Insiders familiar with the matter suggest that the rules for the CAA are likely to be released before the MCC comes into effect.

Upon the issuance of the CAA rules, the Modi government will initiate the process of granting Indian citizenship to persecuted non-Muslim migrants, including Hindus, Sikhs, Jains, Buddhists, Parsis, and Christians, from Bangladesh, Pakistan and Afghanistan who arrived in India by December 31, 2014.

Arora also sought to downplay the controversy saying all the Commissioners are "not expected to be template or clones of each other".

Lavasa said he might consider taking recourse to other measures aimed at restoring the lawful functioning of the Commission in terms of recording minority decisions.

"My various notes on the need for transparency in the recording and disclosure of all decisions including the minority view have gone unheeded, forcing me to withdraw from participating in the deliberations of the complaints," he said in the letter to Arora.

The office of the CEC on Saturday released a statement of Arora which said there has been an "unsavoury and avoidable" controversy reported in the media today about the internal functioning of the Commission in respect of the handling Mode Code of Conduct.

This, he said, has come at a time when all the Chief Electoral Officers throughout the country and their teams were geared for the seventh and last phase of polling on Sunday.

All of them and the senior officers of the EC headquarters have been working their utmost during the last six phases of elections which barring an odd incident here and there have been largely peaceful and conducted in a fair, free and transparent manner.

"The three members of ECI are not expected to be template or clones of each other. There have been so many times in the past when there has been a vast diversion of views as it can and should be. But the same largely remained within the confines of ECI after demission of office unless appearing much later in a book written by the concerned ECs, CECs."

"I said a few days back in another leading daily that eloquence of silence is always difficult but far more desirable which is to see the election process through instead of creating ill-timed controversies."

Arora said it needs to be mentioned in the last meeting of the Commission on May 14, it was unanimously decided that some groups shall be formed to deliberate the issues, which arose in the course of conduct of Lok Sabha elections just as it was done after the elections in 2014.

Out of the 13 issues and areas which were identified, Model Code of Conduct is one of them, Arora said.

Lavasa had opposed and dissented on the clean chits given by the Commission to Modi and Shah over the alleged violations of the Model Code of Conduct by them during their campaign.

The Congress and CPI(M) had complained against Modi's speeches invoking the armed forces in the context of the Balakot aerial strikes and on issues relating to minorities. EC sources said it needs to be clarified categorically and unambiguously that this was purely an internal matter of the Election Commission and as such any speculation, innuendoes and insinuations in this regard should be eschewed.

A bench headed by Chief Justice Ranjan Gogoi, while taking note of EC's contention that it can merely issue notice, an advisory and then lodge criminal complaint on repeated violations of model code of conduct, summoned an official of the poll panel, who is well versed with the issue, to appear before it tomorrow.

The apex court took into account the EC's statement that notices were issued on a speech made by Mayawati asking Muslims to vote and Yogi Adityanath on 'Ali-Bajrang Bali'.

The Bench, which also comprised Justices Deepak Gupta and Sanjiv Khanna, pulled up the EC for not acting against them for their statements on religion and hate speeches.

"We would like to examine the matter. The representative of Election Commission should appear in the court tomorrow at 10.30 am," said the Bench.

The court was hearing a PIL seeking strict action against political parties if their spokespersons and representatives deliver speeches and make remarks in media on religion and caste.

During the hearing, the EC told the top court that it had issued three notices on violation of model code of conduct and the first notice was against Adityanath, which has been closed.

The second notice was against Mayawati, which she was to reply by April 12 but she has not replied yet, the EC said.

Chief Justice Gogoi said this is something the EC is duty bound to act on and it has to get into action immediately.

"What have you done when she (Mayawati) has not replied? What are you impart to do in law?" asked the top court.

The counsel appearing for EC replied that it issued notices and then an advisory. On repeated violation of model code of conduct, a criminal complaint can be filed, the EC counsel said.

"We can't disqualify them (politicians). We can't even derecognise these political parties," the EC counsel said.

"That's it? You (Election Commission) know your power? For violating the model code of conduct, all you can do is issue advisory?" Chief Justice Gogoi observed and said the court will examine the issue relating to the power of EC in model code of conduct violations by politicians.

The Bench then told the counsel appearing for the petitioner that EC says "we are toothless, we are powerless, we issue notices, then advisory and on repeated violation, we file complaint, this is their power".

"The concept of secular democracy promised under the Indian Constitution for the purity of elections is mandatory in order for a Democracy to thrive and succeed. It is a must for the EC and other legislative bodies to be kept free from unhealthy corrupt practices and unhealthy appeals of influence of religion, race, caste, community or language that could have a devastating effect on a country and its Constitution," stated the plea.

"Elections in India are being mutilated under the evil influence of the 'divide and rule policy'&nbsp;through evil influences of caste and religion which has led to communalism of politics which is a major concern for the security of people from the forces within and from forces outside the country. The communalism and caste-based politics has crossed all barriers which can result into an unknown alarmingly dangerous situation."

The Election Commission of India on Friday stated that <a href="https://www.wionews.com/india-news/ec-will-examine-if-pm-modis-address-to-nation-violated-model-code-of-conduct-206148">Prime Minister Narendra Modi's "Mission Shakti" address</a> didn't violate Model Code of Conduct (MCC) as public broadcasters were used.&nbsp;

"Committee has reached to the conclusion that MCC provision regarding misuse of official mass media as contained in Para (IV) of Part VII of MCC isn't attracted in the case," the poll body stated today.&nbsp;

The EC took the decision based on the report of a committee of officers which found that the prime minister did not violate the provision of 'party in power' in the poll code, news agency PTI reported.&nbsp;

Prime Minister Modi addressed the nation after the successful testing of A-SAT missile on Wednesday. After much clamour from the opposition parties, the Election Commission of India directed a Committee of Officers to examine the matter immediately and ascertain if the speech violated the Model Code of Conduct as alleged by the opposition.

India shot down one of its satellites in space on Wednesday with an anti-satellite missile to demonstrate this complex capability, Prime Minister Narendra Modi announced, making it only the fourth country to have used such a weapon.

PM's 'Mission Shakti' address does not violate Model Code of Conduct: Election Commission

Nearly three weeks after the Model Code of Conduct (MCC) came into force, the Election Commission has seized Rs 613.176 crore worth of cash and other material from 29 states and seven Union Territories (UT).

According to the EC`s seizure report dated March 27, liquor worth Rs 104.49 crore has been seized across the country.

Authorities have seized drugs and narcotics worth Rs 145.384 crore, while precious metals worth Rs 170.708 crore have been seized.

Furthermore, the EC seized freebies and other items worth Rs 11.67 crore across the country, as per data provided by the poll body.

EC seized the highest amount of cash in Andhra Pradesh (Rs 62.29 crore), followed by Tamil Nadu (Rs 49.48 crore).&nbsp;

Uttar Pradesh recorded the maximum seizure of liquor (Rs 24.50 crore), followed by Karnataka (Rs 20.45 crore) and Andhra Pradesh (Rs 17.13 crore).

Punjab recorded the maximum seizure of drugs and narcotics (Rs 92.45 crore), followed by Manipur (Rs 23.58 crore) and Uttar Pradesh (Rs 17.04 crore).

Seven phase elections will be held between April 11 and May 19. Results will be declared on May 23.&nbsp;

Lok Sabha polls 2019: Election Commission seizures cross Rs 613 crore

The Election Commission has served notices to five politicians in the state after receiving various complaints against them for allegedly violating the Model Code of Conduct.

Telangana Chief Electoral Officer Rajat Kumar said that notices have been issued to Irrigation Minister T Harish Rao, Congress leader Revanth Reddy, Telugu Desam Party leader Vanteru Pratap Reddy, and his fellow party leader Revuri Prakash Reddy.

"We have also received a complaint against Telangana Pradesh Congress Committee (TPCC) chief Uttam Kumar Reddy for speaking at a religious meeting. We have also sent a notice to him. We have asked them to file their replies," he said.

He further informed that they have also received a complaint against former MLA and Telangana Rashtra Samithi (TRS) candidate Gangula Kamalakar for threatening a BJP leader and added that they are examining the complaints and will take action accordingly.

Telangana CEO said that around 32,796 polling stations have been created for the convenience of the voters. As many as 48,000 police personnel will be deployed on the polling day for security purposes. Apart from the police force, 279 companies of Central Paramilitary Forces (CPMF) will also be deployed for the polls, Rajat Kumar said.Since the Model Code of Conduct was imposed in the state, Rs 90.72 crore including cash and goods has been seized.

He further informed that they have received around 3583 nominations for the assembly polls.

The Assembly elections in the state are scheduled to be held on December 7 to elect members from 119 constituencies. The counting of votes will take place on December 11. The Telangana Assembly was dissolved prematurely in September on the recommendation of the ruling TRS government.

Telangana polls: Notice to 5 politicians for violating poll code

An FIR has been filed against sitting BJP MLA Sanjay Patil by electoral authorities for violating the model code of conduct by exploiting religious sentiments, an official said.

The Model Code of Conduct flying squad for the May 12 assembly polls filed the FIR" on Thursday night, its nodal officer Roogi said.

Patil had violated the model code of conduct by exploiting religious sentiments through his speech, he added.

In a potentially controversial remark, Patil had said that electoral contest in Karnataka was "not about roads and drinking water, but Hindu and Muslim religions".

Patil, Belagavi (Rural) MLA and BJP candidate, is seen making the purported remarks in a video shot in his constituency.

It was not known when the video, which went viral, was shot.

"This election is not about roads, drainage or drinking water. This election is about Hindu and Muslim religions," he told the crowd.

"Keeping a hand on my chest I say loudly, this is Bharat, this is the country of Hindus and this is the country where (Lord) Ram was born. We are prepared to do anything to construct Ram mandir in Ayodhya," Patil purportedly said in the footage.

Patil also told the crowd that the Congress favoured constructing a mosque in Ayodhya instead of a Ram temple.
