Jade Blue McCrossen-Nethercott, a 32-year-old survivor and activist, was given £35,000 in compensation by the Crown Prosecution Service (CPS), which admitted to its wrong handling of the case and apologised.

Sexomnia is a rare sleep disorder in which a person is unaware that sex is happening.

In a letter to Jade, CPS “apologised unreservedly” and expressed commitment "to improve every aspect of how life-changing crimes like rape are dealt with”.

Subject of a BBC documentary, Jade said it was a "big triumph" to hold CPS accountable, adding that it&nbsp;"took me to the darkest points of my life.”

She said she sued CPS in search of accountability and to avoid future mistakes in similar rape cases. “For me it's not about the financial side of things. I'm very much wanting to push for systemic changes with the CPS and the legal system advocating for better training, policies, procedures and practices,” she was quoted as saying by BBC.

Centre for Women's Justice, which provided lawyers to Jade, noted that such a payout from CPS was &nbsp;"extremely rare," BBC reported.

<h2>The rape incident</h2>

The incident at the heart of the case happened in&nbsp;2017. Jade, who was 24 years old at the time, had been at a house party with friends and slept there. She woke up seminude, and found that her necklace was broken. There was a man in the room where Jade had slept. 
 
She felt she was violated. Police was called in, and a rape case was filed.

<h2>What is sexomnia?</h2>

First approved as a clinical condition in 2003, sexomnia, or ‘sleep sex’ happens when victims who are sleeping appear to exhibit signs of consent for sexual activity, which is often forgotten by the time the person wakes up.

Accoridng to an article in The Independent, sexmonia has "become popular among lawyers as a defence for accused rapists."

"Medically, it is a type of parasomnia, an umbrella term for sleep disorders in which people experience or exhibit unusual behaviours during sleep, which also includes sleepwalking," said the article.&nbsp;

“In the case of sexsomnia, people engage in sexual behaviours such as masturbation, sexual movements, or initiating sex with another person,” it quoted &nbsp;clinical sexologist &nbsp;Marie Morice as saying.&nbsp;

Sexomnia happens during non-REM sleep. Non-REM (REM stands for Rapid Eye Movement), which is deeper form of sleep that occurs when your heart rate and body temperature decrease. Considered a form of sleepwalking, sexomnia happens when parts of the brain that control sexual behaviour stay awake while the rest is asleep.

There are very few known instances of sexsomnia, with only a few hundred cases documented worldwide, according to The Independent article.&nbsp;

<h2>Why did CPS drop the case of Jade?</h2>

The case was dropped by CPS in 2020 just days before it was to go into trial. CPS cited two sleep experts who had said Jade was suffering from sexomnia when the incident happened.

That conclusion came after Jade was given a questionnaire about her sleep habits. She was not interviewed by the experts.

Jade said she did not have sexsomnia, however, sleep experts felt it may have been an isolated episode.

The accused was set free without even facing a jury. That made it impossible for the case to be reopened without compelling evidence.

<h2>Jade's legal battle</h2>

After the case was dropped, Jade said she felt more upset about it, than the incident itself.

She filed an &nbsp;appeal in 2021 through the CPS system that gives victims the right to review. The payout and apology letter from a chief crown prosecutor&nbsp;were given after that.

In the apology letter, the CPS admitted the case should have gone into trial, adding it was wrong for it to close it.

West Bengal Chief Minister Mamata Banerjee has alleged that the Left is in connivance with the Ram (the Bharatiya Janata party) to create unrest in West Bengal.

"Left and Ram want to create unrest in Bengal and they both have come together to do this," said Mamata as reported by news agency&nbsp;ANI.

"The people who vandalised RG Kar Hospital yesterday and created this ruckus are not connected to the student movement of RG Kar Medical College, they are outsiders, I have seen as many videos, I have three videos as I can see, in which some people are holding national flags, they are BJP people, and some are DYFI are holding white and red flags," she alleged.

The CBI, as per reports, have visited the victims' homes. Speaking to the press, an official with the investigative agency said, "Investigation is going on. We have taken statements from the parents."

Investigators, as per PTI, have taken note of the time the victims' parents received a call from the hospital informing them of the death of their daughter. The parents were also questioned about her friends and whether she had complained to them of any problems&nbsp;she may have been facing at the RG Kar Medical College and Hospital.

"It was difficult to speak to a couple who have lost their daughter in such a manner," said the officer, as quoted by the news agency.

Apart from five doctors at the hospital, the CBI also interrogated the hospital's former medical superintendent-cum-vice-principal (MSVP), the principal and the head of the chest department, where the victim's body was found.

Additionally, CBI spoke to the officer-in-charge of the Tala police station, under the jurisdiction of which the hospital is located.

The agency has also asked for details of Civic Volunteer Sanjay Roy's call detail record and mobile tower location. Roy has been arrested on suspicion of the murder.

"We are also looking into data consumed by his mobile to ascertain whether he made any video or internet voice calls," the officer said.

According to survivors, many were gang-raped by up to four RSF fighters, in some cases, in front of family members.

"RSF members sexually assaulted women and girls in front of their family members," said the report, particularly noting a case where a mother and her four daughters were raped "repeatedly for days" in front of their father and brothers after putting them under house arrest.

The rights group cited a lawyer who received “reports of rape of six girls, one girl aged 9 years old” and a psychologist who said out of over&nbsp;25 survivor cases he recorded, “at least 80 per cent were aged between 12 and 18."

Men and boys have also been victims of sexual violence, it said.

The conflict-related sexual violence in the impoverished African country was recorded by the rights group from interviews with healthcare professionals, psychiatrists and other care providers&nbsp;in the capital of Khartoum Bahri and Omdurman cities.

<h2>Forced child marriages</h2>

"Women and girls have also been subjected to forced marriage and child marriage," the rights body said in the report, which was compiled&nbsp;based on interviews conducted between September 2023 and February 2024.

The HRW report claimed that RSF forced some women and children into marriage in Khartoum.&nbsp;

Shocking cases of rape in Sudan: Children as young as nine were raped, says rights group report

A 13-year-old boy, his mother and two elder sisters have been arrested from the central Indian state of Madhya Pradesh after the teenager raped and murdered his nine-year-old sister in April, earlier this year.&nbsp;

The incident took place in Rewa district of the state when the boy raped his sister after watching porn on mobile phone.&nbsp;The police managed to crack the case after detaining the teenager, mother and his two sisters, aged 17 and 18, whilst interrogating nearly 50 people.&nbsp;

"A nine-year-old girl was raped and strangled to death under Jawa police station limits on April 24, following which the police had registered a case and started a probe,"&nbsp;Rewa's Superintendent of Police (SP), Vivek Singh was quoted as saying by news wire agency PTI.&nbsp;

The body of the little girl was found in the courtyard of the house where she was sleeping at the time of the incident.&nbsp;

The intense questioning based on technical evidence revealed that the brother had slept beside the girl at night and after watching a porn video, raped her.&nbsp;When the sister threatened to inform the father, he strangled her.&nbsp;

"The boy strangled her and later woke up his mother and confided in his mother. She then found that the victim was still alive. On seeing that, the accused again strangled her," the police added.&nbsp;

Meanwhile, the two elder sisters, who woke up amid the commotion, changed the spot of their bed to mislead the officers during the probe. However, they both broke down during the questioning and admitted to their crime.&nbsp;

The family went to great lengths to hide the crime. They told the police that the girl had died after being bitten by a poisonous insect.&nbsp;Additionally, there were no signs of forced entry into the house and the family members reported no unusual noises during the night.&nbsp;&nbsp;&nbsp;
