her name, to pursue justice, and to get her life back" after the former president allegedly raped her in a New York department store in 1996 and later denied it.

However, Trump's attorney Joseph Tacopina told the jury of three women and six men that Carroll brought the action for political reasons, to sell a book, and to garner media attention, reported The Guardian.

Details of Trump rape civil trial

Tacopina said that the rape accusation was made up by Carroll and two other women who are expected to testify that she told them about the assault immediately afterwards.

“They schemed to hurt Donald Trump politically,” he said.

Tacopina told the jury that Carroll initially accused then-president Trump of rape following a meeting with George Conway, a prominent opponent who was married to Kellyanne Conway, one of the president's closest advisers in the White House. The judge upheld a challenge to Carroll's claim made by his attorneys. When Carroll provides testimony, it's unclear if Tacopina will bring it up again.

Carroll claims that in 1996, after they ran into each other and he asked for help in choosing a gift for a friend, Trump assaulted her in a dressing room of the Bergdorf Goodman department store in New York.

Shawn Crowley, Carroll's attorney, told the jury that Trump forced Carroll into a changing room before attacking her. According to the attorney, Trump slammed Carroll's head against the wall, held her arms behind her back, pulled her tights down, and then pushed his fingers into her vagina.

Crowley claimed that Carroll attempted to knee Trump off and kicked him, but that Trump overpowered her.

“He removed his hand and forced his penis inside her,” the lawyer told the jury.

Crowley addressed the two issues she predicted would be foremost in the jurors' minds. Carroll and Trump entered the dressing room for what reason? And why did she not call the police right away to report the alleged rape?

The attorney claimed that when Carroll was asked to try on a see-through bodysuit by Trump, she threw the suggestion back at him and told him that since it was his colour, he should be the one wearing it. Trump then brought Carroll to the changing room while holding her arm.

“To her, the situation was harmless and funny,” said Crowley. “The truth is she didn’t see Trump as a threat.”

Crowley claimed that following the incident, Carroll did inform two friends. One suggested that she contact the police. The other suggested keeping silent because Trump was an influential person. Carroll, according to Crowley, was "filled with fear and shame" that prevented her from speaking for a long time.

Carroll was subjected to a barrage of "vicious attacks" by the president when she finally made the decision to speak out following Trump's election in 2016 and the rise of the #MeToo movement.

Tacopina argued before the jury that it was impossible that nobody in a major department store noticed Carroll and Trump together and that no employees were present in the vicinity of the alleged assault.

Carroll claimed that the door was unlocked despite Bergdorf Goodman's customary practice of keeping changing rooms shut until a customer requested entry.

Carroll's explanation for why she didn't call the police was contested by Tacopina.

“E Jean Carroll once called the police on teenagers who vandalised her mailbox but not when she was violently raped,” he told the jury.

The trial continues.

Australian Prime Minister Anthony Albanese said on Wednesday (April 26) that 2023 summit of leaders of the Quad countries will take place in Sydney on May 24. This will be the third in-person meeting of the leaders of Australia, the US, India and Japan.

"I am honoured to host the first ever Quad Leaders' Summit in Australia in Sydney," Albanese said.

"The Quad is committed to supporting an open, stable and prosperous Indo-Pacific that is respectful of sovereignty and ensures security and growth for all."

The Australian prime minister said that during the summit, the quad countries will discuss how the grouping can work alongside partners and other groupings like the Association of Southeast Asian Nations (ASEAN) and the Pacific Islands Forum in order to boost coopeartion in the region.

Quad, an informal grouping of nations which includes India, the US, Japan and Australia does not have a military aspect. But it is widely seen as US-led attempt to counter rapidly rising Chinese influence in political, commercial as well as military arena especially in the Indo-Pacific.

China has in past expressed its displeasure at the grouping.

Australia, long thought to be away from global geopolitical hotspots has increasingly found itself at odds with China as the latter had taken concrete steps to make headway into region previously considered Australia's backyard. Chinese attempts to woo island nations in the Pacific Ocean have not gone unnoticed in Australia. Chinese military ships have increased their forays in waters near Australia in recent past as well.

Foreign Minister Penny Wong and Chief of the Defence Force Angus Campbell have said in recent days that Australian forces need to be capable of responding to potential adversaries whose weapons are faster, can strike farther and are more precise than in the past.

Changing that equation is crucial to the future of Australia's military, they said.

In an address to the National Press Club on Monday, Wong said the region should not be reduced to a binary competition between the United States and China; Australia wanted to work with other middle-sized countries, including those in Southeast Asia, to deter aggression, she said.

"America is central to balancing a multipolar region... We cannot just leave it to the U.S.," she said.

The in-person Quad summit will take place next month amid strained relations between China and the US. The two nations have been sparring on varirty on issues ranging from Ukraine war, tech security to Taiwan and Chinese apps like TikTok.

For decades, former US President Donald Trump appeared to shrug off claims, investigations, and even impeachment. His "Teflon Don" image is going to be put to the test; a jury of average citizens are going to hear a lawsuit accusing him of rape.

Jury selection began on Tuesday (April 25) in a trial over former advice columnist E. Jean Carroll's accusation that Trump raped her over three decades ago in a department store dressing room.

Trump's trial is being held in a federal civil court, which means that he will not be jailed regardless of the outcome, reported the Associated Press. He is not obligated to appear in court, and his attorneys have suggested that he will most likely not testify.

The difference between a civil and criminal case

Both civil and criminal proceedings analyse infringement of people's rights and who is to blame. However, they differ in terms of structure, burdens of proof, and penalties, as per The Mississippi Bar Association.

A civil case is a disagreement between two people, or parties, about an issue in particular. A party sues the other, and the jury decides on responsibility and damages. The court may order the party found at fault to pay money to the aggrieved party or to fulfil an obligation, such as honouring a contract.

Criminal law views a crime as an act against society rather than an individual. As a result, the government takes legal action against someone who has committed a crime.

If found guilty, the defendant may be sentenced to pay a fine, serve time in jail or be placed on probation. The law and society regard imprisonment as a loss of personal freedom and consequently a more serious penalty than a monetary fine.

Because the stakes are so much higher for a defendant in a criminal case than between two parties in a civil dispute, the justice system incorporates safeguards to protect a defendant's rights. These include the presumption of innocence, which states that a person is innocent unless proven guilty. Instead of the defendant having to establish his or her innocence, the prosecution must prove the defendant's guilt beyond a reasonable doubt.

In a civil case, the burden of proof is significantly lower. In civil cases, a preponderance of evidence demonstrating a greater than 50 per cent possibility that one of the parties is at blame is sufficient.

Other constitutionally protected rights exist for defendants in criminal proceedings. These include the right to an attorney, whether hired privately or appointed by the court; the right not to be forced to testify against themselves; the right to compel witnesses to testify in their defence; and the right to challenge witnesses who testify against them through cross-examination.

What charges did Carroll level against Trump?

E. Jean Carroll has sued Trump in two different lawsuits. The first charges him with defamation after accusing her of lying in her book, What Do We Need Men For? A Modest Proposal, in which she accuses Trump and other men of sexual abuse.

Carroll filed the second complaint after New York passed legislation last year that gave adult victims of sexual assault a one-year opportunity to file civil lawsuits against their attackers when the statute of limitations had lapsed. She is suing for monetary compensation after accusing Trump of assaulting her in a department store changing room in the mid-1990s, as reported by The Guardian.

The first lawsuit has been put on hold due to legal debate over whether Trump may be sued for comments he made as president.

Trump’s response to the accusations

Trump strongly denied the charges, stating Carroll was "totally lying" and labelling her a "nut job" multiple times. He further stated that because she was "not my type," he would never have assaulted her.

Trump also claimed he had never met Carroll, despite the fact that they were photographed together with their spouses in 1987.

“I’ve never met this person in my life. She is trying to sell a new book – that should indicate her motivation. It should be sold in the fiction section,” he said.

Why did the US Justice Department stand with Trump in Carroll's defamation lawsuit?

The Justice Department demanded that the defamation case be transferred from state to federal court, claiming that Trump's public statements denying rape in 2019 were made as part of his duty as president.

The administration then contended that Carroll is not suing Trump as an individual but as an employee of the US government, and thus the government should be substituted for Trump as the defendant, reported The Guardian.

“The government thus asserts that this case is virtually identical in principle to a lawsuit against a Postal Service driver for causing a car accident while delivering the mail,” said the judge in considering the position in 2020.

The judge rejected the president's assertion that he is just another government employee and stated that his remarks regarding Carroll were not within the scope of his employment.

What happens if Trump loses the case?

If the jury determines that Trump did rape or otherwise assault Carroll, he will very certainly be ordered to pay compensation. It will also mean that, for the first time in US history, a jury has found a former president to be a rapist.
