In such circumstances, it was necessary for the investigation agency to obtain the sanction of competent authority before filing charge sheet. In absence of the sanction, the accused are entitled for acquittal," the court said.

According to the CBI, the police officials were part of teams which abducted and killed Shaikh, his wife and Prajapati in staged encounters.

The court said there was nothing to show that service weapons of the accused policemen were used in the killings.

The three victims who were returning to Sangli in Maharashtra from Hyderabad in a bus were taken into custody by a police team on the intervening night of November 22-23, 2005. The couple was taken in one vehicle and Prajapati in another.

The CBI had said Shaikh was killed on November 26, 2005, allegedly by a joint team of Gujarat and Rajasthan police, and Kausar Bi three days later.

It added that statements of witnesses on Prajapati escaping from the custody of Rajasthan police in December 2006 appeared "cogent and convincing".

Addressing a joint press conference here, Pune rural Superintendent of Police Sandip Patil said "preventive action" has been taken against 1,211 people under the Code of Criminal Procedure (CrPC).

Six people, including children, died when a fire broke out in an apartment building in the northwestern Swiss town of Solothurn overnight, local police said Monday.

"There were more than 20 people in the building. Most were evacuated by the fire brigade, but for six people, including children, the help came too late," Solothurn police said in a statement.

An AFP photographer said all of the apartments in the building, in the centre of town, looked blackened by fire.

The Kashmir Police is investigating various social media accounts propagating videos of "executions" carried out by militants recently, Inspector General of Police (IGP) S P Pani said here Monday.

Union Home Minister Rajnath Singh on Tuesday asked the Delhi Police to change its attitude and treat the people in a friendlier manner.

He said that the police officials should pay more attention towards this."If someone comes to the police station to lodge a complaint, can`t we talk to them politely? If a complainant is waiting for hours, can`t we ask them for water?" Singh asked.

Singh`s comments came while addressing the gathering on the occasion of the flagging off a fleet of 300 modified motorcycles-- Raftaar of Delhi Police--to tackle street crimes and make the city safer for women.

The Home Minister also asked the Delhi Police to become a role model for other states Police forces. He also asked it to take stern action against those involved in criminal activities.

Singh said, "I will ask Police Commissioner to ensure arrangements of tea stalls for complainants at police stations if possible and the Home Ministry will provide funds for it. Why can`t police personnel present themselves as role models?"

Speaking about enhancing the strength of the police, Singh said that the Home Ministry is considering filling up 12,000 posts out of which approval has been given for the recruitment of 4,000 posts.

The Home Minister said that 300 more such modified motorcycles would be inducted soon in the Delhi Police for better patrolling.These motorcycles are equipped with modern communications technology, GPS and alarm system.

Delhi LG Anil Baijal and Delhi Police Commissioner Amulya Patnaik were also present on the occasion.&nbsp;

It is a sad commentary on the states’ respect for the highest judiciary of the land that more than 12 years after the apex court gave directions for police reforms, state governments are still dragging their feet in the matter.

What is no less unfortunate is that the Union government has also not shown the commitment that was expected of it in revamping the police.

The Supreme Court had given directions on September 22, 2006. Around the same time, Soli Sorabjee also submitted a draft of a Model Police Act. The ideal follow-up would have been if the government of India enacted a central legislation on the lines of the Model Police Act, incorporating therein salient features of Supreme Court’s directions.

The central government could also have ensured that similar legislation was passed by at least those state governments where the ruling configuration reflected the power structure at the Centre.

However, nothing of the kind was done. As a result, the states, taking advantage of the caveat that the directions would be operative “till the new legislation is enacted by the state governments”, passed their own laws on the subject, legitimising the status quo.

So, today we have a situation where every state — 17 of them so far — has a different Police Act. In retrospect, it would seem that the British imperialists had more vision. They had a single Police Act for the entire country.

Police Acts passed by the states have on paper set up the mandated institutions: The state security commission, police establishment board and complaints authority.

However, a close scrutiny shows that their composition has been diluted, their charter truncated and their powers curtailed. Besides, there is arbitrariness in the appointment of a DGP while police officers on operational assignments are transferred for various administrative reasons before the completion of two years. There is, further, tardiness in the separation of investigative and law and order functions of the police.

The constitutionality of the acts passed by the state governments has been challenged in the Supreme Court. If the acts are declared ultra vires, that would offer another opportunity to the central government to enact the Model Police Act and ensure that mutatis mutandis similar laws are passed by the state governments.

However, looking at the pace and the zeal with which implementation is being monitored, it is difficult to be very optimistic.

The Justice Thomas Committee, which was appointed by the Supreme Court to examine implementation of its directions in various states, in its report in 2010, expressed “dismay over the total indifference” of the state governments on the issue of reforms in police.

Justice JS Verma Committee (2012) also urged “all states to fully comply with all six Supreme Court directives in order to tackle systemic problems in policing, which exist today”.

What is the relevance of police reforms in the present context? It must be understood that the very survival of the democratic structure and the economic progress of the country are at stake.

The legislatures and Parliament have been infiltrated with persons of questionable antecedents. The nexus between the politicians and criminals is undermining the authority of the state. People who should be behind bars are being protected by the police. A system which permits such an aberration is inherently faulty and must be changed.

Mechanisms must be devised which safeguard the police from becoming a tool in the hands of unscrupulous politicians or oblige it to protect criminals.

The economic growth of the country also requires comprehensive improvement in the law and order situation. We have seen the devastation in Haryana during the reservation agitation in February 2016, when property worth about Rs 20,000 crores was destroyed by the agitators. The police abdicated their functions and were reluctant to confront the agitators. No corporate group would make investments in a state where its installations are vulnerable to attacks by hoodlums. A politicised force cannot deal with such situations effectively. What we need is a professional police force.

Police reforms are also essential to deal with the multifarious problems of internal security. Terrorists have spread their tentacles across the country. Kashmir is on the boil. There are multiple insurgencies in the Northeast. The Maoist insurrection continues to be a formidable threat. Besides, there are caste conflicts and communal problems. We need a reformed and rejuvenated police force to deal with these problems.

The weakness of the police creates a situation where Central Armed Police Forces (CAPFs) have to be inducted and, on occasions, even the Army has to be requisitioned. Under normal circumstances, it should be possible for the police to deal with all internal security problems with some assistance from CAPFs, except where a neighbouring power is involved in stoking the flames of an insurgent or secessionist movement within the country.

Thus, looked at from any angle — survival of democracy, maintaining the trajectory of economic progress or tackling the threats to internal security — we must reorganise and restructure the police in such a manner that it is generally able to perform its mandated functions without having to rely on any support from central forces.

Police reforms are not for the glory of the police. They are a sine qua non for a progressive, modern India, for making the country internally strong and enabling it to play a significant role in international relations.

Punjab police Thursday claimed to have busted a Pakistan-backed terrorist module operating in the state with the arrest of a person from Patiala.

Shabnamdeep Singh alias Maninder Lahoria was asked by his Pakistan-based handlers to target police posts and crowded places during the upcoming festival season, they said adding a pistol, a hand grenade, a motorcycle and letter pads in the name of "Khalistan Gadar Force" and other terrorist outfits were seized from his possession.

DGP Suresh Arora said Singh's arrest has exposed the nexus between Pakistan's Inter-Services Intelligence spy agency and Gurpatwant Singh Pannu's fringe outfit Sikhs for Justice (SFJ) as one of his handlers had identified himself as an SFJ operative.

Arora said Singh hails from Daftari Wala Burar village in Patiala district and was out on bail in a case registered in Rajasthan.

Singh was operating a Facebook account under a pseudonym&nbsp;"Lahoria Jatt Gill". The account had a profile picture of Jarnail Singh Bhindranwale, the DGP said.

A preliminary investigation has revealed that Singh was contacted by Javed Khan Wazir, a suspected Pakistani intelligence officer, in July 2018 and was introduced to a Pakistani Sikh, the DGP said.

Singh was then introduced to Nihal Singh, who identified himself to him as an SFJ operative, Arora said.

Nihal and Wazir communicated regularly with Singh and used to incite him to indulge in arson, he said adding they asked him to record his acts of arson and share with them the videos with details of news reports about the incidents.

Wazir shared the logo and name of "Khalistan Gadar Force" with Singh and asked him to get letter pads printed to use them for issuing statements claiming acts of arson, the DGP said.

Singh and his handlers created a Facebook page in the name of "Khalistan Gadar Force", he said.

Wazir asked Singh to carry out targeted killings and also promised him Rs 10 lakh for each act of violence, he said.

In the second week of October 2018, Singh was asked by his handlers to procure a new phone and install a new messaging application for further communication, the DGP said.

Around October 24, a pistol and grenade were delivered to Singh, the DGP said.&nbsp;

Police claim to bust ISI-backed terror module in Punjab

The West Bengal Police has filed a charge sheet against three persons in connection with the brutal gangrape of a woman in Jalpaiguri district, five days after the incident on October 20, a police officer said Friday.

The 35-year-old woman was raped and an iron rod inserted in her private parts brought back memories of the ghastly Nirbhaya rape case of 2012.

Police filed a charge sheet against the three accused Thursday, the police officer said.

The accused have been charge-sheeted under Sections 376D (gangrape), 326 (causing grievous injury) and 307 (attempt to murder) of the Indian Penal Code.

Under Section 326 the minimum punishment is 10 years and under Section 376 D it is 20 years. The maximum punishment under both these provisions is life term. Under Section 307 the maximum punishment is 10 years.

While we have arrested two persons, one is still absconding, Superintendent of Police (SP) of Jalpaiguri Mitava Maity said.

The incident had taken place near the victim's home at Niranjan Pat locality of Jalpaiguri district.

The prime accused, a relative of the woman, had called her out of her home on the pretext of resolving a land dispute, the SP had earlier said.

He then allegedly raped her and tortured her by inserting an iron rod in her private parts, the SP had said.

Two other persons accompanied the accused, but they did not rape or torture her, the SP had said after he had spoken to the woman, following her operation, at the hospital.

The accused relative and another person who allegedly helped him in the crime were arrested, but the third accused has been absconding.

The tribal woman's husband, a labourer, was away from home during the incident. The woman has three children.

A rickshaw-puller had found her and took her home. She was taken to Dhupguri hospital on October 21 morning and shifted to Jalpaiguri Sadar Hospital.

Doctors operated on her at the Sadar Hospital here on that night and the woman was kept in the intensive care unit.

She was administered blood as she had been bleeding profusely.

"She is in a serious condition but is stable," doctors treating her had said Wednesday.

She was shifted to the critical care unit (CCU) from the ICU on Thursday and doctors at the hospital said that her condition was stable, they said on Friday.&nbsp;

Meanwhile, Uttar Pradesh Minister Ashutosh Tandon said that a new FIR is being registered and the policemen involved in the case have been arrested and expelled from the force.

"Orders were given for rewriting of FIR. Gomti Nagar police won't investigate it, some other police station will probe. DM Lucknow had ordered magisterial inquiry. I have ordered the constitution of SIT. It's a crime. Policemen involved have been arrested and expelled," Tandon said

Tiwari was allegedly shot by Chaudhary&nbsp;at Gomti Nagar area in Lucknow on Friday when he was asked to stop his car.

Tiwari was subsequently taken to Lohia hospital in the city where he succumbed to his injuries.

According to police, shots fired at Tiwari after he allegedly tried to crush police constable's bike. After being hit by the bullet, the victim's car then met with an accident.

"A case under section 302 of the Indian Penal Code (IPC) has been registered against the accused. However, exact reason of his death whether he died of accidental injuries or bullet injury would be confirmed only after post-mortem report," Senior Superintendent of Police (SSP) Kalanidhi Naithani told ANI.

Kalpana Tiwari, wife of deceased Vivek Tiwari , asked Uttar Pradesh Chief Minister Yogi Adityanath to take cognizance of the incident.

"Police had no right to shoot at my husband, demand UP Chief Minister Yogi Adityanath to come here and talk to me," she said.

Uttar Pradesh Deputy Chief Minister Keshav Prasad, meanwhile, told ANI that the investigation into the matter is underway and that actions will be taken against those found guilty.

"Investigation is underway. If an innocent person has been killed by the police probe will be done.Actions will be taken against those found guilty," he said.

“The argument started on a frivolous matter. I manage Armaan’s villa in Goa, which is often rented out, and had made a booking for a client. However, the client had made the payment to the villa staff and when Armaan asked me about the money, I told him that I will ask the staff to transfer it. Suddenly, he started verbally abusing me. Before I realized what was happening, he caught me by my hair and banged my head against the floor. I begged him to allow me to go to the hospital, promising that I wouldn’t approach the police. The wound was so deep that I had to undergo a surgery. The doctor told me that the scar would be visible even after the surgery, as the assault has damaged my skin tissues. He had assaulted me in February this year, and nearly broke my nose.”

She further added that Armaan has been trying to call and apologize to her “Armaan has been sending me text messages since Sunday, asking me to come back home, and he is even promising to marry me right away, but I have had enough!”

This is not the first time Armaan has assaulted her. Neeru revealed that she had left him and gone to Dubai but he pleaded her to come back.

“This relationship has been a huge mistake, but I continued to give him chances despite being warned by friends and family. In fact, I had called time on the relationship in September last year and left for Dubai. I got a job and was living there peacefully. However, three months later, Armaan came to take me back home. Judd added that most of the evidence collected so far involved material previously known to police. It was not clear if there were any local victims, though that remained a part of the investigation.

The men arrested include Roger Catey, 53, who is employed as a project manager in the costumes department of Disney World, a theme park in Orlando which attracts millions of children and families every year.

Thirty-year-old Rickie Vargas-Garcia, who was a Lego builder for Merlin Entertainment which owns the Legoland theme parks, admitted to soliciting children for nude photos online.

Edward Zaborowski, 48, was caught in possession of pornographic photos of children aged between four- and six-years-old. A bartender, he was also a volunteer for the Boy Scouts, as his son was a member.

Judd said: "Parents, you've got to know where your children are going online, because wherever your children are, (predators) are."

The foundation stone of Sterlite’s copper-smelting plant in Tamil Nadu's Thoothukudi district was laid by the late former chief minister of Tamil Nadu, J Jayalalithaa, in the year 1994.

For over two decades, locals here have been fighting cases in various courts to protest its ongoing operations stating that the plant causes severe air and water pollution and contaminates the soil. &nbsp;

So far, there have only been temporary shutdowns and the plant has continued with its operations.&nbsp;

This year, fresh protests started in February when the company commenced works on its second unit amid opposition from the local people.

Section 144 of the CrPC (Criminal Procedure Code which lists out the procedure for administration of law in India), which prevents unlawful assembly of people in an area, has been imposed in and around the Sterlite unit. There is a heavy deployment of police in the city, with additional forces being rushed in from neighbouring cities as well.

Meanwhile, Tamil Nadu Chief Minister K Palaniswami announced a compensation of Rs 10 lakh to the families of each of those killed, Rs 3 lakh to those seriously injured, and Rs 1 lakh for people who suffered minor injuries.

Anti-Sterlite protests: Death toll mounts to 11, Home Ministry demands report from Tamil Nadu govt

Police allegedly used assault rifles to shoot at protesters in Tamil Nadu's Thootukudi, where <a href="http://www.wionews.com/india-news/tamil-nadu-at-least-11-killed-in-clashes-with-police-over-protests-against-sterlite-plant-139005">11 people died</a> on Tuesday.&nbsp;

A video released by news agency ANI shows a man in civilian clothes taking position on top of what appears to be a police van. He is armed with an SLR (self-loading rifle).&nbsp;

In the video, a voice in the background says, "At least one should die."&nbsp;

Thousands of people had hit the streets of Thootukudi (earlier called Tuticorin) Tuesday. They were protesting against a Sterlite copper-smelting plant which they say has caused immense environmental damage. They also allege the plant has caused an outbreak of disease in the area.&nbsp;

Sterlite is owned by the Vedanta group.&nbsp;

The protests against the plant have been going on for years. In 2013, the Supreme Court ordered the company to pay a Rs 100-crore fine.&nbsp;

The protests against the plant erupted again in February when it announced that it was doubling its capacity.&nbsp;

Tuesday had been the 100th consecutive day of protest.&nbsp;

The protests against the plant erupted again in February when it announced that it was doubling its capacity. Security forces recovered a huge cache of explosive materials following a gun-fight with the Naxals in Chhattisgarh's Sukma district, police said Saturday.

The encounter took place on Friday when a joint team of the police's Special Task Force, District Reserve Guard and CoBRA (Commando Battalion for Resolute Action) of the CRPF was out on an anti-Naxal operation, said Sukma Superintendent of Police Abhishek Meena.

While the team was cordoning off Tumirpad forests, Naxals opened fire on them, Meena said.

The area around 500 km away from Raipur.

After a prolonged gun-battle, the Maoists fled, the SP said.

Four steel tiffin boxes, 12 gelatin rods, urea, 20 detonators, cortex wires, batteries and gunpowder were found from the spot, he said.&nbspAll this material is used to make improvised explosive devices (IEDs) by the Naxals.

A team of `military battalion no 1' of the Maoists led by company commander Nagesh, which operates mostly in south Sukma, was involved in the encounter, Meena said.&nbsp

A mob set fire to at least 40 shops and 110 vehicles over a minor argument in Maharashtrá's Aurangabad.

At least one person was reportedly killed from a bullet injury and 40 others were injured in the violence. Two people are said to be in a critical condition.

Clashes ensued between 2 groups after illegal water connection to a ‘religious place’ was reportedly disconnected. Several parts city witnessed youths from two groups taking to streets and attacking each other with some pelting stones. Several vehicles were also burnt.

Various footages of the clashes are being shared on social media platforms. The violence has reportedly left at least 10 policemen injured.

If one group is pelting stones, the other group is requested to keep calm not respond in kind, the police are doing its duty.
