International Commission for Jurists (ICJ) has asked Pakistan authorities to immediately lodge a First Information Report (FIR) and investigate the matter of abduction of human rights activist Idris Khattak. 
 
Khattak, who has documented cases of enforced disappearances, was abducted by intel agencies from Pakhtunkhwa province on&nbsp;November 13, politician Jibran Nasir said.

In a complaint filed in Anbar police station, Khattak driver Shahsawar said that the activist was on his way from Akora Khattak village to Swabi when about four unidentified men stopped the activist's car at motorway Interchange and kidnapped him on November 13. 
 
According to Dawn, though the complaint was filed by Khattak's driver and family, police did not register an FIR. 
 
Meanwhile, the Human Rights Commission of Pakistan (HRCP) demanded Khattak's "immediate recovery", saying that he had "remained associated with progressive politics since his student days". 
 
"HRCP condemns arbitrary detentions and urges the Pakistani state to fulfil its constitutional obligations towards its citizens," the organisation said in a tweet. 
 
According to the Commission of Inquiry on Enforced Disappearances, an entity established by the Pakistani government, 5,000 cases of enforced disappearances have been registered since 2014. Most of them are still unresolved. 
 
Independent local and international human rights organisations put the numbers much higher. Around 20,000 have reportedly been abducted only from Balochistan, out of which more than 2,500 have turned up dead as bullet-riddled dead bodies, bearing signs of extreme torture. 
 
Pakistan's establishment has been long criticised over its practice of enforced disappearances and extrajudicial killings by International bodies and local human rights organisations that dare to speak out on the issue.

Ranbaxy's former promoter Malvinder Singh has approached Delhi High Court seeking quashing of an FIR registered by Economic Offences Wing (EOW) of the Delhi Police, saying it lacks jurisdiction to register FIR.

Malvinder Singh said the Serious Fraud Investigation Office (SFIO) is already conducting investigations.

He claims he can only be tried under companies law by SFIO. Justice Brijesh Sethi is currently hearing the case.

Appearing for Singh, senior advocate Abhishek Manu Singhvi said, "The plea raises the question of lack of jurisdiction. The writ was filed some days ago. It raises the issue of jurisdiction. It's not related to something that happened last night."

Singhvi stated that Section 212 of the Companies Act "clearly bars the investigation under Companies Act by any other agency other than SFIO."

"The Centre has assigned the case to SFIO for investigation. In case SFIO has been investigating any offence under the Companies Act, all other authority/agencies having any information shall provide such information to SFIO," he stated.

EOW's case against the applicant is under Sections 409 and 420 of IPC. SFIO, which investigates cases of serious frauds, is also empowered to investigate charges under CrPC while investigating cases of serious financial frauds, he said and added that parallel investigation by EOW would violate protection from duplication as enshrined under Article 20 of Constitution.

EOW stated that Singh was arrested yesterday. This matter is not appropriate to be taken up at this time and may be adjourned for few weeks, it added.

Singhvi said that in the FIR lodged by EOW, it has acknowledged the investigation being conducted by SFIO.

"How can two proceedings go simultaneously? Both the complaints refer to the same company, same transactions. For species of offences that partake with fraud, SFIO is made the only agency. How can the EOW then continue with the investigation? If SFIO investigating, EOW can't jump the gun," he said.

Singhvi has sought notice to be issued to EOW or grant of stay on the proceedings initiated by EOW.

Appearing for EOW, advocate Avi Singh said, "EOW is investigating companies which are different from the ones notified by the Centre to be investigated by SFIO.

EOW is investigating different companies, promoters are same. SFIO has been given specific allegations and companies to investigate.

"EOW's investigation is also being done under a different Act. EOW is not investigating any offences under Companies Act but offences under IPC, EOW stated.SFIO cannot investigate offences under IPC. Fraud by a company is an offence separate from criminal conspiracy and other offences under IPC," it added.

EOW further mentioned that they are at the stage of initial and crucial investigation.

Speaking to ANI, Khan's advocate Safdar Kazmi said the court has also put a stay on any coercive action in the case.

Khan cannot be arrested till October 24 when the court takes up the matter for hearing.

"During the course of hearing, it came to fore that the allegations made in FIRs did not mention the date and how the offence happen. It also comes to fore that the informants sold their other pieces of land peacefully to the university and they have no objection on them," Kazmi said.

The court has sought a response from the state government and other respondents in the case.

The agency recovered cash worth Rs 47 lakh from the residence of Bulandshahr District Magistrate Abhay Kumar Singh, Rs 10 lakh from Chief Development Officer Devi Sharan Upadhyay's residence and some documents related to properties from the premises of Director of Training and Employment, Vivek.

Even though there was no official comment on the raid, CBI sources said a huge amount of cash was recovered by the agency from Abhay's residence.

The search went on for over two hours, sources said, adding that a machine to count notes was taken inside Abhay's house by the CBI officials.

In the illegal mining scam, CBI had filed an FIR earlier this year, in which names of several bureaucrats and politicians had come up.

According to sources, when the purported scam took place, Abhay was the District Magistrate at Fatehpur district and Upadhyay and Vivek were the Additional District Magistrate and District Magistrate of Deoria city in Uttar Pradesh, respectively.&nbsp;

FIR against Navjot Singh Sidhu over communal remarks

Kochhar had quit the ICICI on October 4 last year in the wake of allegations that she had favoured Videocon in the lending processes because the consumer electronics company`s founders had invested in a company of her husband Deepak Kochhar.

The CBI filed cases against the three along with some others after conducting raids at four premises in Maharashtra, the investigating agency had said.

The preliminary enquiry apparently showed that from June 2009 to October 2011, ICICI Bank had allegedly sanctioned six high-value loans to various Videocon Group companies, CBI sources said.

Chanda Kochhar had taken over the post of the Managing Director of the ICICI Bank on May 1, 2009. The companies M/S Nupower Renewables Limited (NRL) and M/S Supreme Energy Private Limited (SEPL) have also been named in the case registered by CBI.

It is alleged that SEPL was initially incorporated by Dhoot and his associate Vasant Kakade and the ownership of the company was later transferred to Deepak Kochhar by selling the shares of the company to Pinnacle Energy Trust (PET) which was owned by Kochhar.

It was also alleged that Dhoot had invested a large amount of funds in Deepak Kochhar-owned Nupower months after the Videocon group received Rs 3,250 crore as loan from the ICICI Bank in 2012.

The Thoothukudi Magistrate Court on Thursday ordered police officials to register a case against Tamil Nadu Bharatiya Janata Party (BJP) President Dr. Tamilisai Soundararajan, for allegedly abusing a co-passenger, Lois Sophia, who recently raised anti-party slogans on an aircraft.

The court ordered the police to register a case under Sections 341, 294(b) and 506(1) under the Indian Penal Code (IPC), after Sophia's father had approached the court, alleging that Soundararajan and her party workers had reportedly used abusive language against his daughter and misbehaved with her.

On September 3, Sophia allegedly raised 'Fascist BJP Government down down' slogan on a Chennai-Tuticorin flight. Enraged by the same, Soundararajan, also on the same aircraft, got into a verbal spat with the co-passenger and later allegedly with the police, who were stationed at the Tuticorin airport.

Soundararajan also lodged a complaint and Sophia was later detained for interrogation. However, the police released the girl on unconditional bail.

The Tamil Nadu BJP president claimed that the girl belonged to some organisation and was tutored to misbehave with the BJP leaders.

"It is the duty of the media to find out the name of the organisation that she belongs to. No normal passenger sitting in the flight have the audacity to misbehave with the leaders like that. I am sure this move was tutored," she had said last month.

Vyapam case: Court orders FIR against senior Cong leaders

Delhi Police today filed a First Information Report(FIR) in <a href="http://www.wionews.com/india-news/shashi-tharoors-wife-sunanda-pushkar-was-poisoned-report-35475">the death of Sunanda Pushkar</a>, wife of MP Shashi Tharoor, naming the Congress leader as one of the accused.

Sunanda Pushkar was found dead in a Delhi hotel under mysterious circumstances on January 17, 2014. Tharoor had married Sunanda four years earlier on&nbsp;August, 2010.

Shashi Tharoor was charged under sections 498 A (husband or his relative subjecting a woman to cruelty) and 306 (abetment of suicide) of the Indian Penal Code.&nbsp;

The chargesheet said that Pushkar died within three years, three months and 15 days of her marriage with Tharoor.

Meanwhile, Tharoor tweeted saying he intended to contest the "preposterous chargesheet" vigorously, alleging that "it does not speak well of the methods or motivations of the Delhi Police."

"The Law officer made a statement in the Dehli High Court that they have not found anything against anyone and now in six months they say that I have abetted a suicide," he said, adding,"unbelievable."

The Delhi Police had filed an FIR on January 1, 2015 against unknown persons under IPC section 302 (murder).

Speaking on the issue, BJP leader Subramanian Swamy said: "All witnesses & documents were destroyed by UPA govt & corrupt police. On basis of current evidence, this is what could be done."

"More information will come during the trial. There are allegations on Shashi Tharoor that he forced his wife to commit suicide," he added.

This is yet another case of sexual harassment in the University which was already rocked by several incidents of sexual harassments by professors which also led to several protests by the University students.

It was not known when the video, which went viral, was shot.

"This election is not about roads, drainage or drinking water. This election is about Hindu and Muslim religions," he told the crowd.

"Keeping a hand on my chest I say loudly, this is Bharat, this is the country of Hindus and this is the country where (Lord) Ram was born. We are prepared to do anything to construct Ram mandir in Ayodhya," Patil purportedly said in the footage.

Patil also told the crowd that the Congress favoured constructing a mosque in Ayodhya instead of a Ram temple.

The CBI has registered a case of alleged loan fraud of Rs 824.15 crore committed by Chennai-based Kanishk Gold Pvt Ltd on a consortium of 14 banks led by the SBI and carried out searches today, officials said.

The case has been registered by the Central Bureau of Investigation (CBI) on a complaint from the State Bank of India (SBI) on behalf of the 14-bank consortium, they said.

The agency has booked the company Kanishk Gold Pvt Ltd, its promoter Director Bhoopesh Kumar Jain, Director Neeta Jain, Tejraj Achha, Ajay Kumar Jain and Sumit Kedia besides unidentified public servants.

The CBI carried out searches at the official and residential premises of promoters of Kanishk Gold Pvt Ltd as it launched probe in the Rs 824-crore loan fraud case, the officials said.

The company engaged in manufacturing gold jewellery which was marketed under the brand name &#39;Krizz&#39; which were sold through distributors till 2014. But in 2015 it changed its business model to B2B (business-to-business) and started supplying to large retail jewellers, the SBI said in the complaint to the CBI.

The loan accounts of the company were taken over by the SBI from the ICICI in 2008, while its banking arrangement was converted into a multiple banking system in March 2011, it said.

The SBI alleged that the &quot;fraud&quot; is to the tune of Rs 824.15 crore, but the security available with it to cover the &quot;loss&quot; is only around Rs 156.65 crore.

CBI officials said the complaint has been received and the agency was in touch with the bank because of certain loopholes in the complaint which were to be rectified by the bank.

The complaint from the SBI came in public domain before the agency could complete its searches raising fears in the CBI that it may not be able to grab hold of crucial documentary evidence, sources said.

They said &quot;some vested interests&quot; may have leaked the complaint but it is trying hard to do as much damage control as possible.

The bank has alleged that the company had &quot;misrepresented and falsified&quot; the records and financial statements of the company to show a &quot;rosy picture&quot; since 2009 to avail credit facilities from it.

Today, a large number of students of the SLS staged a demonstration and demanded the Dean of the school suspend the professor from all official positions and initiate an inquiry.

In a letter to the Dean, the students said, &quot;As you already know an FIR has been filed against the professor and since he is in several positions of power and holding university posts, we ask you to immediately inform the vice- chancellor and university administration to suspend him from all the positions.&quot;

Members of the JNU Students Union, representatives of the discarded Gender Sensitisation Committee against Sexual Harassment (GSCASH) and those belonging to the women&#39;s collective Pinjra Tod also took part in the protest.

Bengaluru: Youth Congress leader suspended for assaulting man in restaurant, threatening him in hospital

If verbal gymnastics was an Olympic sport, there is little doubt that Ms. Nirmala Sitharaman, the Raksha Mantri, would win the Gold Medal hands down.&nbsp;

&nbsp;

One minute, in a confidential conversation with Ms. Mehbooba Mufti, the Jammu and Kashmir Chief Minister, she is supportive of the Chief Minister&rsquo;s intention to file an FIR against the Army unit that fired in self-defence in the Shopian incident, for &quot;carelessness&quot; on their part.&nbsp; Ten days later as the Supreme Court stays the FIR, the RM unashamedly does a perfect verbal somersault and publicly states that the Supreme Court&rsquo;s directions were expected and that the Central Government supports our &ldquo;brave soldiers&rdquo;! One would not blame the military if it concluded that with friends like her, who needs enemies?

&nbsp;

At the outset it needs to be clarified that despite all the brouhaha in the media, the military veteran community and even among prominent members of the BJP and RSS, for instance, Mr. Subramanium Swamy, the Police can lodge an FIR against the Army, even in a disturbed area where AFSPA is in force if it concludes that a cognizable crime has been committed.&nbsp;

&nbsp;

While AFSPA, in essence, gives the Army operating in disturbed areas police powers of arrest and search without a warrant, given the hostile environment they are required to operate in, Section 7 of the Act only prevents prosecution of Army personnel without the sanction of the Central Government. Even a layman is conversant with the fact that filing of an FIR implies only commencement of an investigation.&nbsp;

&nbsp;

Thus, the filing of the FIR in such circumstances means little and would not in any way adversely impact the morale of personnel, provided they have organisational support. While Ms. Sitharaman&rsquo;s flip-flops have seriously damaged the credibility of the Central Government, sadly the wishy-washy comments of the Northern Army Commander, as well as the lack of any public statement from the Army Chief in support of his troops, has not helped matters. It is probably this perceived lack of organisational support that forced Major Aditya Kumar&rsquo;s father to approach the Supreme Court with the plea to quash the FIR.&nbsp; &nbsp;

&nbsp;

&nbsp;&nbsp; While Mehbooba Mufti could well be ignorant, the Police are certainly fully aware that an FIR can only be lodged against an individual or group when a cognizable offence has been committed by them. In all other circumstances, a Police Report needs to be filed and the case brought before a Magistrate who then directs whether an FIR needs to be filed or not based on the evidence available.&nbsp;

&nbsp;

In the present instance, it needs only a superficial understanding of the law to conclude that firing in self-defence against a mob intent on lynching soldiers, snatching their arms, destroying government property and preventing them from carrying out their duties can hardly be considered a cognizable offence. As a matter of fact, the Police had failed in its duties by not lodging an FIR against the mob and arresting those involved. It is incumbent on the authorities to hold to account those officers responsible for this lapse. &nbsp;

&nbsp;

In any case if there was any doubt as to what exactly occurred and in the version of events brought out by the Army, a Magisterial Enquiry on the basis of a Police Report would have been sufficient to place the facts on record and that would have allowed the authorities to proceed with the case on its merit. Incidentally, the State Government also simultaneously ordered a Magisterial Enquiry along with the FIR, though this Enquiry will have little credibility given the circumstances.

&nbsp;

There is a problem in the manner in which this incident has been dealt with. Clearly, there has been unwarranted and unethical attempts by both the ruling alliance and the opposition in the State to politicise the issue and curry favour with the people.&nbsp; Mehbooba Mufti&rsquo;s assertion in the Assembly while defending the police action of lodging an FIR against the Army by suggesting that&nbsp; &quot;black sheep can be anywhere&quot;, without waiting for a report from an impartial investigator clearly suggests blatant bias against the Army as well as efforts on her Governments part to exert pressure on the Police to target the Army.&nbsp;

&nbsp;

&nbsp; More worrisome is the fact that thanks to judicial activism, AFSPA has lost much of its effectiveness and this has greatly restricted the Army&rsquo;s ability to respond robustly and proactively to security threats for fear of subsequent criminal cases against them. Moreover, the State Government has been excessively lenient towards citizens indulging in acts of stone pelting and other violent activities. As a result, the Army finds it extremely difficult to carry out area domination patrols, especially in rural areas, due to attacks on them by unrestrained mobs. The Army, thus, finds itself losing control of the countryside, a critical element in any counter-insurgency strategy, if it is to succeed.&nbsp;

&nbsp;

&nbsp;There is little doubt that politicians are targeting the military for their own selfish reasons. As we are well aware, no insurgency can be resolved without a political solution being implemented. Unfortunately, in our case, neither the State nor the Central Government is willing to put forward a solution that can help resolve the issue. In such circumstances, the Army will continue to pay the price unless it takes drastic action and refuses to be played.&nbsp;

&nbsp;

The worry is that if the military hierarchy refuses to stand up and confront the political leadership, it is only a matter of time before the rank and file, who bear the brunt of such operations, may take matters into their own hands. That would disastrous for the military.&nbsp;

&nbsp;

&nbsp;Finally, of course, this government does have another option; it could arrange to hand over the situation to Mr. Bhagwat and his merry band of volunteers in khaki who believe they can achieve in three days what the Army hasn&rsquo;t in three decades. If nothing else this ludicrous suggestion may lead to the death of separatists from laughing too much and that wouldn&rsquo;t count as murder would it?&nbsp;

Opinion: Will this brouhaha over Major Aditya help the Army? No

Almost three days after the leak of a class XII Mathematics (II) paper of the Uttar Pradesh board, a case has been registered against centre superintendent of Sri Ganga Ram Baba Saraswati college, police said today. 
The paper which was scheduled for today was leaked on February 9.

District Magistrate Sarvagya Ram Mishra said, &quot;It is a serious matter and a probe has been ordered&quot;.

The incident came to light yesterday when a CCTV footage was checked, Mishra said, adding the board was immediately informed and an alternate paper was supplied.

Following the leak, a new set of paper was distributed to students in 74 centres of the district today.

Meanwhile, not only centre superintendent Vinod Kumar and additional centre superintendent Jitendra Kumar have been replaced, the board has been recommended to debar Vinod Kumar for five years from every type of board work.

They were there because the country wanted them to be there; it was their duty to protect the country in a disturbed region.&nbsp;

&bull;&nbsp; &nbsp; The column was attacked by stone pelters with an intent to hurt the forces, hence, criminal force was applied against them. Why the authorities did not register FIR against the stone pelters.

&nbsp;

&bull;&nbsp; &nbsp; Major Aditya Kumar and his troops had no enmity with the persons who were killed in the incident.

&bull;&nbsp; &nbsp; The Army personnel have the right of self-defence too

&nbsp;

&bull;&nbsp; &nbsp; As per the law in vogue, in a &lsquo;Disturbed Area&rsquo;, the officer is duty bound to protect his subordinates and the government property and can use force. The minimum force is to be used but the decision as to how much force is the minimum force is a decision to be taken by the commander on the spot, based on his judgement. &nbsp;

&nbsp;&nbsp;

&bull;&nbsp; &nbsp; Army after the due warning is expected to fire for effect and not in the air, unlike police, which can use measures like tear gas or firing in air.

&nbsp;

Under the circumstances in which Maj Aditya and his troops were placed, had they not taken any action, they would have been either lynched or burnt. The officer and men, in my opinion, have acted in self-defence as per powers conferred to them by law.

&nbsp;

It needs to be understood that the Army is the instrument of last resort and if they are scarred by legal actions, then the morale of young officers and men will be affected adversely. If they get overcautious, we have to blame our political hierarchy of pushing them into fortress mentality, wherein they will not come out and protect people due to fear of litigation which is exactly desired by Pakistan and militants. If we are soft towards the militants, no corner of the country will be safe. I do not understand why politicians of Kashmir for their petty gains do not understand this, despite an attack on our Parliament.

It also needs to be understood that under the AFSPA, the state has to take permission of the Central Government to proceed against the officer, which the Central Government can refuse, which has happened in many such cases earlier. Even if the permission is to be given a set procedure is to be followed.

I must salute the honourable Supreme Court of India which has put a stay on the FIR registered against Army Major Aditya Kumar in connection with this&nbsp; Shopian firing case. The apex court also directed that no coercive action be taken against Major Aditya in connection with the incident in which three civilians were killed and nine others were injured.

&nbsp;

It should also be a matter of concern that Indian Army unlike most armies in the world is known to use minimum force and does not use even high calibre weapons. Nowhere in the world, you can see an example of an armed soldier being beaten by a lady, and the soldier is showing resilience to tolerate it, and taking such ill treatment from people, whom the soldiers have saved in floods a year earlier. Let us not push our soldiers to wall, the consequences can be disastrous, definitely not in the nation&#39;s interest. &nbsp;

A statue of BR Ambedkar was disfigured allegedly by unidentified persons in the Ambedkar Park near the Moti Enclave colony here, an official said.

The incident took place under the jurisdiction of the Sadar Bazar police station, he added.

On Sunday morning, some residents of the locality found that the statue was disfigured, following which the locals gathered near the park protesting the act, Mathura Sub-Divisional Magistrate (SDM) Kranti Shekhar Singh said.
