The Enforcement Directorate on Thursday told the Supreme Court that custodial interrogation of senior Congress leader <a href="https://www.wionews.com/india-news/inx-media-case-supreme-court-reserves-order-on-chidambarams-anticipatory-bail-plea-for-september-5-extends-interim-protection-from-ed-arrest-246406">P Chidambaram in the INX media case</a> is required as if his plea for anticipatory bail is given it would affect cases involving Vijay Mallya, Mehul Choksi, Nirav Modi and Zakir Naik.

Disputing the contention of Chidambaram's lawyers, the agency also argued that the offence of money laundering is against the society, nation and the economy.

"Money laundering is an offence against society, nation and economy. Economic offences are gravest offences irrespective of quantum of sentence," Solicitor General Tushar Mehta appearing for the probe agency told a Bench of Justice R Banumathi and Justice AS Bopanna.

Countering the arguments of Chidambaram's advocates Kapil Sibal and Abhishek Manu Singhvi that Prevention of Money Laundering Act (PMLA) offences with seven years of punishment is not a grave offence because as per the Code of Criminal Procedure grave offences entail death penalty and life, Mehta said money laundering offences are "grave".

"Chidambaram's counsels have argued that gravity of an offence is subjective. PMLA offences may not be grave for them but the Courts have consistently held that economic offences are grave in nature. Gravity is a relative concept. Quantum of punishment is not relevant. What's important is what will be the impact of your offence in society. Money laundering is an offence against the society, nation and economy. Economic offences are gravest offences irrespective of quantum of sentence," Mehta said.

The top court was hearing Chidambaram's plea against Delhi High Court's order denying anticipatory bail to him in a case being probed by the ED.

Mehta also objected to the proposition made by Chidambaram's counsel Kapil Sibal to confront him with evidence before presenting it in the court, saying it is "absurd" and would have "devastating results" and is "preposterous".

Whether the accused's reply was evasive or not is decided by investigating agency and not by the court, he added.

He said the ED has been investigating various sensitive and high profile cases under PMLA and if Chidambaram's plea is accepted it would affect cases against Vijay Mallya, Mehul Choksi, Neerav Modi, Zakir Naik, Sarada chit fund, terror funding and other cases.

Mehta also contended that if accused at large is confronted with the evidence collected, then the agency will have exposed its evidence and witnesses and it will give a chance to the accused to tamper with evidence and erase the money trail.

"The investigating agency has absolute discretion to what extent to reveal the evidence to the accused. It is best to confront the accused with evidence when he is in custody," Mehta told the court, adding that investigation is an art where the agency brings the accused to divulge details and not a mere question and answer format or an interview.

During the hearing, Mehta said if given an anticipatory bail, Chidambaram may erase the money trail, influence the witnesses and tamper with evidence.

"It's impossible to investigate when he's armed with anticipatory bail. It's ED's right and duty to unearth the truth. It would be difficult for the ED to catch him if he is under a protective umbrella and best way to elicit truth is when an accused is not under a protective umbrella," he said.

He also argued that the top court cannot be created as a regular court of appeal of the orders of the high courts, lower courts, and magistrate courts.

The apex court is "meant to lay down the law", Mehta said during the course of the proceedings in the High Court, a note was filed and it was examined by the Judge, adding that in the judgment it is said twice that the records have been examined to arrive at the conclusion.

"We are showing a document of evidence and they are saying don't show it to court before showing it to me. I want the court to look the material in my possession, including the statement of the accused, I have nothing to hide. I would insist that Court must look into the material available so that there is no iota of doubt about the material is cogent or not," Mehta said while concluding his arguments and added that he has documents in a sealed cover if the top court wanted to see.

In 2017, the Central Bureau of Investigation (CBI) had registered an FIR alleging irregularities in the Foreign Investment Promotion Board (FIPB) clearance was given to INX Media to the tune of Rs 305 crore in 2007 when Chidambaram was the Union finance minister.

A local Antiguan daily, Antigua Observer, reported that PM Gaston&nbsp;Browne is set to revoke Choksi's citizenship. Browne said that his Antigua and Barbuda citizenship will be revoked in short order.

“His citizenship was processed; he got through but the reality is his citizenship will be revoked and he will be repatriated to India; so there is recourse. It’s not a case that we are trying to provide any safe harbour for criminals, for those who are involved in financial crimes,” Browne said.

"I can assure you, after he has exhausted all of his legal options, he will be extradited,” Browne added.&nbsp;

“We have to allow for due process. He has a matter before the court and as we said to the Indian Government, criminals have fundamental rights, too, and Choksi has a right to go to court and defend his position. But I can assure you after he has exhausted all of his legal options, he will be extradited.”

In his statement, PM Browne seems to be sending out a message that his country is not a safe haven for economic offenders.

He said, "It’s not a case that we are trying to provide any safe harbour for criminals, for those who are involved in financial crimes,”

The Antiguan government had told India that "criminals have fundamental rights too and Choksi has a right to go to court and defend his position".

Meanwhile,&nbsp;government sources on Tuesday stated that India waits for Antigua's internal process of revoking Mehul Choksi's citizenship.

External Affairs Minister S Jaishankar said that he has no information on the matter and that he would "not like to comment on it,"&nbsp;news agency ANI reported.

"Only after that extradition process can start separately. India continues to engage with Antigua. MEA yet to hear officially from Antiguan govt about revoking of citizenship," ANI reported quoting government sources.&nbsp;

This comes soon after the&nbsp;Enforcement Directorate (ED) on Saturday informed a Mumbai court that it was willing to provide an air ambulance with medical experts to bring Mehul Choksi from Antigua to India and provide him with all necessary treatment back home.

ED has filed a counter affidavit in a Mumbai court in connection with <a href="https://www.wionews.com/india-news/ready-to-provide-air-ambulance-to-mehul-choksi-to-bring-him-back-to-india-enforcement-directorate-tells-court-229405">Mehul Choksi</a> case in which it stated, "The medical reasons and conditions appear to be facades being erected merely to mislead the court in an obvious attempt to delay the lawful proceedings."

ED filed the counter affidavit following Choksi's recent affidavit in a Mumbai court which he stated that he left the country for medical treatment and did not flee.&nbsp;

Choksi, last week,&nbsp;submitted an affidavit in the High Court of Judicature at Bombay with details of his diseases. Choksi stated that he has left the country for medical treatment and has not fled. He said that he is willing to join the investigation but is unable to travel to India owing to his medical issue. "If the court may deem it fit, it may direct the investigating officer to travel to Antigua," news agency ANI quoted Choksi.&nbsp;

"I am willing to join the investigation but due to my medical issue, I am unable to travel. I undertake to travel to India as soon as I am medically fit to travel," Choksi stated.

"I am currently residing in Antigua and willing to co-operate in the investigation," he added.&nbsp;

Choksi obtained an Antiguan citizenship in January this year. He is co-accused in the multi billion dollar PNB scam along with Nirav Modi.&nbsp;

India continues to pursue Choksi's return with the Government of Antigua through diplomatic and legal channels. &nbsp;New Delhi has already sent an extradition request to the country. Mehul Choksi had surrendered his Indian passport to the High Commission in Guyana in January of 2019.

The development comes days ahead of the G20 summit in Osaka during which PM Modi will strongly raise the issue of economic offenders being &nbsp;provided safe havens.

The law enforcement agency, in its affidavit submitted before a division bench headed by Justice I A Mahanty, said that the submission made by Choksi to the court on his medical conditions appear to be "facades being erected merely to mislead the court in an obvious attempt to delay the lawful proceedings.

"The documentation submitted by the appellant are merely copies. In the absence of the original, both the genesis and veracity of the contents of the documents cannot relied upon by the court," read the ED affidavit.

Seeking dismissal of medical records submitted by Choksi, the ED stated that the intention of Choksi appeared to be suspicious as he "purposefully failed to submit the medical records February 17, 2018, onwards.

"The agency further submitted that Choksi underwent coronary angiography and coronary angioplasty in February 2018 but was allowed to return to work within 3-5 days.

"It is not clear as to what prevents him from undertaking travel after about 8-9 months from the date of undergoing the procedure.

"It further contended that the medical certificates dated October 26, 2018, and January 18, 2019, appears to from general practitioner instead of a cardiac expert.

ED said that no further time should be granted to the appellant to submit any other document at this stage.

"The intention of the appellant is clearly dilatory in the matter," the affidavit read.

The agency also sought dismissal of a plea moved my Choksi against the Special FEOA (Fugitive Economic Offenders Act) special court declaring him a fugitive offender.

In July last year, the ED had filed an application in the Special FEOA (Fugitive Economic Offenders Act) special court to declare Choksi an economic offender.

Soon thereafter, in October, Choksi filed applications seeking for the ED's plea to be dismissed.

The application was, however, dismissed by the special court following which he moved Bombay High Court challenging the order and sought for it to be set aside.

In the affidavit, the ED accused Choksi of "siphoning and laundering the proceeds of crime" generated in the PNB fraud case.

"Summons was issued to him but he has not joined the investigation. He is clearly a fugitive and absconder," ED submitted.

The matter will be taken up for hearing today.

Mehul Choksi and nephew Nirav Modi are key accused in the Punjab National Bank(PNB) fraud case.

They fled the country a year ago. The scam is estimated at two billion US dollars.

"The failure of the applicant's business was termed as 'fraud'&nbsp;by the CBI. The flaws were on the part of the bank and the auditors and not the accused," the plea submitted.

The petitioner claimed that "false" FIRs were filed by the Central Bureau of Investigation (CBI) against him on February 2 and February 15, 2018.

Speaking to ANI, Choksi's counsel Vijay Agarwal said, "We moved an application in the court today contending that no lapses were made on the part of my client. In fact, they were made on the part of Punjab National Bank (PNB) officers and auditors... We explained several lapses to the judge during the hearing, which had been ignored by the investigating officer."

The agency, in its affidavit, sought dismissal of two petitions filed by Choksi&nbsp;one against a plea for him to be declared a fugitive economic offender and the second to permit him to cross-examine those persons on whose statements the ED is relying on to declare Choksi a fugitive economic offender.

The ED, in its affidavit submitted on Monday to a division bench headed by Justice IA Mahanty, said Choksi is accused of siphoning and laundering money to the tune of Rs 6,097 crore in the PNB scam, and despite having issued summons directing him to appear before the agency, he has said he does not intend to cooperate with the probe.

"He is a fugitive and absconder. He has deliberately and intentionally evaded from appearing before the investigating agency even after a special court has issued non-bailable warrants against him. This shows that he does not have any regard for the law of the land," the affidavit said.

"It is apparent that the applicant (Choksi) has left India to avoid criminal prosecution for the offence of money laundering under the provisions of the Prevention of Money Laundering Act and continues to refuse to return to India to face criminal prosecution," it said.

It added that Choksi has already taken citizenship of Antigua which clearly shows that he has no intention of returning to India to cooperate with the probe.

The agency further said that under the Fugitive Economic Offender Act, if the fugitive appears in person before the court then the proceedings can be terminated. However, it said, if the person fails to do so the court can declare him a fugitive economic offender and can confiscate his properties.

"The sole purpose of the Act is to compel the fugitive to return to India and face the proceedings initiated against him," the affidavit said.

The Act was introduced as an effective, expeditious and constitutional way to stop offenders from running away, it added.

The high court will take up the petitions for hearing on Tuesday.

Choksi, in his plea, claimed he was unable to return to India due to persistent health problems.

To this, the ED said it was merely a facade and that Choksi can seek treatment for his health problems in India.

Choksi and his nephew Nirav Modi are wanted by the ED and the CBI for allegedly defrauding the PNB to the tune of Rs 13,400 crore, in collusion with a few of its employees.

The ED had filed an application before a special Prevention of Money Laundering Act court, seeking for Choksi to be declared a "fugitive economic offender" for evading summons to appear before the agency and for his properties be confiscated under the provisions of the Fugitive Economic Offenders Act, 2018.

His bail was rejected last week since the prosecution had pleaded that he may threaten the witnesses. His hearing will again resume on April 26 now.

In February, India revoked his passport and later in August last year, New Delhi sent a couple of extradition requests to the UK - one from the CBI, another from the ED regarding the extradition of the absconder businessman.

While speaking to ANI, Choksi said: "The questionnaire had a total of 32 questions. After tabulating the answers given by 450 people it was found that 25 per cent believed that Modi`s speeches are most appealing while 48 per cent were of the view that Modi`s political marketing is the best."

Choksi, who is also a lawyer, completed his PhD under the guidance of Nilesh Joshi of Arts Department, Veer Narmad South Gujarat University.

Choksi started his PhD when Narendra Modi was the chief minister of Gujarat in 2010. In the initial phase, questions related to Modi's successful leadership were asked and he said he received positive feedback from 51 per cent and negative response from 34.25 per cent. 46.75 per cent of people said to gain popularity, a leader should take decisions that benefit the public.

"81 per cent people think that positive leadership is important to be the prime minister of the country, 31 per cent believe authenticity is necessary and 34 per cent believes that transparency is a must," Choksi said.

On March 11th, the ED&nbsp;had filed a fresh chargesheet against PNB scam accused Nirav Modi under the anti-money laundering law.

The ED had said on March 9 that the United Kingdom's home secretary has recently referred India's request for extraditing the tainted businessman to a court for initiating legal proceedings against him.

The ED&nbsp;had filed the first chargesheet in the&nbsp;case in May last year.

According to British media reports, Nirav Modi is currently living at the landmark Centre Point tower block in London.

The PNB which is the country's second largest state-run bank, had, on February 14 last year, informed the exchanges about detecting the fraud at its Brady House branch in Mumbai, and named the firms led by Modi and his uncle Mehul Choksi's Gitanjali Group, and some other diamond and jewellery merchants as suspects.

Central government agencies - the CBI and the Enforcement Directorate - registered cases on the complaint by the bank and launched nationwide searches on dozens of offices and residences of the alleged fraudsters. The bank named Nirav Modi's brother, his American wife Ami, and uncle Mehul Choksi besides some others in the FIR.

The Interpol had issued a red corner notice(RCN) against Nirav Modi and Mehul Choksi last year.

PNB scam: UK court issues arrest warrant against Nirav Modi; CBI, ED officials to visit London soon

The Enforcement Directorate (ED) has said the government of United Kingdom has sent an extradition request for fugitive diamantaire Nirav Modi to a UK court for further proceeding.

In a tweet, the ED said, &nbsp;"The UK Central Authority of Home Office has confirmed that the extradition request has been sent to the Westminster Magistrate Court for further proceedings."

The Ministry of External Affairs (MEA) had sent two requests - one from the ED and the other from the CBI - to the government of the UK in July 2018.

MEA spokesperson, in his weekly presser, said, "You are aware we had made a request based on information received by ED and CBI. We had made a request for extradition in August last year. The UK is still considering our request for extradition of Nirav Modi".

Britain's leading daily, The Telegraph, had spotted Nirav Modi walking on a London street. In response to all the question posed by the reporter, Nirav Modi responded saying he has no comments.
