In a big win for India, the International Court of Justice (ICJ) on Wednesday gave consular access to Kulbhushan Jadhav, who was arrested and given death sentence by Pakistan on charges of espionage.

Upholding India's stand that Pakistan has violated the 1963 Vienna Convention, the ICJ said that Jadhav's trial by a military court in Pakistan is not accepted thereby stopping his execution.

The death sentence by a Pakistani military court was questioned by India, which said its based on an "extracted confession".&nbsp;

Jadhav, a former Indian navy commander, was arrested in Pakistan in March 2016 and convicted of spying.

Will continue to work vigorously for Jadhav's early release and return to India: MEA's Raveesh Kumar

International Court of Justice will deliver on Wednesday its much-awaited verdict in the case of Kulbhushan Jadhav, who was captured by Pakistani security forces and sentenced to death in 2017 on charges of spying for India.&nbsp;

Jadhav, an Indian national, has been sentenced to death by a Pakistani military court on alleged charges of espionage and terrorism.

India has repeatedly sought consular access to Jadhav since March 2016, when the High Commission of India in Islamabad was first informed of his custody with Pakistan authorities.In a statement in the Rajya Sabha on April 11, 2017, then External Affairs Minister Sushma Swaraj had reiterated that "Kulbhushan Jadhav has been awarded a death sentence by a Pakistani military court-martial on concocted charges, I repeat on concocted charges."

"To make matters even more absurd, three hours after the death sentence was announced the Indian High Commission received an official communication from the Foreign Ministry of Pakistan reiterating the Pakistani proposal for conditional consular access. That tells us a lot about the farcical nature of the alleged proceedings which have led to an indefensible verdict against an innocent kidnapped Indian," Swaraj had informed the Upper House of Parliament.

"Our position on this matter is clear. There is no evidence of wrongdoing by Jadhav. If anything, he is the victim of a plan that seeks to cast aspersions on India to deflect international attention from Pakistan's well-known record of sponsoring and supporting terrorism. Under these circumstances, we have no choice but to regard the sentence, if carried out, as an act of premeditated murder," she had further said in the statement.

The verdict is likely to be read out by President of the ICJ Judge Abdulqawi Ahmed Yusuf at around 6:30 pm (IST) at the Peace Palace in The Hague.

According to media reports, the Indian side is expected to be represented by Joint Secretary (Pakistan, Afghanistan, and Iran) Deepak Mittal and officials from the Legal and Treaties Division of the Ministry of External Affairs (MEA).

Pakistan's legal team, headed by Attorney General for Pakistan Anwar Mansoor Khan has reached The Hague in the Netherlands, where the ICJ is headquartered.&nbsp;

The team also included Foreign Office Spokesperson Muhammad Faisal.Jadhav, a 49-year-old former Naval officer, was sentenced to death by a Pakistani military court on April 11, 2017, on alleged charges of espionage and terrorism.&nbsp;

Following this, India had approached the ICJ against Pakistan "for egregious violations of the Vienna Convention on Consular Relations, 1963" in the matter.India has contended that it had not been informed of Jadhav's detention until long after his arrest and that Pakistan had failed to inform the accused of his rights.India further alleged that in violation of the Vienna Convention the authorities of Pakistan had denied India its right of consular access to Jadhav, despite repeated requests.

Subsequently, on May 18, 2017, a 10-member bench of the ICJ restrained Pakistan from executing Jadhav till the adjudication of the case.In February this year, the ICJ rejected five pleas made by Pakistan during the hearing of Jadhav's case, including the playing of so-called "confessional statement" of the Indian national and a request to adjourn the hearing citing illness of its ad-hoc judge.

The four-day hearing in Jadhav's case started on February 18 at the ICJ headquarters in The Hague.Pakistan had further urged the ICJ to dismiss India`s plea for relief for Jadhav.

Sushma Swaraj welcomes ICJ's verdict in Kulbhushan Jadhav case; thanks PM Modi, Harish Salve

The International Court of Justice (ICJ) ruling in favour of India in the Kulbhushan Jadhav case is a big diplomatic victory. Pakistan, held to have acted in violation of the Vienna Convention, has been asked to grant consular access to Jadhav. Pakistan is now also under obligation to provide effective review and reconsideration of the conviction and (death) sentence of Jadhav. That means the death sentence to Jadhav cannot be carried out. That's about the crux of the judgement.

Looking beyond the diplomatic and legal victory, what is most obvious are the worries in the aftermath of the ICJ verdict. One, Jadhav's trial will continue in Pakistan. Two, the trial will continue in the military court as the status of such a court is the same as that of a civilian court. Three, Jadhav, even with the comfort of consular access, could continue to languish indefinitely in prison. Four, in prison, Jadhav would be in danger of being killed by one or more of the criminal inmates. Five, in effect, the guarantee against judicial execution is no guarantee of the right to life as long as Jadhav is in a Pakistani prison.

The worries arising from the victory for India are both a challenge and opportunity for Pakistani Prime Minister Imran Khan. The challenge is to rise to the needs of the situation, which require Khan to grasp the nettle and assert that he can break out of the military-dictated mould by rising to political and diplomatic statesmanship.

He would win not just India's appreciation but near-universal acclaim and applause should he dare where the generals fear to tread and order the unconditional release of Jadhav. In doing so, he would be stealing the Pakistani army's thunder but also that of the ICJ, which has not gone beyond the established precedent of consular access.

In hearings before the 15-judge panel earlier this year, India had demanded full consular access to Jadhav and argued that the ICJ should annul the decision of Pakistan's military court.

While Pakistan sent a 13-member team to the ICJ for today's verdict, India was represented by Joint Secretary Deepak Mittal and officers from the Legals and Treaties Division of the Ministry of External Affairs.

The death sentence, given by a military court in Pakistan, had evoked sharp reactions in India.

India filed a claim against Pakistan before the ICJ in May 2017 arguing Islamabad had breached the 1963 Vienna Convention by not allowing diplomatic assistance to Jadhav during his secretive trial. Harish Salve, who was representing India in the case, questioned the functioning of Pakistan's notorious military courts and urged the top UN court to annul Jadhav's death sentence, which is based on an "extracted confession".

Big win for India: ICJ grants consular access to Kulbhushan Jadhav

The International Court of Justice (ICJ) order in the <a href="https://www.wionews.com/india-news/big-win-for-india-icj-grants-consular-access-to-kulbhushan-jadhav-236703">Kulbhushan Jadhav case</a> came as a huge relief for India. The order has many points in favour of India but concerns remain about Jadhav’s security and life in Pakistan.

There are some areas of worry too. First, let us take a look at victories for India.

The biggest victory for India is the fact that Jadhav's death sentence remains suspended. <a href="https://www.wionews.com/india-news/full-text-of-icj-order-in-kulbhushan-jadhav-case-236712">The court</a>, in its ruling by 15-1, declared "a continued stay of execution" on Jadhav, saying it "constitutes an indispensable condition for the effective review and reconsideration of the conviction and sentence" of the accused. The court had in May 2017 ordered a stay on Jadhav's execution till the final verdict in the case after India approached it against the Pakistani military court's award of death sentence in an opaque trial.

<a href="https://www.wionews.com/india-news/it-is-no-doubt-a-big-victory-for-india-rajnath-singh-on-icj-verdict-236718">India's stand vindicated by ICJ</a>: India had contended that by not allowing consular access to Jadhav, Pakistan has violated the 1963 Vienna Convention. The ICJ accepted India's stand and and agreed to entertain its plea. "The Court is of the view that Pakistan is under an obligation to cease those acts and to comply fully with its obligations under Article 36 of the Vienna Convention. Consequently, Pakistan must inform Mr. Jadhav without further delay of his rights under Article 36, paragraph 1 (b), and allow Indian consular officers to have access to him and to arrange for his legal representation," the ICJ said on Wednesday.

Pakistan asked to carry out effective review of the death sentence given to Jadhav: "The Court further finds that the appropriate reparation in this case consists in the obligation of the Islamic Republic of Pakistan to provide, by the means of its own choosing, effective review and reconsideration of the conviction and sentence of Jadhav, so as to ensure that full weight is given to the effect of the violation of the rights set forth in Article 36 of the Convention," the ICJ said in its order today.

Moreover, the entire judicial process of Pakistan was found inadequate in the case. The ICJ rejected the objections put forward by Pakistan to the admissibility of India's application. "The ICJ has ruled in favour of India on merits, affirming Jadhav's right to consular access and notification," Reema Omer, international legal advisor, South Asia, of the ICJ said on Twitter.

Lastly, India can again raise the matter with the court, if review by Pakistan is considered not to be effective.

But there are issues which do worry the Indian government:

Effective review of the case has been left to Pakistan to do by means of its own choosing. "Appropriate remedy is effective review and reconsideration of conviction&nbsp; and sentence of Mr. Jadhav - full weight to be given to the effect of violation of rights set forth in Article 36 - choice&nbsp; of&nbsp; means&nbsp; left&nbsp; to&nbsp; Pakistan - Pakistan to take all measures to provide for effective review and reconsideration, including, if necessary, by enacting appropriate legislation - continued stay of execution constitutes condition for effective review and&nbsp; reconsideration of conviction and sentence of Mr. Jadhav," the court said in its order.

Since courts in Pakistan are open to manipulation by the army, how much effective the review really be is anybody's guess.

Kulbhushan Jadhav's release has not been ordered: "With regard to India's contention that it is entitled to restitutio in integrum and its request to annul the decision of the military court and to restrain Pakistan from giving effect to the sentence or conviction, and its further request to direct Pakistan to take steps to annul the decision of&nbsp; the&nbsp; military&nbsp; court, to release Mr. Jadhav and to facilitate his safe passage to India, the Court reiterates that it is not the conviction&nbsp; and sentence of Mr. Jadhav which are to be regarded as a violation of Article 36 of the Vienna Convention. The Court also recalls that "[i]t is not to be presumed... that partial or total annulment of conviction or sentence provides the necessary and sole remedy" in cases of violations of Article 36 of the Vienna Convention. Thus, the Court finds that these submissions made by India cannot be upheld," the court said in its 42-page order.

What this means, worryingly, is that Jadhav remains vulnerable like Sarabjit who was killed inside the Kot Lakhpat prison.

And finally, the ICJ has also not asked assurance from Pakistan that no harm should come in the way of Kulbhushan Jadhav.

The International Court of Justice (ICJ) order in the Kulbhushan Jadhav case came as a huge relief for India. The order has many points in favour of India but concerns remain about Jadhav’s security and life in Pakistan.

ICJ verdict in Kulbhushan Jadhav case: Victories and worries for India

The International Court of Justice (ICJ) on Wednesday accepted India's plea to give consular access to Kulbhushan Jadhav and agreed that Pakistan indeed violated the provisions of 1963 Vienna Convention.

Here are the excerpts from the ICJ order accepting India's plea of granting consular access to Kulbhushan Jadhav:

"The Court concludes that Pakistan's objection based on the said doctrine must be rejected.
&nbsp;
To conclude, the Court finds that Pakistan is under an obligation to provide, by means of its own choosing, effective review and reconsideration of the conviction and sentence of Mr. Jadhav, so as to ensure that full weight is given to the effect of the violation of the rights set forth in Article 36 of the Vienna Convention, taking account of paragraphs 139, 145 and 146 of this judgement.

Unanimously: Finds that it has jurisdiction, on the basis of Article I of the Optional Protocol concerning the Compulsory Settlement of Disputes to the Vienna Convention on Consular Relations of 24 April 1963, to entertain the Application filed by the Republic of India on 8 May 2017;

By 15 votes to one: Rejects the objections by the Islamic Republic of Pakistan to the admissibility of the Application of the Republic of India and finds that the Application of the Republic of India is admissible;

Finds that, by not informing Mr. Kulbhushan Sudhir Jadhav without delay of his rights under Article 36, paragraph 1 (b), of the Vienna Convention on Consular Relations, the Islamic Republic of Pakistan breached the obligations incumbent upon it under that provision;

Finds that, by not notifying the appropriate consular post of the Republic of India in the Islamic Republic of Pakistan without delay of the detention of Mr. Kulbhushan Sudhir Jadhav and thereby depriving the Republic of India of the right to render the assistance provided for by the Vienna Convention to the individual concerned, the Islamic Republic of Pakistan breached the obligations incumbent upon it under Article 36, paragraph 1 (b), of the Vienna Convention on Consular Relations;

Finds that the Islamic Republic of Pakistan deprived the Republic of India of the right to communicate with and have access to Mr. Kulbhushan Sudhir Jadhav, to visit him in detention and to arrange for his legal representation, and thereby breached the obligations incumbent upon it under Article 36, paragraph 1 (a) and (c), of the Vienna Convention on Consular Relations;

Finds that the appropriate reparation in this case consists in the obligation of the Islamic Republic of Pakistan to provide, by the means of its own choosing, effective review and reconsideration of the conviction and sentence of Mr. Kulbhushan Sudhir Jadhav, so as to ensure that full weight is given to the effect of the violation of the rights set forth in Article 36 of the Convention, taking account of paragraphs 139, 145 and 146 of this Judgment;

Declares that a continued stay of execution constitutes an indispensable condition for the effective review and reconsideration of the conviction and sentence of Mr. Kulbhushan Sudhir Jadhav."

The International Court of Justice (ICJ) is set to rule on Wednesday in a <a href="https://www.wionews.com/world/live-kulbhushan-jadhav-case-verdict-today-at-international-court-of-justice-236670">case relating to Indian national Kulbhushan Jadhav</a>, whose death sentence by a Pakistani court based on an "extracted confession" has been questioned by India.

In hearings before the 15-judge panel earlier this year, India argued that the <a href="https://www.wionews.com/photos/kulbhushan-jadhav-case-what-is-the-international-court-of-justice-and-how-does-it-work-236692">ICJ </a>should annul the decision of Pakistan's military court and order the release of <a href="https://www.wionews.com/india-news/kulbhushan-jadhav-a-profile-236673">Kulbhushan Jadhav</a>, a former Indian navy commander who was arrested in Pakistan in March 2016 and convicted of spying. Even if Jadhav is not released, says India, he should at least be given a trial beforw a civilian court.

India has also said that it should be given the right to arrange for Jadhav's legal representation and demanded full consular access.

"All eyes are set on today's verdict. Pakistan will be left exposed this time around as they have no accountability for justice. Kulbhushan is innocent and today we are hoping Indian diplomacy will finally bring good news for us and family of Jadhav," his friend Arvind Singh told WION ahead of the crucial verdict.

While Pakistan has sent a 13-member team to the ICJ for today's verdict, India is being represented by Joint Secretary Deepak Mittal and officers from the Legals and Treaties Division of the Ministry of Expertan Affairs.

India won an injunction that ordered Jadhav's execution stayed while the court looked into the case.

Pakistan said that India was trying to use the court intended to resolve international disputes as a criminal appeals court. They also said the relief sought by India was disproportionate even if the treaty were violated, and at most Jadhav's case could be reviewed.

The ICJ is the United Nation's highest court, and its decisions are binding - though it has no power to enforce them and they have been ignored in rare instances.

All eyes on ICJ ahead of crucial verdict in Kulbhushan Jadhav case

The International Court of Justice (ICJ) will deliver its verdict in the <a href="https://www.wionews.com/india-news/kulbhushan-jadhav-case-international-court-of-justice-to-deliver-verdict-today-at-630-pm-236541">Kulbhushan Jadhav case</a> on Wednesday evening. Jadhav has been imprisoned in Pakistan since his arrest in 2016.

Forty-nine-year-old Jadhav is a retired Indian Navy officer and belongs to Maharashtra. He joined the navy in 1991.

Jadhav belongs to the family of police officers and had set up a business of operating ferries from the Iranian port of Bandar Abbas. He was arrested by Pakistan in 2016 on suspicion of espionage, but India says he was kidnapped from Iran.

But a Pakistani military court went ahead and <a href="https://www.wionews.com/india-news/ahead-of-icj-verdict-a-look-at-how-pakistan-violated-international-law-in-kulbhushan-jadhav-case-236581">sentenced him to death</a> on charges of "espionage and terrorism" after a closed trial in April 2017. Jadhav's sentencing evoked a sharp reaction in India.

Pakistan even rejected India's plea for consular access to Jadhav at the ICJ. However, it facilitated a meeting of Jadhav with his mother and wife in Islamabad on December 25, 2017.

A bench of the ICJ, which was set up after World War II to resolve international disputes, on May 18, 2017 had restrained Pakistan from executing Jadhav till adjudication of the case.

During the hearing in ICJ, both India and Pakistan submitted their detailed pleas and responses.

India based its case on two broad issues - breach of Vienna Convention on consular access and the process of resolution.

Kulbhushan Jadhav case: Will not prejudge verdict, says Pakistan foreign office

The International court of justice (ICJ) based in The Hague, Netherlands will announce its final decision on India Vs Pakistan Kulbhushan Jadhav case on July 17 at 6.30 pm.

The ICJ in a release said, "A public sitting will take place at 3 pm at the Peace Palace in The Hague, during which Judge Abdulqawi Ahmed Yusuf, President of the Court, will read the Court’s decision."

Both Indian and Pakistani government have been informed about the date by the ICJ.

The final oral hearing in the case took place from February 18 to 21, 2019 at the international court during which both India and Pakistan presented their arguments.

Kulbhushan Jadhav is an Indian national who was abducted by Pakistani spy agency Inter-Services Intelligence (ISI) from Iran and later a Pakistani military court awarded death sentence to him on alleged espionage charges.

India has been demanding consular access to Jadhav since March 25, 2016, when the High Commission of India in Islamabad was first informed about his custody with the Pakistan authorities.&nbsp;

Islamabad has so far refused to provide consular access to Jadhav. India went to the world court on May 8, 2017, and filed a case against Pakistan for “for egregious violations of the Vienna Convention on Consular Relations, 1963” and got a stay on his hanging.

On May 18, 2017, the ICJ delivered its order asking Pakistan not to go ahead with his execution.

The ICJ order said, "Pakistan shall take all measures at its disposal to ensure that Jadhav is not executed pending the final decision in these proceedings and shall inform the Court of all the measures taken in implementation of the present order."&nbsp;

India, in its application, has asked the ICJ for suspending Jadhav's death sentence.&nbsp;

On December 25, 2017, Pakistan allowed Kulbhushan's mother and wife to meet him in Islamabad, an event that became a media circus after Pakistani Foreign Ministry officials removed the footwear and 'mangalsutra' of Kulbhushan's wife.

The International court of justice (ICJ) based in The Hague, Netherlands will announce its final decision on India Vs Pakistan Kulbhushan Jadhav case on July 17 at 6.30 pm. The ICJ in a release said, "A public sitting will take place at 3 pm at the Peace Palace in The Hague, during which Judge Abdulqawi Ahmed Yusuf, President of the Court, will read the Court’s decision." Both Indian and Pakistani government have been informed about the date by the ICJ. India has been demanding consular access to Jadhav since March 25, 2016, when the High Commission of India in Islamabad was first informed about his custody with the Pakistan authorities. The ICJ order said, "Pakistan shall take all measures at its disposal to ensure that Jadhav is not executed pending the final decision in these proceedings and shall inform the Court of all the measures taken in implementation of the present order." India, in its application, has asked the ICJ for suspending Jadhav's death sentence. On December 25, 2017, Pakistan allowed Kulbhushan's mother and wife to meet him in Islamabad, an event that became a media circus after Pakistani Foreign Ministry officials removed the footwear and 'mangalsutra' of Kulbhushan's wife. Final decision by International court of justice on Kulbhushan Jadhav later this month

India has asked Pakistan to provide consular access Kulbhushan Jadhav, an Indian national abducted by Pakistani spy agencies from Iran in a Note Verbale sent to Pakistani high commission sent on Tuesday.&nbsp;

India had gone to the International court of justice (ICJ) regarding the sentence announced by the Pakistan military court and got a stay. The ICJ will be announcing the final verdict in the case very soon after the oral hearing in February by both sides in The Hague where the world court is located.

India has demanded consular for not only Jadhav but 4 other Indian prisoners — Mohammad Javaid, Abdul Hakeem, Muhammad Ismail, Salfikar Ali languishing in Pakistani jails.&nbsp;

The note verbale on the release and repatriation of Indian prisoners and fishermen in Pakistan calls for release of 10 Indian civil prisoners lodged in Pakistani jails since they have already completed their sentence. New Delhi has also confirmed Identity of 5 prisoners lodged in Pakistan jails to be Indians and called for there early release as well.

503 Indian fishermen are believed to be in Pakistan’s custody of which Pakistan has acknowledged the custody of 483 fishermen who are Indian or believed-to-be-Indian in their jails. Since 2014, the Indian Government has been able to secure the release of 1749 Indian prisoners, including 1725 fishermen along with 57 boats.

New Delhi has strongly raised its concern and protested the delay in the informing the death of one Indian fisherman Bhikha s/o Bhagwan in Karachi Jail to the Indian high commission in Islamabad. He dies in early March.&nbsp;

This is not the first case in which delay has been seen regarding informing the death of an Indian fisherman. In the past death of two Indian fishermen — Deva bhai and Nanu Bhai was informed after an inordinate delay.

In October 2017, India had suggested Pakistan that the two sides could work together for the release and repatriation of elderly, women and mentally unsound prisoners on humanitarian grounds and proposed to revive the mechanism of Joint Judicial Committee.

In the past 6 months, the ministry of external affairs via — 3 note verbale, one on January 1, other in December and November — has called on Islamabad to organise an early visit of Joint Judicial Committee to Pakistan but it has got no response.

The military’s spokesperson said: "We wanted to be sure that there was no mischief involved from our side and once we found out, our Prime Minister gave a policy statement, "We want peace with India but please be rest assured, should you initiate any aggression."&nbsp;

"First, you shall never be able to surprise us. We are ready, in response, we shall for sure surprise you. We shall dominate the escalation ladder", said Major General Asif Ghafoor who was also quick to mention the Kulbhushan Jadhav case, while taking a jibe at India saying that India needs to stop sending Kulbhushan Jadhav's to&nbsp;Pakistan and stop terrorism in order to build good relations.

In an&nbsp;hour-long press conference which focused on developments post-Pulwama attack, the spokesperson of Pakistan’s military rebuffed claims of Pakistan’s diplomatic isolation and gave a hand count of Pakistan’s recent diplomatic success.

He said that Pakistan and Iran have been in contact and deliberations are ongoing to fence the 909 km Pak–Iran border while referring to Iran as a "brotherly country". The development comes after the Iranian Border Guards were attacked which the Iranian side accused Pakistan-based terror outfits orchestrating from across the border.

In response to WION's question on the proscription of globally listed terrorist Hafiz Saeed’s organization, he said: “We proscribed them but a process was followed, they were told to do something’s when they were put on the watch-list which they failed, so they have been banned. This is in our interest, there is a time for everything to be done and this has not been done in under any pressure. The process to ensure the ban is being expedited on the ground.”

Pakistan on Thursday asked the International Court of Justice (ICJ) to "dismiss or declare inadmissible" India's claim for relief to<a href="http://www.wionews.com/india-news/kulbhushan-jadhavs-death-sentence-based-on-extracted-confession-should-be-annulled-india-tells-icj-198649"> Kulbhushan Jadhav</a>, who is on a death row in the country.

Jadhav, 48, a retired Indian Navy officer, was sentenced to death by a <a href="http://www.wionews.com/world/kulbhushan-jadhav-case-india-has-demonstrated-lack-of-faith-throughout-the-proceedings-alleges-pakistan-at-icj-198323">Pakistani military court on charges</a> of "espionage and terrorism" after a closed trial in April 2017. His sentencing evoked a sharp reaction in India.

India on Wednesday had questioned the functioning of Pakistan's&nbsp;military courts and urged the top UN court to annul Jadhav's death sentence, which is based on an "extracted confession".

Making the final submission in the ICJ on the last day of the hearing, Pakistan's counsel Khawar Qureshi said, "India's claim for relief must be dismissed or declared inadmissible."

"India's claim for relief (in the Jadhav case) remains as far fetched now as it was then (May 8, 2017)," he told the judges in his concluding remarks.

Closing the arguments, Pakistan's Attorney General Anwar Mansoor Khan said, "India seeks relief which they cannot claim from this court."

Asserting that the military court in Pakistan works according to the Constitution, he asked the ICJ to "dismiss India's request" in the case.

Khan also assured the court that the process of judicial review in Pakistan was robust and Jadhav can avail it if he chooses.

"Jadhav has been charged with terrorism for which an FIR has been registered with the police that is a civilian agency. The military courts have sufficient proof of espionage and the said military court on the available evidence and the judicial confession proceeded to convict him despite he being given the option of going for a judicial review, he has refused to do so," Khan told the court.

He said India claims consular access, "surely (it) was not allowed for good reason in terms of the agreement of 2008, specially for the reason that commander Jadhav being involved in espionage."

Khan also raked up the Kashmir issue and said Pakistan was awaiting India's response on Samjhauta train blast case and has sought evidence on his country's role in the Pulwama terror attack.

After his submission, ICJ top judge Abdulqawi Ahmed Yusuf adjourned the hearing and said a date for the judgement would be announced later.

On Wednesday, Harish Salve, who was representing India in the case, said that the time has come for the ICJ to make Article 36 a potent weapon for protecting human rights.

On Pakistan's military courts, he said the International Commission of Jurists and European Parliament have criticised their functioning and added that anything diluting provisions of Vienna Convention must fail.

India moved the ICJ in May 2017 for the "egregious violation" of the provisions of the Vienna Convention by Pakistan by repeatedly denying New Delhi consular access to Jadhav.

Jadhav, 48, a retired Indian Navy officer, was sentenced to death by a Pakistani military court on charges of "espionage and terrorism" after a closed trial in April 2017. His sentencing evoked a sharp reaction in India.

"Annul the decision of the military court and restrain Pakistan from giving effect to the (death) sentence. Release Jadhav and ensure safe release forthwith. If not then direct a trial under normal law with full consular access," said Deepak Mittal, Joint Secretary, the Ministry of External Affairs, making the final submission in the court on the third day of the hearing.

He requested the court to declare that Pakistan acted in breach of Article 36 of Vienna Convention and failed to inform Jadhav of his rights.

Harish Salve, who was representing India in the case, also said that the time has come for the ICJ to make Article 36 a potent weapon for protecting human rights. "Jadhav has become a pawn in Pakistan's tool to divert international scrutiny from itself," Salve said in his arguments during which he mentioned the "dastardly" terror attack in Pulwama and another in Iran last week by Pakistan-based terror groups targeting security forces in both countries.

Salve said that Pakistan is used as a safe haven by UN proscribed terrorist entities like al-Qaeda, LeT, JeM, Haqqani Network et al and individuals like JuD chief Hafiz Saeed and underworld don Dawood Ibrahim.

"There was a time when the world respected Pakistan, today the world doesn't have the same respect for Pakistan in its own incarnation," Salve said, taking a dig at Pakistan's counsel Khawar Qureshi, who on Tuesday said 'he has great respect for India but not its present incarnation.'

Salve said that Jadhav has been sent to gallows on the basis of "extracted confession". "Jadhav's trial was completed in 4-6 months or weeks...What happened to the 150 people killed in the Mumbai terror attacks?" Salve asked as he raked up the Ajmal Kasab case to highlight the meaning of judicial review.

"In Kasab case, the LeT terrorist who was apprehended and caught red-handed by brave police officers, the Supreme Court of India examined materials on record first-hand since it was the case of a death sentence. This is called review," he said. He also objected to the abusive language used by Pakistan's counsel in the case, urging the UN court to draw a red line.

Counsel Qureshi's transcript is "peppered with words such as shameless, nonsensical, laughable, breathtaking and arrogance. India takes exception to be addressed in this fashion. I would let the matter rest as Indian culture prevents me from indulging in a similar language of insults," he said.

"India doesn't know Pakistan, Pakistan is a state that has provided the largest contingent for peacekeeping, whose soldiers have lost lives in pursuing world security," he said.

"India's conduct and abusive process... India has deployed this process for political theatre," lawyer Qureshi said.

He alleged that the Indian Navy officer was a "spy" and not a businessman.

Qureshi also alleged that Jadhav was an "instrument of India's official policy of terror".

News brief: Big stories of the day

Pakistan said on Monday that India did not provide answers to the key questions it raised at the International Court of Justice (ICJ) about <a href="http://www.wionews.com/world/kulbhushan-jadhav-case-pakistan-embarrassed-to-disclose-charges-against-jadhav-says-india-at-icj-198089">Kulbhushan Jadhav</a>, who has been sentenced to death by a Pakistani military court.

Pakistan's Foreign Office spokesperson Mohammad Faisal in a video message posted on social media said that Indian arguments had nothing new.

"There was nothing new in India's argument on the issues which we raised, like our question about how he (Jadhav) got the passport with name of Hussain Mubarak Patel and how he travelled 17 times to India using that passport," he said.

Faisal said India also did not show any document like pension book or bank statement to prove that Jadhav had retired from the Indian Navy.

He said India demanded "acquittal, release and return" of Jadhav but "it had no answer to the question that how justice will be done with thousands of people who were killed due to his sabotage and terrorist activities."
Faisal said Pakistan would submit its argument on Tuesday.

The ICJ set a timetable for public hearings from February 18 to 21.

The English Queen's Counsel Khawar Qureshi will make submissions on February 19 from Islamabad's side. Then India will reply on February 20 while Islamabad will make its closing submissions on February 21.

The hearings will be streamed live on the Court's website as well as on UN Web TV, the United Nations online television channel.

"We are fully prepared with our strongest evidence being the valid Indian passport recovered from Commander Jadhav with a Muslim name," the official said.

Both India and Pakistan have already submitted their detailed pleas and responses in the world court.

In its written pleadings, India accused Pakistan of violating the Vienna Convention by not giving consular access to Jadhav arguing that the convention did not say that such access would not be available to an individual arrested on espionage charges.

In response, Pakistan through its counter-memorial told the ICJ that the Vienna Convention on Consular Relations 1963 applied only to legitimate visitors and did not cover clandestine operations.

Pakistan had said that "since India did not deny that Jadhav was travelling on a passport with an assumed Muslim name, they have no case to plead."

Pakistan said that India did not explain how "a serving naval commander" was travelling under an assumed name. It also stated that "since Jadhav was on active duty, it is obvious that he was a spy sent on a special mission".

In its submission to the ICJ, Pakistan had stated that Jadhav is not an ordinary person as he had entered the country with the intent of spying and carrying out sabotage activities.

India has been maintaining that the trial of Jadhav by a military court in Pakistan was "farcical".

In the pictures issued by Pakistan after the meeting, Jadhav was seen sitting behind a glass screen while his mother and wife sat on the other side. They spoke through intercom.

Later, India accused Pakistan of disregarding cultural and religious sensibilities of Jadhav's family members under the pretext of security by removing the mangal sutra, bangles and bindi of his mother and wife before they could meet him.

India also asserted that Jadhav appeared coerced and under considerable stress during the tightly-controlled interaction at the Pakistan Foreign Office.

After the meeting, Pakistan issued a video message of Jadhav in which he is seen thanking the Pakistan government for arranging a meeting with his wife and mother.&nbsp;

The English Queen's Counsel Khawar Qureshi will make submissions on February 19 from Islamabad's side. Then India will reply on February 20 while Islamabad will make its closing submissions on February 21, the daily said.

It is expected that the ICJ's decision may be delivered by the summer of 2019.

"We are fully prepared with our strongest evidence being the valid Indian passport recovered from Commander Jadhav with a Muslim name, the official told the Dawn, adding that Pakistan was committed to implementing the decision, irrespective of what decision came from the ICJ.

In reply to a question about Iran, the official said the Pakistan government was convinced that Iran had no role in Jadhav's episode though he remained there for some time. "India wants to drag Iran into this dispute but we will not let it happen," he said.

In New Delhi, Ministry of External Affairs Spokesperson Raveesh Kumar on Thursday declined to go into the details of the case.

"The oral proceedings on the International Court of Justice are commencing on February 18. India will present its case before the court. Since the matter is subjudice it is not appropriate for me to state our position in public. Whatever we have to do, we will do at the court," he said in response to a question.

Pakistan claims that its security forces arrested Jadhav from restive Balochistan province on March 3, 2016 after he reportedly entered from Iran. However, India maintains that Jadhav was kidnapped from Iran where he had business interests after retiring from the Navy. Jadhav's sentencing had evoked a sharp reaction in India.

Pakistan committed to implementing ICJ's decision in Kulbhushan Jadhav case: Official

A top court in Pakistan has given a one-month deadline to the federal government to complete formalities to deport Indian prisoner <a href="http://www.wionews.com/south-asia/pakistan-court-orders-release-of-indian-national-hamid-nehal-ansari-183735">Hamid Nehal Ansari</a>, whose three-year jail term will end on December 15.

Ansari, a 33-year-old Mumbai resident, is currently lodged in the Peshawar Central Jail after being sentenced by a military court to three years' imprisonment for possessing a fake Pakistani identity card on December 15, 2015.

He was arrested in Pakistan in 2012 for illegally entering the country from Afghanistan, reportedly to meet a girl he had befriended online.

A two-judge Peshawar High Court bench, comprising Justice Roohul Amin and Justice Qalandar Ali Khan, on Thursday heard an appeal filed by Ansari through a senior lawyer. The petition said that the federal government hasn't taken any steps for his release.

Ansari's lawyer, Qazi Muhammad Anwar, said that his client's prison term will end on December 15 and he should be released on the morning of December 16.

Anwar informed the bench that the sentence of Indian national would complete after two days and both the Ministry of Interior and authorities of prison, where he was lodged, were completely silent about his release and deportation to India.

After hearing this, Justice Khan asked the Additional Attorney General to explain how would they keep the prisoner in jail after completion of his term.

"I wonder that after two days the jail term of the prisoner would be completed and the government did not complete requirements for releasing and deportation of the prisoner," the judge observed after additional attorney general informed the court that documents for release and deportation of the prisoner were not ready.

An officer, representing the interior ministry, informed the court that a prisoner could be kept for one month while the legal documents were being prepared.

After knowing the legal position, the court directed the ministry to make all the arrangements within a month for releasing and deportation of the prisoner.

On previous hearing, deputy attorney general recorded his statement on behalf of the interior ministry and said Ansari would be handed over to Indian authorities at Wagah border after completion of his term.&nbsp;

Ansari had gone missing after he was taken into custody by Pakistani intelligence agencies and local police in Kohat in 2012 and finally in reply to a habeas corpus petition filed by his mother, Fauzia Ansari, the high court was informed that he was in custody of the Pakistan Army and was being tried by a military court.

India submits second reply to ICJ in Kulbhushan Jadhav case

Pakistan today once again <a href="http://www.wionews.com/india-news/indian-envoy-to-pakistan-not-allowed-to-meet-sikh-pilgrims-india-lodges-protests-130568">denied the Indian consular team</a> access to&nbsp;Gurdwara Panja Sahib in Punjab province.

On Sunday, the Ministry of External Affairs(MEA) had lodged a protest with the Pakistan authorities over blocking of consular access to Sikh pilgrims in the country.

"A standard practice has been that the Indian High Commission’s consular/protocol team is attached with visiting pilgrims, to perform consular and protocol duties, like helping out in medical or family emergencies. However, this year, the consular team has been denied access to Indian Sikh pilgrims," the MEA had said.&nbsp;

The issue continued to boil on Monday as India summoned Pakistan's Deputy High Commissioner to lodge&nbsp;a protest over attempts to raise the "Khalistan issue" during the visit of Sikh pilgrims in Pakistan.

"A strong protest was lodged at attempts being made during the ongoing visit of the Sikh pilgrims from India to Pakistan to raise the issue of "Khalistan" by making inflammatory statements and displaying posters at various places of pilgrims visit in Pakistan," the ministry said.&nbsp;

A group of 1,800 Sikh pilgrims are on a visit to Pakistan since April 12 under a bilateral agreement aimed at facilitating visits to religious shrines.&nbsp;

The MEA said the Indian High Commissioner, who was to greet Indian pilgrims on the occasion of Baisakhi, was compelled to return when he was en route to Gurdwara Panja Sahib.&nbsp;

"It was conveyed that such repeated attempts by authorities and entities in Pakistan to extend support to secessionist movements in India amount to interference in its internal affairs," the MEA added.

The MEA said such incidents during the visit of Indian pilgrims went against the spirit of the bilateral protocol of 1974 governing the exchange of visits of pilgrims between the two countries.

Meanwhile, Pakistan said the allegation were "baseless". Pakistan foreign office spokesman Mohammad Faisal also said that it was "deeply regrettable that facts in this matter had been completely distorted and misrepresented."

Faisal said the Secretary of the Evacuee Trust Property Board (ETPB) had extended an invitation to the High Commissioner of India to attend the main function of Baisakhi at the Gurdwara Panja Sahib on April 14 and the foreign ministry granted the travel permission to him.

"However, in the run-up to the main function, the ETPB authorities noticed strong resentment among segments of Sikh Yatrees, gathered there from different parts of the world, protesting the release in India of some film on Baba Guru Nanak Devji," Faisal claimed.

"Considering an emotionally charged environment and the possibility of any untoward situation, the ETPB authorities contacted the Indian High Commission officials and suggested cancellation of the visit," Faisal said. &nbsp;

He said the Indian High Commission officials, after due deliberation, conveyed back to ETPB their agreement to call off the visit in view of such a situation.&nbsp;

"The cancellation took place with mutual understanding," Faisal said, claiming that the facts regarding visits of Consular/Protocol teams on April 12 and 14 have also been twisted.&nbsp;
