Shareholders of Tesla have sued CEO Elon Musk and the electric car-making company over “false and misleading” claims about the safety of their electric vehicles' Autopilot and Full Self-Driving technologies.

In a class action suit filed in San Francisco federal court on Monday, the shareholders have alleged that the company lied to them over four years by concealing how its technologies – suspected as a possible cause of multiple fatal crashes – “created a serious risk of accident and injury”.

They recalled when Tesla’s share price fell several times after the National Highway Traffic Safety Administration began probing the technologies, and reports that the Securities and Exchange Commission was investigating Musk's Autopilot claims.

“As a result of defendants’ wrongful acts and omissions, and the precipitous decline in the market value of the company’s common stock, plaintiff and other class members have suffered significant losses and damages,” the complaint said.

The suit seeks unspecified damages for Tesla shareholders from February 19, 2019, to February 17, 2023. Chief financial officer Zachary Kirkhorn and his predecessor Deepak Ahuja are also defendants.

On Monday, Tesla's share price rose up by $10.75 at the closing, or 5.5 per cent at $207.63, but the stock has lost about half its value since peaking in November 2021.

The world's second-richest person is expected at Tesla's March 1 investor day to promote the company's artificial intelligence capability and plans to expand its vehicle line-up.

This is not the first time that Musk was sued by the company’s shareholders. The tech billionaire was dragged to court over his 2018 tweets indicating that he would take Tesla private. The shareholders said that the tweets cost them millions of dollars. Earlier this month, the court had ruled in favour of Musk.

In another lawsuit continuing this week, shareholders claimed that they received “misleading” information that led them to approve an exorbitant pay package for the billionaire.

Elon Musk, Tesla sued by shareholders over ‘misleading’ self-driving claims

Investors who claimed that Tesla Inc. and its CEO Elon Musk overstated the efficacy and safety of its electric vehicles' Autopilot and Full Self-Driving technology filed a lawsuit against them on Monday.

Tesla accused of making false, misleading statements

Mexico is witnessing fierce competition among its states to secure a possible Tesla plant in a tussle similar to what goes on among US cities and governments competing to gain investments from IT companies. Mexican governors have gone to new extremes to promote their states, by installing billboards, constructing dedicated lanes for cars, or making mockups of Tesla ads, reported the Associated Press.

Tesla has not given in any official word and there is no assurance that it will construct a full-fledged plant. The hype is unfounded, and the major source of it is Mexican officials' claims that Tesla CEO Elon Musk would soon get on a phone call with Mexico president Andrés Manuel López Obrador.

Motown, in a move, could turn Tesla into universal filling station of EV era. Tesla will open part of its U.S. charging network to electric vehicles made by rivals. The deal is a part of $7.5 billion.

Tesla to share charging network, 3,500 chargers for non-Tesla customers

In a move that could help turn Tesla into the universal "filling station" of the electric vehicle (EV) era, Tesla will open part of its US charging network to rivals. The deal is part of a $7.5 billion US program to expand EV use and cut carbon emissions. However, experts believe this will risk eroding a competitive edge for vehicles made by Tesla, which has exclusive access to the biggest network of high-speed superchargers in the United States.

By late 2024, Tesla would open 3,500 new and existing superchargers along highway corridors to non-Tesla customers. It would also offer 4,000 slower chargers at locations like hotels and restaurants.Tesla would be eligible for a subsidy - including retrofitting its existing fleet - if its chargers allow other vehicles with a Federally backed charging standard called CCS to charge.

The US administration said Tesla had not committed to adopting CCS as its standard but must comply with the requirements to qualify for Federal funds. Tesla currently has 17,711 superchargers, accounting for about 60 per cent of the total US fast chargers, which can add hundreds of miles of driving range in an hour or less.

A win-win?

The US government's initiative to access Tesla's network significantly boosts the administration's initiative to create 500,000 EV chargers by 2030, up from 130,000 currently. There are also nearly 10,000 "destination" chargers with Tesla plugs that can recharge a vehicle overnight.

Will Tesla turn into the universal EV 'filling station'?

The price of Tesla Inc's best-selling vehicle, Model Y, was increased by $1,000 in the United States after the ceiling on the crossover electric vehicles' price which is eligible for tax credits was raised by the government.

The price of the Model Y Long Range was increased to $54,990 and the Model Y Performance was revised to $57,990, with a raise of $1,000 each by Tesla, as per the previous and current prices posted on the company's website.

This was the second increase in the Model Y Long Range's price in the last two weeks.

The models are still 15% and 17% cheaper, respectively, compared to their earlier prices before they were slashed by Tesla last month to stoke demand and before the company had accounted for the $7,500 tax credit that buyers now can receive.

The Treasury Department, in a reversal, on Friday ruled that crossover cars like the Model Y will become eligible for electric vehicle tax credits as long as their prices are below $80,000.

The ceiling for wagons, cars and sedans is further lower at $55,000.

The decision turned into a win for General Motors, Ford, Tesla as well as other automakers which had appealed to the government to loosen the vehicle definitions in the incentive plan's implementation so that their more lineups are eligible.

A buyer of Tesla Model Y, at its previous price, would have been able to only add around $1,000 in extra features, like a tow hitch, before the price is pushed above the level at which one can apply the tax incentive.

The prices were cut by Tesla globally in January responding to the signs of decreasing demand. The prices were deducted for the second time on Friday in South Korea.

Tesla's Model Y price shoots by $1,000 after tax credit terms relaxed in US

Tesla CEO Elon Musk has been found not guilty by a US jury over his 2018 tweet that was perceived to be misleading investors when he mentioned about securing funding to make Tesla a private company. Shares of Tesla rose 1.6 per cent in after-hours trading following the verdict. The tweets sent the Tesla share price on a rollercoaster ride, and a class action suit was filed against Musk claiming that the tech billionaire acted recklessly in an effort to squeeze investors who had bet against the company.

Musk then had agreed to step aside as Tesla board chairman and settled for $20m.

On August 7, 2018, Musk tweeted, "Am considering taking Tesla private at $420. Funding secured."

According to reports, the nine jurors in California court took less than two hours to reach their verdict on Friday afternoon.

While appearing on the witness stand, Musk said, "Just because I tweet something does not mean people believe it or will act accordingly."

Shareholders had argued that "funding secured" suggested more than a verbal agreement.

Elon Musk found not guilty in 2018 Tesla ‘funding secured’ tweet case

A Tesla financial filing submitted on Tuesday (January 31) disclosed that the United States Department of Justice (DOJ) requested documents related to the company's autopilot and Full Self-Driving (FSD) features. The company stated that the impact will be on business, cash flows and financial position if the government decides to pursue an enforcement action.

The document mentioned that it "has received requests from the DOJ for documents related to Tesla’s autopilot and FSD features". The document from the justice department appeared to be an intensified regulatory scrutiny.

Tesla mentioned the recent updates on current litigation actions against and probes into the company in the latest quarterly report to investors and the Securities and Exchange Commission.

News agency Reuters reported that in October, Tesla is facing a criminal probe over claims that the company's electric vehicles could drive themselves. The news agency also mentioned that the American Justice Department had initiated the probe in 2021 after multiple crashes involving autopilot. The latest report suggests that the justice department might have asked to provide more information for the investigation.

In its SEC filing, as quoted by Gizmodo, the automaker noted, "To our knowledge, no government agency in any ongoing investigation has concluded that any wrongdoing occurred. We cannot predict the outcome or impact of any ongoing matters."

The automaker said that they cannot predict the outcome or impact of any ongoing matters, but in case the government decided to pursue an enforcement action, there is a possibility of a material adverse impact on the company's business, results of operation, prospects, cash flows and financial position.

At a recent Tesla conference call, the Chief Executive Officer, Elon Musk, said that the focus is on innovations that will both improve road safety and position the company as a technology leader. He also stated that "full self-driving is obviously getting better very rapidly."

US Justice Department seeks documents of Tesla's autopilot and Full Self-Driving features

Tesla chief Elon Musk has come under the scanner of the US securities regulator over his involvement in the EV car’s self-driving claims, Bloomberg reported citing a person familiar with the development.

The move is part of an ongoing investigation by the Securities and Exchange Commission (SEC) over the company’s remarks about its Autopilot driver-assistance system.

Musk is already under trial for allegedly misleading investors with his 2018 tweet saying "funding secured" for taking Tesla private.

According to Bloomberg, the watchdog is looking into whether Musk may have inappropriately made forward-looking statements.

Although it is unclear which remarks or actions of Musk have garnered the agency’s attention.

Last week, a senior engineer on the Tesla team working on its Autopilot software in a testimony revealed that a video the company released in 2016 purporting to show a Tesla vehicle driving itself was in fact staged.

Elluswamy said that the video titled “Full Self-Driving Hardware on All Teslas” was intended to “portray what was possible to build the system” rather than what customers could actually expect the system to do.

The clip, which was tweeted by Musk claiming that “Tesla drives itself,” shows a Tesla driving and parking itself, avoiding obstacles, and following red and green lights.

The video starts with a title card saying that “the person in the driver’s seat is only there for legal reasons” and that “he is not doing anything. The car is driving by itself.”

Elluswamy said that the demo was “specific to some predetermined route,” rather than to the production version of the tech that was just relying on input from cameras and sensors.

“It was using additional premapped information to drive,” he said, after telling lawyers that the route the car followed had previously been 3D mapped.

Tesla CEO Elon Musk appeared in a San Francisco federal court to defend tweets he posted to his tens of millions of followers in August 2018. The tweets said he had “funding secured” to take his electric vehicle company private for $420 per share, and that “investor support” for such a deal was “confirmed.”

Elon Musk testifies in federal court over Tesla tweet, investors claim tweet costs them in millions

Tesla CEO Elon Musk appeared in a San Francisco federal courtroom on Friday in a trial over a 2018 tweet in which he claimed to have “secured funding” to take Tesla private, a tweet that shareholders allege cost them millions in trading losses, and defended himself by saying that “just because I tweet something does not mean people believe it or will act accordingly”.

Wearing a dark suit over a white button-down shirt, the billionaire testified for less than 30 minutes before the court adjourned on Monday, Guardian reported. Musk spoke softly and in bemused manner sometimes, a contrast to his combative testimony in past trials.

Musk’s testimony began with questions about his use of Twitter, the microblogging site he bought in October and called it the most democratic way to communicate while adding that his tweets did not always affect Tesla stock the way he expected.

The class-action trial in San Francisco court centres on allegations that Musk had lied when he tweeted, costing investors. Earlier, investor Timothy Fries told the jury how he lost $5,000 by buying Tesla stock after Musk’s tweet.

Fries told the jury that funding secured meant to him that “there had been some vetting, some critical review of those funding sources”.

Musk described the difficulties the company went through around the time he sent the “funding secured” tweet, including bets by short-sellers that the stock would fall.

“A bunch of sharks on Wall Street wanted Tesla to die, very badly,” he said, describing short-sellers, who profit when a stock falls in price.

On Wednesday, Musk’s attorney, Alex Spiro, told the jury that his client believed he had financing from Saudi backers and was taking steps to make the deal happen and had tried to protect the “shareholders” by posting the tweet that had “technical inaccuracies”.

A jury of nine will decide whether the tweet artificially inflated Tesla's share price by playing up the status of the funding for the deal and if so, by how much.

Elon Musk is on trial this week for potential fraud after tweeting in 2018 that he was poised to take Tesla private. In a federal courtroom in San Francisco, where Tesla CEO Musk was scheduled to be one of those summoned to testify, the selection of jurors who would evaluate the evidence began. The episode started in August 2018 when Musk tweeted that he had the funds to take Tesla private, sparking a wild rise in the price of the company's stock.

Stockholders sued Musk for allegedly costing them billions of dollars with the tweet that said finance was "secured" to buy out the company's shareholders.

"The plaintiff alleges that these tweets were materially false and artificially affected the price of Tesla stock and other securities after they were made," US District Court Judge Edward Chen said while summarizing the case for potential jurors.

The Tesla tycoon's attorneys, according to Chen, will contend that any attempts to prove that Musk's tweet was "materially" false or that shareholders experienced damage as a result would fail at trial.

Elon Musk's Tesla trial for alleged fraud over ‘funding secured’ tweet begins

Tesla is in trouble. A 2016 video by Tesla showcasing its self-driving technology came into question after a senior engineer's testimony claimed the video was staged.

The video, still available on Tesla's website, shows a car navigating itself while the driver is seen "not doing anything." Elon Musk, the CEO of Tesla, touted the video, which is still stored on the company's website, on Twitter in October 2016 as proof that "Tesla drives itself."

However, Ashok Elluswamy, the Director of Tesla's Autopilot Software, said in a deposition the video doesn't accurately portray what was seen.

The engineer detailed how the video was produced and said the car seen parking itself had crashed into the fence at the parking lot when the driver wasn't present.

The video was staged to promote Tesla's self-driving technology to demonstrate features that the system lacked, such as the ability to accelerate at a green light and stop at a red one, said the engineer.

Tesla has come under attack from the German union IG Metall and lawmakers over claims made by workers at its Brandenburg facility over inappropriate work hours and repression of free speech. A growing number of employees have been alleging longer workdays and limited free time, according to IG Metall, which has an office close to the factory and claims to be in regular contact with its workforce.

As per IG Metall, employees were being told to sign non-disclosure agreements along with their employment contracts, which made them more reluctant to publicly criticise their working conditions.

These worries were exacerbated by a new position advertised on Tesla's career website for a "Security Intelligence Investigator," who would work with the legal and human resources departments to gather "on-the-ground information both inside and outside Tesla walls in order to protect the company from threats."

"Workers started at Tesla with great enthusiasm for the project. Over time we are observing that this enthusiasm is withering," Irene Schulz of IG Metall Berlin-Brandenburg-Sachsen said in a statement.

"Tesla is not doing enough to improve working conditions and is leaving too little time for leisure, family, and recovery."

Tesla was not immediately available for comment to Reuters.

Two insiders who spoke to Reuters allege that Tesla China has also requested non-disclosure agreements from certain employees. For Tesla employees in Austin, San Francisco, and Shanghai, Reuters discovered many people on LinkedIn with the title "Security Intelligence Investigator."

German business newspaper Handelsblatt said on Monday that local lawmakers from the center-left SPD to the center-right CDU had voiced concern about the claims and demanded that both Tesla and the local government conduct investigations.

Tesla slammed in Germany by union workers over unreasonable working hours, lack of free speech

Tesla has come under fire from German union IG Metall and politicians over allegations by workers of unreasonable working hours and fears over speaking out at its Brandenburg plant, with some calling for inquiries into the carmaker.

World Business Watch: Tesla under fire in Germany over union concerns on working hours

Tesla has literally launched a price war with its rivals as it announced on Friday (January 13) that it will cut the price of its best-selling electric vehicle (EV) models. It said that the cut will be up to 20 per cent in Europe and the United States. The announcement comes as competition continues to rise in the growing EV industry. In early trading on Friday, Tesla shares fell as much as 4.5 per cent though there was some recovery later. The shares of Elon Musk-led company have plummeted for more than a year.

Analyst Dan Ives of Wedbush Securities said: "It's no secret that demand for Tesla is starting to see some cracks in this global slowdown for 2023."

Ives said the price cut was the "right move" and "a clear shot across the bow at European automakers and US stalwarts (GM and Ford) that Tesla is not going to play nice in the sandbox."

A report by Wall Street Journal noted that the discount now makes it possible for buyers of Tesla's US-built Model Y to take advantage of a tax credit in the US by bringing the price of the car below a $55,000 cap.

Tesla slashes price of its best-selling electric vehicle models in US, Europe

Zhu Xiaotong, also known as Tom Zhu, smiled in a vest and a black hat with a white "T" for Tesla in a Twitter post celebrating Tesla manufacturing 3,000 Model Ys a week at its Texas factory last month. Zhu, who oversaw the US automaker's operations in Asia-Pacific and managed its Shanghai factory to become the company's most productive in the world, was sent to Austin late last year to assist with running Tesla's newest plant, as reported by the South China Morning Post.

It is claimed that Zhu is now in charge of worldwide automotive production, sales, and service—a degree of authority that is perhaps second only to that of Tesla CEO Elon Musk—despite the fact that Tesla has not yet made any announcements or designated him as an executive officer.

Early life and education

Zhu was born in China and is said to also have a New Zealand passport. Prior to that, he contributed to the establishment of an international engineering consultancy that offered support to Chinese contractors wanting to expand overseas. He graduated from Duke University's Fuqua School of Business after obtaining a bachelor of commerce in information technology from New Zealand's AUT, as reported by the South China Morning Post.

Tom Zhu's Tesla run

Zhu joined Tesla in early 2014 to help expand its Supercharger network. By the end of his first year at Tesla, Zhu had swiftly risen through the ranks and was in charge of the China operations. Under his leadership, Tesla's Shanghai factory—the company's first site outside the US—materialized quickly, transforming from a muddy field to a dazzling assembly line for electric vehicles in less than a year. Zhu was elevated to the positions of president of Greater China and worldwide vice president before mass production even began at the end of 2019.

He was promoted in July of last year when the automaker expanded into Thailand, Hong Kong, and Singapore. He now has overall responsibility for Tesla Asia-Pacific. Musk also commended Zhu's China team for "burning the 3 am oil" when they toiled nonstop to keep the Shanghai factory running throughout the city's Covid lockdowns. The company underwent improvements to increase manufacturing capacity to 1 million electric vehicles annually during what was an incredibly challenging final year.

What do Tom Zhu's co-workers say about him?

Zhu is seen as practical and responsive by a number of current and former Tesla China employees, who point out that he frequently responds to emails and texts quickly and at all hours of the day. Zhu referred to himself as "tenacious" in an interview with Duke's Fuqua School.

Explained: Who is Tom Zhu, Elon Musk's right-hand man at Tesla?

A tweet from Elon Musk indicating that Tesla might allow some owners who are testing a “Full Self-Driving” system to disable an alert that reminds them to keep their hands on the steering wheel has drawn attention from US safety regulators.

World Business Watch: Musk tweet about disabling driver monitoring in Tesla being probed

The United States National Highway Traffic Safety Administration (NHTSA), on Monday, told reporters that the regulatory body is investigating Tesla CEO Elon Musk’s tweet in the context of at least 14 Teslas crashing into emergency vehicles while using its Autopilot driver assist system. The acting head of NHTSA, Ann Carlson, made the statement while addressing the press on the sidelines of an event in Washington.

According to reports, in June 2022, the NHTSA moved up to an engineering analysis amid its ongoing defect probe into at least 830,000 Tesla vehicles with the driver assistance system Autopilot feature in the context of crashes involving parked emergency vehicles. Additionally, for the past two years, the electric carmaker has been beta-testing its “Full Self-Driving” (FSD) with owners who have not been trained to use the system but are reportedly being actively monitored by the company.

The probe began in August 2021, and the NHTSA’s Carlson said they are “investing a lot of resources”, which includes a lot of “technical expertise, actually some legal novelty and so we're moving as quickly as we can, but we also want to be careful and make sure we have all the information we need.”

Meanwhile, a tweet from Tesla CEO indicated that Tesla might allow some owners testing the “Full Self-Driving” system to disable alerts which remind them to keep their hands on the steering wheel. Subsequently, the regulatory body said they have asked Tesla for additional information on Musk's tweet which is now a part of the broader ongoing investigation into the 14 vehicles.

The ongoing investigation is necessary before NHTSA can demand a recall and it also includes a review of whether Tesla vehicles ensure that the drivers are paying attention as they said previously that evidence suggests that the drivers had complied with the electric carmaker’s alert protocols. This has since raised questions about the effectiveness of the company’s alert strategy for its drivers.

Earlier this year, the electric carmaker also said at least 160,000 of its cars which amount to nearly 15 per cent of all Tesla which is currently on US roads are participating. While the company website says that their cars cannot drive themselves, the “Full Self-Driving” can more or less autonomously navigate roads in several instances. However, experts have raised concerns about the system’s errors, said a report by the Associated Press.

The tweet in question was an interaction between Twitter Chief Executive Elon Musk and a user on December 31 about Tesla’s FSD feature, said Carlson confirming that the agency was in discussion with Tesla about the same.

The tweet reportedly suggested that drivers who have used Tesla’s “Full Self-Driving” software system for more than 10,000 miles should be able to disable the “steering wheel nag,” an alert which asks drivers to hold the wheel and confirm that they are paying attention.

In response on the microblogging platform Musk wrote, “Agreed, update coming in Jan.” While there is no clarity on the kind of changes Tesla will make or even disable the “steering wheel nag”. Meanwhile, many have raised concerns about the dangers of disabling such an important feature.
