This week's proceedings before a panel of 17 judges will not deal with the core allegation of genocide, but Gambia has requested a court order for Myanmar to halt any activity that may aggravate the dispute.

The 2017 crackdown forced 740,000 Rohingya to flee over the border into sprawling camps in Bangladesh, in violence that United Nations investigators say amounts to "genocide".

"The Gambia is taking this action to seek justice and accountability for the genocide being committed by Myanmar against the Rohingya," Justice Minister Abubacarr Tambadou said in a statement.

The court is expected to hold its first hearings in December on Gambia's request for urgent interim measures "to protect the Rohingya against further harm", Gambia's lawyers Foley Hoag said in a statement, describing the case as "historic".

Human Rights Watch hailed the move by the tiny west African state, saying it was the "first judicial scrutiny" of Myanmar's alleged crimes against the Rohingya.

Param-Preet Singh, associate international justice director at HRW, said the court's "prompt adoption of provisional measures could help stop the worst ongoing abuses" in Myanmar.

The lawsuit asks the ICJ to "order Myanmar to cease and desist from its genocidal acts, to punish the perpetrators, and to provide reparations for the Rohingya victims," Gambia's justice ministry said.

It said Myanmar had failed to meet its obligations to prevent and to punish genocide, accusing it of "wanton acts of violence and malicious degradation with the specific intent of state actors to destroy the Rohingya as a group".

Yusuf said that Pakistan wrongly stated that its provisions were not applicable to prisoners suspected of espionage.

Pakistan, last week, said it has provided consular access to Indian national Kulbhushan Jadhav and has now initiated "logical and legal steps" in the case.

India has rejected Pakistan's allegations about Jadhav's involvement in spying and subversive activities and said he was kidnapped by from Iranian port of Chabahar, where he was running a business.&nbsp;

The court also asked Pakistan to review its order of death sentence awarded to Jadhav facing charges of espionage and conspiracy against Pakistan in what was seen as a major win for India.

In a 15 to 1 decision, the world court directed Pakistan to allow Jadhav consular access.

The court unanimously found that it had jurisdiction in the case and by a vote of 15-1, pronounced its verdict, with the sole dissenting Judge being Ad Hoc Judge Tassdduq Hussain Jillani who is the former Chief justice of Pakistan.

India was first informed about Jadhav's custody by Pakistani authorities on 25 March 2016. In 2017 Islamabad announced that the military has awarded death sentence to him.

In a major win for India, the ICJ on Wednesday continued its stay on the execution of the Indian national, held in a Pakistani jail on allegations of spying, and called for an effective review and reconsideration of the conviction.&nbsp;

India put intense diplomatic pressure on Pakistan through numerous diplomatic notes and demarches and letter by the External Affairs Minister (EAM) over a sustained period for consular access and release of Jadhav, as per government sources.

"India`s Stand on Vienna Convention and consular access was upheld. India will get access to Jadhav. India`s legal arguments were upheld, including the correctness of the decision to approach ICJ," they said.

Sources said that Jadhav is innocent and that "he was kidnapped from Iran, where he was residing and carrying on business after retiring from the Indian Navy. There is absolutely no clarification by Pakistan about the circumstances of his arrest".

India put up a formidable legal team led by Harish Salve. The ICJ agreed to India's viewpoint by issuing a binding order to Pakistan to prevent the execution of Jadhav.

The court also granted him consular access holding Pakistan guilty of violating the Vienna Convention. Reacting to the ICJ verdict, Union Home Minister Amit Shah said that it is yet another manifestation of the Narendra Modi government's diplomatic efforts.

It has used proxy groups such as Jaish al Adl against Iran, while Iranian officials have spoken of Pakistan's sponsorship of terror activities along the Iran-Pakistan border. On May 18, 2017, a 10-member bench of the ICJ had restrained Pakistan from executing Jadhav till the adjudication of the case.

The verdict by Pakistan's military court was based on Jadhav's confession taken under custody, without proper legal representation and this was in clear violation of the Vienna Convention and the international law, including international covenant on civil and political rights. However, the international covenant on civil and political rights clearly states that use of military courts for the trial of civilians is in violation of due process standards.
