After announcing his candidacy for the 2024 US presidential elections on Wednesday, May 17, Florida Governor Ron Desantis signed four bills that ban gender-affirming care for minors, restrict drag shows and discussion of personal pronouns in schools and force people to use certain bathrooms. DeSantis signed the bills on International Day Against Homophobia, Transphobia, and Biphobia.

The debate around LGBTQ+ legislations has become one of the major agendas for DeSantis as he prepares for his run for the presidency.

The signing of the legislation

DeSantis signed the legislation that bans gender-affirming care for minors at the Cambridge Christian School in Tampa in front of a large crowd and promised to make Florida a “citadel of normalcy”. The crowd present welcomed the bill.

He also signed a bill extending the state’s controversial “don’t say gay” law, which will now prohibit any classroom instruction regarding sexual orientation or gender identity through eighth grade.

In his statement, DeSantis pointed out that “It’s kind of sad that we even have some of these discussions, Let Kids Be Kids.” He further added that “We never did this through all of human history until like, what, two weeks ago? They’re having third-graders declare pronouns? We’re not doing the pronoun Olympics in Florida.”

Democrats oppose the LGBTQ+ bill

While DeSantis claims that he is protecting parents’ rights, his opponents have a completely different take on the issue. Democrats believe DeSantis is denying the rights of parents with transgender kids.

Gone are the days when conversations in the US centred around topics like murders, sexual assault, etc. These days, bathrooms, or more specifically bathrooms for transgender people, have become the topic of debate, and the latest state to join this debate is Kansas.

Overriding the state's governor Laura Kelly's veto, the state legislature on Thursday enacted what may be the nation's most sweeping transgender bathroom law.

With this law, Kansas has joined at least eight other states in preventing trans people from using bathrooms associated with their gender identities, as opposed to the gender assigned at birth. The state even went one step ahead, imposing restrictions on locker rooms, prisons, domestic violence shelters and rape crisis centres.

The Kansas law, according to a report in The Guardian, stands out from other states' laws by legally distinguishing between male and female based on the sex designated at birth. It states that "distinctions between the sexes" in bathrooms and other areas serve "the important governmental objectives" of protecting people's "health, safety and privacy."

However, it is still not clear how the new law will be enforced.

The recent legislation in Kansas defines "sex" as the biological gender one is assigned at birth, which can only be male or female. However, it does provide some exemptions for intersex individuals if their condition is recognised as a disability under US law. Additionally, the law establishes clear-cut definitions for males and females based on their reproductive anatomy.

The bathroom wars: How it all started

Before Kansas, North Dakota enacted a law prohibiting transgender children and adults from using restrooms, locker rooms, or shower facilities in state-operated universities and correctional institutions.

North Carolina, in 2016, set the ball rolling by becoming the first US state to pass a bill barring transgender people from using bathrooms consistent with their gender identities.

Today, the following states have such laws: North Carolina, Idaho, Iowa, Alabama, Oklahoma, Tennessee, Arkansas, and Kansas.

Why bathrooms?

The battle, as per Vox, began in Houston, Texas in 2014.

Back then, the Houston Equal Rights Ordinance (HERO) was passed by the city council.

It aimed to prohibit discrimination against individuals based on several characteristics - notably sexual orientation and gender identity - in the workplace, housing, and public places such as restaurants, hotels, and other venues that cater to the public. This local ordinance was created to address a deficiency in the laws of Texas due to which LGBTQ people are typically not covered by state and federal anti-discrimination legislation.

Nevertheless, conservatives ended up utilising it as a means to an end.

What do conservatives have against HERO?

They argued that businesses should be allowed to discriminate against LGBTQ people who go against their religious values.

In 2015, after lengthy legal battles, they even managed to get a referendum on HERO. Results predicted that while 45 per cent of adults in Houston would vote for HERO, 36 per cent would vote against it; the remaining said they were unsure.

But in spite of this, ultimately, HERO got rejected.

How was HERO rejected?

Conservatives used fear-mongering tactics related to bathrooms to sway public opinion against the HERO law, which would have allowed transgender individuals to use bathrooms corresponding to the gender they identify with, rather than assigned at birth. They claimed that if the law passed, men would disguise themselves as transgender women to enter women's bathrooms and sexually assault them.

So, despite initially being popular in polls, the HERO law was rejected by voters in November due to the successful fear tactics employed by ceonservatives.

Since then, bathrooms have become the crude tool conservatives used to ban anti-discrimination measures in different states.

Would a law like HERO actually increase incidents of sexual assault?

In two separate investigations conducted some years ago, Media Matters confirmed with experts and officials in 12 states and 17 school districts with protections for trans people that they had seen no increases in sex crimes after they enacted anti-discrimination policies.

And while incidents of men sneaking into women's bathrooms have happened, they did not happen because of transgender protection laws.

In fact, in 2019, a team of researchers, including those from Harvard, found that "youth whose restroom/locker room use was restricted were more likely to experience sexual assault compared to those without restrictions."

As per research based on survey data of 3,700 American teens aged 13-17, around 36 per cent of transgender or gender-non-conforming students with restricted bathroom or locker room access reported being sexually assaulted in the 12 months period before the study. Among transgender boys, 26.5 per cent experienced sexual assault within the last year, while the percentage was 27.0 per cent for nonbinary youth assigned female at birth. Among transgender girls, the percentage was 18.5 per cent, and for nonbinary youth assigned male at birth, it was 17.6 per cent.

Overall, the scenario around transgender bathroom access remains complex and highly contested and is likely to continue to evolve in the coming years as the debate over LGBTQ rights and discrimination continues.

As India debates whether same-sex marriage should be allowed legally, a child rights activist has come out against the move, and has said that such marriages will infringe upon the rights of the children and would deprive them of "at least one parent."

Talking to IANS, Kumar V Jahgirdar, founder and president of the Child Rights Initiative for Shared Parenting (CRISP) told IANS that "It is natural for any child to have a natural father and mother," and that with the proposed law India is "heading to the creation of a fatherless or motherless society."

He said that in a same-sex marriage, one person will be 'acting' as though they are "a father or mother respectively," but that in fact a child "raised by a same-sex couple is deprived of at least one parent."

He labelled this "a human rights violation that the same-sex marriage movement will never address."

As per Jahgirdar, "this will have a devastating effect on the psychology of the child and is also a violation of child rights as per a UN convention to have two different genders as parents. It is set to become a fashion to speak about LGBTQ rights and nobody is bothered about child rights. The child rights and same sex rights can't go in the same boat."

"I hope the apex court takes this seriously and does not hamper child fundamental rights," he added.

The child rights activist also predicted that "children in same-sex marriage may feel a stigma that may end in drugs or school dropouts or land up in jail as a teenager."

Jahgirdar claimed that the legalisation of same-sex marriages will further add confusion to the Domestic Violence Act that "is meant to protect women against men."

He also said that if the law is passed, rules regarding the custody of the child post-separation or divorce of the parents must be laid out. The custody of children and shared parenting in cases of separation must be ensured, he added.

Gravitas: Indian Government opposes same-sex marriage

The Indian Supreme Court, on Tuesday (April 18) heard arguments on a batch of 15 pleas which have sought the legalisation of same-sex marriage in the country. This comes a day after the Indian government reiterated its opposition to the motion calling the petitions an “urban elitist concept far removed from social ethos of the country”.

The five-judge bench

The five-judge Constitution Bench, headed by Chief Justice of India (CJI) DY Chandrachud also comprised Justices S K Kaul, S R Bhat, Hima Kohli and P S Narasimha. During the hearing, the CJI said there is no such thing as an “absolute” concept of biological man and woman adding that “it’s not just a question of what your genitals are.”

The CJI has called the marriage issue one of “seminal importance”. The apex court on November 25 last year had sought the Centre’s response to separate pleas moved by two gay couples seeking enforcement of their right to marry and a direction to the authorities concerned to register their marriages under the Special Marriage Act.

However, the CJI had earlier said that the mandatory 30-day notice of a couple’s intention to marry under the previously mentioned act is “unconstitutional”. He stated, “Even in a heterosexual marriage, that you have to give notice and have people object to whether there should be a marriage or not is unconstitutional.”

Petitioners’ argument

Senior Advocate Mukul Rohatgi who presented the arguments from the petitioners said that those in same-sex relationships should also have equal rights similar to their heterosexual brethren.

Subsequently, referring to the 2018 ruling which struck down section 377 and decriminalised homosexuality, Rohtagi argued that the LGBTQ should also have the right to dignity and to the institution of marriage and family which is available to others.

He has also sought the provisions under the Special Marriage Act to read marriage between “spouse” instead of “man and woman”. Additionally, Senior Advocate Menaka Guruswamy, also arguing for the petitioners said that it is not only “a question of dignity but a bouquet of rights that LGBTQ people are being denied…like life insurance or medical insurance.”

This comes as the CJI asked the lawyers to steer clear of the personal laws as the court would focus on if the right can be conferred under The Special Marriage Act (SMA), 1954 as they have ‘broadly understood matter’.

The Indian government’s stance

Prior to the hearing, the government, on Monday, said that a court order recognising same-sex marriages would be virtually rewriting an entire branch of law. It has also argued how the court must refrain from passing such “omnibus orders”. Solicitor General Tushar Mehta, appearing for the government, reiterates its stance that the judiciary has no authority on the matter.

“This would be better if gone into by the parliament. The parliament has eminent parliamentarians. Parliamentary committees are not acting in the way we see parliament function. Committees have all parties as members,” said Mehta.

The CJI’s remarks about the notion of a biological woman or man not being absolute were also in response to Mehta’s statement when he said, “Societal acceptance of any relationship is never dependent on either the legislation or judgement. The legislative intent of the legislature throughout has been a relationship between a biological man and a biological female.”

The next hearing

The apex court will continue to hear petitioners on Wednesday and Thursday while the Indian government will present their arguments next week.

Additionally, Senior Advocate Menaka Guruswamy, also arguing for the petitioners said that it is not only “a question of dignity but a bouquet of rights that LGBTQ people are being denied…like life insurance or medical insurance.” This comes as the CJI asked the lawyers to steer clear of the personal laws as the court would focus on if the right can be conferred under The Special Marriage Act (SMA), 1954 as they have ‘broadly understood matter’. The Indian government’s stance Prior to the hearing, the government, on Monday, said that a court order recognising same-sex marriages would be virtually rewriting an entire branch of law. It has also argued how the court must refrain from passing such “omnibus orders”. Solicitor General Tushar Mehta, appearing for the government, reiterates its stance that the judiciary has no authority on the matter. The CJI’s remarks about the notion of a biological woman or man not being absolute were also in response to Mehta’s statement when he said, “Societal acceptance of any relationship is never dependent on either the legislation or judgement. The legislative intent of the legislature throughout has been a relationship between a biological man and a biological female.” The next hearing The apex court will continue to hear petitioners on Wednesday and Thursday while the Indian government will present their arguments next week. India’s apex court heard arguments on same-sex marriage legalisation. Here’s what happened

This week Hungarian lawmakers passed a bill that will allow citizens anonymously to report on same-sex couples who raise children. This comes as Prime Minister Viktor Orban's government has been curbing the rights of the country's LGBTQ community in adopting kids.

Under this approved bill, people are allowed to contest the "institutionally recognised role of marriage and the family" and those who contest children's rights "to an identity appropiate to their sex at birth."

Hungary: Lawmakers pass new law allowing locals to report anonymously on same-sex couples

Last week, Russian authorities arrested a Chinese LGBTQ blogger, for allegedly violating the country’s law which bans the so-called gay “propaganda,” said their lawyer, Adel Khaydarshin. According to media reports, Chinese citizen Haoyang Xu and his partner Gela Gogishvili, a Russian citizen, document their life as a same-sex couple living in Russia on social media platforms like TikTok, YouTube and Telegram.

Khaydarshin has since told CNN that after a hearing on Thursday, Haoyang was found guilty and is now being held in a temporary detention centre for foreigners and faces deportation from Russia. Whereas, his partner who was also charged in connection with the law faces fines of up to 200,000 Rubles ($2,463) but has not been arrested yet, said the couple’s lawyer.

Citing court documents, the media report said that Haoyang was arrested for allegedly posting videos depicting “non-traditional sexual relations” with Gogishvili. It added, “Namely, being males, they kiss each other, hug, touch each other on various parts of the body, including in the genital area, while the description of the videos contains the following, How does a gay couple sleep? Kiss me all night.”

Khaydarshin has also told CNN that the Chinese national has not been deported yet and will be given the chance to appeal the court’s decision. An image and video of Haoyang’s arrest were also posted on the couple’s Telegram account.

The law in question came into effect months ago after a bill expanding the existing ban on so-called LGBTQ “propaganda” in Russia was signed by Russian President Vladimir Putin. The recently amended law was first adopted in 2013 and also banned the dissemination of LGBTQ-related information to minors.

The footage was found by the police during an inspection of the couple’s YouTube account, said the court documents, adding that nearly 1,800 of the account’s 64,900 subscribers were under 18 years of age, reported CNN. However, these claims could not be independently verified.

In 2022, the country’s upper house of parliament unanimously voted to make the controversial law more stringent as it now applies to Russians of all ages. Additionally, in the same year, the government also made it illegal for anyone to promote same-sex relationships or suggest that non-heterosexual orientations are “normal,” reported CNN.

In what comes as a major setback for the LGBTQ+ community and their rights, the Republican states of Indiana and Idaho in the United States have approved legislation banning all types of gender-affirming healthcare for minors — meaning they will not be able to transition from their assigned gender at birth.

In what comes as a major setback for the LGBTQ+ community and their rights, the Republican states of Indiana and Idaho in the United States have approved legislation banning all types of gender-affirming healthcare for minors — meaning they will not be able to transition from their assigned gender at birth. Eric Holcomb, the Idaho governor signed the bill on Wednesday prohibiting transgender youth from seeking medication or surgeries that help in the transition process. Additionally, the bill mandates those taking medication for transition stop doing so by the end of the year. Notably, the legislation in the northwestern state will come into effect from July 1 and doctors providing gender-affirming care would be disciplined by a licensing board, per an Associated Press report. “Permanent gender-changing surgeries with lifelong impacts and medically prescribed preparation for such a transition should occur as an adult, not as a minor,” said Holcomb. WATCH | Transgender rights activists clash with Neo-Nazi's in Melbourne × Assisting transition a felony crime Meanwhile, Idaho Governor Brad Little signed the legislation on Tuesday which criminalised gender-affirming care for youth. The law kicks into effect from January next year and doctors who are caught providing hormones, puberty blockers or other gender-affirming care to minors would be charged with a felony crime. “In signing this bill, I recognise our society plays a role in protecting minors from surgeries or treatments that can irreversibly damage their healthy bodies,” said Little before adding, “However, as policymakers, we should take great caution whenever we consider allowing the government to interfere with loving parents and their decisions about what is best for their children.” ALSO READ | This US state has approved construction of monument dedicated to aborted fetuses Naysayers and supporters argue the legislation The naysayers of the move say that banning healthcare facilities is an impediment for the trans community kids who might require vital and often life-saving care. They added that most procedures available to trans kids are reversible and safe. Indiana American Civil Liberties Union filed a lawsuit, immediately after the passing of the legislation saying it was a violation of individuals' constitutional rights which guarantees equal protection regarding medical services. Meanwhile, the supporters of the legislation argue that such procedures are harmful and carry lifelong repercussions and that only an adult should take the decisions - not the minor or their parents. Uganda passes most extreme anti-LGBTQ laws, US fumes

Uganda Anti-Gay Bill: People who identify as gay in Uganda risk life in prison after Parliament passed a new bill to crack down on Homosexual activities. It also includes the death penalty in certain cases. That move has drawn various reactions. White House warned members of Uganda’s parliament that sanctions restricting them from doing business with the US could be on the way for those responsible for the passage of the law. The United Nations has termed it a deeply troubling development. WION's Eric Njoka speaks to Roland Ebole, who is a Uganda & Tanzania researcher for amnesty international that has also condemned the passage of the bill.

Uganda anti-gay bill sparks intense friction and global backlash

Uganda's Parliament passes an anti-LGBTQ bill. It awaits the President's approval. The bill includes harsh punishments like life imprisonment and death sentences. The bill is being criticized worldwide. 30 (including Uganda) out of 54 countries of Africa already consider being gay a crime. Human Right activists are highly criticizing the bill.

The elites in Africa, which include political, religious, and community leaders, often claim that homosexual practices are an imported western evil. So why is Africa such a difficult place for the LGBTQ+ community? Scholars say it is because of colonial laws and religious morality. This week we spotlight this sensitive societal topic that has been making headlines recently.

The Canadian government on Tuesday (March 7) expunged the historic indecency and anti-abortion laws targeting women and members of the LGBTQ community. The repealed laws had targeted women and LGBTQ individuals' access to abortion as well as to bathhouses, nightclubs, and swinger clubs, considered to be safe spaces for the queer communities.

In a statement published in Cision, Canada's Minister for Public Safety Marco Mendicino said on Tuesday, "Today's additions of abortion-related, bawdy house and indecency-based offences to the Expungement of Historically Unjust Convictions Act (which came into effect in 2018) represent yet another important and necessary step towards righting historical and systemic discrimination faced by many Canadians."

On the other hand, the country's Women and Gender Equality and Youth Minister Marci Ien said that citizens deserved non-discriminatory policies that put their safety first, which is why the government "recognises that past laws and regulations were unjust and compromised the freedoms of 2SLGBTQI+ communities and women."

"This is another crucial step in achieving the goals set out in the Federal 2SLGBTQI+ Action Plan – by continuing to promote human rights and encourage the development of inclusive federal policies, programs, and laws," Ien added.

By repealing these laws, people with previous convictions can apply for an expungement order for free under the Expungement of Historically Unjust Convictions Act, which allows for the permanent destruction of historically unjust records of conviction, the news agency Reuters reported on Tuesday.

There is no fee to apply for an expungement order. Applicants would be needed o provide evidence that the conviction meets certain criteria. "Given the historical nature of the offences, sworn statements/solemn declarations may be accepted as evidence if applicants have demonstrated that court and police records are not available," the above statement read.

On January 1, new textbooks were rolled out by the Bangladesh government for millions of schoolchildren between the age of 11 and 13 featuring a segment on transgenders.

The textbook contains images of transgenders in respectable jobs, including a beautician, a development worker and an elected mayor. The book narrates a fictional story of a child who transitions, takes a female name and goes to live with a transgender community.

The government recognised transgenders as a third gender in 2013, but they remain marginalised in a country where sexual activity between people of the same sex is illegal. Many transgenders live in poverty and have no opportunity for a proper education, much less a job. Many are forced to beg or engage in sex work to survive.

The creators of the book hope it will help nurture acceptance.

Muhammad Moshiuzzaman, a member of the National Curriculum and Textbook Board, said, “We have piloted it in very small areas, and we got a very positive result, response from our students, because it was a completely unknown matter to them. It is new knowledge for them and they accepted it very well.”

“We came to know about them by learning from the book, we think we should help them with their progress," said Fatiah Alam, 12, a student at Gomail High school on the outskirts of the capital Dhaka, one of the schools that uses the new textbook.

According to officials, there are about 10,000 'hijras' (transgenders) in Bangladesh but rights groups say the figure could be as high as 1.5 million in the country of 170 million people.

The textbook has not been welcomed by everyone. A large crowd of conservative Muslims angered by the inclusion of hijras recently held a protest at Dhaka’s main mosque calling for the textbook to be recalled.

Nevertheless, the transgender community and their supporters are hopeful that the textbooks will spread awareness and in turn help improve their status in society.

"If our story catches people's attention and they keep our suffering in mind, that will be good for us. Those who learn more about us will hopefully understand and then work towards our development in the future," transgender community leader Jonak told Reuters at her office in Dhaka.

For the first time, a South Korean high court has given legal recognition to same-sex couples. On Tuesday, the Seoul High Court ruled that the state's health insurer should provide spousal coverage to same-sex couples. Lawyers and advocates have hailed the ruling as the first legal recognition of same-sex unions in the country. This historic ruling overturns a decision by a lower court which had ruled that a same-sex dependent was ineligible for National Health Insurance Service benefits available to other couples. The couple behind this judgement also expressed their happiness with the ruling and said they were "delighted".

"It is not only our victory but also a victory for many same-sex couples and LGBTQ families in Korea," they said.

However, the national health insurer said that it will file an appeal with the nation's Supreme Court.

The couple, So Sung-wook and Kim Yong-min had been embroiled in a legal battle with the National Health Insurance Service since 2021. They had filed a suit against the insurer after being denied spousal benefits.

An earlier decision by a lower court had ruled in favour of the insurer. The ruling, as per Reuters, was taken on the grounds that a same-sex union cannot be considered a common law marriage under common law. Yong-min and Sung-wook then contested this ruling.

As per their lawyer, Ryu Min-hee, the appellate court in its ruling said that the spousal coverage system under the state health insurance system isn't just for families as defined by the law.

The court also said that denying rights to same-sex relationships was discrimination and that protecting the rights of minorities is the "biggest responsibility" of the court as the "last bastion" of human rights.

Boram Jang, an Amnesty International researcher, said that the ruling "is an important decision that moves South Korea closer to achieving marriage equality." As per him, it goes a long way to offer hope that the prejudice against the LGBTQI+ community can be overcome.

South Korea moves one step closer to legitimising same-sex couples

Malaysian activists on Thursday criticised the government's decision of banning three books for allegedly promoting the "LGBTQ lifestyle," saying that this step would further damage gay and transgender rights. The Malaysian home ministry in its statement released on Tuesday said that "Jacob's Room to Choose," a children's book about gender expression was banned in January. Two other children's books, "The Tale of Steven," and the Malay-language title, "Aku" were also banned, AFP reported.

Justifying its measure, the ministry said that its objective was to "prevent the spread of elements that are harmful to morality in the community."
