Final decision by International court of justice on Kulbhushan Jadhav later this month

The people responsible for the atrocities that forced hundreds of thousands of Rohingya Muslims to flee from Myanmar's Rakhine state will be held to account, an International Criminal Court official said on Monday.

Following a visit to&nbsp;Bangladesh&nbsp;refugee camps, the ICC's Phakiso Mochochoko said the fact that Myanmar is not a signatory to the Hague-based international court "will not in any way be a hindrance" to an investigation.

"It may present a little bit of challenge for us in terms of investigation, but we have faced a situation like this in the past and we've been able to deal with them," the court's director of jurisdiction told reporters in the capital Dhaka.

Mochochoko made the comments after leading a delegation to&nbsp;Bangladesh's southeastern Cox's Bazar district, home to around one million Rohingya refugees.

The delegation, however, clarified that its visit to the camps was not a part of any investigation but to collect insights for an ongoing assessment of the office of prosecutor Fatou Bensouda whether to warrant a full investigation.

"A preliminary examination is not an investigation, but an assessment of the Rome Statute criteria to decide whether an investigation into the situation at hand is warranted," he said.

"Therefore during this mission, as is standard practice of the Office, the delegation did not collect evidence or perform any other investigative activities," Mochochoko said.

About 740,000 Rohingya have fled Rakhine state to&nbsp;Bangladesh&nbsp;since August 2017 following a brutal military crackdown that UN officials described as "ethnic cleansing". Thousands more arrived in previous years following earlier bouts of anti-Rohingya violence.

Mochochoko said the preliminary probe would be "all about individual responsibility".

"The people who are responsible, the people who gave instruction, the people who commanded, the people who did all the other things and facilitated the commission of this crime," he said.

"The prosecutor is bound or intended to ensure that accountability for the suffering of the Rohingya people is met and those who are responsible for the atrocity that happened there are brought to account," he added.

The visit came after judges last year ruled that even though Myanmar has not signed up to the Hague-based ICC, the court still has jurisdiction over crimes against the Rohingya because&nbsp;Bangladesh&nbsp;is a member.

Colonial power Britain split off the islands from Mauritius -- which lies around 1,200 miles (2,000 kilometres) away -- three years before Port Louis gained independence in 1968. It also paid Mauritius three million pounds.

Between 1968 and 1973 around 2,000 Chagos islanders were evicted, to Britain, Mauritius and Seychelles, to make way for a military base on Diego Garcia, the largest of the islands. The evictions were described in a British diplomatic cable at the time as the removal of "some few Tarzans and Man Fridays".

Diego Garcia is now under lease to the United States and played a key strategic role in the Cold War before being used as a staging ground for US bombing campaigns against Afghanistan and Iraq in the 2000s.

Olivier Bancoult, chairman of the Mauritius-based Chagos Refugees Group, told reporters outside court that he was "so happy".

"It is a big victory against an injustice done by the British government for many years. We people have been suffering for many years -- I am so lucky today," he said.

The ICJ opinion comes as a stunning blow to London in a case that goes to the heart of historic issues of decolonisation and current questions about Britain's place in the world as it prepares to leave the European Union.

Mauritius' lawyer Philippe Sands said there was "no wiggle room" in the judges' view and that Britain would resist pressure to comply.

A US official said Washington saw the case as "purely a bilateral dispute" between Britain and Mauritius. But he questioned the authority of the court, saying that issues should be resolved through negotiations between governments.

When judges heard the case in September, Mauritius argued that it was illegal for Britain to have broken up its territory while it was still the colonial power.

He said India claims consular access, "surely (it) was not allowed for good reason in terms of the agreement of 2008, specially for the reason that commander Jadhav being involved in espionage."

Khan also raked up the Kashmir issue and said Pakistan was awaiting India's response on Samjhauta train blast case and has sought evidence on his country's role in the Pulwama terror attack.

In its written pleadings, India accused Pakistan of violating the Vienna Convention by not giving consular access to Jadhav arguing that the convention did not say that such access would not be available to an individual arrested on espionage charges.

Pakistan had said that "since India did not deny that Jadhav was travelling on a passport with an assumed Muslim name, they have no case to plead."

Pakistan said that India did not explain how "a serving naval commander" was travelling under an assumed name. It also stated that "since Jadhav was on active duty, it is obvious that he was a spy sent on a special mission".

The hearings at the tribunal were separate from Iran's claim relating to current US sanctions against Teheran.

Iran's claim in both cases is based on a 1955 Amity Treaty, which was signed 24 years before Iran's Islamic Revolution that turned the two countries into arch enemies.

"The actions at the root of this case centre on Iran's support for international terrorism," Richard Visek, legal advisor to the US Department of State, said on Monday, calling on the court to reject Iran's suit.

Washington announced last week it would withdraw from the Amity Treaty after the tribunal ordered the US to ensure that sanctions against Iran do not affect humanitarian aid or civil aviation safety.

It will take a year for a withdrawal from the Amity Treaty to take effect and Iran's case against the asset seizure, which was filed in 2016, will continue regardless.

The hearings in The Hague will run until Friday and focus on US objections to the UN's highest court's jurisdiction. No date for a ruling has been set.

Halt sanctions on humanitarian goods to Iran: International Court of Justice to US

India on Tuesday submitted its reply in the International Court of Justice in connection with the Kulbhushan Jadhav case.

Jadhav, 47, was sentenced to death on charges of espionage and terrorism by a Pakistani military court in April last year.

The International Court of Justice in May had halted his execution on India's appeal.

India submits second reply to ICJ in Kulbhushan Jadhav case

The UN's top court said Thursday it will hold hearings in June into Malaysia's request to overturn its ruling in a decades-old dispute with Singapore over a tiny but strategic island.

The International Court of Justice (ICJ) "will hold public hearings in the case concerning the revision of the judgement of 23 May 2008 in the case concerning sovereignty over Pedra Branca/Pulau Batu Puteh."

Four days of audiences will be held starting on June 11 in the imposing tribunal housed in the Peace Palace in The Hague, the ICJ added in a statement.

Malaysia lodged its case in February 2017, calling for the court to overturn its 2008 ruling granting its neighbour sovereignty over the disputed rocky outcrop.

Kuala Lumpur maintained new documents had been discovered in British archives backing its territorial claim to the islet.

Malaysia calls the island Pulau Batu Puteh, while Singapore dubs it Pedra Branca (white rock).

The island is in a strategically important position, 7.7 nautical miles (14 kilometres) off Johor on the eastern approach to the Singapore Strait from the South China Sea.

Singapore had operated the Horsburgh Lighthouse on the granite island for more than 130 years without protest from its neighbour.

But in a map of its maritime boundaries drawn up in 1980, Kuala Lumpur staked its claim to the islet.

After years of failed negotiations, the parties turned to ICJ, which in 2008 ruled the island belonged to Singapore.&nbsp

Another rocky outcrop called Middle Rocks was found to belong to Malaysia, while a low-tide bank called South Ledge was deemed to be in overlapping territorial waters.

But in its 2017 filing, Malaysia asked the court to revise that judgement based on the discovery of three documents in the British national archives between August 2016 and late January 2017.

They included internal correspondence from the Singapore colonial authorities in 1958, a British naval incident report from 1958 and a map from the 1960s.

Kuala Lumpur maintained these documents showed that "officials at the highest levels in the British colonial and Singaporean administration appreciated that Pedra Branca/Pulau Batu Puteh did not form part of Singapore's sovereign territory," according to the ICJ.

Under the court's rules, states can ask for a judgement to be revised if new facts come to light within 10 years of the first ruling.

In a separate filing, Malaysia has also asked for an interpretation of the 2008 ruling, saying despite having formed a joint committee with Singapore the two countries have failed to delimit their maritime borders in the area.

The ICJ will also hold four days of hearings on this filing between June 18 to 22.
